Will Orvis agree to remove the sign facing the interstate once construction of the adjacent building occurs (No
questions asked and no request to relocate the sign)? Do they understand that this is technically a temporary
sign? Yes, when this particular sign permit is issued it can be identified as temporary to be removed when the
adjacent space is constructed.
What plans do you have in place to stop any further requests from adjacent tenants that might want to enjoy
the same privilege for the interstate-facing sign? We do have criteria to protect for these requests, it is " ...... a
tenant in excess of 5,000 square feet, and the company shall operate at least 100 stores nationally." We can
modify and beef this up any time you need us to. We are concerned about opening a "can of worms".

COLLECTED FROM THE RENAISSANCE MISSISSIPPI RETAIL AND ART
DEVELOPMENT WILL BE DIVERTED TO THE SALES TAX INCENTIVE
FUND FOR A PERIOD OF UP TO FIFTEEN YEARS, OR WHEN THE
AGGREGATE AMOUNT OF THIRTY PERCENT (30%) OF THE APPROVED
PROJECT COSTS BY THE MISSISSIPPI DEVELOPMENT AUTHORITY
INCURRED BY RENAISSANCE AT COLONY PARK, LLC FOR THE
TOURISM PROJECT HAS BEEN PAID, WHICHEVER SHALL OCCUR
FIRST, PURSUANT TO SECTION 57-26-1 ET SEQ. MISSISSIPPI CODE OF
1972, AS AMENDED; AND FOR RELATED PURPOSES.
WHEREAS, pursuant to the provisions of the Mississippi Tourism Project
Incentive Program, as set forth in Section 57-26-1, et seq., Mississippi Code of 1972, as
amended (the "Tourism Act"), Renaissance at Colony Park, LLC, a Mississippi limited
liability company, by and through its Members, proposes to develop the Renaissance
Project within the City of Ridgeland, Mississippi (the "City") and in connection therewith
will make application to the MDA for the benefits provided by the Tourism Act; and
WHEREAS, the Renaissance Project is a cultural retail attraction project as
contemplated in the Tourism Act and the Renaissance Project will have a significant
impact on the economy of the City, Madison County, and the surrounding region; and
WHEREAS, the Tourism Act requires said cultural retail attraction must be
located within a qualified resort area as defined in Section 67-1-5 of Mississippi Code of
1972;and

WHEREAS, the Renaissance Project is also a subpart of Colony Park masterplanned development with a total investment in excess of $500 Million Dollars
($500,000,000) in land, hotels, office space, retail, residential, architecture, engineering,
fixtures, equipment, furnishings, amenities and other related cost (the "Colony Park
Project"); and
WHEREAS, in support of the Colony Park Project, the City has heretofore issued its
$24,625,000 City of Ridgeland, Mississippi Tax Increment Limited Obligation Bonds (Colony
Park Project), Series 2009 (the "Series 2009 Bonds") and $10,375,000 City of Ridgeland,
Mississippi Tax Increment Limited Obligation Bonds (Colony Park Project), Series 2011 (the
"Series 2011 Bonds" and together with the Series 2009 Bonds the "Bonds");
WHEREAS, with respect to the City's outstanding Bonds, the City, by further resolution
of its Mayor and Aldermen (the "Governing Body"), may require diversions of City sales tax
collected by the State from the Renaissance Project to be escrowed. Any such diversion by the
City in connection with the Bonds shall be in coordination with MDA and any applicable MDA
guidelines, and subject to an escrow agreement (or similar agreement) consented to by
Renaissance at Colony Park, LLC.
WHEREAS, the City acknowledges that the Renaissance Project has and will
have multiple phases consisting of various costs for each phase that comprise the
complete application as submitted by Renaissance at Colony Park, LLC to the MDA; and
WHEREAS, pursuant to the Tourism Act, the City acknowledges that the City
sales tax collected from the Renaissance Project, which costs are estimated to be
approximately One Hundred Million Dollars ($100,000,000.00) will be diverted to the
Sales Tax Incentive Fund for a period of up to fifteen years, or when the aggregate
amount of thirty percent (30%) of the MDA approved Project costs incurred by
Renaissance at Colony Park, LLC for the tourism project has been paid, whichever shall
occur first; and
WHEREAS, the City is in full support of the Renaissance Project and supports
the application by Renaissance at Colony Park, LLC to MDA for the benefits allowed
pursuant to the Tourism Act.
NOW, THEREFORE, BE IT RESOLVED by the Governing Body ofthe City,
as follows:
Section 1.
That all the findings of fact made and set forth in the preamble of
this Resolution shall be in the same and are hereby declared and adjudicated to be true
and correct.
Section 2.
That the City fully supports the Renaissance Project and the
application of Renaissance at Colony Park, LLC to the MDA for the benefits allowed
pursuant to the Tourism Act and acknowledges and agrees that sales tax collected from
the Project, which costs are estimated to be approximately One Hundred Million Dollars

($1 00,000,000.00) will be diverted to the Sales Tax Incentive Fund for a period of up to

Section 4.
That the City shall commit to its obligations under this Resolution
provided that the Renaissance at Colony Park, LLC is in compliance with the applicable
MDA regulations, schedules, timelines and guidelines governing the duties and
obligations of the Renaissance at Colony Park, LLC.
Section 5.
That the Mayor of the City is authorized to execute any and all
necessary documents and clarifications required or requested by MDA for the
qualification of the Tourism Incentive Program.

The survey and legal description attached hereto as Exhibit "A" clearly indicate the specific area
under consideration for which the qualified resort area status designation is sought.

The Project is located in the City of Ridgeland, Mississippi, along Interstate Highland Colony
Parkway and Steed Road. The Project consists of a Lifestyle Main Street concept, including spacious
green common areas for strolling and relaxing, beautiful water features throughout, sidewalk cafes and a
town center square hosting an on-going array of special events such as concerts and shows. The open-air
lifestyle center concept goes beyond shopping, dining and entertainment, relying heavily on the
architecture and amenities to create a new experience for the consumer. Hours of operation will be 7:00
am until 2:00 am. The qualified resort status would enable the Project to serve alcoholic beverages during
the hours of operation and for private events held from time to time. It would be an additional amenity
Ridgeland could offer and would be beneficial to Ridgeland, Madison County, and to the Metro area.

Attached hereto as Exhibit "B" are endorsements from the Madison County Business League,
Madison County Economic Development Authority, and the Ridgeland Tourism Commission.

Attached hereto as Exhibit "C" is the assurance from the Police Chief of the City of Ridgeland,
Mississippi that he will insure that all Local Option Alcoholic Beverage Control Laws of the State of
Mississippi and the rules and regulations of the Alcoholic Beverage Division will be enforced.

Attached hereto as Exhibit "0" is a Certified Copy of the Minutes of the Mayor and Alderman of
the City of Ridgeland, Mississippi approving the request for the Project for the application as a Qualified
Resort.

Qualified Resort Status for the Project. As ofthe date of filing this Application, no public comments
have been received by the City of Ridgeland, Mississippi.

The Mayor called the first regular May 2014 meeting of the Mayor and Board of Aldermen to

Next came the matter of accepting the Minutes of the Aprill4, 2014 Work Session and the April
15, 2014 Mayor and Board of Aldermen Meeting. The Minutes were accepted with no
corrections noted.
Next came the request of Riverbend Tire Center, LLC for a conditional use permit for the
property located at 291 HWY 51, Suite C-1, Ridgeland, Madison County, Mississippi. Alan
Hart, Community Development Director. informed the Mayor and Bt)ard of Aldcm1an that the

WHEREAS, the Renaissance Project is also a subpart of Colony Park masterplarmed development with a total investment in excess of $500 Million Dollars
($500,000,000) in land, hotels, office space; retail, residential, architecture, engineering,
fixtures, equipment, furnishings, amenities and other related cost (the "Colony Park
Project"); and
WHEREAS, in support of the Colony Park Project, the City has heretofore issued its
$24,625,000 City of Ridgeland, Mississippi Tax Increment Limited Obligation Bonds (Colony
Park Project), Series 2009 (the "Series 2009 Bonds") and $10,375,000 City of Ridgeland,
Mississippi Tax Increment Limited Obligation Bonds (Colony Park Project), Series 2011 (the
"Series 2011 Bonds" and together with the Series 2009 Bonds the "Bonds");
WHEREAS, with respect to the City's outstanding Bonds, the City, by further resolution
of its Mayor and Aldermen (the "Governing Body"), may require diversions of City sales tax
collected by the State from the Renaissance Project to be escrowed. Any such diversion by the
City in connection with the Bonds shall be in coordination with MDA and any applicable MDA
guidelines, and subject to an escrow agreement (or similar agreement) consented to by
Renaissance at Colony Park, LLC.
WHEREAS, the City acknowledges that the Renaissance Project has and will
have multiple phases consisting of various costs for each phase that comprise the
complete application as submitted by Renaissance at Colony Park, LLC to the MDA; and
WHEREAS, pursuant to the Tourism Act, the City acknowledges that the City
sales tax collected from the Renaissance Project, which costs are estimated to be
approximately One Hundred Million Dollars ($100,000,000.00) will be diverted to the
Sales Tax Incentive Fund for a period of up to fifteen years, or when the aggregate
amount of thirty p~rcent (30%) of the MDA approved Project costs inctirred by
Renaissance at Colony Park, LLC for the tourism project has been paid, whichever shall
occur first; and
WHEREAS, the City is in full support of the Renaissance Project and supports
the application of Renaissance at Colony Park, LLC to MDA for the benefits allowed
pursuant to the Tourism Act:
NOW, THEREFORE, BE IT RESOLVED by the Governing Body ofthe City,
as follows:
Section 1.
That all the findings of fact made and set forth in the preamble ofthis
Resolution shall be the same and are hereby found to be declared and adjudicated to be true and
correct.
Section 2.
That the City fully supports the Renaissance Project and the application by
Renaissance at Colony Park, LLC to the MDA for the benefits allowed pursuant to the Tourism
Act and acknowledges and agrees that sales tax collected from the Project, which costs are
estimated to be approximately One Hundred Million Dollars ($100,000,000.00) will be diverted

67-1-5 of the of the Mississippi Code of 1972, to publish the required notices and to
execute any and all necessary documents and clarifications required or requested by the
Mississippi Department of Revenue to obtain such status.
Section 4..
That the City shall commit to its obligations under this Resolution
provided that the Renaissance at Colony Park, LLC is in compliance with the applicable
MDA regulations, schedules, timelines and guidelines governing the duties and
obligations of the Renaissance at Colony Park, LLC.
Section 5.
That the Mayor of the City is authorized to execute any and all
necessary documents and clarifications required or requested by MDA for the
qualification of the Tourism Incentive Program.

regulations of the Alcoholic Beverage Control Commission in such areas; and
5) A certified copy of the Order as entered on the minutes of the Mayor and Board of Ridgeland,
Mississippi regarding said resort area classification.
Request is hereby made pursuant to said regulation for an expression of public opinion from residents in
the above described area under consideration in connection with said approval. Opinions should be
forwarded to the Alcohol Beverage Control Division, Post Office Box 540 Madison, Mississippi 391300540. Notice is hereby given that approval on the application rests not with the Mayor and Board of
Ridgeland, Mississippi, but with the State of Mississippi pursuant to the laws of the State of Mississippi.

This would provide instant canopy for the areas for the walk that circles the space.
If, and I understand this may not happen, there are second level restaurants, the view to the fountain would not
be obstructed as the tree placement happens on the other side of the fountain.
The tree canopy from the second level restaurants would aid in visually closing off the phase two plaza from the
rest of the drive, and make the restaurants even more desirable space
The placement of the Live Oaks within the space are closer to the buildings, so a long view of the fountain space
is maintained.

I helped a colleague with having these trees used on a Lifestyle center in Atlanta called Avalon. The use of the trees in
impressive, but rather than putting together multiple trees to form a large canopy, the trees were used to provide
scale. The use ofthe trees in Renaissance would be far more impressive.

I don't know what the right answer is for Costco in Ridgeland, but please be aware (as I'm sure
you are) that the ones who came to the meeting last night do not represent ALL Ridgeland
citizens. I haven't heard anything that has convinced me that a Costco should not come to
Ridgeland. Good luck and know you have my support. One thing I am convinced of is you have
Ridgeland's best interest at heart.

This application is being filed by the Mayor and Board of Alderman of the City of Ridgeland.
As required by said law, the content of the said application shall include: 1) a map marked to
indicate the specific area under consideration; 2) The reasons why the area should be
declared a resort area are that this area attracts tourists and vacationers because of its retail
and scenic attractions and facilities and that the area designated herein serves the tourist
and vacationers to a very high degree; 3) endorsements from three civic clubs in the area; 4)
assurances from both the Sheriff of Madison County and the Chief of Police of the City of
Ridgeland that will ensure that their respective departments will enforce the Local Option
Alcoholic Beverage Control Laws of the Alcoholic Beverage Control Commission in such
areas; and 5) a certified copy of the Order as entered on the minutes of the Mayor and Board
of Alderman of Ridgeland, Mississippi regarding said resort area classification.
Request is hereby made pursuant to said law for' an expression of public opinion from
residents in the above described area under consideration in connection with said approval.
Opinions should be forward to the Alcohol Beverage Control Division, Post Office Box 540
Madison, Mississippi, 39130-0540. Notice is hereby given that approval on the application
rests not with the Mayor and Board of Aldermen of Ridgeland, Mississippi, but with the State
of Mississippi pursuant to the laws of the State of Mississippi. Approval of the described
area as a resort area will permit the operation of open bars in the area. Any person wishing
to request a hearing before the Board of Tax Appeals on the resort status of the area
described herein must request a hearing in writing and it must be received by the
Department of Revenue within (15) fifteen days from the first date this notice was published.

COMES NOW, the Mayor and Board of Alderman of the City of Ridgeland, Mississippi and
requests the Mississippi Department of Revenue to grant a qualified resort status to 45 acres,
more or less, located between Highland Colony Parkway, the Natchez Trace and Interstate 55, as
more particularly described in Exhibit A attached hereto (the "Project"). The Project is located in
the City of Ridgeland, Madison County, Mississippi 39158. In support thereof, the City submits
the following, to wit:
I. Map of the Project
The survey and legal description attached hereto as Exhibit A clearly indicate the specific
area under consideration for which the qualified resort area status designation is sought.
II. Justification for Status
The Project is located in the City of Ridgeland, Mississippi, along Highland Colony Parkway.
The Project will be an extension of the existing, vibrant developments along Highland Colony
Parkway and will be an additional amenity that will service the citizens of the Metro-Jackson area.
This area attracts tourists and vacationers because of its popular retail, scenic attractions, and
facilities, and the Project area is strategically located to contribute to the existing developments.
The designation as a qualified resort area will serve as an additional attraction to visitors,
benefitting the City of Ridgeland, Madison County, and the Jackson area.
Ill. Endorsements
Attached hereto as Exhibit B are endorsements from the Madison County Business
League, Madison County Economic Development Authority, and the Ridgeland Tourism
Commission.
IV. Assurances from Law Enforcement
Attached as Exhibit C is the assurance from the Chief of Police of the City of Ridgeland,
Mississippi that he will insure that all Local Option Alcoholic Beverage Control Laws of the State
of Mississippi and the rules and regulations of the Alcoholic Beverage Division will be enforced.

A description of a tract or parcel of land containing 45.22 acres (1,969,830 square feet), more or
less, situated in the Northeast Quarter of Section 25, Township 7 North, Range 1 East, Madison
County, Mississippi. The below description is based on the Mississippi State Plane Coordinate
System, West Zone, NAD 83, grid values, U.S. Feet, and being more particular described as

Commencing at a found concrete monument located at the Northwest corner of Section 25,

The Mayor and Board of Aldermen were provided the June 2015 Sates Tax Report and the May 2015
Financial Report.
Next came the recognition of Officer Erin Boyd for being selected as "Officer of the Month" for May
2015. Mayor McGee informed the Board of Aldermen that Officer Erin Boyd responded to the Chateau
at Ridgeland in reference to an unresponsive male who had fallen. Upon Officer Boyd's arrival, she
found that the male was still unresponsive. Officer Boyd, who is also a certified paramedic, immediately
began CPR and continued CPR for approximately five minutes until the Ridgeland Fire Department
personnel arrived on scene. At this time a fire paramedic continued while Officer Boyd intubated the
unresponsive male and provided additional life-saving medical attention. The unresponsive male became
responsive and was transported by ambulance to the hospital. Due to Officer Boyd's initiative, quick
thinking, and emergency medical experience, she saved the life of another human being who had fallen
and had sustained serious injury. Mayor McGee informed Officer Boyd that her actions were
commendable and indicative of a professional and motivated officer. Mayor McGee then thanked Officer
Erin Boyd for her dedicated service to the citizens of Ridgeland, Mississippi.
Next came the matter of accepting the Minutes of the June 2, 2015 Board of Aldermen meeting and the
June I, 2015 Work Session Minutes. The Minutes were accepted and approved with no corrections
noted.
Mayor McGee informed the Board of Alderman that the Public Hearing was continued until the first
meeting in July, being July 7, 2015, at the request of Kelly Simpkins, attorney for the City of Ridgeland.
Next carne the consideration of an Ordinance Enlarging, Extending and Defining the Corporate Limits
and Boundaries of the City of Ridgeland, Madison County, Mississippi. Alderman Chuck Gautier moved
to adopt the Ordinance Enlarging, Extending and Defining the Corporate Limits and Boundaries of the
City of Ridgeland, Madison County, Mississippi. The Motion was seconded by Alderman Brian Ramsey

This application is being filed by the Mayor and Board of Alderman of the City of Ridgeland.
As required by said law, the content of the said application shall include: 1) a map marked to
indicate the specific area under consideration; 2) The reasons why the area should be declared
a resort area are that this area attracts tourists and vacationers because of its retail and scenic
attractions and facilities and that the area designated herein serves the tourist and vacationers
to a very high degree; 3) endorsements from three civic clubs in the area; 4) assurances from
both the Sheriff of Madison County and the Chief of Police of the City of Ridgeland that will
ensure that their respective departments will enforce the Local Option Alcoholic Beverage
Control Laws of the Alcoholic Beverage Control Commission in such areas; and 5) a certified
copy of the Order as entered on the minutes of the Mayor and Board of Alderman of Ridgeland,
Mississippi regarding said resort area classification.
Request is hereby made pursuant to said law for an expression of public opinion from residents
in the above described area under consideration in connection with said approval. Opinions
should be forward to the Alcohol Beverage Control Division, Post Office Box 540 Madison,
Mississippi, 39130-0540. Notice is hereby given that approval on the application rests not with
the Mayor and Board of Aldermen of Ridgeland, Mississippi, but with the State of Mississippi
pursuant to the laws of the State of Mississippi. Approval of the described area as a resort
area will permit the operation of open bars in the area. Any person wishing to request a hearing
before the Board of Tax Appeals on the resort status of the area described herein must request
a hearing in writing and it must be received by the Department of Revenue within (15) fifteen
days from the first date this notice was published. Requests shall be sent to: Chief
Counsel/Legal Division, Department of Revenue, P. 0. Box 22828, Jackson, MS 39225.

I am on mission and I am not sure who to contact and I am hoping that you can point me in the right direction. I am an
avid user of the trails and so is my running group. I know that there are not any current plans to re-open the bathrooms
at the old craft center. Who would I need to talk to about having some porta potties put there until they are fixed? Is
this the Parkway's responsibility or the City or a combination?
I know there are some at what we refer to as the "gravel pit" but the craft center is a great starting place for many users
of the trails. With the weather changing many bikers runners and walkers are going to be out there and these restrooms
are needed.

soon as you can get images together to illustrate the sign types, please provide 2 copies of the images and sign criteria
to Matt Dodd. If you can get this done right away, ARB meets tomorrow night; otherwise, you can target the December
14th ARB meeting for approval.
Also, the Mayor and I discussed the New York Life sign and feel that this sign can be permitted as a Halo-lit sign with an
internally illuminated New York Life Logo. We feel that it will conform to the standards in your Sign Criteria
amendment. Coordinate directly with Chris Ramsey on the sign application for New York Life.

Thanks Alderman Heard! Chris Ramsey's inspection on Monday did reveal the siltation issues as described. The majority
of the issues occur at the north-end of the pond, but there also appears to be an issue in the southwest corner of the
pond. The areas that are growing silt are out of the main stream flow of the water that makes its way from one end to
the other. This flow and buildup is much like that of a natural stream or river. Chris has instructed Jamie to strictly
enforce silt fence requirements in Township, although we technically have little-to-no jurisdiction. Obviously, we have
an interest due to downstream impacts, but the entire Township site is under the enforcement of a Large Construction
Permit administered by MDEQ. We find it to be better practice to address the enforcement of the issue with the
Permitted contractor, but if we reach any resistance, our only recourse is to notify MDEQ. We are on it.

Gentlemen,
These are pictures of the West end of the detention pond at Old Agency Village. As
you can see this end of the pond is filling up with run off silt and basically filling up the
end of the pond so much it has created an island. Great for the birds and other critters,
but an eyesore for our neighborhood,and will develop into a flood issue if not
addressed. I have previously brought this issue to the attention of the City numerous
times prior to this email. I believe Buster was informed about this, but nothing has
been done. I believe this West end needs to be dredged out so that we don't end up
with 1/2 foot deep pond that is becoming an eyesore.

assurances from both the Sheriff of Madison County and the Chief of Police of the City of

As a resident of Greenwood Plantation, I am VERY concerned about the possible location of a Costco on
the property south of the Natchez Trace between 1-55 and Highland Colony Parkway.

Andrew Mattiace's company, MHC Land, LLC, is approaching the time that it will sign a contract with the proposed
purchaser of the Santa site on Highland Colony Parkway. The Purchase and Sale Agreement will require that the seller
make representations about the zoning status of the property, including the fact that the property can be used for a
vehicle fueling facility. Since the Santa site is zoned C-2, the seller cannot make that representation without an
exception to explain that the property cannot be used for a vehicle fueling facility. Andrew indicated that the City is
proposing an amendment of the zoning code to resolve that matter. To make the exception in the Purchase and Sale
Agreement acceptable, the seller will need to provide an explanation about the proposed amendment. A copy of the
proposed amendment and a proposed schedule for its adoption would be helpful to keep the proposed transaction
moving. Can you provide a copy of the proposed amendment and information about the proposed schedule?

WHEREAS, the Mayor and Board of Aldermen of the City of Ridgeland, Mississippi
did lawfully adopt a Zoning Ordinance on February 4, 2014 after proper notice and a public
hearing; and
WHEREAS, the Mayor and Board of Aldermen of the City of Ridgeland, Mississippi
did lawfully adopt a Zoning Ordinance Amendment on February 3, 2015 after proper notice and
a public hearing; and
WHEREAS, additional development trends of a certain commercial use has resulted in
the need to consider appropriate regulations and restrictions; and
NOW THEREFORE BE IT RESOLVED, the Mayor and Board of Aldermen adopt the
following sections as amendments to the Official Zoning Ordinance of the City of Ridgeland,
Mississippi by amending the following sections:
Section 1
Replace the Section 21 "Service Station" Definition with the following language: Service
Station: Any area of land, including the structure thereon, which is used primarily for the retail
sale of gasoline, diesel fuel, ethanol, oil, propane, other fuels, and/or the sale or installation of
automobile accessories and may also include incidental services such as facilities for lubricating,
washing (either automatic or by hand), and cleaning, or otherwise servicing automobiles and
light trucks. This term does not include the painting or major repair of vehicles.

VlHEREAS, the Mayor and Board of Aldermen referred the Petition to the Zoning
Board of the City of Ridgeland (the Zoning "Board") which Board scheduled a hearing on
said Petition for June 9, 2005, at 6:00 o'clock p.m.; and,
WHEREAS, the City Clerk did cause notice of the June 9, 2005, hearing to be
published in the Madison County Journal, a newspaper published in the City of
Ridgeland, lVfadison County, Mississippi, in the marmer ar1d lor the time required by law,

manner and for the time required by law; and, whereas, the Petitioner did provide

of the City of Ridgeland, Mississippi, did conduct a full and complete hearing on the
Petition, and received comments ;md heard evidence presented by the Petitioner and

Aldem1en; and,
WHEREAS, the Mayor and Board of Aldennen are familiar with the property and
existing land uses within the City of Ridgeland and in the area of the City where the
property is located, and in acting on this Ordinance, have duly considered the matters and
facts within their personal knowledge as same affect the land uses required in the
Petition; and,
WHEREAS, the Mayor asked whether the Board of Aldem1en desired to take any
action regarding the Petition and the recommendation of the Zoning Board, and after
