STATUTE
OF THE
ASSOCIATION OF KOSOVO MUNICIPALITIES

Prishtina/Pristina, June 2010

Based on Article 31 of the Law on Local Self-government no. 3/L 040 (the Official
Gazette of the Republic of Kosovo, no. 28.2008), article 10 of the European Charter of
the Local Authorities, the Assembly of the Association of Kosovo Municipalites, in its
meeting held on 30.6.2010 approved the:

STATUTE OF THE
ASSOCIATION OF KOSOVO MUNICIPALITIES

I. GENERAL PROVISIONS
Article 1
Aim
1.1. The Statute of the Association of Kosovo Municipalities is the highest act of the
Association that is approved by the Assembly of the Association in accrodance with the
legislation enforce in the Republic of Kosovo.
1.2. The Statute is a base for ensurance of the implementation of competences and
responsabilites of the Association as it is defined with the legislation enforce in the
Republic of Kosovo.
1.3. The Statute regulates the objectives, Associations bodies and their responsabilites,
the rights, duties, responsabilites of the members of the Association and financial
administration of the Association;
Article 2
Definition
2.1. Association of Kosovo Municipalities (hereinafter the Association) is a nonprofitable organisation and it is a legal subject that represents general interests of its
members Local Authorities.
2.2. The Association has the freedom to act, the right for constitutional initiatives (legal
framework) and other laws. The activities of the Association are based on the principles
of the voluntarism of its members, on the democratic principles and in the principles of
decentralization of the government.
2.3. Members of the Association are local authorities of the Republic of Kosovo.
2.4. Local authorities join the membership of the Association through the Assembly of
the Association following the decision taken by the Municipal Assembly.

2.5. The Association shall be called: ASOCIACIONI I KOMUNAVE T KOSOVS; acronym


AKK / THE ASSOCIATION OF KOSOVO MUNICIPALITIES; acronym AKM / ASOCIJACIJA
OPTINA KOSOVA / AOK
2.6. Association has its own bank account, the emblem where it says: Association of
Kosovo Municipalities Kosovo.
2.7. The time period of the activities of the Association is not limited.
2.8. The head office of the Association is in: Prishtina/Pristina.

II. OBJECTIVES AND DUTIES OF THE ASSOCIATION


Article 3
3.1. The Association is engaged that in the Republic of Kosovo to implement rules from
the European Charter of Local Self-Governance in Kosovo; to organize and co-ordinate
the activities of its members in the field of investments, economic development of
municipalities; improving legal base; supporting the businesses, culture, education,
science, health care, welfare and social services, conflict resolution, improving the
services for the citizens and in cooperation with international sister associations and
with International Organizations.
3.2. Association is responsible for the followign duties:
3.2.1. to initiate, organize and promote the co-operation between local authorities of
the Republic of Kosovo, propose solving the general problems of local authorities, issues
methodology materials which are distributed to the local authorities;
3.2.2. gives ideas, suggestions and remarks in draft laws and sub-legal acts dealing with
local governments;
3.2.3. provides organizational and legal assitance for local authorities;
3.2.4. represents the general professional interests of the authorities and civil service by
the local authorities;
3.2.5. represents the interests of its members towards the international authorities and
organizations and also assist local authorities to co-operate with foreign partners;
3.2.6. Organizes and co-ordinates professional trainings of political authorities and civil
servants among local authorities;
3.2.7. Organizes and co-ordinate the flow of information for its members and publishes
its publications;
3.2.8. creates funds, opens representative offices, public institutions;
3.2.9. Provides other services for its members.
III. LEADING BODIES OF THE ASSOCIATION (PROCEDURES OF ESTABLISHMENT,
ORGANIZATION OF THE DECISION PROCESS, FUNCTIONS, THE RIGHTS, OBLIGATIONS
AND RESPONSABILITES) AND ADMINISTRATION

Article 4
4.1. Leading bodies (governing) of the Association are: the Assembly, the Council and
the Board of the Association;
4.2. The highest governing body of the Association is the Assenbly which consists of the
all members of the Association. At the Assembly do participate as well the
representatives of the minorities in accordance to an agreement of the mayors (number
and ethnicity). It is required as well the representation of political parties;
4.3. Local Authorities (municipal assemblies) delegate for each 10 member 1 (one)
representative in the Assembly of the Association;
4.4. Local authorities elect their representatives in the Assembly of the Association in
proportion with the number of votes that the party won in the Assembly of the
Municipality.
Representatives (members of the Assembly) can be replaced with the decision of
Municipal Assembly but in accordance with provision 4.3 of this act. Representatives in
the Assembly will be replaced after every electoral process of municipal level, in
accordance with above-mentioned procedure.
4.5. The regular assembly meeting will take place not later than three months after the
local elections and announcement of their results. The assembly will meet at least once
(1) per year. The president of the Association calls the meetings and proposes the
agenda which is approved by the Assembly;
4.6. The place, date and the agenda have to be announced at least one (1) month in
advance. All the materials should be distributed to the members of the Assembly not
later that one-week prior the meeting.
4.7. Unforeseen (extra ordinary) meetings of the Assembly can be convoked at least one
month after the announcement and after the approval of 2/3 of members of the
Assembly.
4.8. Decisions are all-powerful if are taken by the majority of votes by the present
members and the voting is done in a transparent way.
4.9 Statute and Regulations of the Association are approved, amended and fulfilled with
an open and transparent voting with 2/3 of votes by the participants present in the
Assembly.
4.10. President and Deputy President are elected with the majority of votes during an
open voting;
4.11. The association can be dissolved by the decision of the Assembly and is considered
that the Association is dissolved when 2/3 of members have voted with an opening
voting.
4.12. The Assembly is chaired by the President of the Association, who is elected by the
Assembly. The minutes of the meetings are taken by the Secretariat of the Association.
The mandate of the President is in accordance with the mandate of local elections;
4.13. The assembly approves the decisions concerning issues in accordance with
approved agenda.
4.14. The Assembly of the Association approves, amends and fulfills the Statute of the
Association;

4.14.1 issues and amends the work regulation, regulations and other general acts of the
Association and as well amendmends in this regulation;
4.14.2 confirms and changes the membership-fee;
4.14.3. accepts new members and dismiss members in accordance with provision 2.3
and 3.3;
4.14.4. estimates and approves the annual work plan, annual financial plan,
expenditures of the Association, and in any case of the need the Council is called to
make it more flexible;
4.14.5. determines the priority of activities and responsibilities for Association;
4.14.6. elects the commissions of the Association;
4.14.7. elects the president and deputy president of the Association;
4.14.8. approves the symbols of the Association;
4.14.9. brings the decision of dissolution of the association and appoints the
commission for liquidation of the Association;
4.14.10. elects from its membership the Board members and dismisses them;
4.14.11. practice also other functions defined by positive laws and international
convents;
4.14.12. The Assembly of the Association can delegate some of its responsibilities to the
Board of the Association or any other body or to the employees of the Association, with
the decision of the majority of votes;
4.15. In the time period between two assemblies, the Assembly of the Association will
be administrated by the Council of Mayors. The Council will convoke at least every three
months. The meetings of the Council are chaired by the President of the Association
who at the same time signs all the decisions of the Council.
4.15.1. The Council is composed by the Mayors and Board Members.
4.16. Meetings of the Council and the decisions are considered all-powerful, if at the
meeting have participated more than the half of the number of the members of the
Council. Decisions are brought with open voting and with the majority of present
members at the meeting. If the voting is half-half, the vote of the chairperson defines
the decision.
4.17. The Council of Association is responsible for:
4.17.1. with the recommendation of the board, analyses the acts and project-decisions
(project resolutions) which are connected directly with local authority activities;
4.17.2. analyses the issues proposed by the Board and as well the issues proposed by
the members of the council, and takes adequate decisions;
4.17.3. Analysis the reports of the Board;
4.17.4. Completes other functions decided by the Assembly of the Association;
4.18. The Board of the Association is elected by the members of the Assembly of the
Association. The Board is composed by seven (7) members: president, deputy president
and five (5) other members. The representation at the Board is done as in the following:
three (3) members (including the President), come from the party that won the majority
of municipalities at the last local elections; two (2) members (including the deputy
president), from the party that won less municipalities than the first party, one (1) from
the party that won less municipalities than the second party, and one (1) member, from
the party of Serb community. The Board gathers at least once per month. The Board is

gathered by the call of the president of the association, who chairs the meeting and
signs all the taken decisions.
4.19. Board of Association is responsible for:
4.19.1. discussing the problems raised at the meetings of the Assembly, Council, Mayors
and offers solutions-proposals;
4.19.2. issuing decisions, making remarks and proposals towards the authorities and
government, regarding the improvement of self-government;
4.19.3. analysing the reports of the Collegia;
4.19.4. approving decisions for membership in any independent international
organization;
4.19.5. confirming the Agreements of the Association;
4.19.6. determining the obligatory tasks for the administration, defines the
administrative structure;
4.19.7. analyzing financial activities of the Association and analyses work agreements
with the members of the commission and sets their salaries;
4.19.8. discussing the plan of activities and the report of the administration;
4.19.9. confirming and determining the list of the commissions, Collegia and regulations;
4.19.10. appointing and dismissing the leader of the administration through an open
competition;
4.20. The decision in Board is considered all-powerful, if more than the half members of
the board voted for;
4.21. the Board of the Association decides if it is necessary to create different
consultative bodies;
4.22. The mandate of the president and deputy president starts from the day of election
in the meeting of the Assembly. The mandate of board members is in accordance with
the local election mandate. If the president or deputy president are changing their
positions or withdrawing from their activities in local authorities system, then their
functions are dissolved as well. In such case, the Council trusts these functions to the
Board Members up to the next assembly meeting.
4.23. President of the association is responsible to:
4.23.1. organize the work of management institutions of the Association;
4.23.2. represent the association in front of state authorities; Presidency, Kosovo
Assembly and Government, Independent International Organizations;
4.23.3. define the responsibilities, authorizations and competencies of deputy
presidents;
4.23.4. with the authorization of the Board signs the agreements;
4.23.5. guarantees the continuity of activities of the Association, during the election of
the new members as representatives of local authorities, after new municipal elections;
4.24. Activities of the Association will be organized by the administration, which
determines technical rules for management bodies of the administration. The
administration is chaired by the administration. Administration works based on the law,
based on the regulations for the responsibility approved by the Assembly, based on the
decisions of the Assembly, on the decisions of the Council, Board and based on the
orders of director of the administration.
4.25. Director of Administration:

4.25.1. Organizes and leads the daily activities of the Association


4.25.2. solves the organizational, economic and financial issues of the administration;
4.25.3. Submits to the Board for analyses the working and account plans and provides
information to members of the Association concerning the implementation of decisions
of the Assembly;
4.25.4. Represents the Association in the court, in relations with other legal subjects
concerning the competence in front of local authorities and state institutions;
4.25.5. confirms economic activities of the administration;
4.25.6. Employs, dismiss and undertakes disciplinary measures for the personnel, based
on the laws enforce of the Republic of Kosovo;
4.25.7. open and close the bank account
4.25.8. authorizes, when necessary, board members to complete tasks from their
competencies;
4.25.9. bring out orders concerning the work of administration;
4.25.10. ensures the protection of property of Association and works toward better
working conditions;
4.26. Activities of the commission and Collegia are based in regulation of Association
while technical regulations are accomplished by the Administration.
4.27. The Administration implements the law on languages in Kosovo.

IV. THE RIGHTS, OBLIGATIONS AND RESPONSABILITES OF THE MEMEBERS OF THE


ASSOCITION
Article 5
5.1. Members of the Association have the right:
5.1.1. to be freely provided with information, to have metodological assistance and
other services;
5.1.2. to make proposals in the Association for developemnt of self-govermnemt and for
activities of the Association;
5.1.3. To delegate representatives at the Assembly of the Associaion and to substitute
them in accordance with provisions 4.3 and 4.4. Members have the right to nominate,
to select and to be seleced for managing duties as well in the bodies of control of the
Association.
5.1.4. Municipal Assembly can take decision to withdraw from the membership in the
Association. Prior the withdraw, the municipality (local authorities) are obliged to pay
the membership for the time spent the time for being a member.
5.2. the members of the Association are responsible for:
5.2.1. to pay 0.07 per person, based on the notes of Statsitcal Entity of the Republic of
Kosovo, for the respective municipality;
5.2.2.to respect the regulations and decision of the Assembly of the Association and the
Council;
5.3. With the recomandation of the Counil of Association, Assembly of the Association
can dissolve the member of the Association, who has violated provisions of the
regulation and decision for dissolvment should be taken with 2/3 of the votes of all

members. If it didnt pay the membership it is left only as an observer in the Assembly of
the Associaiton.
V. PROPERTY, FINANCIAL RESOURCES AND PROCEDURES FOR THE USE OF THE
PROPERTY
Article 6
6.1. Property of the association and other funds consist of:
6.1.1. membership-fee and municipal budgets;
6.1.2. incomes from publications and services;
6.1.3. incomes from central level, local level and from abroad;
6.1.4. funds from gifts, aid, donations and funds from any inheritance;
6.1.5. incomes from any other sources;
6.2. Association uses, administrates the funds and has the property in accordance with
regulation of the Association and with the law enforce in the Republic of Kosovo;
6.3. The property of Association is managed with full responsibility by the Director of
Administration. The prosperity of the Association is used only with the aim for
implementation of the Association.
Article 7
7. Control over financial activities
7.1. Control over financial activities of Association is accomplished by the Independent
Auditor.
7.2. Administration along with the Board selects the bidder for an independent audit.
7.3. The independent auditor accomplished inspection of financial activities of
administration, at least once a year where this report is presented to the Board for
approval.
7.4. All the documents concerning the finances should be available in any time to the
members of the Assembly of the Association.
Article 8
8. Dissolution of the association
8.1. The Association can be dissolved by the decision of the Assembly, if for that have
voted more than 2/3 of the members of the Association.
8.2. The association can be dissolved by the decision of state authorities (authority that
registered the association), if in the association remain less than half of its members and
if other positions are not fulfilled within a year.
8.3. The Assembly, if brings the decision for dissolving the Association, it should appoint
the liquidation committee and to define its responsibilities.
8.4. The liquidation committee is obliged to inform all the members of the assembly
concerning the dissolving process.

VI. TRANSITIONAL AND FINAL PROVISIONS


Article 9
9.1. By entrance into force of this Statute is ceased to be valid the Statute No. officially
of the dt. 30.06.2001.
