INTRODUCTIONAny intentional false communication, either written or spoken, that harms a pers
on's reputation;decreases the respect, regard, or confidence in which a person is
held; or induces disparaging,hostile, or disagreeable opinions or feelings against
a person is known as defamation.
To win a defamation case, a plaintiff must show four things:
1) A false statement purporting to be fact;
2) Publication or communication of that statement to a third person;
3) Fault;
4) Damages, or some harm caused to the person or entity who is the subject of
the statement.
Under common law, to constitute defamation, a claim must generally be false
and have been made to someone other than the person defamed. Some common
law jurisdictions also distinguish between spoken defamation, called slander,
and defamation in other media such as printed words or images, called libel.
The act of making untrue statements about another which damages his/her reput
ation. If thedefamatory statement is printed or broadcast over the media it is lib
el and, if only oral, it Isslander. Public figures, including officeholders and cand
idates have to show that the defamationwas made with malicious intent and was
not just fair comment.

relied on the Doctrinal Method, which is primarily based upon books,
news, articles etc. A comprehensive study is made in order to arrive at
analytical & critical support of the arguments. The segments are structured
