The winds from the storm wore 20-40 mph, and lasted for approximately 20, minutes, ‘At 1635 hours Station Lake Worth inlet received a call from Jupiter PD regarding the overdue vessel of Austin Stephanos and Perry Cohen ries he vessel was located by United States Coast Guard 67 miles of Ponce De Leon Inlet in Volusia County. Found in approximately 1500" of water. 7315 ‘At 0930 hrs the USCG ended the search and rescue for the Missing teens. ‘No further information at this time. Stephanos and Perry J. Cohen left 91 River Dr, Tequesta, FL on a 18' 2" white SeaCraft center console, powered by a single 115 horsepower Yamaha outboard motor (FL 0838 DL). Perry Cohen had a text Conversation at approximately 0949 hours with his mother stating he was going fishing with Austin. Austin Stephanos texted his parents at approximately 1125 hours to advise they were going fishing. The boys were reported to have fueled the vessel at Jib Club Marina (60 Beach Rd.) between 1000 - 1100 hours purchasing $122 worth of fuel. A large weather cell impacted the Jupiter area at approximately 1330 hours and continued offshore until dissipating at 1500 hours. At 1618 hours Perys family called 911 to report they had not hheard from their son. A search and rescue mission was iniliated withthe United Sates Coast Guard (USCG), Florida Fish and Wildife Conservation Commission (FWC), Palm Beach County Sheriff's Orfice, Tequesta Police Department and Jupiter Police Department, On July 26,2015 at approximately 1400 hours the USCG located the missing teen’s vessel, capsized and floating offshore in a northbound direction approximately sixty-seven miles east of Ponce de Leon inlet. The search and rescue concluded on July 31, 2016. Austin Stephanos and Perry Cohen are sill listed as missing in the Florida Crime Information Center database for missing persons. Occupants Austin B. Reports for the above listed groups, Tequesta Police Department, and United States Coast Guard have not been included in this report Patterson's Investigation 94-15 |, Investigator Kyle Patterson, was contacted by Lt. Mike Omold of the Florida Fish and Wildlife Conservation Commission, who asked me to meet with him at the regional office. At approximately 1200 hours | met with Lt. Mike Omoid, Investigator Brent McCarthy, Inv. Kelsea Wiernicki, and Captain Jeff Ardelean. At this time | was asked to take over the investigation in reference fo the missing teens in Jupiter, FL. | was given the information Collected during Inv. McCarthy's investigation (see McCarthy's report). We discussed the case in detail and how we were going to proceed with the case. 95-15 | began to organize the case file. | also worked on the accident report in our mobile forms electronic data base system. 'nv. Wiernicki and | established a witness organizational chart for referencing the parties involved in the case. We also reviewed the NOAA certified weather data given to us by Inv. McCarthy. (Refer to Tab 8) 3/Page 9.6615 | called numerous known fends, and their parents, of Austin Stephanos and Perry Cohen, and left messages wit them. | spoke with Austin’s friend Elie Spivey and her mother; Elie advised she did receive the "Peace out Jup" Snapchat on July 24, 2015 from Austin’s phone. She said they spoke about going to the Bahamas the day before, but Austin said it was too rough. | made contact with Paul Robinson of 6 Maritime. | spoke with him in reference to his private investigation. He would not discuss it in detail. He did advise he had completed a five page report which was tumed over to the family. The report was not to be distributed without Nick Komiloff's consent. Nick Korniloff and Vince McBeth of the McBeth Group International, have Copies of the report. Captain Ardelean spoke with Mr. McBeth at a later date and was told the report would be available when we met with Nick Korniloft 97-15 | received the recorded statements and other miscellaneous forms from Inv. MoCarthy. | listened to the recorded statements and took notes from the statements given. | also Feviewed news clips from social media in order to find any leads | could follow-up on. 98-15 | emailed Christopher Eddy of the U.S. Coast Guard. | asked for their official report in reference to the case. | talked to Laura Laurie at the State Attorney's office and she advised me that we did not hhave criminal charges in reference to this case at this time, She advised that without criminal Charges we could not get a subpoena for phone records or Snapohat. | was also told she would not be reviewing the case since there is no confirmed death at this time. (Captain Ardelean emailed Chief Assistant State Attorney Brian Femandes a copy of this report to review in February prior to is release.) | spoke with Phil Cohen, the biological father of Perry Cohen, in reference to the case. He advised that he was not being kept involved in the case by the other family members and he hhad questions and concems. At this time, we decided to give all family members periodic updates via email 9.915 U.S. Coast Guard advised FWC that the subject vessel may have been found 167 miles off the Florida coast by a motor trawler, The motor trawler gave a GPS location and the FL #'s Were verified by a mate who jumped in the water and swam to the vessel. Capt. Ardelean Notified the Cohen family and | notified the Stephanos family. 4|Page 910-15 |n the moming, U.S. Coast Guard sent an aircraft to the area where the vessel was reportedly seen on September 9, 2015, FWC made arrangements for the recovery of the vessel if located. The U.S. Coast Guard was not able to relocate the vessel via their air Search and FWC cancelled our efforts to contract a salvage company to recover the vessel 914-15 | called and interviewed the rescue swimmer, Derrian Duryea from the U.S. Coast Guard, ‘who got in the water when the vessel was first located on July 26, 2015, He described the water clay as clear with a visibility of 50-60 ft. He advised me that the center console and Seat were intact. He verified that the engine cover was missing and that he could see the ‘motor block. He described an anchor line extending about 50 f rom the midship cleat into {he water with an anchor attached to the end of the line. There was another line that was 20 ft long tied off to the stem, free floating, He did not see any fishing poles or coolers under the vessel, but he did see a life jacket. The vessel appeared to be in good shape and intact. Captain Ardelean was contacted by Nick Koriloff who advised that he believed the teens Could have been abducted. He believed this based on photos found on the camera located (on the roof of the Ocean Trail Condo. These photos showed a vessel similar in size to the 18 fl. SeaCraft south of the inlet that appeared (0 be stationary. The photos show other vessels in the area of the said vessel Captain Ardelean explained to Nick Komniloff that we would need to get an outside agency involved to assistin the investigation of an abduction. Captain Ardelean was going to contact Palm Beach Sheriff's Orfice when FBI Agent Paul Bruno contacted him. Agent Bruno advised they had been contacted by Nick Komiloff about the possible abduction ofthe boys. They felt there was not enough information to open up an investigation, but they were willing to help FWC in any way. In order to locate the vessel in the photograph, FWC tured over Austin's phone records fo the FBI, These records were given to lnv. McCarthy by Blu Stephanos. Agent Bruno informed FWC the phone records did not show the text, data information and cell tower information that is needed to locate the phone. The family asked AT&T for this information and they were denied, saying they would have to have a law enforcement subpoena, 9-15-15 Captain Ardelean and | visited with the Stephanos family and took a recorded interview from Blu Stephanos. Carly Black joined us in the middle ofthe interview. Blu Stephanos provided the following: * Peace River K-9 Search and Rescue Association is not being paid by his family. * He had never seen the vessel Austin was out on that day. * Austin was allowed to go offshore and fish. Sl Page ‘+ He was not able to identity the fishing rods and reels or if there were portable gas tanks missing. * He believes the rods and reels (Tiagra 30's or 50's) were missing based on reports he had received but cannot confirm Austin checked in via text with him that morning at 1124 hours, He does not receive Snapchats, Austin was a very experienced boater. Austin could fix some mechanical problems. Carly Black verified they did go fishing offshore the day before. Captain Ardelean and | met with Peace River K-9 Search and Rescue Association at the FIC Jupiter Office. They advised the following: ‘+ They had a center console and a bone that they had recovered over the previous few days. The center console was viewed by the Stephanos family and was later determined not to be related to the subject vessel, The medical examiner examined the bone and advised that is was not a human bone, (Refer to tab 6) * They explained they were an independent search and rescue group assisting the Stephanos family at their request + They searched and recovered these items based on coordinated efforts from Kendra Melos, the Stephanos family and DEEM|. (see 9-17-15 for more information) + Det, Galloway, from Camden County, GA, had been given what appeared fo be a human foot bone from a fisherman found in GA, (See 9-30-15) * On July 26 there was a photo believed to be a boy on a raft taken from an airplane. (Pilot Bobby Smith see 9-16-15) ‘+ Advised there was an eyenitness tothe boys fishing close to shore before the storm. (See 9-24-15 and 10-13-15 for more information) 9-16-45 | spoke with Bobby Smith who was searching forthe boys in his aircraft on July 26, 2016. He told me that he has no doubt in his mind what he saw. From his plane fiying at about 1000 ft, he saw two white pieces of debris ted together with an orange life jacket. The plane ‘made three or four revolutions lowering to 200 ft. Laying on the debris was a person on their back, lifting their arms above their head. Smith got a GPS location from his Garmin 430 and climbed to 1500 ft. so he could talk to Jax Center on hs radio. When he tried to find the Person and debris after cimbing in elevation, he was unable to find it again. Once the U.S Coast Guard arrived on scene and Smith lft to refuel, the U.S Coast Guard searched the atea and was not able to verity Smith’ sighting 6 [Page 91745 | received information about a fishing pole that was found on the beach in the area of beach access 73. | walked the beach looking for any other articles that would be related to the Case. | did not find any items of interest on the beach. It should be known that FWC has ‘ecelved numerous items from several sources including FWC employees. All tems found to date have had no significance to the investigation | went to the Jib Club Marina and spoke to the gas attendant Jeffrey Krizka about cameras at the marina, He stated there were no cameras watching the gas tanks or any of the boats atthe marina, He advised there were no gas cans on the vessel and the boys only filed up the gas tank of the vessel | spoke with Damon Smallwood who reported finding the vessel on September 9, 2015, He advised he was 190 miles offshore when he found it, and the vessel was floating upside down. He went into the water and found the vessel to be in good shape. He looked under the vessel to find the console was stil intact and a life jacket stil floating under the vessel The engine cowling was missing and there were no lines or anchors attached to the vessel. The vessel had a black bottom and the Florida registration numbers matched according the U.S Coast Guard. He photographed the vessel, He altempted fo right the vessel to tow it in, but was unsuccessful. He sent the photos of the vessel to me at my request. | spoke with Rex Richards and questioned him about the anchors on the vessel. He stated when he sold the boat there were two anchors on the vessel; a big one for fishing and a small one for the sand bar. He described them as standard Dan Forth type anchors with no Clasp, but they did have rope spliced into the chain, They would have been stored in the front locker. | asked about the cleats on the vessel and he stated the vessel had five cleats; two on the bow, two on the stern, and one on the midship. | asked about safely equipment and he advised he took the flares off because he had a shotgun pistol flare gun on board He also stated he was told by Richard Kuntz they had bought new flares and all safety equipment was on the vessel. While running down additional leads, | spoke with Kendra Melos and she told me she was just a mom wanting to help the families find their children, Melos said she had done some 'ocal inquires and located some pictures from the Jupiter cam and sent them to DEEMI. She also stated that she may have located an eyewitness to the missing teens. Kendra told me that Pamela Stabley believes she saw the boys prior to the storm. Pamela claims to have Called the U.S. Coast Guard prior to the storm and advised them that two boys were stranded with a broke down motor. Ms. Melos asked Pamela to send the phone records to her. Pamela's phone records were then forwarded to me. | looked up the phone numbers dialed by Pamela and both numbers came back to the U.S, Coast Guard. The three calls were ‘made at 1401, 1403 and 1421 hours. | spoke with Richard Kuntz who advised there was only one anchor on the vessel. He also Stated that all the safety equipment required to go offshore was onboard. He did not know ‘what kind of flares were on the boat, but thought the flares were in an ‘orange tube. 7\Page 9-18-15 | met with Rex Richards to discuss the center console found by Peace River. He did not recognize the center console and did not believe it went to the vessel. He advised the three orange life jackets and the white or red throwable life cushion were kept under the center console in a blue hamper with AIC Rick written on it. There were two or three 10 to12 ft docking lines on the boat, and the big anchor had 50 ft. or more anchor line. The small anchor had 50 ft or less anchor line on it ohn Warner from DEEMI advised they had exhausted all leads and would be providing me with a report 9-19-15, | spoke with Trin Anthon who was hired by 6 Maritime and had been assisting with the ‘search in GA. She has had two cadaver hits in the Wassa Marsh Area, She has had these hits two different times. This is the same area where some of the lie jackets and throwable flotation devices were found. She was looking for help to dive the area, 9-22-15 | spoke again with Tarin Anthon who gave me USFWS Agent Stacey Welch's names and ‘numbers in reference to diving the cadaver hits in Wassa Marsh, She stated she did not have the abilty o perform the dive missions. Later that day Captain Ardelean spoke with Agent Welch, who agreed to assist Peace River K-9 Search and Rescue with performing dives in reference to the K-9 tits 9-23-15 | met with Jupiter P.D. Detective Frank to ty and enhance the photos from the Jupiter cam We looked at the photos and were not able fo enhance them. Detective Frank was able to break our railroad bridge video down into stil shots, and enhance the pictures, This did not reveal any new information | went to Grand Slam Bait and Tackle to interview a man named WJ, who may have had information about the boys fishing habits and the vessel | spoke to Brian Black, the owner, \who advised VJ was not there. He also advised that VJ and the boys did nat fish together. also asked if he knew what safety equipment was on the vessel and he advised he did not. 9-24-15 Lt Omold and I took our 15 f. vessel wih a 75 HP motor and ran the same route the boys took that day, B[Pa Run made by Inv. Patterson and Lt Ornold on 15! Key West 1121 hours left Richard Kuntz’s house by water. 1128 hours traveled under FEC Railroad Bridge. 1144 hours arrived at Diane Stephanos' house. Waited 6 minutes and left at 1150 hours 1154 hours arrived at vib Club. Waited 6 minutes and left at 1200 hours. 1206 hours passed house with camera, ‘Avg. speed was 10.2 MPH. Max Speed was 25.3 MPH What we know about the timeline that took place on July 24, 2015 Approximately 0800 hours the boys wake up. § Carly Black took the boys to Richard Kuntz’ house. ® The boys retrieved the $100 for fuel that was left on the counter by Mr. Kuntz. 6 (0942 hours, the vessel with the boys traveled under Railroad Bridge. 7 Between 0949 hours to 1008 hours, text conversation from Perry Cohen (via Austin Stephanos' cell phone) fo Pamela Cohen stating they were going fishing inshore. Between 1000 - 1030 hours, left Diane Stephanos’ house after getting ice and protein bars, & Between 0952 - 1109 hours, bought fuel atthe Jib Club according to fuel receipts. 1026 hours, Tequesta P.D. provided a video of a vessel matching the description heading out the inlet? At 1124 hours, text message received from Austin Stephanos to Blu Stephanos stating just out here fishing.” AAt1125 hours, text message from Austin Stephanos to Carly Black statin “checking At 1316 hours, according to phone records that we received from AT&T reflecting data / internet use, Austin’s phone appeared to disconnect from the internet and never regained connection. The records did not show any data entries from that point on, A large weather cell impacted the Jupiter area at approximately 1330 hours and Continued offshore until dissipating at 1500 hours, Verified by weather charts that Inv, McCarthy received from NOAA. (See tab 8) At 1448 hours, according to phone records received reflecting phone calls, Carly Black's phone called Austin’s phone and continued to do so with no answer. At 1635 hours, Station Lake Worth Inlet received a call from Jupiter PD regarding the overdue vessel of Austin Stephanos and Perry Cohen. ® Information received by Black / Kuntz Family ” Verified through pictures, videos, or snap chats. For all videos and photos refer to digitally, attached file in case File ® According to Diane Stephanos 9|Page On July 26, 2015 the vessel is located by United States Coast Guard (USCG) 67 miles due east of Ponoe de Leon Inlet in Volusia County. On July 31, 2015 at approximately 0930 hrs. Major Soverel, Captain Suggs, Captain Ardelean, Lieutenant Omold, Tequesta Police Deparment, USCG and Investigator McCarthy met with the families at ‘Tequesta Police Department to advise that USCG was ending their search. 9-24-15, LU. Omold and | spoke with James Dulin (Commercial Fisherman who spoke to the media after the boys went missing) and he advised us of the following: * Asstorm was coming from the West around 2 pm. ‘* He was fishing five miles out. + He saw at least 40 boats headed into the Jupiter Inlet. * He saw a small boat with two young people onboard head offshore. He saw them from about a mile away. He could not determine their exact age. * Storm was so bad it was blowing his boat around. ‘+ He could not provide any detail on who he saw goin, or out of, the Jupiter Inet | talked fo Pamela Stabley, who was staying at the Reef Club the day of the incident. She advised the following: * At1401 hours she called U.S. Coast Guard in reference to a broken down vessel (verified through phone records). + The vessel hed two young boys on board * One of the boys was kneeling down at the back of the vessel and he kept iting something * The vessel cranked up and they left the area headed south toward the Juno Pier. 9-29-15 |Imade contact with Zar from Boathouse Marine. | spoke with him in reference to the serial ‘umber for the motor and asked about any previous problems the motor had. He was not able fo give me any information about the motor at that time. | spoke to Peace Rive K-9 Search and Rescue and they advised they had exhausted alltheir leads and would supply me with a report 9.3015 | spoke with Detective Gallaway in reference to bones that were found in Camden County, GA during the search. One of the bones found was believed to be a horse bone. There were human bones found, but the bones were deemed to be very old. None of the bones found were relevant to this case, 10[Page 10-1615 Captain Ardelean and I met with Nick Korniloff and Pam Cohen. They advised the following: * Carly Black came and got Pery Cohen and he stayed at Austin Stephanos’ house the night before. Perry Cohen and Austin Stephanos had gone out on the boat the day before. Perry Cohen did not have a phone because his was broken. Perry Cohen checked in via text with Pam Cohen early that morning stating they were going fishing inshore for Red Fish and Snook * Perry Cohen had a boating safety card and experience driving vessels under Nick Komniloffs direction. Petry Cohen had very litte mechanical knowledge. Perry Cohen frequently went fishing with Austin Stephanos on multiple vessels. Perry Cohen was not to leave the inlet and must check in frequent Carly Black and Austin Stephanos were advised in the past that Perry Cohen was Not to go ofishore without an adult on board, ‘+ Nick Korniloff reconfirmed the rules with Austin Stephanos and Perry Cohen when ‘Austin Stephanos got the new boat * Pam Cohen and Nick Korniloff were driving back from Miami at approximately 4:18 pm, when they found out the boys had not checked in since 11:25 am. * Nick Korniloff called 911 at this time. ‘* Perry Cohen asked Nick Kornioff to borrow the GPS unit from their smaller boat Nick Koriloff gave him the GPS unt and asked why they needed it when they were going to be ishing inshore. Perry Cohen told him Austin Stephanos wanted to try it Out to see if he liked it before buying one for his boat, He stated it would not work on Austin's boat but if they wanted to take it they could ‘+ According to Pam Cohen, Carly Black said the boys did not take the GPS with them and Brian Black returned it to Niok Komniloff at a later date after the incident Al the conclusion of the interview Nick Kornilof showed us an anchor that was found offshore. He also showed us two life jackets and one throwable flotaion device that was found in GA. We took the lfe jackets and put them in evidence for DNA analysis by FDLE. The anchor was taken to Rex Richards to verify if the anchor belonged to the vessel 10-2-15 Captain Ardelean and | met with Rex Richards to do a follow up interview. Rex stated the following + He believed the vessel had two anchors when sold ‘* He was not sure what had been taken off or put on the vessel since purchased. * He sold the boat a little over a month before the accident. 11|Page + He believed Perry Cohen was on the sea trial (he later found out that it was not Perry Cohen and he notified us of this information). The sea tral consisted of a boat ride from Burt Reynold’s boat ramp to Richard Kuntz’s house ‘+ The back of the live well was cut out to make the bilge larger. ‘+ The floor was raised up in the back to improve the self-baling system. «The rocket launcher was purchased from Birdsall Marine located in West Palm Beach, and later installed by Rex Richards. + He believed there were three life jackets on the vessel when he sold the vessel. * Austin Stephanos pulled the bimini top off ofthe vessel after they purchased it * The cowling fit well, and he painted it because it had some scratches from previous ‘owner, ‘+ He did not know the previous owner and did not have service records or bill of sale. Rex Richards mounted the motor on the vessel and did all the wiring, * Rex Richards had the vessel refurbished and running for approximately one year before he sold it ‘He paid $5000 for the motor from Boathouse Marine. * The anchor given to us by Nick Komniloff was not recognized by Rex Richards. Rex splices his anchor lines to the anchor, and he was sure the anchor we showed him ‘was not one that he left on the boat when he soldi 10-615 | received a phone call from Rex Richards stating that the sea trial was on June 22, 2015. He also stated that after talking to Richard Kuntz he did not believe that Perry was on the sea tral | went to Boathouse Marine and questioned Zar about the previous owner of the motor. | asked if he had any information about the motor particularly the serial number. He did not, but assured me he would review his files and get back to me. | went o Birdsall Marine and researched the rocket launcher that was put on the vessel. The 34" four rod holder, fixed back, rocket launcher was the particular one purchased for this vessel. A Yeti 65 quart cooler was the largest cooler that would fit under the rocket launcher (picture of rocket launcher in tab 2). 10-7-15 received an email from Boathouse Marine with the bill of: ‘sale, serial number and a Yamaha service order report. (Refer to Tab 2) | received emails from the U.S. Coast Guard with the phone records received on the day of the accident and a copy of their report for my review. 12|Page 10-815 | met with Lt. Clifton Harrison and other Coast Guard personnel at the U.S, Coast Guard Station Lake Worth. The meeting was in reference to the phone calls Pamela Stabley made {o the U.S. Coast Guard on the day the boys went missing. We met to discuss drift pattems, and Ms. Stabley's accounts of what she saw on July 24, 2015, 10-13-15 | retuned the anchor to Nick Komiloff. Ut Clifton Harrison (USCG) and | met with Pamela Stabley at the Jupiter Reef Club in reference to what she saw on the day ofthe incident. She advised the following: * She saw the vessel from approximately 200-300 yards * She saw the boat rocking like it was going to fp. * She could tell it was two young boys on the vessel and they were working on the back ofthe boat ‘+ Itwas raining out and very overcast. * She called Coast Guard because in 18 years of staying al the Reef Club, she had never seen anyone out in the bad weather on a boat. She also thought they were broke down. * She told us she called back to the Coast Guard 20 min later to tell them that someone helped them and they lef. ‘After questioning her further about her statements describing another vessel coming to help, she advised that no other vessel had actually come up to the boys. She told me that she had told the U.S Coast Guard that a boat came up to the boys the day ofthe incident because she was mad that no one had responded before the boys left. She advised the vessel she observed with two boys actually started their motor and left the area heading south The vessel utilized by Austin Stephanos and Perry Cohen was an 18 ft. center consoled SeaCraft without atop. Austin Stephanos was described by Coast Guard as being 5'2" with blonde hair, weighing approximately 120 Ibs. Perry Cohen was described by Coast Guard as 52" with brown hair weighing approximately 90 Ibs. In order to determine the plausibility of Pamela Stabley’s observations, a re-enactment of her report was conducted. A 22 ft center console vessel without a top was utiized to simulate the vessel operated by Austin Stephanos and Perry Cohen, The simulation vessel was occupied by two crew members from Station Lake Worth inlet ‘One was a female, 18 years old, 133 Ibs. with brown hair. The other crew member was a male, 27 years old, 180 Ibs. with brown hair. We asked Pamela Stabley where she emembered seeing the vessel on the day of the incident and Lt. Harrison positioned the 22 {t. vessel in the location she advised. The vessel was positioned at a distance of about 220 yards away. Once she was confident of the position of the vessel. The twa crew members 13 [Page stood up and Pamela Stabley was asked to provide a description of the two crew members. Her descriptions were as follows: * She believed the vessel she saw on July 24, 2016 was larger than the vessel used for the re-enactment, * She intaly believed the people onboard were a father and son. She changed her description of the smaller individual to a female after 40 minutes, The vessel had ‘moved in to approximately 150 yards when she noticed the female place her hand on her hips which made her change her mind about seeing a father and son, In the re-enactment, Pamela Slabley was unable to identity the age or sex of the two individuals during ideal conditions at a distance of just over 200 yards. Pamela was unable {o identify details regarding the people on the boat. | took photographs of the deck she was standing on, and the vessel at 220 yards, with and without zoom. ° ' participated in this interview at the request of the U.S, Coast Guard as they conducted their inquity of Pamela Stabley, what she saw, and the phone calls she made that day. A final reportis available through the U.S, Coast Guard. 10-20-15 At approximately 1432 hours | transported and checked evidence into the FDLE lab in Orlando. This consisted of the two life jackets and one throwable flotation device received by Nick Komiloff. The evidence was examined for DNA, blood, and/or fibers. (Refer to tab 1) 10-28-15 I received an email from Captain Ardelean in reference to the phone records that were being analyzed by the FBI. A power point was given by David Magnuson (FBI) of his findings, This ‘shows the cel tower locations and the location ofthe phone, In slide one and two there are {yping errors in reference tothe time. The time shows 12:02 pm and according to the phone ‘ecords it should show 12:02 am) (Refer to tab 3). Captain Ardelean talked to him ata later date, they figured out thatthe data records and data cell tower records were not provided by AT8T, This may have significance as Snapchat messaging would be provided in data records. AT&T advised they would need a warrant to provide that information fo FWC. 11-715 | feceived an email reference to the FDLE report advising me that the report was finalized. | Signed on to the FDLE database and downloaded the report. The report noted that the DNA Collected was not interpretable and the information contained from the life jackets and the throwable flotation device did not meet the criteria to be entered into CODIS. (Refer to tab 1) * For all videos and photos refer to digitally attached fle in case File 14|Page 114.945 Captain Ardelean and | made contact with Alvia Smallegange, who, according to phone records, called Austin's cell phone at 12:02 a.m. on July 24, 2015. We asked her if she talked to them on the day ofthe incident, She advised that she called them to see i they ‘were still going out on the boat as planned, but there was no answer. According to phone records the call was made at 12:02 a.m. on July 24, 2015, which is contradictory to the FBI map that shows the call was made at 12:02 p.m. (Refer to Tab 3) 11-12-45 | drove to the FDLE lab in Orlando and retrieved the two life jackets and one throwable flotation device, | also received DNA extractions and Cuttings obtained during the DNA analysis process. | transported all the items from the lab in Orlando to the FWC Jupiter evidence compound. 12-10-15 FWC contacted the State Attorney's office in Palm Beach County in reference to subpoenas and search warrants to assist us with determining an accurate timeline, AT&T would not release the phone records with cell tower information to us without a search warrant. Cell tower information might tell us the location of Austin’s phone throughout the day. We ‘equested a search warrant and subpoena from the State Atiomey's office for phone records from AT&T as well as Snapchat. Based on the information given to the State Altoney's office, they stated there was no probable cause for a criminal violation, which is needed fo obtain a search warrant. We were able to obtain subpoenas for Snapchat and AT&T phone, ‘SMS, and data records (not including cell tower information) based on a missing person’s investigation, 12-1545 Captain Ardelean, Lt Omold, Investigator Wiernicki and | met and reviewed the phone records received from AT&T. We compared these records to the records already obtained We received three sets of records; phone call, text messages (SMS), and data (all intemet usage including iMessages). We were able to verify that all texts sent were received and available through phone records. The text messages were found inthe data portion and the SUS portion ofthe phone records. Through these records we were able to cary the times Phone calls were made and received. According to the phone records we received from ATT reflecting data / internet use, Austin’s phone appeared to disconnect from the intemet and never regained connection at 1316 hours. The records did not show any data entries from that point on. 12-2345 | received an email from Snapchat with the records from Austin’s Snapchat account. The records show thal Austin set up the account in 2012 using his email address. According to ‘Snapchat there were no records of correspondence available for this account 15 [Page {interviewed Tanya Kugel again, as | leamed she had some clarification to the statement made to Inv. McCarthy on August 4, 2015, She said she was confused about the times that the boys were at Diane Stephanos’ house on the day of the incident. Based on her recollections of the day, phone records, and the time of her doctor's appointment, she believes that the boys would have been at Diane's house at 8:30 ~9:00 am, She also stated She remembered thinking "can't believe the boys are here so early’, because they came in 0 lle in the aftemoon from fishing offshore the day before. Austin told her he was going Dolphin fishing and he would bring her back some. She stated that they did grab two small 988 cans, and based on the way he was carrying them they did not appear to have gas in them. The boys were in a hurry to get offshore ‘According to Tanya Kugel, Nick Bingo was supposed fo go with them but did not due lo strep throat. | called Nick Bingo and he did not tak to, or see the boys, onthe day ofthe incident, Conclusion According tothe information received and the facts found, we know that Austin Stephanos and Perry Cohen were taken to Richard Kunt’s house by Carly Black on the morning of July 24, 2015 at or around 0900 hours. They took Austin's vessel, a 1978 18'2" SeaCraft bearing FL 0838 DLJ Hin #SECF801 10977, fora day of fishing, They went under the railroad bridge at 0942 hours as this was recorded by the bridge video system. They went to Diane Stephanos' house to fil their cooler wit ice, get protein bars and fishing poles, They left the house and stopped at the JIB Club Marina for fuel between the hours of 0952 hours and 1109 hours based on the receipts obtained from the JIB Club, ‘A vessel matching that description lft the inlet at approximately 1025 hours. A tex! message received al 1124 hours and 1125 hours by Blu Stephanos and Carly Black from Austin saying "What's up I'm checking in I'm just out here fishing,” was the last known Correspondence with the boys. This text message was traced toa cell tower sie in Jupiter and showed their location fo be south of the Jupiter Inlet. The exact location is unknown, A large weather cell impacted the Jupiter area at approximately 1330 hours and continued offshore until dissipating at 1500 hours ‘At 1618 hours Perry's family called 911 to report they had not heard from their son. A search and rescue mission was initiated with the United Sates Coast Guard (USCG), Florida Fish and Wildife Conservation Commission (FC), Palm Beach County Sherif's Office, Tequesta Police Department and Jupiter Police Department. This search was initiated in Palm Beach County, Florida and extended as far east as the Bahamas and as far north as the Carolina's, The massive search and rescue efforts included personnel from local, mult- Slate, federal agencies, search and rescue/recovery divers and the Department of Defense. Equipment used fom the different agencies included federal aircraft (long range reconnaissance aicra, rotary aircraft), mulple-state's aircraft (ned wing, rotary aircraft), federal watercraft (offshore cutter/ships and response vessels), muliple state's vessels (inshore, offshore vessels), motor vehicles, and all-lerain vehicles on the beach 16|Page The USCG located the missing teen's vessel on July 26, 2015. The vessel was found Capsized and floating offshore in a northoound direction approximately sixty-seven miles ast of Ponce de Leon Inlet. The massive search and rescue effort concluded on July 31, 2015, Austin Stephanos and Perry Cohen are sill isted as missing in the Florida Crime Information Center database for missing persons. Search efforts for the missing teenagers were unsuccessful and our investigation has exhausted any credible leads which might have helped locate Austin Stephenos and Perry ‘Cohen. We have been unable to find any further information as to the whereabouts of these missing teenagers at this time. Tequesta Police Department has entered both Austin Stephanos and Perry Cohen into the Florida Crime Information Center's database for missing persons. This will remain classified as a missing person(s) case until additional information is discovered. Mr. Kuntz stated that his mother set the limits on where Austin was allowed to go on the boat, but he “didn't think there was any.” © The vessels registered in Mr. Kuntz daughter, Carly Black’s name. © Regarding safety equipment, Mr. Kuntz stated, “It had everything on there that it was supposed to, except a fricken EPIRB” Mr. Kuntz stated that he ‘was almost positive that there were at least three (3) life preservers on there.” Mr. Kuntz thought thatthe life preservers and the battery were under the console. The console did not have a door and was always open. The vessel did not have a VHF radio, © On 7/25/2015 Mr. Kuntz drove to Jacksonville and chartered a plane to assist in he search and rescue. © Mr, Kuntz stated that he was within “5-10 minutes’ away when the vessel was located. The following information was obtained © Ms. Kugal advised the boys there was going to be a storm later inthe day, © Ms. Kugal stated that Austin and Perry asked about two (2) red gas cans and stated they needed ice. © Ms. Kugal stated she saw Austin and Perry eave ‘about 0930" hrs. (Laer she advised that she had referenced her phone records. Ms. Kugal placed a call at 0955 hrs and stated the boys had left by then) © Ms. Kugal stated she saw the boys load two (2) gas cans on the boat Ms. Kugal stated Austin and Perry were at Diane Stephanos's house for approximately twenty (20) minutes. ° 6/7/2015 At approximately 1347 | sent an email requesting historical inlet photographs from the St. Lucie Inlet administration personnel for 7/24/2015, 8/10/2015 At approximately 1520 brs, | requested all radar, data, charts and graphs from NOAA that depicts the weather and water conditions in and around Jupiter inlet on 7/24/2015, 51 At approximately 1555 hrs. | took a sworn recorded statement from Rex Richards (previous vessel owner) athis house, utlizing the FWC Recorded Statement Outline (FWCDLE 012 (01/08)) The following relevant information was obtained, © Mr. Richards believes he acquired the vessel in 2012 ‘© When Mr. Richards received the vessel he stated the condition of the vessel was “bad” and that ‘it had been sitting for twenty (20) years. © Mr. Richards stated he did cosmetic work to the vessel as well as fiberglassed a new closing hatch in the rear. ‘© Mr Richards replaced all the locking mechanisms on the hatches. © Mr Richards ran new wiring related to the engine when he placed the Yamaha on the vessel Mr. Richards also wired in new navigational lights on the vessel, Mr. Richards placed a 2005 115 hp Yamaha motor on the vessel that he acquired from Boathouse Marine in Riviera Beach. Mr. Richards performed no mechanical work on the Yamaha moter, Mr. Richards did have Boathouse Marine fix a leak in the trim and tit on the motor, When Mr. Richards purchased the Yamaha motor it had just received an oll change, new spark plugs and filter. Mr. Richards ran the vessel all over the state in the intracoastal as well as off shore. © Mr. Richards put approximately 150 hours on the motor. When he sold the vessel, the engine had approximately over 1000 hours. The vessel contained a stereo but no marine radio, When Mr, Richards sold the vessel, all safety equipment including life jackets, throw-able PFD, fire extinguisher and a whistle went with it wih the exception of flares. ©The life jackets were stored in a laundry basket under the console. © Mr, Richards took Austin for a sea trial when the vessel was purchased. ‘© Mr. Richards never had issues with the Yamaha motor. 8/17/2015 e020 0 ° ‘Atapproximately 1217 hrs. | received an email link from St. Lucio inlet administration personnel who had Photos of the St. Lucie Inlet for the date of 7/24/2015. Mrs, Black stated that Rick Kuntz had called at approximately 0730 ~ 0800 hrs and offered to take Austin and Perry to the boat, The boys decided to go later in the morning Mrs, Black drove Austin and Perry tothe vessel at Rick Kuntz house at approximately 0900 — 0930 hrs. The only phone contact Mrs. Black received from Austin was a text message that said, “checking in’ received at 1125 hrs Austin would check in on the phone with Mrs. Black approximately every two (2) ~ three (3) hours when on the boat. Mr, Black went to the Bahamas to go fishing the morning of 7/24/2015. Mr. Black did not fnd out about the boys until 2000 hrs. Mr. Black received word that Austin and Perry might have gone to the Bahamas, Mr. Black decided to stay in the Bahamas for the night driving around and looking various places. Mr, Black was accompanied with Ben, Bily Black and Julianne Johnson 7/23/2015 was the last contact Mr. Black had with Austin The rules and guidelines Austin had when out on the boat was to check in frequently and to not go way off shore. Four (4) to five (5) miles offshore was acceptable Mr. Black stated the boat was in good condition and was sturdy. Austin was pulled over a week before but was not ticketed because all of his safety equipment ‘was on board. The Blacks were never aware of any limitations in regards to Perry Cohen going on the boat with Austin. You will notice in the PowerPoint that the times are 4 hours off from what the records show, as the records are in Universal Coordinated Time (UTC) (aka GMT). The US East Coast is minus § hours from UTC, then we add an hour for Daylight Savings Time, so the its minus 4 from the time listed. So, also, the records do not really go to 4 pm EDST, the only go to 12:02 pm EDST. Not much other useful data to plot, as you know. Here is what we are looking at: ‘The boys departed on a fishing trip sometime late in the morning of 7/24/15. They left from a dock in the Loxahatchee River, boated to a relative’s house in the Intracoastal Waterway, stopped for gas at the Jupiter Inlet Boat Club Marina, and then departed offshore. There are many unanswered questions as to the timeframe they left the intet, however a bad storm rolled into the area from the west around 12:30, I you can, we would lke to know the general area they were on 7/24. The one boy used chat apps on his phone quite a bit which used data that day, but the best | can see is only two calls. They were reported missing sometime after 4pm. We are attempting to assist FWC with their investigation and believe the phone records/tower locations will dispel CF confirm various reports of sightings and theories from that day. {really appreciate you taking the time to look at this. Ceo coming into Tequesta Police Department, Kornilo and Pamela Cohen went to Jupiter Police Department srdoefePort this incident. JPD notified the Coast Guard at 4:30pm, Seatow at 4:37pm FW ax 5:27pm and PBSO at 6:30pm. After we gathered specifics about the boat and missing persons, that information was Passed on to all of the aforementioned agencies.
