Background:
TheNationalFitnessCampaign(NFC)createsoutdoorFitnessCourtsaccessibletothegeneral
public,forallsocioeconomiclevelsandgeographies,atnocharge.Byturningopenspacesinto
vibrantcommunityresourcesforhealthandfitness,NFCsupportsthefitandhealthylifestylesof
neighborhoodsacrossAmerica.

TheFitnessCourtwasinventedinSanFranciscoin
1979.WiththesupportofMayorDianneFeinstein,
theMarinaGreenlocation,aswellasseveralothers
inSanFrancisco,wereopened.Duringthe1980s,
theNFCinstalled10,000freefitnesscourtsin
communitiesacrossAmerica.SponsoredbyWells
Fargoandmorethan100hospitals,itengaged
millionsandwasembracedandcelebratedbytwo
U.S.presidents,governors,andover4,000mayors
whosecitiesreceivedthem.Tothisday,theMarina
GreenFitnessCourtremainsavibrantgathering
placeenjoyedbyover150,000activeusersayear.
Thefounderoftheoriginalfitnesscourt,dismayed
byAmericasdeclinesinhealthandwellness,hasrelaunchedtheNFCtoagainbuildaplacein
everycommunitywherepeoplecanenjoy,shareandencourageoneanothersfitnessandhealth.

FitnessCourtDesign
TheFitnessCourtwasdesignedbytheNFCteam,includingmultiplefocusgroupsessionswith
athletesandindividualsofallfitnesslevelsoveraneighteenmonthperiod.

ThephysicalstructureweredesignedbySamLucente,formerdesignchiefatHewlettPackard,and
theexerciseprogramwascreatedbyMarkLauren,authorandfitnesstrainingleaderforthe
military'sspecialforces,whosemethodologyprovidesthefoundationforthefunctionality,
versatilityandvalueofthisbodyweightcircuittrainingsystem.

HowitWorks
TheFitnessCourtisasevenstationbodyweightfitnesscircuit,designedasatrainingtoolfor
peopleofallagesandfitnesslevels.Itusesnoweightsormachines,insteadrelyingonagraduated
trainingsystemofmaneuveringandliftingonesownbodyweight.Eachofthesevenstations
offerstrainingforoneessentialbodymovement,including:Core,Squatting,Pushing,Lunging,
Pulling,Agility,andBending.

Usersfollowthecircuit,selectinganexerciseateachstationandanamountoftimeformovement
andrest.Themanyexerciseoptionsateachstationcanaccommodateandtrainbeginnerswithno
fitnesstrainingaswellasthemostcompetitiveathletesthroughbothstabilizedbeginning
movementsanddestabilizedadvancedmovements.

CourtSignsofferthreesimplemovementsforeachstationandtheFitnessCourtwebsiteoffers
manymore.Usersareencouragedtobuildtheirownroutinesbycombiningthemanyoptions
offered.Inaddition,clinicsandworkshopswillbeofferedledbyprofessionaltrainerswhowill
instructusersonexercisesandroutinesaccommodatedbythecourt.

Sustainability
TheFitnessCourtismadeofsustainable,recyclablematerials,including70%recycledrubber
flooringandrecycledsteelframing.Inaddition,theFitnessCourt,whenremovedwillbemorethan
90%recyclable.

FitnessCourtDesignandLocation(seeattached).

MemorandumofUnderstanding:
RPDwouldliketoenterintoaMemorandumofUnderstanding(MOU)(seeattached)withNFCto
locatethefirstFitnessCourtatatemporarysiteonthetriangleadjacenttoMarinaGreen(see
below).

KeyMOUtermsarethefollowing:

NFCisresponsiblefordesigning,developing,constructingandinstallingtheFitnessCourtatits
solecostincompliancewiththeRPDOperationalrequirements.NFCwillalsoworkwithRPDs
DirectorofOperationstodevelopamaintenanceplanandprovideRPDwiththenecessary
fundstomonitor,operateandmaintaintheFitnessCourt.Inaddition,NFCwillworkclosely
withRPDandrelevantneighborhoodgroupstocustomizeandapprovetheprogramtosupport
theprogramminggoalsofRPD,aswellasgatherfeedbackfromusersandneighborsregarding
thepresenceanduseoftheFitnessCourts.Lastly,iftheprogrambecomespermanent,NFCwill
providefundingforthecostofanyRPDstaffthatmayberequiredtomanagetheprogramfor
theCity.
RPDwillprovideRPDoperations,structuralmaintenanceandotherappropriatestaffforthe
maintenanceoftheFitnessCourttothelevelrequiredundertheMOU,willworkwithall
relevantstakeholderstoaddressconcernsorrequestedmodifications,andwillensurethatall
courtsignage,includingsponsorshipsignage,complieswithexistingparksignagepolicyand
regulations.Lastly,RPDhastheauthority,atitssolediscretion,tohaltoperationoftheFitness
CourtifthefacilitydoesnotmeetRPDoperationalorsafetystandards.
ThisFitnessCourtshallremainforamutuallyagreeduponamountoftime,between3and6
months,afterwhichtimeitcanbeeitherremovedormadepermanent.IfaMarinaGreen
locationischosen,theFitnessCourtmustberemovedbyJuly15,2011,toaccommodatethe
AmericasCupExhibitionRaces,unlesstheAmericasCupEventAuthorityagreesthatthe
FitnessCourtcanremain.
UserfeedbackwillbeusedasabasisforfutureprogrammingandwhethertheFitnessCourt
shouldbecomepermanent.
Ifsuccessful,theNFCshallengagesponsorstosupportFitnessCourtsinothergeographically
anddemographicallydiverseparklocationsinSanFrancisco.Allcourtsignage,including
sponsorshipsignage,mustcomplywithexistingparksignagepolicyandregulations,andmust
beapprovedbyRPD.

MEMORANDUM OF UNDERSTANDING
REGARDING MANAGEMENT OF
The National Fitness Campaign Temporary Fitness Court

THIS MEMORANDUM OF UNDERSTANDING ("MOU"), dated for reference purposes only


as of _______________, 2011, is entered into by and between the City and County of San Francisco
Recreation and Park Commission ("Commission") and the National Fitness Campaign (NFC), a
California LLC Corporation.
RECITALS
A.
NFC creates outdoor Fitness Courts accessible to the general public, for all socioeconomic levels and geographies, at no charge. By turning open spaces into vibrant community resources
for health and fitness, NFC supports the fit and healthy lifestyles of neighborhoods across America.
B.
The Recreation and Park Department ("RPD") will agree to locate the first Fitness Court
in a temporary site, either adjacent to the existing Marina Green location, the triangle adjacent to Marina
Green or another mutually agreed upon location within 60 days of approval by the RPD Commission the
temporary fitness court, or another mutually agreed upon date.
C.
This Fitness Court shall remain for a mutually agreed upon amount of time, between 3
and 6 months, after which time it can be either removed or made permanent. If a Marina Green location is
chosen, the Fitness Court must be removed by July 15, 2011, to accommodate the Americas Cup
Exhibition Races, unless the Americas Cup Event Authority agrees that the Fitness Court can remain. If
the Fitness Court remains on Marina Green, no corporate sponsorship signage is allowed during any
Americas Cup activities.
D.
The temporary Fitness Court shall be used to introduce San Franciscans to the Fitness
Court concept through clinics and workshops led by professional trainers who will instruct users on
exercises and routines accommodated by the court. User feedback will be used as a basis for future
programming and whether the Fitness Court should become permanent.
E.
If successful, the NFC shall engage sponsors to support Fitness Courts in other
geographically and demographically diverse park locations in San Francisco. All court signage, including
sponsorship signage, must comply with existing park signage policy and regulations, and must be
approved by RPD.
F.
If the program expands beyond 8-10 sites, RPD agrees to work with NFC to create a
cross-sector advisory board that will utilize the Fitness Court as the basis for improving health and fitness
outcomes across San Francisco in schools, parks, businesses and other publicly accessibly community
locations. The board will work with NFC and its partners to provide guidance on programming,
partnerships and site selection for Fitness Courts across San Francisco.
G.
Its is important to both RPD and NFC that the Fitness Court is made of sustainable,
recyclable materials, including 70% recycled rubber flooring and recycled steel framing. In addition, the
Fitness Court, when removed will be more than 90% recyclable.
H.
The purpose of this MOU is to further define the framework of cooperation between RPD
and NFC for the maintenance, beneficial uses and facilities of the Fitness Court, the performance of
NFCs and the City's obligations under the MOU, and certain other matters set forth below.

NOW, THEREFORE, IT IS AGREED AS FOLLOWS:


AGREEMENT
A.
Recitals. The foregoing recitals are true and correct and are incorporated herein by this
reference.
B.
Effective Date; Term. The term of this MOU shall commence on October 1, 2011 ("Effective
Date"), and terminate on September 30, 2012 (Termination Date).
C.
NFC Responsibilities in Fitness Court. Activities to be undertaken by NFC with respect to the
Fitness Court shall include the following:
1.

Design and develop the Fitness Court at its sole cost in compliance with the RPD
Operational requirements. NFC shall provide RPD with the opportunity to review and
comment on NFC's design of the Fitness Court.

2.

Gather all required City approvals at its sole cost to authorize the construction and
placement of the Fitness Court.

3.

Construct, deliver and install the Fitness Court at its sole cost in compliance with the
MOU, the permits issued for the Fitness Court, and the approved final design.

4.

Work with RPD Director of Operations to develop a maintenance plan. For the term of
MOU, provide RPD with the necessary funds to monitor, operate and maintain the
Fitness Court, including all Fitness Court fixtures, security structures and graffiti
abatement.

5.

Fund any amounts at its sole cost required to procure third party insurance policies for the
Fitness Court required by the City's risk manager or otherwise required by RPD.

6.

Work closely with RPD and relevant neighborhood groups to customize and approve the
program to support the programming goals of RPD and fitness goals of people in
neighborhoods across San Francisco.

7.

Gather feedback from users and neighbors regarding the presence and use of the Fitness
Courts.

8.

If the program becomes permanent, provide funding for the cost of RPD staff that may be
required to manage the program for the City.

D.
RPD Authority and Responsibilities in Fitness Court.

RPD will exercise the following

maintenance of facilities and the Fitness Court to the level required under the MOU. NFC
will provide funding for these tasks during the Funding Period as indicated in Section
C.4.

2.

Work with other City departments, Neighborhood Groups and any other relevant
stakeholders to address concerns or requested modifications.

3.

Ensure that all court signage, including sponsorship signage, comply with existing park
signage policy and regulations, and approve such signage in a timely manner.

4.

RPD has the authority, at its sole discreation, to halt operation of the Fitness Court if the
facility does not meet RPD operational or safety standards.

5.

RPD has the authority to remove the Fitness court, at NFCs expense, if the court has not
been removed after the mutually agreed upon amount of time has expired.

E.
Notices. All notices, demand, consents or approvals which are or may be required to be given by
either party to the other under this MOU shall be in writing and shall be deemed to have been fully given
when delivered in person to the following designated representatives at the following addresses, or any
other address designated by a party through a notice delivered to the other two parties:
