Allegation #1: 22.058 Departmental Reports
B. No employee shall, with intent to deceive, knowingly cause to be made or recorded any
false, inaccurate, or misleading report.
Sanction: G.O. 22.058 Departmental Reports
Sanction: Knowingly making a false statement or entry in any departmental report, record,
application, interview, hearing or judicial proceeding. CLASS 5
On April 29, 2015, City of Phoenix Citizen
filed a Complaint against Police
Officer Joel Queenan claiming he completed a False Departmental Report. The Complaint
stems from an incident at Luke Air Force Base (AFB) on March 16, 2015, where
was
video and audio recording a military facility and was aggressive and uncompliant when asked
for identification by Department Of Defense (DOD) Police Officers and Law Enforcement as
well as uncompliant when detained by Glendale Police Department (GPD) Officers. Queenan
arrested and booked
for Failure to Provide Identification and towed
vehicle.
Queenan, as witnessed by another Officer and three Luke AFB Law Enforcement Officers, as
well as viewed and heard on various video and audio recorded files, was within Policy as
Queenan completed an accurate departmental report documenting his actions.
INTERVIEWS by Sgt Mark Lankford
Interview of Officer Donald Montgomery

On Tuesday, April 28, 2015, at 13:21 hours, I conducted a digitally recorded interview with
United States Air Force (USAF) Police Officer Donald Montgomery at a private office in the
Security Forces Building at Luke AFB. The following is a summary of my interview. For the
complete interview, listen to the audio recording which is saved in WAV format on the "N"
Drive.
Prior to asking Montgomery any questions, I gave him a brief summary of how the
Departmental Investigation (DI) materialized, my role, and confirmed he was familiar with the
information. I asked Montgomery what his official title and duty is to which Montgomery states
he is a "Police Officer at Luke AFB" and works for the USAF with numerous responsibilities to
include entry control on to Luke AFB. Montgomery explained he attended a Law Enforcement
Academy. On March 16th he was wearing the uniform he wore for this interview, and the
uniform has patches on both sleeves with the word "POLICE" as well as displays a badge and
police duty belt with pistol.
Montgomery then explained the contact with
to include
operating a Dash
Camera in his vehicle,
providing his Military Identification Card to Montgomery, and
when Montgomery told
he could not record the installation
began screaming
"get your supervisor, get your supervisor". Montgomery then asked
to pull to the side
of the road to keep the entrance open and Montgomery called his supervisor to the scene.
Montgomery states approximately 5 minutes later,
exits his vehicle now recording the
gate with his cell phone.

Montgomery then stated when his supervisor USAF Reserve Master Sergeant (MSGT) Luanne
Bruggeman arrived she was briefed on

Driver License and he refused. Montgomery had no further contact with
.
I asked Montgomery what he saw and heard concerning
interaction with GPD to
which he stated he and Bruggeman gave Queenan a statement to what
did and observed
as Queenan and GPD Officer Jonathan Clubb detained
. Montgomery had no further
involvement.
I concluded the interview by asking if he had anything further to add to which Montgomery
stated: "the guy went from zero to pissed off instantaneously for whatever reason. I have no
idea." Montgomery did ask the Officers if
had weapons as Montgomery was concerned
for his safety.
I then confirmed Montgomery was attempting to advise
he was violating US Law to
which Montgomery advised the incident falls under Title 18 USC stating to video tape on base
you need the Base Commander's approval. Montgomery had nothing further and was provided
a business card with my contact information and the interview concluded.

Interview of SSGT Christopher Washburn, USAF
On Tuesday, April 28, 2015, at 13:48 hours, I conducted a digitally recorded interview with
SSGT Christopher Washburn at a private office in the Security Forces Building at Luke AFB.
The following is a summary of my interview. For the complete interview, listen to the audio
recording which is saved in WAV format on the "N" Drive.
Prior to asking Washburn any questions, I gave him a brief summary of how the DI
materialized, my role, and confirmed he was familiar with the information. Washburn stated he
was a back-up Officer to Bruggeman who was called to the gate for
. Washburn was
briefed by Montgomery of
not recognizing Montgomery's authority to perform gate
control procedures. Washburn and Bruggeman made contact with
in his Honda and
"was verbally aggressive" and began videotaping the contact on his cell phone.
Washburn stated GPD was called to the scene while Luke AFB Officers kept "eyes on him".
Washburn stated
would open his door and yell obscenities at the Officers and at one
point did attempt to exit but was ordered back into his vehicle. Washburn stated GPD arrived,
got a brief from Luke AFB Officers, and contacted
in his Honda to which
resisted and GPD was eventually able to detain
. Washburn stated throughout contact
was verbally abusive, non-compliant and lacked respect for authority.
I asked where
was seated after he was detained to which Washburn stated on a small
wall behind his vehicle and later in the back seat of Queenan's Police vehicle. Washburn
confirmed his role was as a back-up. I asked if Washburn heard or observed Queenan adjust
handcuffs to which he did see Officers adjust
handcuffs on a few occasions.
I asked if the GPD Officers were rude to which he stated no. Washburn remained on scene until
was transported by Queenan at which point Washburn returned to patrol duties on Luke
AFB. Washburn had nothing further and was provided a business card with my contact
information and the interview concluded.
Interview of
On Wednesday, April 29, 2015, at 10:30 hours, I conducted a digitally recorded interview with
Mr.
at the GPD main station conference room. Present for the interview was
Professional Standards Unit (PSU) Lieutenant Carrie Castrovinci. The following is a summary
of my interview. For the complete interview, listen to the audio recording which is saved in
WAV format on the "N" Drive.
After confirming
information and explaining my role with GPD, I asked
how
I could assist him.
stated: "Officer Queenan lied on his Police report and I want him
charged for False Reporting. That's a Misdemeanor. That's for starters."
then stated he
had a number of questions concerning an inventory of his vehicle stating it was discussed in his
email complaints. I then asked
to go through his Complaint of Queenan.
began looking through a copy of his Police report stating: "He didn't have Probable

who approved him recording Luke AFB with his Dash Camera to which
replies: "What difference does that make? What difference does that make? Why are
you even asking that question? Did I violate the law? Did I commit a crime? Why are you
asking that question?"
then explains he has been recording on his Dash Camera for two
years and never had an issue in the past and has not violated the law.
I then confirmed
also recorded his contact with Luke AFB on his cell phone and asked

if he could provide me a copy of that as well as any other evidence to which he said he would.
(Of Note:
later emailed me two files which contained cell phone video. The two cell
video files will be reviewed and discussed later in this DI).

would be part of my DI.

Bruggeman to which I advised procedures to file a report. (Of Note: DR 15-58843 will be
completed later).
I advised
he would hear back from PSU via a phone call or mail on his Complaint
resolution and asked if I could assist further to which
stated no and the interview
concluded.
Interview of Sergeant Jeff Daukas
On Thursday, April 30, 2015, at 11:15 hours, I conducted a telephonic interview with Sergeant
Jeff Daukas #12233 concerning his involvement with the DI. The interview was conducted
telephonically and digitally recorded as Daukas was a witness, did not desire a Peer
Representative, and was not scheduled to return to duty for approximately 2 weeks. Daukas was
familiar with the GPD Notice of Admonishment, understood the notice, and advised he did not
need it read to him. The following is a summary of my interview with Daukas. For the complete
interview, listen to the audio recording which is saved in WAV format on the "N" Drive.
Prior to asking Daukas any questions, I gave him a brief summary of how the DI materialized
and confirmed he was familiar with the information. I asked Daukas if he recalled the original
Call For Service (CFS) and could he review what he recalled. Daukas stated he specifically
recalled the incident at Luke AFB as the base was not Code 4 and he took note of this. Daukas
recalls later receiving a call from Queenan updating him on the investigation and arrest. I asked
Daukas if he had any further information concerning the CFS to which he did not.
I then reviewed the email complaint (March 19) from
which was forwarded to Daukas
(March 20) for follow up to which Daukas recalled the information. I then stated PSU received
a second email from
on March 27 with an attachment which contained a memo Daukas
mailed
on March 22 and confirmed Daukas was familiar with this as well. I asked
Daukas to describe his investigation of the Complaint.
Daukas stated during his attempt to contact
draw his Taser for a less lethal option when Clubb noted Queenan had the driver by his left
hand with his Taser pointed at the driver. Clubb stated they were able to get the driver to be
compliant and detained the driver with handcuffs.
Clubb stated he sat the detained driver behind the vehicle on a short wall and stood by with him
while Queenan investigated. Clubb stated
wanted water to which Clubb provided once
Queenan returned to stand by with
. Clubb retrieved the water from
Honda
trunk at his request. Clubb stated while standing with
made comments of an
unlawful detainment by Luke AFB and GPD and he was taking legal action. Clubb also stood
by while Queenan investigated to include Miranda Warnings, questioning, and the arrest of
.
I asked Clubb what was
arrested for to which he stated Queenan told
it was for
failing to provide Identification to Luke AFB Officers after being asked and required to
provide. Clubb also stated he obtained
wallet from inside the vehicle and placed it
with
property. I asked Clubb if he searched
vehicle to which he stated
gave him permission to retrieve water from a golf bag in the trunk of
Honda
and to turn his vehicle off to save fuel.
I then explained to Clubb I had additional questions of which he may have already answered
but we would go over them again. I asked Clubb if he had an opportunity to review the Police
report and was there anything incorrect in the report to which he said the report was accurate.
I asked Clubb why he responded Code 3 on the call to which he stated based on the information
provided that Luke AFB Officers were not Code 4 and the subject not detained Clubb and
Queenan responded Code 3. Clubb stated this is the first time he has ever responded to Luke
AFB Code 3 as Luke AFB Officers normally have the situation under control.
I asked why
was detained to which Clubb stated upon arrival
s Honda was
parked on base past the gate,
was non-compliant, and would not provide identification.
Clubb stated based on this information
was detained for Trespassing and to make the
scene safe.
I asked if Queenan identified himself to
to which Clubb stated yes, and to step out of
the car. Clubb also stated he heard
say no and observed
physically pull away
from Queenan. I confirmed Clubb and Queenan were both in uniform and driving marked
Police vehicles.
I then asked Clubb to specifically review what he observed
do when Queenan asked
him to step out of the vehicle to which he stated he heard
say "no" and Clubb looked
into the front passenger window observing
pulling his left arm away from Queenan and
moving his right arm and body towards the center console of the Honda. Clubb confirmed the
Honda was still operating. Clubb also repeated hearing
say: "no". Clubb again
described how he assisted detain
by holding his right hand while Queenan had
left.
I asked Clubb why was
seated detained behind the Honda for approximately 40
minutes and in the back seat of Queenan's vehicle for approximately 50 minutes and what was
occurring. Clubb explained in addition to the State charge of not providing Identification, Luke
AFB was also conducting their investigation and coordinating whether to file Federal charges
for videotaping the base as well as coordinating search and seizure of the recording equipment

Prior to asking Queenan any questions, I advised Queenan of video
provided to the
City Attorney related to the case and allowed Queenan to view it. I then gave him a brief
summary of how the DI materialized and confirmed he was familiar with the information.
Queenan reviewed his employment which included 4 years as a GPD Patrol Officer, 6 month's
as an ADOT Sworn Officer, and 5 years as a United States Marine where his primary duty was
Law Enforcement.
I asked Queenan what he recalled concerning the CFS to which he stated he was dispatched to a
CFS at Luke AFB for a subject disturbing. While in route, Queenan asked the Dispatcher to
check on the status of the Luke AFB Officers due to the time and distance required to respond
to the base. Queenan stated Dispatch advised the Luke AFB Officers "were not OK and the
subject not in custody" and Queenan responded to the base Code 3.
Queenan said upon arrival he parked his patrol vehicle behind a Honda Civic parked past the
gate on the right side of the road and obtained a statement from Luke AFB Officers. Officers
advised
had been filming Luke AFB Force Protection procedures, was asked to pull to
the side of the road, a Supervisor responded,
refused to provide his identification, was
"extremely non-compliant and combative" by getting out of the vehicle, and got in a verbal
discussion with a Luke AFB Officer nearly to the point of a physical altercation. Queenan
confirmed
was still in the Honda and approached the driver side while Clubb
approached the passenger side.
Queenan noted the windows were rolled up and
was on the phone. Queenan opened the
driver door and "identified myself as Glendale Police and asked him to step out of the vehicle".
Queenan then stated: "

left hand and put it in a wrist lock and "he refused to continue to obey my commands
so I ended up removing my Taser and pointing it threatening it's use which he finally
complied". Queenan then holstered his Taser, removed

Queenan stated he learned from the Luke AFB supervisor, Bruggeman, she was called to the
gate by Montgomery and upon contact with

refused; to provide his name and date of birth and he refused, and GPD was then called to
respond. After speaking with Montgomery and Bruggeman, Queenan stated he then spoke with
.
Queenan stated "I read him his Miranda Warnings verbatim from the Miranda Warning Card I
keep in my front left pocket" and questioned
. During the questioning,
admitted
to recording the base and pulling to the side of the road. When Queenan discussed
identification and Luke AFB Law Enforcement he would not give a clear answer but eventually
acknowledged Luke AFB Officers were Law Enforcement for the base. As a result of
Queenan's investigation, he found Probable Cause for the arrest of
for Failure to
Provide Identification when lawfully detained and secured
in the rear seat of Queenan's
Tahoe Police vehicle.
Once secured, Queenan continued to coordinate with Luke AFB Officers on the search and
seizure of
recording equipment to which Queenan updated Luke AFB on State Law.
Queenan stated while he waited for Luke Command to decide on a Federal investigation,
charges, and evidence search and seizure "for quite an extended period of time", Queenan
checked on
updating him on the delay of waiting for Federal authorities to decide on
their investigation.
Queenan then decided to not wait any longer, secured
vehicle, and transported
to the Glendale City Jail for booking. During booking
stated he would bond
out of jail and made a phone call to coordinate. Post booking, Queenan returned to the Honda
and had the vehicle towed from Luke AFB. Queenan then checked with the jail to discover
had bonded out and Queenan secured his property and keys with the vehicle and mailed
the pink copy of the tow form to
.
I then explained to Queenan I had additional questions of which he may have already answered
but we would go over them again. I asked Queenan if he had an opportunity to review his
Police report and was there anything incorrect or untruthful in the report to which he said the
report was correct.
I asked Queenan why he responded Code 3 on the call to which he stated based on the distance
to the base, Luke AFB Officers stated they were not OK, and
not in custody, Queenan
responded Code 3 to expedite his response. I asked why
was detained to which
Queenan stated
appeared to be trespassing by being on base, parked to the side, and not
being compliant to include not providing Identification. Queenan stated he detained
for
trespassing to make the scene safe based on the information he had. Queenan stated he told
this.
I asked Queenan if he identified himself to which he stated: "yes I did". Queenan also
acknowledged being in uniform and driving a marked Police vehicle. When Queenan contacted
inside his Honda to detain him, I asked Queenan what he saw and heard to which
Queenan stated he approached as discussed and saw
on his cell phone. Queenan stated:
"Opened the driver door and I said Glendale Police and I began to order him out of the vehicle.

then leaned towards the center line of the vehicle". Queenan then attempted to
gain control of

updating him on the criminal investigation and DI to which O'Neil contacted

arranged for a report to be taken.
filed a phone report of False Reporting under GPD
DR 15completed by Officer Robert Schmuck #11194. The email is filed as an exhibit to
this DI.
On Monday May 11, at 1:41 PM, I received an eighth email from
stating the name of
the Sergeant at Luke AFB was listed incorrectly on the report and requested I correct both
reports. I then directed Schmuck to correct both reports to which he did at 3:17 PM. On May
12, I telephoned
advising him the reports were changed. The email and phone call are
filed as an exhibit to this DI.
In addition to the seven previously discussed interviews, the following information was
reviewed for the DI.
GPD / Luke AFB Call For Service March 16, 2015, at 14:06 Hours
The original CFS indicates on March 16, 2015, at 14:06 hours, Reporting Party Bruggeman
requested Officers respond to Luke AFB "Lightning Gate" for a subject filming them while
coming on base and upon the base stopping the subject he became "uncompliant and
belligerent". The subject was also refusing to give his information, was "cussing at the Sgts",
and came in a white Honda Accord. At 14:11 hours, Queenan asks Dispatch to call Luke AFB
back to check their status to which Luke AFB states the subject is not in custody and they are
not Code 4. At 14:19 hours, the back-up, Clubb, advises the subject detained. The event number
is E1500036144. The Incident number is I15034870. The CFS is filed as an exhibit to this DI.
Luke AFB phone call to Dispatch requesting GPD Assistance
The 911 phone call, from a Luke AFB Sergeant, indicates the same information as the
previously discussed CFS. Twice the caller states the subject is very uncompliant and
belligerent. The caller confirms GPD Officers will respond to this call next to which Dispatch
advises GPD Officers are already in route as a "priority". The WAV file is filed as an exhibit to
this DI.
GPD Radio Traffic
The GPD radio traffic from Dispatch indicates a voiced request for two units to respond to
Luke AFB to which Queenan and Clubb answer up and respond. Dispatch advises the same
information as the previously discussed CFS and phone call to Dispatch. Queenan then asks
Dispatch to check on the status of the Luke AFB Officers and the subject to which Dispatch
voices after calling Luke AFB that the Luke Officers are not Code 4 and the subject is not in
custody. Queenan copies the update.

Officer Allan Seidl #16321 then asks Dispatch to place him on the CFS until the scene is Code
4. Of Note: Seidl does not arrive on scene and is not a subject or witness to this DI.
Club then voices he and Queenan have arrived and requests a check of Arizona License Plate
. Dispatch advises the plate is current on a
Honda Accord registered to
n. Clubb copies the traffic and advises "one detained". Seidl then voices he is "10-8"

GPD phone call to check Luke AFB status
As previously discussed, Queenan, while in route to Luke AFB, requests Dispatch call Luke
AFB back to check on their status as well as the subjects. A review of the phone call from
Dispatch confirms the Dispatcher asks Luke AFB if the subject is in custody and if they are
Code 4 to which Luke AFB Police advises they are not. The WAV file is filed as an exhibit to
this DI.
Queenan Officer Log
A review of the Officer Log for Queenan indicates he was dispatched to Luke AFB at 14:07
hours until 16:00 hours for a Suspicious Person / Circumstance CFS closing the call with an
Offense report under Incident I15034870. Queenan's next log entry indicates he is at GPD
Detention from 16:00 to 19:02 hours. The Log is filed as an exhibit to this DI.
Clubb Officer Log
A review of the Officer Log for Clubb indicates he was dispatched to Luke AFB at 14:07 hours
until 15:24 hours for a Suspicious Person / Circumstance CFS closing the call as a back-up
Officer under Incident I15034870. The Log is filed as an exhibit to this DI.
GPD DR 15-34870
A review of DR 15indicates Queenan completed a "cleared arrest" report for
for Obstruction - Refuse True Name, a violation of ARS 13-2412.A, a Class 2 Misdemeanor.
The City of Glendale is V1, Bruggeman is RP1, and Montgomery RP2. The vehicle involved is
White
Honda Accord.
A review of the DR indicates the same CFS information as previously discussed of Luke AFB
Law Enforcement Personnel requesting GPD assistance for
being non-compliant.
Queenan reports having Dispatch check on Luke AFB and Dispatch advising Officers were not
okay and
not in custody. Queenan then responds Code 3.
Queenan arrives observing
Honda parked on Luke AFB past the gate. Queenan
contacts Bruggeman who states Luke AFB personnel are Code 4 and
, seated inside the
Honda, was very aggressive and non-compliant refusing to provide his information or Driver's
License. Bruggeman then states
was detained for violating DOD Policy of recording
his approach to the Base. Bruggeman states Luke Officers were limited to their involvement as
was a civilian and this is why GPD was called to assist.
Queenan advises Bruggeman he can enforce State Statues only and not Federal Statues and as
such when a subject is detained is required to provide his identification. Queenan states he
attempts to detain
by having him exit his Honda and
is non-compliant.

Post DI interview with Clubb, I directed Clubb to complete a supplement report to include his
involvement and the inclusion of the audio recording of Clubb's interaction with
as part
of the criminal investigation. Clubb's supplement was completed on May 9, 2015. A review of
the report indicates the following.
A review of Clubb's supplement to the DR indicates the same CFS information as previously
discussed of Luke AFB requesting GPD assistance for
being non-compliant. Clubb also
responded Code 3.
Upon arrival at Luke AFB, Clubb, the back-up Officer to Queenan, approached the right side of
the vehicle as Queenan approached the left. Clubb reports hearing Queenan identify himself as
Glendale Police and order
out of the vehicle. Clubb reports hearing
say "no"
and observe
pull away from Queenan moving his body and arms towards the center
console of the vehicle. Clubb reports moving to the driver side to assist Queenan briefly
removing his Taser from the holster but re-holsters noting
follow on compliance to
commands.
Once detained, Clubb reports
asked what he was being arrested for and Clubb states
trespassing. Clubb then stands by
seated behind the Honda while Queenan investigates.
Clubb reports
began making comments of lawsuits against the Federal Government and
GPD and for this reason Clubb activates his digital recorder and later saving the audio WAV
file in DIMS.
Clubb reports
requested water and gave permission for Clubb to get water from
Honda Accord trunk as well as shut the vehicle off to save fuel. Clubb also reports
giving water to
. Clubb reports the audio capture of Queenan's questioning of
.
Clubb reports initially retrieving
keys and cell phone from the Honda at
request but does not due to the possibility of the DOD seizing the items as evidence and as such
was left inside the Honda.

Queenan In Car Camera Video
Queenan's GPD Tahoe Police vehicle had an operational In Car Camera system. A review of
the in car camera file associated with this CFS indicates usable video and audio for the CFS.
The video begins at 14:11 hours with Queenan in route to Luke AFB driving Code 3 arriving at
14:18 hours. Queenan parks his vehicle next to a Luke AFB Police Vehicle in a "fan"
configuration and behind
Honda with the Honda in camera view. The Honda is inside
the gate area parked on the right side of the road with two Luke AFB Police Officers / Security
Personnel standing behind their Police vehicle. The word "POLICE" can be seen written on the
side of the Luke AFB Police vehicle.
Queenan is out of camera view for 45 seconds then approaches the driver side door of the
Honda while Clubb approaches the passenger side. As they approach, Clubb voices (as
previously discussed) for Dispatch to perform a check of the Honda's license plate number. At

14:19:06 hours, Queenan opens the driver door and is observed attempting to detain
the driver.
appears to struggle with Queenan when Queenan is observed drawing his
Taser and pointing it at

rear of the Honda to the driver door and assisting Queenan.
Queenan then escorts
out of the Honda while holding his left wrist while Clubb has

Queenan then walks over to the open driver door, reaches into the Honda retrieving an item,
then walks back to his Police vehicle. The only clear audio portion consists of police radio
traffic and car radio audio. Some audio is heard of Queenan discussing with Luke AFB Police
and their leadership that
would not provide Identification to Luke AFB Officers and the
need for a warrant for seized items. Luke AFB Police also explain to Queenan
exiting
his Honda and confronting them.
At 14:24:23, Clubb is observed standing
up, adjusting his handcuffs, and sitting
back down. At 14:31:22 hours, Queenan, Bruggeman, and Washburn return to
and Clubb behind the Honda and have a conversation which cannot be heard on the in car
system.
At 14:33:16 hours, Clubb is observed reaching into the driver door area, opening the trunk,
retrieving a bottle of water from the trunk, and giving
a drink of water. Clubb then
closes the trunk. At 14:35:45 Clubb returns to the Honda and sits in the driver seat. At 14:37:47
hours, Queenan is observed walking out of camera view to where Luke AFB Police are
standing. At 14:40:56 hours, Clubb is observed giving
another drink of water. At 14:44
hours, Queenan returns to
At 14:47 hours, Clubb is observed putting the water bottle
back into the Honda trunk. At 14:48 hours,
is escorted and secured in Queenan's right
back seat of his Tahoe Police vehicle.
At 14:49 hours,
and Queenan discuss the Honda while Queenan explains to

begins at 14:11 hours with Clubb following Queenan in route to Luke AFB driving Code 3
arriving at 14:18 hours. Clubb parks his vehicle behind two Luke AFB Police vehicles and
Queenan's GPD Tahoe vehicle. Queenan's vehicle has the overhead red and blue lights on.
Honda is not in view.
Queenan is observed speaking with a DOD Police Officer and a Military Security Police
Officer. As Clubb walks towards Queenan, Queenan and Clubb then walk out of video in the
direction of the Honda. The only clear audio portion consists of police radio traffic and car
radio audio. Clubb voices (as previously discussed) for Dispatch to perform a check of the
Honda's license plate number. Clubb voices "copy, one detained" at 14:19 hours.
At 14:22 hours, three Military Police are observed behind Queenan's vehicle talking together
and on Cell Phones. At 14:48 hours, Queenan is observed standing near the right rear door of
Queenan's vehicle searching
and placing his property into a clear property bag held by
Clubb.

statements on Air Force Forms from Montgomery, Bruggeman, and Washburn, sample Military

- BASE DEFENSE OPERATIONS CENTER BLOTTER: The Blotter is an official record of
Luke AFB Law Enforcement activity. The Blotter entry for this investigation is titled:
Informational Entry / Provoking Speeches and Gestures. The subject is
driving his
Honda as reported by Montgomery. The synopsis is similar to the previous information
discussed in this DI including:
filming the base, non-compliance, GPD involvement,
and JAG / leadership notification.
- MONTGOMERY OFFICIAL STATEMENT: An Air Force Form 1168, Statement of
Suspect/Witness/Complainant, was handwritten by Montgomery. The front of the form lists
Montgomery's information. The back of the form is a handwritten statement of what occurred.
The statement is similar to the previous information discussed in this DI including:

filming the gate, yelling at Montgomery, and Bruggeman requested to respond.
The statement discusses what occurred when
exited his vehicle after pulling to the side.
Montgomery reports: "At approximately 1353 hrs, Mr
got out of his vehicle and started
walking towards me and looked really upset. I told him to get back in his vehicle and he replied
where is your supervisor. I replied coming across Litchfield Road right now. He kept walking
towards me and I raised my voice and repeated you need to get back in your vehicle now. He
then turned back to his car then stopped twisted and yelled AND FUCK YOU TOO. Then
proceeded to get back into his vehicle. About a min later B-1 arrived on scene and was briefed."

- WASHBURN OFFICIAL STATEMENT: An Air Force Form 1168, Statement of
Suspect/Witness/Complainant, was typed by Washburn. The front of the form lists Washburn's
information. The back of the form is a typed statement of what occurred. The statement is
similar to the previous information discussed in this DI including Washburn witnessing
refusing to provide his Driver License to Bruggeman.

the evidence known at the time that the statutory requirement for that charge of "after being
advised that the person's refusal to answer is unlawful" was met to the extent that it would
sustain a conviction for that charge at trial beyond a reasonable doubt. As we have talked
about, that does not imply that charging the defendant with an offense arising from that statute
based upon probable cause at the time of the incident was in any way improper. To the second
point, our office is presently reviewing the incident and the evidence provided for any
appropriate obstruction, trespass, traffic, and disorderly conduct charges. We anticipate that
additional charges will be filed.

On Thursday March 19, 2015, at 12:13 hours, PSU received via the City of Glendale PSU
Email address an email from
with an attached file. The title of the file was Internal
Affairs Complaint. The attached file was a typed and signed letter from
advising of a
complaint against "one African American Police Officer" (later identified as Queenan) as well
as a typed and partially completed GPD Citizen Complaint Form.
A summary of the complaint includes: Queenan refused to loosen handcuffs. Queenan used
"Excessive Force" by not immediately transporting
to jail.

On March 16, 2015, at 13:31 hours,
was operating a Dash mounted Camera and Cell
Phone Camera from inside his Honda vehicle video and audio recording the Luke AFB
"Lightning Gate" and DOD Police Officer gate century as he entered Luke AFB. DOD Police
Officer Montgomery advised
he could not operate the video devices to which
became verbally confrontational and aggressive.
was directed by the Officer to park his
vehicle on the side of the road and requested Luke AFB Supervisor Bruggeman respond.
During contact with Bruggeman,
was also verbally confrontational, aggressive, and
non-compliant by failing to provide Identification to Bruggeman when asked. Due to
non-compliance and aggression as well as
being a civilian, Bruggeman contacted GPD
requesting Officers respond. GPD Officers Queenan and Clubb were dispatched and responded
Code 3 as Luke AFB Officers stated they were not Code 4.
Upon arrival, Queenan, based on the information provided, attempted to detain

Queenan identified himself and gave commands for
to exit his Honda to which he
physically and verbally refused until Officers used soft empty hand techniques and threatened
Taser. Once detained, Queenan investigated and booked
for failure to provide
Identification to Law Enforcement. Luke AFB declined to pursue Federal charges against
for video recording a military base and decided against obtaining a warrant to seize
recording equipment.

Based on seven interviews and the preponderance of numerous items of evidence to include
documents, video, and audio, Queenan acted within Policy as well as did not complete a False
Police Report. In addition, Daukas' attempt to address
Complaint was within Policy
and Clubb's actions as a back-up Officer was also within Policy. As such, Daukas and Clubb

are witnesses to this DI. Therefore, Allegation 1, knowingly making a false report against
Queenan, is exonerated.
Clubb and Queenan reviewed the DI with no comments. Daukas declined an opportunity to
review the DI.
On June 7 and 8, 2015, PSU and Lankford received via the City of Glendale PSU email address
two emails from
with attached files. The attached file was of a complaint against
Daukas for failing to supervise as well as a Notice of Claim to the City of Glendale requesting
settlement for $50,000. A copy of the emails and attachments was forwarded to the City
Attorney and saved as an exhibit to the DI. As discussed in this DI, Queenan, Clubb, and
Daukas' actions were within Policy. On June 9, 2015,
was telephoned and advised his
information was received by PSU and will be included in the DI.
On 1 July, a letter was mailed to
advising him of the DI findings. The letter was
returned. The letter was scanned and e-mailed to
on 9 July.
On 30 July, Lankford received via City of Glendale an email from

of the complaint against Daukas and the criminal investigation against Luke AFB Officers. Per
