The accused was arrested on
17.7.2009 under Section 8 (1) of
Mizoram
Liquor
Total
Prohibition Act, 1995. Today is
fixed for Bail Hearing
The Counsel for the Petitioner
submitted that the accused is a
first time offender and have no
previous convictions or criminal
case pending against him and he
further stated that he is the sole
bread winner of his family
looking after his old aged
parents, his wife and one minor
child.
He also stated that the accused
was arrested by the Excise
Personnel without any civilian
witness thereby violating the
provisions of Sec- 100 of the
Cr.PC.

As such the Counsel for the


Petitioner pray for the release of
the accused on bail with the
condition that the accused will
be present in court regularly as
and whenever required by the
court.
The Counsel for the Defendant
strongly opposes the release of
the accused on bail at this initial
stage as there is fear of
absconding at the time of trial
during his release on bail.
After hearing both the parties,
the Magistrate issues an order
for the release of the accused on
bail with reliable surety upon
the payment of bail amount of
Rs. 3000/- (Rupees three
thousand) only.
