CONTRUCTION LABOR CONTRACT

KNOW ALL MEN BY THESE PRESENTS:

This Contract is made and executed this 14th day of August
2015 at Puerto Princesa City, Province of Palawan, Philippines by
and between:
TESSIE C. BASAYA, of legal age, married and residing at
____________________________, Puerto Princesa City, hereinafter
referred to as the FIRST PARTY;
- and _________________________, of legal age, married and residing
at ________________, Puerto Princesa City, hereinafter referred to as
the SECOND PARTY;
WITHNESETH:
1.
That for and in consideration of the sum of ONE HUNDRED
TWENTY THOUSAND (P120,000.00) PHILIPPINE CURRENCY
which the FIRST PARTY agrees to pay unto the SECOND PARTY,
the said SECOND PARTY agrees and undertakes to accomplish the
followings construction works:

Fabrication of trusses for covered gym of Barangay

Marufines, Puerto Princesa City;
Continuation of construction of covered gym of
Barangay Marufines;
Additional pouring of beams of Barangay Hall of
Barangay Marufines;
Repair of posts of Barangay Hall of Barangay Marufines.

2.
That the SECOND PARTY agrees that the works comprised in
this contract shall be completed within __________ days and shall
commence on __________________;
3.
This contract may be terminated by either party for any
cause upon 30-day prior written notice by one party to the other;

4.
That the FIRST PARTY shall provide the necessary
construction materials and supplies, tools, equipment and other
facilities in relation to the accomplishment
of the
abovementioned construction works;
5.
That the SECOND PARTY shall provide the labor for the above
construction works and shall select and hire its worker. The
SECOND PARTY alone shall be responsible for the payment of their
wages and other employment benefits in accordance with existing
laws and regulations;
6.
That the SECOND PARTY shall retain the right to control the
manner and the means of performing the work with the FIRST
PARTY, having the control or direction only as to the results to be
accomplished;
7.
That it is understood, for the above reasons, these workers
shall be considered as the employees of the SECOND PARTY;
8.
That the FIRST PARTY shall in no manner be answerable or
accountable for any incident or injury which may occur to any
worker or personnel of the SECOND PARTY during the time and
consequence upon the performance of the work and services
under this CONTRACT, nor for any injury, loss or damage arising
from fault, negligence or carelessness of the SECOND PARTY or
anyone of its workers to any person or persons or to his or their
property;
9. This contract may be terminated by either party for any
cause upon 30-day prior written notice by one party to the other;
10. That a liquidated damages shall be imposed to the SECOND
PARTY in case of breach hereof, which shall be at least equivalent
to ONE TENTH OF ONE PERCENT (1/10 of 1%) of the cost of
uncompleted and unusable portion of the work for every day of
delay.
Once the cumulative amount of liquidated damages
reaches ten percent (10%) of the amount of the contract, the
FIRST PARTY shall rescind the contract without prejudice to other
courses of action or remedies open to her
