I. EXECUTIVE BRIEF
This transition report presents the accomplishments, challenges and
current status of the Department of Agrarian Reform (DAR) Masbate
Provincial Office on the implementation of the Comprehensive Agrarian
Reform Program (CARP) in the province. It also includes the milestones of the
office from President Corazon C. Aquino's term up to the present
administration.
In terms of agrarian reform implementation, the province of Masbate is
perhaps one of the most geographically, politically and socially challenging
places. It is composed of three (3) islands, Ticao, Burias and Masbate main
island,

with

twenty-one

(21)

municipalities

divided

into

three

(3)

congressional districts. Given the province's slow pace of development and


the seemingly unchanging incidence of poverty, Masbate deserves priority
attention for social justice action which is DAR's main objective.
It is good to note that since the implementation of CARP in 1988, DARMasbate has lived-up with the expectations, significantly contributing to the
development of the province and complementing the poverty alleviation
programs

of

the

local

government.

Substantiating

this

significant

contribution is the land acquisition and distribution (LAD) accomplishment


with a total of 67,388.3205 hectares which is already distributed to 40,130
Agrarian Reform Beneficiaries (ARBs) who are holders of Certificate of Land
Ownership Award (CLOA) and Emancipation Patent (EP).
Complementing this are the various support services given by the DAR
to its ARBs, through one of the Major Final Outputs called the Technical
Advisory and Support Services (TASS). Through this task, millions of pesos
had been poured in Masbate by way of the different flagship programs such
as

MagKaSaka

Project,

Bayan-Anihan,

Agrarian

Reform

Community

Connectivity and Economic Support Services (ARCCESS) and foreign assisted

projects designed to develop Agrarian Reform Communities (ARCs) like


ARCDP 2, ARISP III and SPOTS 2.
Among the more emphatic projects under these support services are
the construction of Farm-to-Market Roads (FMRs) which gave farmers better
access to market centers, Communal Irrigation System (CIS) that boosts the
agricultural production of ARBs, modern farm equipment such as Tractors,
Rice Reapers, Combine Harvester, etc. that would shift the ARBs' agricultural
activities

to

mechanized

farming

which

is

time-saving,

convenient,

economical and efficient as compared to the traditional farming system.


So far, DAR has already fulfilled many of its promises to the people.
However, many tasks still remains to be done and must be completed with a
great sense of urgency. Among these tasks are the completion of distribution
of lands to the landless and making sure that lands already distributed are
transformed into agriculturally productive ones. To achieve all of these, the
next administration must continue the policy environment and exuberance
that the present administration had already shown.
II.

MAJOR MILESTONE BY ADMINISTRATION

LAND TENURE SERVICES (LTS)


In the history of CARP implementation in the province of Masbate,
the Ramos administration recorded the biggest LAD accomplishment
with a total of 24,258.9173 hectares composed of 4,265 landholdings
and distributed to 13,055 ARBs. During these years, many lands all over
the country were declared as Government Owned Lands (GOL) or
Kilusang Kabuhayan at Kaunlaran (KKK) areas pursuant to Presidential
Proclamation No. 2282 and immediately subjected to CARP coverage.
The GOL/KKK lands with an area of 12,623.4429 hectares constituted
more than half of the total accomplishment of DAR-Masbate.
It is also notable that during Corazon C. Aquino's term of office DARMasbate also performed well with a total LAD accomplishment of

13,486.6675 hectares which was distributed to 7,618 ARBs. During the


administration's six-year term, 1991 tallied the most accomplishment
with 5,401.6022 hectares. Majority of the total accomplishment were
lands owned by Government Financing Institutions (GFI) and settlement
areas declared through Presidential Proclamation No. 189.
Overall, the DAR-Masbate has already acquired and distributed a
total of 67,388.3205 hectares to 40,130 ARBs who were awarded with
EP/CLOAs.

OTHER LTI ACTIVITIES


Corazon C. Aquino
During Corazon C. Aquino's term lands owned by GFIs which are
suitable for agriculture were transferred to DAR through the issuance of
Executive Order No. 407. The office used the task force system to
expediently accomplished the acquisition and distribution of these lands.

This greatly helped the DAR-Masbate to significantly increase its LAD
accomplishment.
It was also during the time of President Ramos that manualization of
LAD process had been made. New manuals were issued to attain
uniformity of interpretation. Hand in hand with this is the installation of
computers in the province making it easier for the agency to retrieve
records and various information needed.
The LAD track system was also introduced during the Ramos
Regime, this system provides the agency a significant tool in accounting

our land distribution balances. It does not only capture the movement of
Claim folders from all levels but also provides information according to
landowners, size of the property, location and stages of CARP coverage.
It

is

also

during

this

regime

that

the

agency

made

joint

implementing guidelines with LRA, DENR, and LBP to simplify LAD


guidelines and to facilitate coordination relative to the completion of
documents.

Of the five (5) administrations that implemented CARP, the Estrada
leadership

was

the

shortest

in

terms

of

years,

thus,

LAD

accomplishment was fairly low. During this brief regime of two-and-ahalf years, DAR-Masbate was only able to accomplish a total of
4,505.8909 hectares with only 1,155 EP/CLOAs generated and awarded
to 4,080 ARBs.

the

longest

administration term, ten (10) years in office. During the lengthy span of
the Arroyo administration, DAR-Masbate's LAD accomplishment was at
19,132.0075 hectares with 11,740 ARBs awarded with EP/CLOAs. Most of
the accomplishment came from the Voluntary Land Transfer (VLT) and
Compulsory Acquisition (CA) Scheme.

One great leap towards a faster and more efficient delivery of land
tenure improvement is the upgrading of the DARs database system
which ultimately replaces LAD CARPER DB and CLOA-IS along with other
LTI-related data sources. A boon to the DAR processors faced with the
geographical challenges of an island province, LTI OpTool is the new
centralized repository of LTI data where any changes made to the

records therein are reflected to all users (DARCO, DARRO, and DARPO)
instantly, dispensing with the need for consolidation.
With the advent of LTI OpTool, one of the Aquino administration's
innovations, working with LTI data has never been easier. The system
paves the way for collaborations on tasks and the close monitoring of
progress made for each task. This contributes to creating valid,
accurate, and up-to-date data sources, which will consequently improve
work productivity and the over-all efficiency of DAR operations.

AGRARIAN LEGAL SERVICES (ALS)


Corazon C. Aquino
In the regime of President Corazon C. Aquino, when the province
was found lacking in terms of lawyers and adjudicators, as per available
data (1990-1992) from the DAR Masbate Legal Division, a total of 78 ALI
cases have been accomplished, covering 302 hectares of land with at
least 72 ARBs having been provided legal assistance.

Faced with the same challenge of the scarcity in the Departments
legal work force by reason of such disincentivizing salary of DAR
lawyers, President Ramos six-year term accomplished a total of 102
judicial cases, 541 quasi-judicial cases, 281 ALI cases, and 283
mediations.

President Estradas term has brought about accomplishments
totaling to1,301 quasi-judicial cases and 1,076 mediations.
Gloria Macapagal Arroyo
President Arroyo, having been seated in power for so long as ten
years, have accomplished, at certain points, more than the set target. In

the year 2007, mediations have totaled to 325, almost doubling the 175
target for the year. In year 2008, quasi-judicial accomplishments totaled
to 260 with 257 being the years target. Mediation also summed up to
405 which is more than double of 202 target for the same year. In 2009,
457 over 317 target mediations, 13 judicial cases, and 154 quasi-judicial
cases have been accomplished tantamount to 805 ARBs served with
agrarian justice.
All in all, covering 1,994 hectares of land, the Arroyo administration
have accomplished 164 judicial cases, 1,530 quasi-judicial cases, 301
ALI cases, and 3,479 mediations which far exceeds its total year target
of 1,106. Moreover, a total of 1,396 ARBs have been served agrarian
justice within 10 years of the presidents regime.

The year 2013, by far, is the most remarkable in terms of Agrarian
Legal

accomplishments

under

President

Aquinos

administrationwith accomplishments surpassing set targets for that


year. Accomplished quasi-judicial cases soared as high as 229 which is
more than double of the 96 quasi-judicial target. Mediations, with 320
accomplishments, also exceeded the 252 target for the year 2013 by 68.
Also, the year 2014 recorded the highest number of ARBs provided
with legal assistance. 790 ARBs have been given justice in a span of one
(1) year, 372 of whom are from mediations and 327 from quasi-judicial
prosecutions.
As of September 2015, the totality of accomplishments under
President Aquinos regimen is 62 judicial cases, 998 quasi-judicial cases,
501 ALI cases, and 1,444 mediations, covering a total land area of
13,086 hectares and giving agrarian justice to a sum of 2,630 ARBs.

PROGRAM BENEFICIARIES DEVELOPMENT (PBD)

The ARC Development as a concept was the most significant
contribution made by this administration to the Agrarian Reform
Program. The ARC Development was an area-focused concept wherein
development was focused on the Agrarian Reform Community (ARC) as
a nucleus for development.
In Masbate, there were thirty-four (34) agrarian reform-covered
areas which were declared as ARCs.

With the declaration of these

communities, the introduction of foreign-assisted projects (FAPs) were


introduced, thus, the province of Masbate became a recipient of the
ARCDP 2, ARISP III and SPOTS 2.

During the Estrada administration, one of the flagship projects then
was the MagKaSaka Project which aimed at modernizing farming through
the establishment of milling facilities in rice-based ARCs.

agriculture were invited to explore the possibility of putting up modern


facilities in selected ARCs across the country which was envisioned to
become the hub of rural development.
In Masbate, the rice-based TAJAM ARC was considered as the pilot
ARC for this proposed project. Unfortunately, the Estrada administration
was marred by massive protest actions (EDSA 2) which led to his short
lived administration, thus the Magkasaka Project did not see fruition.

During the term of President Arroyo, Bayan-Anihan Program for


Rural Development (BPRD) was introduced. It is DARs banner program
to hasten the implementation of the Comprehensive Agrarian Reform
Program (CARP). The programs main six thrusts are: fast tracking of
Land

Acquisition

and

Distribution;

integrating,

rationalizing

and

institutionalizing the delivery of support services; swift delivery of


agrarian justice; promotion of peace; intensifying and institutionalizing
of social marketing; and modernizing the DAR bureaucracy.
In Masbate many ARCs, i.e. MAMANI ARC in Monreal, Lantangan ARC
in Mandaon, QUENSCUP ARC in Cataingan, etc. benefited from the
Swine/Hog, Carabao and Cattle dispersal under the Bayan-Anihan
Program. Most of the ARBOs used the project as a start-up capital for the
livelihood of their members.
The Bayan-Anihan framework was well embraced in Masbate. The
province conducted programs and trainings that would support the ARBs
to have a sustainable economy. This Arroyo flagship program helped in
the acceleration of Farm-to-Market Roads (FMRs) construction so that
FBs can distribute their products to market centers.

Support Services (ARCCESS) is the Aquino Administration's flagship


program. This is a support service delivery mechanism of the DAR
created to contribute to the overall goal of rural poverty reduction
especially in the agrarian reform areas.

1. Creation of Task Force to accomplish urgent tasks and directives, i.e.,
Provincial Task Force on Problematic Landholdings; Provincial Task
Force to expedite the completion of serving of Notice of Coverage;

a Task Force that resolved a high profile or controversial task such as

ALS
1. Agrarian Adjudication Fund. This provides assistance to an ARB or
a tenant who is criminally charged in the regular court and is already

languishing in jail. Assistance in the payment of the necessary bail


bond can be availed thru the Adjudication Fund.
2. Referral. A process where the case filed in the regular court against
tenants or ARBs is referred by the court motu proprio or through a
motion to the PARPO for determination whether it involves an
agrarian dispute or not. After determination, the PARPO shall issue a
certification on the matter. The process in effect protects ARBs or
tenants from the abuses of the landowners who discriminately filed
cases at the regular court for purposes of harassment.
3. Alternative Dispute Resolution. Adversarial cases filed at the
PARAD are subjected to an Alternative Dispute Resolution to allow the
parties to settle their dispute amicably. This usually results to a
Compromise Agreement where the resolution is not only expeditious
but also automatically becomes final and executory.
4. Trainers Training for ARB Paralegals. Some Legal Officers are
trained

to

become

trainers

for

ARB

Paralegals

to

become

knowledgeable in Agrarian Laws. This is one of the best practices


especially in Agrarian Reform Communities because the paralegals
would help facilitate resolution of disputes among the ARBS within
the community.
5. Legal Case Monitoring System. It is a process where cases filed at
the PARAD are entered into a database. As such, the status of the
case can be monitored at any time. It will consequently facilitate in
the checking of accomplishments thru the database.
6. Pulong-pulong. Is an activity where a Barangay(s) or a group(s) of
ARBs in a certain landholding are gathered together to tackle
concerns relating to CARP implementation, surveys, titling, payment
to the LBP, or conflicting landholdings, to name some. This activity is
aimed at identifying and assessing all issues and other ARB concerns,

classifying them according to their nature and coming up with the


best approach to resolve the problem.
TASS
1. Hiring of roving bookkeepers to assist Agrarian Reform Beneficiaries
Organizations (ARBOs) with their financial transactions and books of
account management.
2. Modeling of farming technologies and/or technology transfer like the
introduction of using a low cost Net House for model farms, Drip
Irrigation System and the System of Rice Intensification (SRI).
3. Conduct of learning expeditions for technical personnel together with
members of ARBOs to observe firsthand the good practices of
successful organizations in other Agrarian Reform Communities
(ARCs) in other provinces.
4. Establishment of Barangay Food Terminals wherein organizations are
given business start-up capital like sacks of rice and other
commodities amounting to a maximum of

P200,000.00. The DAR

requires the organization to provide an equity in the form of building


where the business is to be established.
5. Conduct of Farmers Field School (FFS) wherein ARBs are taught and
trained to adopt modern farming systems and technology.
6. Creation of e-mail addresses and Facebook accounts for ARBOs as
part of the public relations, information and social marketing
campaign of the office.
STO
1. In the entirety of Region V, Masbate was the first province to adopt
the ATM Payroll system. DBM urges the Government Agencies and
Institutions to adopt the ATM Payroll System. The COA Report noted

that the use of ATMs can lower the risk of fund misuse, aside from
promoting greater convenience, transparency, and accountability. The
national government has been actively upgrading our financial
management systems and pushing for the highest degree of
transparency in our practices.
2. Throughout Region V, Masbate is one of the first province to comply
in the Biometric System Policy. Pursuance to Section 1 & 2, Rule XVII
of the Rules Implementing Book V of E.O. No. 292 (The Revised
Administrative Code of 1987) Civil Service Commission directed all
Government Agencies and Institutions to implement Biometric
System in terms of Daily Time In and Out of employees on their
respective offices. Biometric systems rely on specific data about
unique biological traits in order to work effectively.
3. DAR-Masbate implements the "Officer of the Day" system wherein an
employee is assigned at the office building entrance to guide and
entertain visitors'/clients' queries. Every establishment has its own
rules and regulation, protocols and policies, it is much easier for
every individual if there is someone guiding him in the step by step
process. For this reason, DAR Masbate makes sure that there is
always someone to man the Officer of the day desk to help and guide
every clienteles on their concerns.

their own lands to sow and develop makes these two bosses incomparable.
PARO Felix E. Fruto, a graduate of BS Agriculture with MBA, acquired all
the experiences, knowledge and skills while working at DAR for 33 years of
his life made him undeniably competent for the position of OIC-PARPO II.
PARPO Herald R. Tambal, a graduate of BSBA Management and LLB and
with 27 units of MPA, spent his 27 years working at DAR, enabling him to
obtain all the capabilities he has now, made him suitable for the position of
OIC-PARPO I.
Defying all challenges and circumstances made these people veterans.
CARPO Magencio A. Pasion of the Support to Operations Division, a graduate
of BS Agriculture and LLB, and with MPA; CARPO Delia R. Amante (Land
Tenure Improvement), a graduate of AB Math with MPA; and CARPO Floro A.
Espares (Program Beneficiaries Development), a graduate of AB Polsci with
MPA (CAR), are best qualified for being the Chiefs of their respective
Divisions. However, in the Legal Assistant Division, we only have Atty.
Nasayao as a Radiating Division Head. DAR Masbate does not have its own
appointed Legal Division Chief.

Spouses Engr. Oscar F. Teodoro and Engr. Sylvia N. Teodoro are best
qualified to be MARPOs because being licensed engineers, they possess the
knowledge, skills, and background that this position requires in terms of
surveying. It is much easier for them to locate the placement of monuments.
It is also easy for them to visualize the silhouette of the landholdings they
are going to survey for they themselves know how to plot them by just using
the Narrative Technical Descriptions.
MARPOs Eusebio L. Cervantes, Augusto A. Alba and Amadeo C. Cedio,
all graduates of Bachelor of Laws, are also qualified for their positions
because the works of MARPOs are technical which means that they have to
follow the process judiciously to avoid conflicts and injustices on the part of
landowners and ARBs.
ARPTs Rolly F. Gonzaga, a graduate of AB Economics; Mila M. Dela
Rosa, a graduate of BS Agribusiness; and Cyrus S. Camara, a graduate of
Bachelor of Laws, are all qualified for their positions because of the reason
that ARPTs are not only providing technical assistance to the ARBs, but they
are also guiding, helping and educating them on how to improve their quality
of living.
This is the DAR-Masbate workforce. An office capable of efficiently
working together to accomplish all the tasks given to them.

report as ANNEX "C"
VII.

CHALLENGES
In the span of twenty-seven (27) years of CARP implementation in the

Province of Masbate, the DAR provincial office has experienced the following
challenges and hardships:

1. Resistance of Landowners in the acquisition of their private


agricultural lands;
2. Prevalence of peace and order problem;
3. Difficulty in the increasing the LAD accomplishment since
majority of landholdings in the province are already small in
area;
4. The remaining targeted landholdings for distribution are mostly
problematic;
5. Many landholdings above 5 hectares but not exceeding 10
hectares are still in the CARP scope even though the
landowners have two or more children/compulsory heirs who
are actual occupants/tillers of the land;
6. Insufficiency of service vehicles that can be used for field work;
7. Being the only province in Region V that is composed of three
(3) islands, Masbate is geographically challenging in terms of
LTS and PBD work.
VII.

FLASHPOINT CASES

At the start of President Aquino's administration in 2010 one of the


highlight cases resolved by the Supreme Court was the case of A.Z. Arnaiz
Realty Inc., represented by Carmen Z. Arnaiz vs. Office of the President;
Department of Agrarian Reform, et al., G.R. No. 170623.
The case involves a petition by A.Z. Arnaiz Realty, Inc. for the exclusion
from CARP coverage of its property with an aggregate area of 843.3990
hectares, situated at barangays Asid, Malinta and Sinalongan, Masbate City.
The basis for its petition is the contention that their land had been devoted
to cattle-ranching purposes since time immemorial, not tenanted and have
areas more than 18% slopes. Portions of the said property was subsequently
bought by Nuestra Seora Del Carmen, Inc. so some of the transferred titles
are now in its name.

The Supreme Court ruled in favor of DAR ratiocinating that the petitioner
failed to prove that its property is solely devoted to cattle raising, thus, not
pasture land and should be covered by CARP. The court gave weight on the
investigation

and

ocular

inspection

reports

of

DAR

leading

to

the

presumption that the findings of fact of the Regional Director, Secretary of


Agrarian Reform and the Court of Appeals are supported by substantial
evidence.
This case which started in 1995 and decided with finality by the Supreme
Court only in July 9, 2010 is a long and hard fought battle which stalled DARMasbate's acquisition and distribution of the vast Arnaiz estate. At present
date, portions of the said property is already undergoing the documentation
process, however, the landowners still resist, contending that their property
should not be documented because they have a pending application for the
land conversion.
IX.

STAKEHOLDERS' ANALYSIS

A. Agrarian Reform Beneficiaries (ARBs)


The ARBs are positively affected by the Program for it enables them
to have their own land to sow. Aside from landownership benefits, they
are also empowered by DAR

through the delivery of various support

services to help them improve their quality of living.


B. Landowners (LOs)
Most of the Landowners are negatively affected by the program
since DAR has taken a parcel of their land. However, for those landowners
who cannot manage their lands anymore due to squatters or lack of
descendants who are interested to till the land, the program has given
positive effects on them. They are benefited in terms of being
compensated for the land which they may potentially lose in the future.
C. Local Government Units (LGUs)

Collaboration between the DAR and LGUs in generating and


accomplishing projects of agrarian concern is one positive offshoot of the
program. Such partnership is a two-way street; the LGUs are compelled to
support the department in its endeavours for the ARCs; thus, they are
given an opportunity to create projects in their names and that of the DAR
while the latter gains additional workforce for the attainment of its goals
for the furtherance of agrarian reform.
D. Land Bank of the Philippines (LBP)
While acting as the financier for the DARs acquisition of lands,
which in turn are distributed to qualified beneficiaries, the LBP profits from
the program. The ARBs are obliged to pay for their awarded lands to the
LBP for more than what the latter has disbursed for the DARs obtainment
of the landholding. The only repercussion is that some ARBs fail to pay for
their awarded lands, which is of course a bad thing for the LBP.
