(a)FINDINGSANDDECLARATIONSTheCongressfindsanddeclaresthat
(1)AllgovernmentrecordsrelatedtoCivilRightsColdCasesshouldbepreservedfor
historicalandgovernmentalpurposes
(2)allgovernmentrecordsconcerningCivilRightsColdCasesshouldcarrya
presumptionofimmediatedisclosure,andallrecordsshouldbeeventuallydisclosedto
enablethepublictobecomefullyinformedaboutthehistorysurroundingthecases
(3)legislationisnecessarytocreateanenforceable,independent,andaccountable
processforthepublicdisclosureofsuchrecords
(4)legislationisnecessarybecausecongressionalrecordsrelatedtoCivilRightsCold
Caseswouldnototherwisebesubjecttopublicdisclosure
(5)legislationisnecessarybecausetheFreedomofInformationAct,asimplementedby

(b)PURPOSESThepurposesofthisActare
(1)toprovideforthecreationoftheCivilRightsColdCasesCollectiontothepublicat
theNationalArchivesandRecordsAdministrationand
(2)torequiretheexpeditiouspublictransmissiontotheArchivistandpublicdisclosureof
suchrecords.
Section3.Definitions

(1) "Archivist"meansArchivistoftheUnitedStates.
(2) "CivilRightsColdCasemeansanyunsolvedcaserelatedtocriminalcivilrightsstatutes
specifically:

(9)"Originatingbody"meanstheExecutiveagency,governmentcommission,
congressionalcommittee,orothergovernmentalentitythatcreatedarecordorparticular
informationwithinarecord.
(10)"Publicinterest"meansthecompellinginterestinthepromptpublicdisclosureof
civilrightsColdCasesrecordsforhistoricalandgovernmentalpurposesandforthe
purposeoffullyinformingtheAmericanpeopleaboutthehistorysurroundingallCivil
RightsColdCasesintheUnitedStates.
(11)"Record"includesabook,paper,map,photograph,soundorvideorecording,
machinereadablematerial,computerized,digitized,orelectronicinformation,regardless
ofthemediumonwhichitisstored,orotherdocumentarymaterial,regardlessofits
physicalformorcharacteristics.
(12)"ReviewBoard"meanstheCivilRightsColdCasesRecordsReviewBoard
establishedbySection7.
(13)"Thirdagency"meansaGovernmentagencythatoriginatedacivilrightsColdCase
recordthatisinthepossessionofanotheragency.
Section4.CivilRightsColdCaseRecordsCollectionattheNationalArchives
andRecordsAdministration
(a)INGENERAL
(1)Notlaterthan60daysafterthedateofenactmentofthisAct,theNationalArchives
andRecordsAdministrationshallcommenceestablishmentofacollectionofrecordsto
beknownastheColdCaseRecordsCollection.Insodoing,theArchivistshallensurethe
physicalintegrityandoriginalprovenanceofallrecords.TheCollectionshallconsistof
recordcopiesofallGovernmentrecordsrelatingtotheCivilRightsColdCases,which
shallbetransmittedtotheNationalArchivesinaccordancewithsection2107oftitle44,
UnitedStatesCode.TheArchivistshallprepareandpublishasubjectguidebookand
indextothecollection.
(2)TheCollectionshallinclude
(A)allcivilrightsColdCaserecords
(i)thathavebeentransmittedtotheNationalArchivesordisclosedto
thepublicinanunredactedformpriortothedateofenactmentofthisAct
(ii)thatarerequiredtobetransmittedtotheNationalArchivesor
(iii)thedisclosureofwhichispostponedunderthisAct
(B)acentraldirectorycomprisedofidentificationaidscreatedforeachrecordtransmitted
totheArchivistundersection5and
(C)allReviewBoardrecordsasrequiredbythisAct.
(b)DISCLOSUREOFRECORDSAllColdCaserecordstransmittedtotheNationalArchives
fordisclosuretothepublicshallbeincludedintheCollectionandshallbeavailabletothepublic
forinspectionandcopyingattheNationalArchiveswithin30daysaftertheirtransmissiontothe
NationalArchives.
(c)FEESFORCOPYINGTheArchivistshall
(1)useefficientelectronicmeanswhenpossible,

(1)TheCollectionshallbepreserved,protected,archived,andmadeavailabletothe
publicattheNationalArchivesusingappropriationsauthorized,specified,andrestricted
foruseunderthetermsofthisAct.
(2)TheNationalArchives,inconsultationwiththeInformationSecurityOversight
Office,shallensurethesecurityofthepostponedColdCaserecordsintheCollection.
Section5.Review,Identification,TransmissiontotheNationalArchives,andPublic
DisclosureofClassifiedColdCaseRecordsbyGovernmentOffices
(a)INGENERAL
(1)AssoonaspracticableafterthedateofenactmentofthisAct,eachGovernmentoffice
shallidentifyandorganizeitsrecordsofclassifiedColdCasedocumentsandprepare
themfortransmissiontotheArchivistforinclusionintheCollection.
(2)NoColdCaserecordshallbedestroyed,altered,ormutilatedinanyway.
(3)NoColdCaserecordrecordmadeavailableordisclosedtothepublicpriortothedate
ofenactmentofthisActmaybewithheld,redacted,postponedforpublicdisclosure,or
reclassified.
(4)NoColdCaserecordcreatedbyapersonorentityoutsidegovernment(excluding
namesoridentitiesconsistentwiththerequirementsofsection6)shallbewithheld,
redacted,postponedforpublicdisclosure,orreclassified.
(b)CUSTODYOFCLASSIFIEDColdCaseRECORDSPENDINGREVIEWDuringthe
reviewbyGovernmentofficesandpendingreviewactivitybytheReviewBoard,each
GovernmentofficeshallretaincustodyofitsColdCaserecordsforpurposesofpreservation,
security,andefficiency,unless
(1)theReviewBoardrequiresthephysicaltransferofrecordsforpurposesofconducting
anindependentandimpartialreview
(2)transferisnecessaryforanadministrativehearingorotherReviewBoardfunctionor

(c)REVIEW
(1)Notlaterthan300daysaftertheenactmentofthisAct,eachGovernmentofficeshall
review,identifyandorganizeeachColdCaserecordinitscustodyorpossessionfor
disclosuretothepublic,reviewbytheReviewBoard,andtransmissiontotheArchivist.
(2)Incarryingoutparagraph(1),aGovernmentofficeshall
(A)determinewhichofitsrecordsareColdCaserecords
(B)determinewhichofitsColdCaserecordshavebeenofficiallydisclosedormade
publiclyavailableinacompleteandunredactedform
(C)(i)determinewhichofitsColdCaserecords,orparticularinformationcontainedin
sucharecord,wascreatedbyathirdagencyorbyanotherGovernmentofficeand(ii)
transmittoathirdagencyorothergovernmentofficethoserecords,orparticular
informationcontainedinthoserecords,orcompleteandaccuratecopiesthereof
(D)(i)determinewhetheritsColdCaseRecordsorparticularinformationinColdCase

(3)TheDirectorofeacharchivaldepositoryestablishedundersection2112ofTitle44,
UnitedStatesCode,shallhaveasaprioritytheexpeditedreviewforpublicdisclosureof
ColdCaserecordsinthepossessionandcustodyofthedepository,andshallmakesuch
recordsavailabletotheReviewBoardasrequiredbythisAct.
(d)IDENTIFICATIONAIDS
(1)
(A)Notlaterthan45daysafterthedateofenactmentofthisAct,theArchivist,in
consultationwiththeappropriateGovernmentoffices,shallprepareandmakeavailable
toallGovernmentofficesastandardformofidentificationorfindingaidforusewith
eachColdCaserecordsubjecttoreviewunderthisAct.
(B)TheArchivistshallensurethattheidentificationaidprogramisestablishedinsucha
mannerastoresultinthecreationofauniformsystemofelectronicrecordsby
Governmentofficesthatarecompatiblewitheachother.
(2)Uponcompletionofanidentificationaid,aGovernmentofficeshall
(A)attachaprintedcopytotherecorditdescribes
(B)transmittotheReviewBoardaprintedcopyand
(C)attachaprintedcopytoeachColdCaserecorditdescribeswhenitistransmittedto
theArchivist.
(3)ColdCaserecordswhichareinthepossessionoftheNationalArchivesonthedateof
enactmentofthisAct,andwhichhavebeenpubliclyavailableintheirentiretywithout
redaction,shallbemadeavailableintheCollectionwithoutanyadditionalreviewbythe
ReviewBoardoranotherauthorizedofficeunderthisAct,andshallnotberequiredto
havesuchanidentificationaidunlessrequiredbytheArchivist.
(e)TRANSMISSIONTOTHENATIONALARCHIVESEachGovernmentofficeshall
(1)transmittotheArchivist,andmakeavailabletothepublicnolaterthan300daysafter
thedateofenactmentofthisAct,allColdCaserecordsthatcanbepubliclydisclosed,
includingthosethatarepubliclyavailableonthedateofenactmentofthisAct,without
anyredaction,adjustment,orwithholdingunderthestandardsofthisActand
(2)transmittotheArchivistuponapprovalforpostponementbytheReviewBoardor
uponcompletionofotheractionauthorizedbythisAct,allColdCaserecordsthepublic
disclosureofwhichhasbeenpostponed,inwholeorinpart,underthestandardsofthis
Act,tobecomepartoftheprotectedCollection.
(f)CUSTODYOFPOSTPONEDCOLDCASERECORDSAColdCaserecordthepublic
disclosureofwhichhasbeenpostponedshall,pendingtransmissiontotheArchivist,beheldfor
reasonsofsecurityandpreservationbytheoriginatingbodyuntilsuchtimeastheinformation
securityprogramhasbeenestablishedattheNationalArchivesasrequiredinsection4(c)(2).
(g)PERIODICREVIEWOFPOSTPONEDCOLDCASERECORDS(1)Allpostponedor
redactedrecordsshallbereviewedperiodicallybytheoriginatingagencyandtheArchivist
consistentwiththerecommendationsoftheReviewBoardundersection9(c)(3)(B).
(2)(A)AperiodicreviewshalladdressthepublicdisclosureofadditionalColdCase
recordsintheCollectionunderthestandardsofthisAct.
(B)AllpostponedColdCaserecordsdeterminedtorequirecontinuedpostponementshall
requireanunclassifiedwrittendescriptionofthereasonforsuchcontinued
postponement.SuchdescriptionshallbeprovidedtotheArchivistandpublishedinthe
FederalRegisterupondetermination.
(C)TheperiodicreviewofpostponedColdCaserecordsshallservetodowngradeand
declassifysecurityclassifiedinformation.
(D)EachColdCaserecordshallbepubliclydisclosedinfull,andavailableinthe
Collectionnolaterthanthedatethatis25yearsafterthedateofenactmentof
enactmentofthisAct,unlessthePresidentcertifies,asrequiredbythisAct,that
(i)continuedpostponementismadenecessarybyanidentifiableharmtomilitary
defense,intelligenceoperations,orconductofforeignrelationsand
(ii)theidentifiableharmisofsuchgravitythatitoutweighsthepublicinterestin
disclosure.
(h)DIGITIZATIONOFRECORDSExecutivebranchagenciesshall
(1)Makeelectronicrecordsavailabletoreviewboardpursuanttostandardsestablished
bysection552(a)(3)oftitle5,UnitedStatesCode
(2)grantwaiversoffeespursuanttothestandardsestablishedbysection552(a)(4)oftitle
5,UnitedStatesCode.
Section6.GroundsforPostponementofPublicDisclosureofRecords
DisclosureofcivilrightsColdCaserecordsorparticularinformationwithinColdCaserecords
tothepublicmaybepostponedsubjecttothelimitationsofthisActifthereisclearand
convincingevidencethat
(1)thethreattothemilitarydefense,intelligenceoperations,orconductofdomestic
affairsoftheUnitedStatesposedbythepublicdisclosureoftheColdCaserecordisof
suchgravitythatitoutweighsthepublicinterest,andsuchpublicdisclosurewouldreveal
(A)anintelligencesourceormethodwhichiscurrentlyutilized,orreasonablyexpected
tobeutilized,bytheUnitedStatesGovernmentandwhichhasnotbeenofficially
disclosed,thedisclosureofwhichwouldinterferewiththeconductofintelligence
activitiesor
(B)anyothermattercurrentlyrelatingtothemilitarydefense,intelligenceoperationsor
conductofforeignrelationsoftheUnitedStates,thedisclosureofwhichwould
demonstrablyimpairthenationalsecurityoftheUnitedStates
(2)thepublicdisclosureoftheColdCaserecordswouldrevealthenameoridentityofa
livingpersonwhoprovidedconfidentialinformationtotheUnitedStatesandwouldpose
asubstantialriskofharmtothatperson
(3)thepublicdisclosureoftheColdCaseRecordcouldreasonablybeexpectedto
constituteanunwarrantedinvasionofpersonalprivacy,andthatinvasionofprivacyisso
substantialthatitoutweighsthepublicinterest
(4)thepublicdisclosureoftheColdCaseRecordwouldcompromisetheexistenceofan
understandingofconfidentialitycurrentlyrequiringprotectionbetweenagovernment
agentandacooperatingindividualorgroup,andpublicdisclosurewouldbesoharmful
thatitoutweighsthepublicinterestor
(5)thepublicdisclosureoftheColdCaseRecordwouldrevealasecurityorprotective
procedurecurrentlyutilized,orreasonablyexpectedtobeutilized,bytheSecretService
oranotherGovernmentagencyresponsibleforprotectingGovernmentofficials,and
publicdisclosurewouldbesoharmfulthatitoutweighsthepublicinterest.
Section7.EstablishmentandPowersoftheColdCaseRecordsReviewBoard
(a)ESTABLISHMENTThereisestablishedasanindependentagencyaboardtobeknownas
theColdCaseRecordsReviewBoard.
(b)APPOINTMENT(1)ThePresident,byandwiththeadviceandconsentoftheSenate,shall
appoint,withoutregardtopoliticalaffiliation,5citizenstoserveasmembersoftheReview
Boardtoensureandfacilitatethereview,transmissiontotheArchivist,andpublicdisclosureof
governmentrecordsrelatedtotheassassinationofPresidentJohnF.Kennedy.
(2)ThePresidentshallmakenominationstotheReviewBoardnotlaterthan30calendar
daysafterthedateofenactmentofthisAct.
(3)IftheSenatevotesnottoconfirmanominationtotheReviewBoard,thePresident
shallmakeanadditionalnominationnotlaterthan30daysthereafter.
(4)(A)ThePresidentshallmakenominationstotheReviewBoardafterconsidering
personsrecommendedbytheAmericanHistoricalAssociation,theOrganizationof
AmericanHistorians,theSocietyofAmericanArchivists,andtheAmericanBar
Association.
(B)Ifanorganizationdescribedinsubparagraph(A)doesnotrecommendatleast2
nomineesmeetingthequalificationsstatedinparagraph(5)bythedatethatis45days
afterthedateofenactmentofthisAct,thePresidentshallconsiderfornominationthe
personsrecommendedbytheotherorganizationsdescribedinsubparagraph(A).
(C)ThePresidentmayrequestanorganizationdescribedinsubparagraph(A)tosubmit
additionalnominations.
(5)PersonsnominatedtotheReviewBoard
(A)shallbeimpartialprivatecitizens,noneofwhomispresentlyemployedbyany
branchoftheGovernment,andnoneofwhomshallhavehadanypreviousinvolvement
withanyofficialinvestigationorinquiryconductedbyaFederal,State,orlocal
government,relatingtoanyCivilRightsColdCases
(B)shallbedistinguishedpersonsofhighnationalprofessionalreputationintheir
respectivefieldswhoarecapableofexercisingtheindependentandobjectivejudgment
necessarytothefulfillmentoftheirroleinensuringandfacilitatingthereview,
transmissiontothepublic,andpublicdisclosureoffilesrelatedtoColdCasesandwho
possessanappreciationofthevalueofsuchmaterialtothepublic,scholars,and
governmentand
(C)shallincludeatleast1professionalhistorianand1attorney.
(e)SECURITYCLEARANCES(1)AllReviewBoardnomineesshallbegrantedthe
necessarysecurityclearancesinanacceleratedmannersubjecttothestandardproceduresfor
grantingsuchclearances.
(2)Allnomineesshallqualifyforthenecessaryclearancepriortobeingconsideredfor
confirmationbytheCommitteeonGovernmentalAffairsoftheSenate.
(d)CONFIRMATIONHEARINGS(1)TheCommitteeonGovernmentalAffairsoftheSenate
shallholdconfirmationhearingswithin30daysinwhichtheSenateisinsessionafterthe
nominationof3ReviewBoardmembers.
(2)TheCommitteeonGovernmentalAffairsshallvoteonthenominationswithin14
daysinwhichtheSenateisinsessionaftertheconfirmationhearings,andshallreportits
resultstothefullSenateimmediately.
(3)TheSenateshallvoteoneachnomineetoconfirmorrejectwithin14daysinwhich
theSenateisinsessionafterreceivingthereportfromtheCommitteeonGovernmental
Affairs.
(e)VACANCYAvacancyontheReviewBoardshallbefilledinthesamemanneras
specifiedfororiginalappointmentwithin30daysoftheoccurrenceofthevacancy.
(f)CHAIRPERSONTheMembersoftheReviewBoardshallelectoneofitsmembersas
chairpersonatitsinitialmeeting.
(g)REMOVALOFREVIEWBOARDMEMBER(1)NomemberoftheReviewBoardshall
beremovedfromoffice,otherthan
(A)byimpeachmentandconvictionor
(B)bytheactionofthePresidentforinefficiency,neglectofduty,malfeasanceinoffice,
physicaldisability,mentalincapacity,oranyotherconditionthatsubstantiallyimpairs
theperformanceofthemember'sduties.
(2)(A)IfamemberoftheReviewBoardisremovedfromoffice,andthatremovalisby
thePresident,notlaterthan10daysaftertheremovalthePresidentshallsubmittothe
CommitteeonGovernmentOperationsoftheHouseofRepresentativesandthe
CommitteeonGovernmentalAffairsoftheSenateareportspecifyingthefactsfoundand
thegroundsfortheremoval.
(B)ThePresidentshallpublishintheFederalRegisterareportsubmittedunder
paragraph(2)(A),exceptthatthePresidentmay,ifnecessarytoprotecttherightsofa
personnamedinthereportortopreventundueinterferencewithanypending
prosecution,postponeorrefrainfrompublishinganyorallofthereportuntilthe
completionofsuchpendingcasesorpursuanttoprivacyprotectionrequirementsinlaw.
(3)(A)AmemberoftheReviewBoardremovedfromofficemayobtainjudicialreview
oftheremovalinacivilactioncommencedintheUnitedStatesDistrictCourtforthe
DistrictofColumbia.
(B)Themembermaybereinstatedorgrantedotherappropriatereliefbyorderofthe
court.
(h)COMPENSATIONOFMEMBERS(1)AmemberoftheReviewBoardshallbe
compensatedatarateequaltothedailyequivalentoftheannualrateofbasicpayprescribedfor
levelIVoftheExecutiveScheduleundersection5315oftitle5,UnitedStatesCode,foreach
day(includingtraveltime)duringwhichthememberisengagedintheperformanceoftheduties
oftheReviewBoard.
(2)AmemberoftheReviewBoardshallbeallowedreasonabletravelexpenses,
includingperdieminlieuofsubsistence,atratesforemployeesofagenciesunder

membersshallterminatenotlaterthan2yearsafterthedateofenactmentofthisAct,exceptthat
theReviewBoardmay,bymajorityvote,extenditstermforanadditional1yearperiodifithas
notcompleteditsworkwithinthat2yearperiod.
(2)Uponitstermination,theReviewBoardshallsubmitreportstothePresidentandthe
Congress,includingacompleteandaccurateaccountingofexpendituresduringits
existence,andshallcompleteallotherreportingrequirementsunderthisAct.
(3)Uponterminationandwindingup,theReviewBoardshalltransferallofitsrecordsto
theArchivistforinclusionintheCollection,andnorecordoftheReviewBoardshallbe
destroyed.
Section8.ColdCaseRecordsReviewBoardPersonnel
(a)EXECUTIVEDIRECTOR(1)Notlaterthan45daysaftertheinitialmeetingofthe
ReviewBoard,theReviewBoardshallappointonecitizen,withoutregardtopoliticalaffiliation,
tothepositionofExecutiveDirector.
(2)ThepersonappointedasExecutiveDirectorshallbeaprivatecitizenofintegrityand
impartialitywhoisadistinguishedprofessionalandwhoisnotapresentemployeeofany
branchoftheGovernmentandhashadnopreviousinvolvementwithanyofficial
investigationorinquiryrelatingtotheCivilRightsColdCases.
(3)(A)AcandidateforExecutiveDirectorshallbegrantedthenecessarysecurity
clearancesinanacceleratedmannersubjecttothestandardproceduresforgrantingsuch
clearances.
(B)Acandidateshallqualifyforthenecessarysecurityclearancepriortobeing
approvedbytheReviewBoard.
(4)TheExecutiveDirectorshall

(5)TheExecutiveDirectorshallnotberemovedforreasonsotherthanbyamajorityvote
oftheReviewBoardforcauseonthegroundsofinefficiency,neglectofduty,
malfeasanceinoffice,physicaldisability,mentalincapacity,oranyotherconditionthat
substantiallyimpairstheperformanceoftheresponsibilitiesoftheExecutiveDirectoror
thestaffoftheReviewBoard.

purposesofpreservation,security,andefficiency,unless
(1)theReviewBoardrequiresthephysicaltransferofrecordsforreasonsofconducting

(2)InapprovingpostponementofpublicdisclosureofanColdCaseRecord,theReview
Boardshallseekto

summarizesthepostponementsapprovedbytheReviewBoardorinitiatedbythePresident,the

agency,lengthorotherphysicaldescription,andeachgroundforpostponementthatisrelied
upon.
(f)REPORTSBYTHEREVIEWBOARD(1)TheReviewBoardshallreportitsactivitiesto
theleadershipoftheCongress,theCommitteeonGovernmentOperationsoftheHouseof
Representatives,theCommitteeonGovernmentalAffairsoftheSenate,thePresident,the
Archivist,andtheheadofanyGovernmentofficewhoserecordshavebeenthesubjectof
ReviewBoardactivity.
(2)Thefirstreportshallbeissuedonthedatethatis1yearafterthedateofenactmentof
thisAct,andsubsequentreportsevery12monthsthereafteruntilterminationofthe
ReviewBoard.

doctrinethatwouldotherwiseprohibitsuchtransmissionordisclosure,withtheexceptionof

(b)FREEDOMOFINFORMATIONACTNothinginthisActshallbeconstruedtoeliminate
orlimitanyrighttofilerequestswithanyExecutiveagencyorseekjudicialreviewofthe

pertaintotheappointmentandoperationoftheReviewBoardshallceasetobeeffectivewhen
theReviewBoardandthetermsofitsmembershaveterminatedpursuanttosection7(o).
(b)OTHERPROVISIONSTheremainingprovisionsofthisActshallcontinueineffectuntil
suchtimeastheArchivistcertifiestothePresidentandtheCongressthatallCivilRightsCold
CasesrecordshavebeenmadeavailabletothepublicinaccordancewiththisAct.
Section13.AuthorizationofAppropriations
(a)INGENERALThereareauthorizedtobeappropriatedsuchsumsasarenecessarytocarry
outthisAct,toremainavailableuntilexpended.
(b)INTERIMFUNDINGUntilsuchtimeasfundsareappropriatedpursuanttosubsection(a),
thePresidentmayusesuchsumsasareavailablefordiscretionaryusetocarryoutthisAct.
Section14.Severability
IfanyprovisionofthisActortheapplicationthereoftoanypersonorcircumstanceisheld
invalid,theremainderofthisActandtheapplicationofthatprovisiontootherpersonsnot
similarlysituatedortoothercircumstancesshallnotbeaffectedbytheinvalidation.
