The reasons for the Motion are:

5 (1) The California Supreme Court is in default:

(2) The California Supreme Court’s Motion to Dismiss was filed late

8 and without a court order allowing a late filing;

(3) The California Supreme Court’s Motion to Dismiss is frivolous,

without merit and filed to harass and oppress Plaintiff.

12 This Motion is based upon the Notice of Motion, the Memorandum of

Points and Authorities, the Request to Enter Default, the Opposition to the

15 Motion to Dismiss, the Request for Judicial Notice, the pleadings and papers on
16
file in the case and such other documents which the Court may allow at the time

of the hearing.

The California Supreme Court is presently in default. (See Request to Enter

4 Default filed simultaneously herewith and incorporated herein by reference as if

set forth in full.)

7 The California Supreme Court filed its Motion to Dismiss late and in
8
violation of Court Rules as it did not have any order from the Court allowing a
9

late filing. Further, such Motion is frivolous, without merit and filed for the sole
11
purpose of harassing and oppressing Plaintiff. (See Request to Enter Default,
12
Opposition to Motion to Dismiss and Request for Judicial Notice filed herewith
13

14 and incorporated herein by references as if set forth in full.)

For the reasons set forth above and in all of the aforementioned documents,

17 Plaintiff respectfully requests that the Court strike the California Supreme

Court’s Motion to Dismiss.
