MEMORANDUM IN SUPPORT
A.8704-C (Rosenthal)/ S.6340-A (Lanza)

The Independence Party of New York supports A.8704-C/S.6340-A, which relates to prohibiting
advertising for the use of dwelling units in a class A multiple dwelling.
The Independence Party supports this effort to eliminate illegal short-term rentals, by requiring that the
appropriate party is held responsible for his or her actions. Currently, New York City faces an ever
increasing problem of the illegal short-term rental of multi-family residential properties. This ever
growing illegal activity raises many safety issues, adds to building wear and tear costs, and creates
quality of life concerns for residents. The Independence Party is opposed to the proliferation of these
uses, and seeks to ensure that the appropriate party is penalized for illegal short-term rentals. This
legislation addresses our concerns by adding penalties of up to $7500 for peoplewhich could include
either a tenant or an ownerwho advertise illegal rentals. This bill further ensures that the individual
or entity that advertises an illegal unit would be fined, instead of unfairly subjecting a building owner to
penalty, regardless of who is responsible for the illegal activity.
Adopting this legislation would be a positive step in addressing the many concerns the State
Independence Party sees with the illegal practice of short-term rentals of multi-family residential
properties in New York City. Accordingly, the Independence Party of New York State supports A .8704-C
(Rosenthal)/ S .6340-A (Lanza).
