PETITION
COMES NOW petitioner, by the undersigned counsel and unto this Honorable
Court, most respectfully alleges:
1. Petitioner is of legal age, Filipino citizen and a resident of 22 Acacia Street,
Forest Homes, Pasig City;
2. Petitioner and respondent are husband and wife, having been legally married
on March 2, 2000 at Parish of the Five Wounds, in Pasig City, a copy of their
marriage certificate is hereto attached as Annex A;
3. A child was born in wedlock, Michael Oliver S. Dimagiba, aged 5 years old, a
copy of his Certificate of Live Birth is hereto attached as Annex B;
4.

Respondent has been judicially declared an absentee as of July 4, 2004, in

accordance with the Family Code, a copy of the final judgment is hereto
attached as Annex C.

PRAYER
WHEREFORE, premises considered, it is most respectfully prayed that the
dissolution of the conjugal property through judicial separation be granted by the Court
and that ownership of the aforementioned conjugal property be awarded to the
petitioner.
