Artifact #2 Teacher's Rights and Responsibilities

In a heated argument a a white teacher expressed she "hated all black folks." This
was while having a conversation with the prinicipal and assistant principal who were
black that were assigned to the predominately black school. When others found out what
she said it was negatively received amongst her white and black peers. The principal then
moved to have her dismissed due to the concern that would not be able to unbiasly
administer education to a group of people she did not personally like.
The fourteenth amendment of the federal constitution prohibits discrimination by
race, color, creed, religion or nationality. This fourth amendment was created to force
states who openly practiced racism under the newly formed governement of the United
States to reduce or eliminate their practice of racism. The amendment was written to
protect an individual's right to express themselves with out fear of punishment.
In the case of Brown v Board of Education 1964 it was shown that racism
practiced in schools have a devestating and negative impact on how the children of that
racial group view themselves and in turn view how they feel about how smart they are or
how successful they can be. The studies used showed students of each color dolls of
similar colors and then dolls of different colors. Almost all the white children identified
the white doll as being the most desireable. Likewise, black students identified that the
white doll also was the most desireable to them. In addition, black students expressed that
the black doll was not pretty and that if schools are segregating white from black then
there must be something wrong with being black.

stated the "burden shifts to employer to state a legitimate non-discriminatory" reason for
termination or dismissal. The first amendment constitutionally gives us freedom of
speech. In this instance the tenured teacher believes she is able to hold her own opinion
and freely express while teaching a group of people she has expressed discontent. Under
federal a state law or school board cannot create laws that prohibit freedom of speech. If

All individuals including teachers has protected rights as citizens of this country.
However, accepting a job as a teacher and adhering to a moral standard trump these rights
in regards to children's education. As we intrust our children's minds and well being to a
stranger it is important to know that that person hold moral boundaries. It is important
that children understand their value and that there are teachers who are truly willing to
support them in their developmental years.
