1. On Apsi27, 2016, there was filed in my office a petition te submit othe voters the
following change tothe Boulder Home Rule Chater:
Article I, Section +is amended by adding the following
In order to broaden the opportunites for public service and to assure that elected
afficial of governments are responsive tothe citizen of tase governments. no
person shail be eligible to ofice as Council member if he or she has been elected
{o offce as Council member three or more times in his or her ifime. This
limitation on eligibility shall apply 1 any Council member serving aterm of office

2. On May 4,2016, my office issued a comment eter suggesting certain changes pursuant
to Boulder Home Rule Chater section 38B, CRS. 32-2-210 and CRS. 31-11-1-1, et
0q., and appcoving he following summary forthe petition:

3. On May 5, 2016, there was filed in my office revised petition anda statement of intent
signed bythe commie of petitioner to circulate the petition fr vote atthe next
regularly scheduled election on November 8, 2016.
4. On May 6,2016, my office issued a letter conditionally approving the petition for
cizculation with the condition thatthe form of the circulator affidavit be amended to
‘match te language in CRS. 31-11-1063XeXD.
5. On,June 28, 2016 the signed petition to amend the charter was filed with my office. It
contained 111 sections, declared to contain 6,912 signatures. (Petition sections were
‘numbered I-11, 14-19, 21,23, 28, 29-31, 34, 36, 38-43, 45-60, 62-67, 70-73, 75-83, 87-
91, 95, 97-99, 102-119, 133-130, 133-140, 189-151.)
& A petition to submit a charter amendment atthe next regular election must be signed by
at east five percent ofthe registered electors of the municipality registered on the date
the statement of intent was filed with the clerk (May 5, 2016)7. OnMay 5, 2016, the Boulder County Clerk and Recorder determined that there were
92,822 registered voters residing inthe City of Boulder, Colorado. Therefor, the
numberof valid signatures required is 4,642.
8. Within fteen working days of the filing ofthe petition, the city clerk shall certify tothe
governing body as tothe validity and sufficiency of such petition. CRS. 31-3
‘The deadline fr cerifiation is July 20, 2016.
9, After review ofthe petition, I find that 94 petition sections,
signatures, do not met the threshold. See Attachment A (Ii
Forms for 9 petition sections)
10, As aresul, the 5,904 proposed signatures on these 94 petition sections are invalidated
and have not beea reviewed for suiieney. Subtracting this number (5,904) from the
total proposed signatures onal of the sections (6,912) leaves atoal of 1,008 proposed
signatures on the remaining petition sections
11, Because 1,008 signatures do pot meet the 5% required number of 4,642, those signatures
have not been reviewed for slficieney.
12. Thereby certify to the Boulder City Courell, pursuant fo C:R.S 31-2-210(3), thatthe
petition is not sufficient at this time.
