From our consideration,
We are contacting you as Chilean lawyers that are currently
working on the presentation of a "Habeas Corpus" (application for
protection), in favour of 45 minors deprived of liberty in the Israeli prison
of Ofer () , under the guise of "administrative detention." This list
was provided to us by our friend Mr. Nicola Hadwa, a representative in
Chile of the Latinoamerican League for the return of Palestine", who
obtained the list because he realized the urgency of protecting the lives
and safety of these children, under International Humanitarian Law and
the International System for the Promotion and Protection of Human
Rights.
It is important to mention that in December 2015, our Supreme
Court, knowing of an appeal in processing the application for protection
filed by two Chilean citizens, in favor of two political prisoners in prisons
in Venezuela, was declared admissible and accepted in full, accepting
the doctrine of universal jurisdiction of human rights, unprecedented in
the judicial history of Chile, that in our opinion, opens the door to
exercise a similar action in the case of under-age Palestinians imprisoned
by the State of Israel.
Therefore, and in order to have the greatest amount of information
to prepare an adequate defense and preparation of legal actions; we
would like to ask for your cooperation in the areas already described,
with particular attention to the circumstances, times and motivations
surrounding the arrests and prisons in which these minors were
incarcerated, whose names are here to attached.
In addition, we need you to send us an official document of the
ministry containing the list of Palestinian children imprisoned in Israeli
Ofer prison, compiled by the Palestinian Ministry of Prisoners.
Finally, as you can understand, that these legal efforts attempted
by a group of Chilean lawyers, are not only because of the tragic events
that Chile has gone through in recent history with the military
dictatorship, but moreover, is consistent with the aim of asylum and
protection that our country has given to people of Palestinian origin, that
is reflected today in the Palestinian colony located in Chile; the largest
community outside of Palestine.
