Bah, who resided at 113 Morningside Ayenue (26" precinct), In. the months prior, Mr. Bah displayed unusual behavior, acting e:atically and distancing himself from relatives and friends. He had no known psychiatric history prior to this, His mother had become worried about him and came to New York to coax him into getting help, Mr, Bab wes supposed to meet his mother at the airport but he never made itso his mother went to his apartment. He, greeted her and allowed her into the apartment. ‘While there, she saw things that increased her level of concem. He lost weight, his beard was vakempt, and he had stitches over his eye, He told her thet he believed he was someone other than himselt She also observed a urine stain an his bed but he refused to let her clean it, instead saying that he liked to smell it. Approximately an hour afler her arrival, Mf, Bab asked his mother to leave. ‘Ms, Bah was concemed that her son was siok and asked family and ftiends for advice. She wanted to get him to the hospital but didn't know how. The next day, Septeniber 25, she rotumed and, with the help of two friends, unsuccessflly attempted to visit him again. At approximately 1841 hous that day, she told the 9L1 operator thet she needed ass ambulence for ker son because he had “mental problems” and she was worried, he might hunt himself or others, She ssid she could not control him and repeated many ‘times that he had mental problems. At approximately 1843 hours, Police Officers Brian Stanton, tax # 949693, Esmereida Santana, tax # 942819 (26 Adam), Vincent Johnson, tax # 948055 (Li's operator), and Lieutenant Robert Gellitelli, tax # 928343 (platoon commander) received the radio assignment conceming Mr. Bah, which was assigned as a 10-54 EDP with a psychiatric history, The officers met Ms. Bah in front of the building, where che informed the officers that her son was acting irrationally, but had no history of mental illness or violence, The officers went to apartment SD on the 5" floor and knocked on Mr. Beh’s door. Mr. Bah partially opened the door, revealing that he was completely naked and holding a large knife in bis right hand. Mr. Bah yelled out “it's not me, its not me” and “I’m not Mohamed.” Initislly, Officers Stanton and Santana placed their feet in the doorway to prevent Mr, Bah trom closing the door, but when Officer Stanton saw the CONFIDENTIAL DEF 2129 knife he stepped back and alerted Santana, at which time she too stepped back and the door closed. The lieutenant requested emergency serviees personnel and they fook no further action Sergeant Joseph MeCormack, tax # 919583, Detectives Raul Gonzalez, tax # 904057, Christopher Zaberto, tax # 907614, Edwin Mateo, and Police Officers Andrew Kress and Michael Green responded. Upon atrival, they secired the apattaient door so that Mr. Bah could not open it from the inside and punched out the peephole to aitempt to sce inside the apartment: Unfortunately, it was dark and they could not see. ‘They established an entry stack with Officer Kress first, utilizing a ballistié shield and X26 Taser drawn; Detective Mateo, utilizing the Arwen Model 37 munitions non-lethal Iouncher (deploys a 37mm Jess-lethel projectile); Officer Green, ‘cartying: a Y-bar; Detective Zaberto, carrying a fire extinguishes; and Sergeant MéCormack, with an M-26 ‘Taser, The officers made several attempts at establishing a dialogue with Mr. Bah but were largely unsuccessful, Mr Beh was beard moaning or speaking unintelligibly, on several occasions. Officer Kress ted the ‘Taser, which was ineffective. Detective Mateo then fired the Arwen Model 37 twice, but it is not fmown if Mr. Bah wés hit. Mr. Bah then tumed and lunged at Detective Mateo, slashing him in the side, striking his medical pouch. Sergeant McCormack, whd was behind Detective Mates, fired the M26 Taset oVer Detective Maieo’s shoulder, The Teser had ho effect on Mr. Bah but the lead wires niaile contact with Detective Mateo, causing his body-to tock pp aitd fall on his left cide, Mr. Bah, still holding the knife, advanced and began stabbing’at Officer Kress’s lower abdomen, Detective Mateo thei fired 5 times, Officer Kress 3 tines, and Officer Green 2 times. Mr. Bah fell to the ground and emergency service personnel begail treating him. Emergency médical services personnel were staged in the building and also began treating Mz. Bah. The three discharging officers were taken to New York Piesbyterian- Cornell Hospital, where they were treated for tinnitus and other minor injuries. Mr. Bab ‘was pronounced dead at 2016 hours. Mr. Bah was hit 8 times, Seven bullets were lodged CONFIDENTIAL DEF 2130 in his body and one bullet exited the body. One bullet entered his heed and the others hit his arms and chest area. The autopsy also tevealed markings on his body consistent with three Taser darts and rubber pellet wounds. The New York County District Attomey's Office presented the case to @ grand jury. The grand jury received approximately 50 exhibits and heard testimony fom more than 25 witnesses. On November 26, 2013, the grand jury concluded its investigation and voted not to indict the officers. INTERVIEWS: 5, Interviews were conducted with the discharging officers and seven members of the service-witnesses. Additionally, there were six civilian ear-witnesses. Their interviews did not substentially contribute to the investigation and they are therefore not cepeated below, Relevant interviews helped form the narrative herein and are summarized below. MEMBER OF THE SERVICE SUBJECTS Detective Mateo said he was assigned in the “Adam” car with Officer Kress on the date in question, He said thet upon arrival, Ms, Bab informed him thst her son was in the apartment naked, not acting like himself, and in possession of a kuife, He said that he was wearing a ballistic helinet and heavy vest, and that an entry stack was formed in fiont of the apartment door. He was also armed with an Arwen Model 37 less- Lethal Munitions Launcher, Detective Mateo said he heard Mr, Bah inside the epartinent mumbling, and he perecived it to be some kind of prayer. Officer Kress, who was first in the stack and at the door, continuously tried talking to Me. Bab, but Mr. Beh never responded. He recounted that the apartment door’s peephole was removed and a “chem light” was inserted to illuminate the dark apartment. The chem light was not effective, He mews that other members of ESU were also unsuccessful using e pole camera in an attempt io see into the windows, He said that Lieutenant Licitra ordered a partial breach of the door to utilize a pole camera. He said that Lieulensnt Licitra used the pole camera and relayed to the team that Mr, Bah was behind the door with his left and extended and his right hand behind his back, Immediately after thet. statement, he said, Mr. Bah violently pulled the door open, He said he followed Officer Kress into the apartment and saw Mr, Bah raise his hand and begin slashing Officer Kress’s ballistie shield with a large nlf. He said Officer Kress moved to his Jefl and deployed the X-26 Teser with minimal effect. Delective Mateo then. discharged two rounds from the Arwen Model 37 from approximately three feet away. He said the rounds had n0 effect on Mr, Bab, who was then grunting incoherently and lunged at him and slashed the left side of his medical pouch, He said that Sergeant McCormack, who was behind him, then fired the M-26 ‘Taser over his (Detective Mateo’s) lef shoulder, striking Mr. Bah. But the lead wires ‘made contact with him [Detective Mateo] and caused his body to lock up and fall to the ground. He said that while lying on his side slightly outside of the apartment, the door ‘began to close and Officer Kress was still inside so he kicked the door opea, He seid that Mr. Bah advanced toward bim again, swinging the knife and meking contact with Mateo’s left arm, He said he then feared for his life and yelled “shoot, shoot.” He said he was still on his side, drew his firearm, and fired five times at Mr. Bah. Leter, Detective CONFIDENTIAL DEF 2131 Mateo gave his firearm to Lieutenant Licitra while sitting in an ambulance, He then Jeamned hie fired five rounds. Police Officer Kress seid that he was the lead bunker in the entry stack; ‘holding @ ballistic shield in his left Hand and an X-26 Taser in his right hand. He was wearing a ballistic helaiet and heavy vest, He said that he attempted to establish dialogue with Mr. Bah several times tut he received no response. He ‘mentioned the peephole and the unsuccessful pole camera attempt from the floor below. He then mentioned that Officer Green tried to pick the apartment locks but was also unsuccessfal. ‘The door was then breached using the rabbet tool and the pole camera was inserted. ‘When Mr. Bah dpeited the doot, Officer Kress said that he was in the "fetal funnel.” [The fatal finnel, generally, is the doorwéy ares whieiein an officer is siljouetied against bis owt eatry point ftom the perspeitive of persons inside the room, It is a dangerous place. to, be,] Because of that, Officer Kress said. he knew that he'had to ehter the apartmient, COrice aside, Me Bali was to his left and holding a aie Rife in his hand while gto ee incoherently. He said that fie gave otders 10 Mr. Bah to drop the knife but Mr. Bah did not comply, He then. fired the X-26 Teser at Mr. Bah from approximately thee to. four. feet away. He said he was unsure if the darts struck Mr. Bah, but Mi. Bah started niaking slashing tiotions with pepe appearing to try to cut the lead wires from, the Taser. He seid Mp, Bab then charged the ‘a it hinh in an ovethand motion, Officer i Me. Bah’ avvaly. Mi. Police Office Green said he was assigned ‘Truck Two's “Boy” car with Detective Zaberio. He sald that he was behind Detective Mateo in the stack arid was in possession ofa Y bat. He sald he heard Mr, Bah ‘yelling incoheredtly and thet Officer Kress wag tndble (o make contact with Mr, Bab. He said that Lieutenant Licitra directed, hint to pick the door locks buthe was unable. He suid that there Was ho intention to. enter the apartment yet but only to insert a'pole camera, Officer Green utilized the rabbet tool to separate the door fiom its frame enough to insért the camera. After using the rabbet tool he returned to his position in the stack. When Mr, Bah opened the doot, he heard Officer Kress yelling “Drop the Imife” and subsequently heard the élicking noise of a deployed Taser. Deteétive Mateo, who was electrically charged by the’Tasér-and in front of him, fell backward on top of hini, causing hii to also become electricilly charged. He said he fell backward into the hallway and dropped the Y bar. He then saw the apartment door elositig but Detective Mateo got up end re-entered the apartment. He followed Detective Mateo into the apartment and saw Mr. Bah stabbing Officer Kress in tbe lower ‘abdomen atca. Officer Green then drew his weapon and fired twice. He heard other shots as well. He said Detective Zaberto immediately began to render medical aid. He Keoss Said'he used the Detective Malo, wo he Green. Oifice CONFIDENTIAL, DEF 2132 mentioned that when medical aid was being rendered to Mr, Bah, he saw Taser daris in Mr. Bah’s body. He also said that at the time he fired, he feared for the life of Officer Kress, who was then being stabbed in the abdumen by Mt, Bah, MBER OF THE SERVICE WITNESSES Seven members of the service were interviewed as witnesses in this incident: Lieutenants Licitra and Gallitelli, Sergeant McCormack, Detective Zaberto, and Officers Stanton, Sanatana, and Johnson. Their interviews are summarized only to the extent that relevant information contributed to the investigation, Lieutenant Gallitelli said that Ms. Bah told him that ber son was in his apartment, where he lived alone, acting irrationally even though he did not have a psychiatric history. She slso said he was unayned, He said thet one of the officers knocked on the door and Mr. Bah opened it, was completely naked, and incoherent and ‘unintelligible, The lieutenant said that Officer Stanton started @ conversation with Mr, Bah but then suddenly stepped back. Mr. Bah then slammed the door and locked it. ‘Offer Stanton infommed him that Mr. Bah had a Jarge knife in his hand. He said he then tequested ESU and directed BMS to wait on the floor below. He said that as ESU was. suiting up, HNT and TARU arrived. He was not eble to see ESU breach the déor but said he did hear two Taser deployments and seven to ten, gunshots. Lieuienant Licitra said that when he arrived he was briefed by Detective Gonzalez. He said before sriving on, the 5" floor, the door had already been tied to the steir rail and the peephole was already removed. He eid that he and Detective Zaberio ‘went to the 4" floor to raise a pole camera up to the 5° floor windows but they could not see in due to window coverings. He returned to the 5" floor and wes informed that Mr. Bah wes not communicating with them. He said the door was then breached to allow the pole camera in but not to make entry. He said thet HNT was then in the process of gathering information fom Ms. Beh end they previously tried to call Mr, Bah but were unsuccessful, Mr. Bah then opened the door. The entry team went in and he eventually, heard an unidentified officer yelling “He's stabbing me, shoot him.” He said he then ‘heard eight to ten rounds. He then inspected some of the discharging members’ firearms, He said he observed a Taser dart lodged in Mr, Bab’s chest, Sergeant McCormack was assigned as the Truck 2 supervisor, He said they put on their heavy gear and then were briefed by Lieutenant Gallitelli, Much of his statement mirrored the narrative and repeating it is not necessary, Additionally, he said that he directed the patrol units to gain entrance to the apartment below to see the floor plan. He also requested the Hostage Negotiation Team and TARU. He said that in preparation of breaching the door to insert the pole camere, he loosened the rope that was securing the door. He untied it from the stair rail and held it firmly with his hands, He said that after the camera was inserted and they were trying to view it, Mr, Bah violently cepened the door, causing him to lose control of the zope. He mentioned that Officer Kress fired the Taser and Detective Mateo fired the Arwen with no effect. He heard one of the officers say “He’s got a knife, he’s stabbing me, shoot him,” He said he could not see if the EDP was armed but his body movements indicated that he was fighting with the officers. He identified a small target, placed the Taser dot on the upper torso, and pulled the trigger on the M-26 Taser. He said it hed no effect and at that point, the officers fired 6 CONFIDENTIAL, DEF 2133 at Mr. Bab, He said he saw Taser barbs lodged in Mr. Bah’s neck and chest, but the barb in his chest became dislodged. He was unsure which barbs came from which Taser. ° Detective Zaberto, upon arrival, was told by Ms. Bah that her son bad no medical history but was acting irrationally lately. When he got to the 5"* floor, Officer Kress was already attempting fo speak with Mr. Beh and.was holding the bimker up to the peephole to restrict Mr. Bah’s view. After a few minutes, he went to the 4 floor, ‘rough an apartment and onto the fire escape to deploy the pole camera to Me. Bah’s windows, He said hte was unable to’'see anything because shades made it impossible, Suibsequerily, the Gamers was inserted through the doot. He ‘siid Lieutenait Licitt wes maiienvering the pole camera through a crack in the apartment door that was ibade by the rabbet tool, He said that while Lieutenant Licitts moved the camera, he (Detective Zaberto) wes' viewing the thonitor. He said that Mr. Bah moved the cantiera, moaling it impossible to see, anything inside, He said the monitor was given back fo Lieuredaat itr and, he (Det. He said he saw Mr. Bah, naked, itt his vody bladed tows hith, He asked Mr Bah if he had any clothes he could put on and Mr. Bah ne incoherently, “Not mé, you.” Mr. Bah then tried t0 close the door but Officers n and Santana ttied to prevent. the door dosing by’ using thelr bodies, But Officer 5 siid he thea saw a large “butcher's: knife” in Mr. Bah’s hand so he pulled back and pushed his partucr back 16 let the door close, Officer Stanton thei relayed information, shout the knife. Officer Stainton thereafter had limited involvement and did not witness the discharge, Police Offiver Sauitans’s statement was Consistent with Officer Stanton’ She said thet when the apattment door opened, she had-a partial view of Mr, Bah and, coulé see that he was nalced. She said thet when Mr. Bah tried to close the door, slie put her foot into the doorway to prevent it from closing. Sho said that she eard her partner say Imife ard she femoved her foct, allowing the door to close. Police Officer Johnson's sistement was also consiétent, He said that when the door opened, ho could sce Mr, Baby naked behind the half-opened door. He said be beard Mr, Bah toumbling something like “Not me. It wasn’t me.” He said that Officer Stanton had his foot in the door frame and then he siddenly removed his foot and backéd away from the door saying “He has & knife.” He said they ell backed up and Lieutenant Galiteili called for ESU. Soon after that he heard Mir. Bah praying. He was then assigned to secure the apartment undemeath Mr. Bah, CONFIDENTIAL DEF 2134 CIVILIAN SUBJECT Mr, Bah made no statcments prior to his death. ADDITIONAL INFORMATION 6 ‘Other information thet was either relevant or reviewed by the Board to aid the Board’s analysis: © P.G, 216-05 “Mentally If or Emotionally Disturbed Persons” is the department's policy for EDP jobs, On page 3 of 5, in 2 note, the procedure says [emphasis added) (© The highest renking uniformed police supervisor at the scene is in command and will coordinate police operations. If the mentally ill or EDP is contained and is believed to be armed or violent but due fo containment poses no immediate threat of danger to any person, no additional action ‘will be taken without the authorization of the commencing officer or duty © Doting the board, } conferred with Assistant Chief Wein, commanding officer of tho Special Operations Division. The Emergency Service Unit hes mo, separate protocol or procedure far EDP jobs. So the Board determined that, since the duty captain was not yet present, no further action should have been taken with regard to opening the door to insert the pole camera. REVIEW OF MATERIAL INCONSISTENCIES 1 ‘The investigative folder was reviewed and some inconsistencies were noted. According to the final report by the investigations unit, Detective Mateo’s statement indicated that when he fell backwards, Mr. Bah advanced towerd him end he ‘drew his weapon and fired, But Officer Kress indicated that Mr. Bah was attacking him (Officer Kress) when he and the other officers fired. And Officer Groen indicated that Mr. Bah wes stabbing Officer Kress when he fired. None of these inconsistencies would pave changed the outcome or the findings of the Bosrd. ASSESSMENT OF TACTICS AND PROCEDURES 8. Independent and exclusive of the findings and recommendations, the Board assessed the procedural response end tactics of members of the service. Reasonable, although unsuccessful, attempts were made to make contact with Mr. Beh. The shooting of Mr. Bah was justified under the law and police procedure. However, Licutenant Licitra should not have partially opened the door for the purpose of inserting a CONFIDENTIAL, DEF 2135 pole camera. Firs, as Mr. Bah wes isolated and contained, there was no rush to moke poniact with him, Second, according to department guidetines, the duty eaptain should have been conferred with prior to making such a decision. Third, there is conte history With the emergency service unit and emotionally disturbed persons’ response to donk openings. On several. occasions in the past, ‘while ‘attempting fo make partial door breaches to insert cameras, the emotionally disturbed person has charged the door. Once this occurs, ESU personnel heve no choice but to engage, But if the door wes never breached, they would not have found themselves in that situation, LESS-LETAAL OPTIONS Ofive engaged, two offiters fired ‘Tasers and ahother officer fired the Aiwen Less-lethal ‘munitions Jauncher. None, of these had an effedt on ME.
