PLENARY ACTION

Possession unlawful from time of


entry.
Prior possession is INDISPENSABLE.
Decision here is res judicata only as
to possession.
Prescriptive period of one year
period starts from last demand to
vacate.
Possession was lawful at first but
later became illegal, i.e. defendant
withholds possession after
expiration of his right.
Prior physical possession is not

mentioned in RULE 70 RoC, or
when the possession of land is
due to tolerance of the owner.
It is not necessary to wait until
the expiration of 1 year before
commencement of action.
It can also be filed after the
expiration of the 1 year period
