Statement of Objections and Hearing Brief

Contestants respectfully submit this Statement of Objections to the Committees Report and
Recommendations for Resolution dated June 30, 2016. This document is also intended to
serve as a Hearing Brief to assist the Committee in reviewing the relevant facts and law in this
contest. Additionally, this document provides the Committee with facts and relevant governing
rules not presented in the previous pleadings.

Summary of the Contest
The Committee is familiar with the nature of the Contest based on the Contestants
Notice of Contest (NOI) filed June 18, 2016 and the Statement of Position (SOP) filed June
22, 2016 and the Respondents Statement of Position. A number of controversies surround the
pervasive and material balloting irregularities throughout the Colorado Republican State
Convention election process. According to the accounts of the press and many delegates, the
balloting process was chaotic, disorganized, rife with errors, privacy violations, unequal
treatment, and out of compliance with a number of foundational rules, bylaws, state statutes,
and the 16(f) filing. Such an election, by its very nature, cannot produce the fair, accurate, or
verifiable results required for an RNC delegate election. Respondents position that the higher
vote totals credited to them validates their election, is circular logic and must be rejected, given
the material problems in the candidate eligibility and balloting processes that undercut the
credibility and accuracy of the entire election.
The razor-thin results that divided the winning delegates from the alternates had single-
digit margins, making even small errors material, with the likelihood of impacting the results
and the outcome. Some margins are as small as one one-hundredth of one percent (0.01%).
The combination of wide-ranging irregularities made the true will of the convention delegates
indeterminable and unverifiable. The Contestants request that the Committee apply its broad

discretionary authority to craft equitable remedies that recognize that the RNC must not
tolerate or condone material and reckless non-compliance with the convention delegate
election process. To do otherwise undercuts the credibility of all elected convention delegates.
Material errors began when the Colorado Republican Committee (CRC) applied
unequal and favored treatment to some would-be delegates in their candidacy application
efforts. Reckless and non-compliant ballot layout and design chosen by the CRC in knowing
violation of the bylaws created cascading errors and potential manipulation when CRC chose
to eliminate candidates names from the face of the ballot, and did so inconsistently. CRCs
bias and extreme carelessness created material uncorrected errors. Further, at least 6% of the
delegate candidates names were excluded from the candidates listing in the convention
program booklet (ballot supplement). The records show favorable treatment given to at least
five of the Respondents by including them in a small group of seven last-minute additions to
the convention program and website, when at least 38 similarly situated delegate candidates
were excluded from the initial ballot lists distributed to delegates. [Exhibit 1] Improper
favoritism continued when the CRC facilitated and granted electioneering opportunities on the
convention stage not available to other delegates, including the Contestant delegates.
The non-compliant ballots made voting difficult because of their non-standard large and
unwieldy size. These ballots were chosen to accommodate a favored vendors tabulation
software limitations. In fact, the Teller Committee referred to the ballots as monster ballots.
Balloting took place in a chaotic environment, and Chairman Steve House permitted voted
ballots to be cast before the CRC disclosed the complete list of candidates, further
disadvantaging over 6% of the candidates. Many voters cast their ballot before ballot number
corrections and additional candidates were announced. Such procedures greatly
disadvantaged dozens of candidates and those who wished to vote for those candidates. It is
reasonable to conclude that such widespread errors would impact the results and outcomes in
this thin-margin election.
The egregiously flawed processes continued in the ballot counting room as the Teller
Committee rejected and invalidated 82 ballots (2,132 votes) for purported over-votes
without inspecting obvious anomalies in the tabulation results. There were strong indications of
a software or scanning problem, but they were ignored. Additionally, the Teller Committee
counted at least 136 votes for unassigned numbers, further suggesting a ballot scanning

problem that should have been immediately investigated, rather than being concealed from the
convention and not mentioned in the Tellers report. The Chairman failed to announce the vote
total results or invalidated votes as required by the meeting rules, wrongly depriving the
convention body of the knowledge of the thin margins and material quantities of anomalies.
Without this important knowledge and the practical means to object to the Tellers Report,
delegates were misled by the Chairman and Teller Committee to adopt the materially flawed
election results that suited the CRCs purposes of electing the 16-member Cruz slate.
CRC has rejected Contestants multiple attempts to resolve the controversies outside
this contest process, including conducting a vote of its Executive Committee not to investigate
the irregularities that were widely reported and well documented. [Exhibit 2 Aff. Jankowski 12-
15]

Contest Proceedings and Objections

Contestants presented seven major issues of CRCs material non-compliance:

1. Violation of the bylaw requirement to print candidate names on the face of the ballot.
2. Inaccuracy of the tabulation and improper Teller Committee procedures.
3. CRC improperly gave the official Cruz slate favored treatment in their election bids.
4. CRC placed ineligible candidates on the ballot.
5. CRCs certification of the Respondents was made in bad faith and continued a
pattern of willful wrongdoing that was willfully repeated after non-compliant and
sometimes fraudulent Congressional District elections.
6. State delegates were precluded from making effective objections to the flawed
process.
7. The combination of additional subsidiary rules violations contributed to the
unverifiable, unreliable flawed election result.

Contestants seek a remedy decertifying the delegates ranked 9th, 10th, 11th, 12th, and
13th based on reported vote total results, replacing them with Contestant delegates and one
additional eligible delegate.


Respondents Statement of Position

Respondents filed a Statement of Position basing the CRCs non-compliance with the
bylaws balloting requirements on purported impossibility and impracticality because of tight
meeting schedules. The Respondents irresponsibly claim that ballot supplements were a
proper substitute for a compliant ballot and that such supplements were fair to delegates.
Further, the Respondents claim that the ballot tabulations were without material error and deny
that unfair advantage was given to the Respondents who were part of the Cruz slate. The
Respondents inaccurately state that no exceptions were made to permit untimely filing of
delegates Intent to Run forms. Respondents deny that delegates were unable to raise
objections in the convention.

This Statement of Objection and Hearing Brief is the Contestants first opportunity to
answer the Respondents claims. Contestants will present evidence demonstrating that the
Respondents Statement of Position and incorporated sworn testimony of CRCs Executive
Director CRC Executive Director Shana Banberger (Banberger)]was submitted in bad faith
and primarily consists of willful false and misleading statements, meant to deceive the
Committee.

The Committees Report and Recommendations for Resolution

The Committees Report and Recommendations for Resolution was issued June 30,
2016 and reported only three of the Contestants seven major allegations of violation. Those
three areas were limited to 1) exclusion of names from the ballot, 2) the accuracy of the
tabulation of results, and 3) the convention delegates ability to effectively object. This
Statement of Objections reasserts the additional originally alleged material violations and
submits additional facts and violations not included in the original Statement of Position.

The Committee found that the CRC attempted strict compliance with State Convention
rules as practically as possible. The Committee further found that there was insufficient

evidence to establish that CRC operated in bad faith and insufficient evidence that the failure
to comply with the bylaws materially affected the outcome of the election.

The Contestants respectfully submit that the Respondents misled the Committee,
causing it to err its findings. The Contestants will offer evidence in this Statement that the
Committees findings are in error because the CRC has operated, and continues to operate, in
bad faith and has misled this Committee through their gross misrepresentation of facts in the
input into the Statement on Position and by withholding fundamental records from the
Contestants. The Respondents by means of their filing of irresponsibly misleading and false
statements in their Statement of Position attempt to maintain their delegation status through
unethical and wrongful means.

ADDITIONAL STATEMENTS OF LAW AND FACTS

The Procedure for the Contests of Elections at 8.D. provides for the Objections to
include additional facts and/or law to the record. Contestants respectfully wish to reassert all
seven original grounds of the contests as summarized above, including the three issues
addressed by the Committee. In addition, Contestants submit additional facts summarized
below and provided in more detail in Affidavits and Exhibits.
Contestants are dismayed by the Respondents false and irresponsible statements to
this Committee filed in their Statement of Position. Contestants rebuttal of such falsehoods
comprises many of the new facts listed below and presented in context in the argument
section.

A. Additional Facts Not Presented in Prior Pleadings

1. Compliant ballot format and timely printing were practical and available.

The Contestants will demonstrate that the underlying reason for the unnecessary and
improper numbers-only ballots was to favor a new voting system vendor (Dominion) that
lacks the required software capability to tabulate a multi-page contest, although other well-

respected, experienced vendors do have such capabilities. Respondents have falsely claimed
that they had no choice but to print non-compliant ballots excluding the candidates names
because of a short timeframe for ballot printing between county assemblies and the state
convention. Their claim that commercial ballot printers can print 5,000 ballots days earlier if the
ballots contained only numbers and not names is preposterous and illogical on its face. In fact,
in considerable correspondence between Banberger and the balloting vendor (Teller
Committee), the El Paso County Clerks Office (EPCO), during the period December 2015
through March reflects no intention to involve a commercial ballot printer. Commercial ballot
printers appear to have first been discussed on March 16. [Exhibit 3] Until that time, EPCO and
Banberger planned to print the ballots in the EPCO office with EPCOs specialized in-house
Ballot-On-Demand printersan operation that would require only a few hours of printing time.
[Exhibit 4, Exhibit 27] EPCO has at least 30 Ballot-On-Demand printers and more than enough
in-house capacity for printing this small lot of 5,000 ballots. [Exhibit 5]
The Respondents narrative that ballot-printing timeline constraints created the need for
numbers-only ballots is blatantly false and brings the Respondents credibility into question.
Although Respondents claim that March 28 was a hard and fast deadline communicated in
early March by the selected ballot printer, the vendor selected on March 16 began ballot
printing on April 5. A review of the materials reveals that Banberger contracted in December
with EPCO to handle all ballot design, layout, printing, acquisition, distribution, and tabulation
of ballots. CRCs only role was to approve the ballot content and pay for the services.
Banberger appeared to have EPCO handle all printing arrangements, and she did not appear
to deal with ballot printers despite her false claims in her affidavit. EPCO dealt with the printer
and voting system vendors as part of their contracted role.
More importantly, capable and experienced voting system vendors supplied compliant
sample ballots with delegate candidates names, these vendors could have been selected, and
ballots could have been timely printed either on Ballot-On-Demand printers or in a commercial
printing operation. EPCOs favored suppliers (Dominion) software tabulation program was
incapable of tabulating a contest over one page in length, although other competing vendors
could tabulate results across multiple pages. The unwieldly, 22-inch-long ballot without bylaw-
required delegate candidates names was a reckless and wrongful accommodation to meet the

favored vendors software limitations (one-ballot-face-only tabulation). A multi-page standard


size ballot could have been used.
Once Banberger and EPCO chose this improper compromise of ballot integrity to
accommodate an incapable vendor, the integrity of the election was at great risk, with little that
could be done to mitigate the risk.

The additional documented facts below support the reality that compliant ballots were
readily and timely available.

a. Contrary to Respondents claims, compliant ballot layout and printing was readily
and timely available, practical, and affordable and was offered to CRC, but rejected.
[Exhibit 6-7]
b. The 2012 voting system supplier (ES&S) proposed similar ballots for 2016 on March
7, 2016. [Exhibit 8]
c. CRC could have easily met the ballot-format bylaw requirements by merely selecting
an experienced and capable voting systems vendor, then having ballots printed
either by Ballot-On-Demand printers or commercial specialized ballot printers on a
timely basis.
d. CRC rejected compliant ballot-layout proposals and timely printing proposals from
experienced, capable voting system suppliers, in favor of a preferred supplier whose
voting system limited by software constraints, could not tabulate contests with
hundreds of delegate candidates names.
e. Proposals were received as late as March 11 from well-respected voting system
vendors that could lay out and format ballots with required delegate candidates
names and pledges. [Exhibits 6-8] Dominion could not tabulate a contest extending
beyond one page. The competing vendors could have met this need.
f. From the start of the project, the El Paso County Clerks office, responsible for ballot
preparation, planned to print the ballots in-house on its specialized Ballot-On-
Demand printers. Printing the required inventory of ballots could have been
accomplished in a matter of hours, not days, removing the invalid excuse of
purported commercial printing deadlines. [Exhibit 4]

g. Printing deadlines were not considered a potential problem by party officials prior to
the decision to design non-compliant ballots, much less found to be problematic and
justification for non-compliant ballot production, because the ballots were to be
printed in house.
h. The actual commercial ballot printing began April 4, [Exhibit 9-1] well after the
purported, but unsupported purported printer deadline of March 28 claimed by the
Respondents.
i. Banbergers claim that ballot printing vendors could not print the needed 5,000
ballots with names in 11 days turnaround, but one vendor could print the ballots if
only numbers instead of names were required defies common sense. Printing time
differences for additional characters printed, or duplex printing, would be minimal.
j. Evidence demonstrates that ballot design without required names was a mid-March
CRC decision having nothing to do with printing deadlines.
k. As late as March 4, Banberger was stating her preference for a ballot printed with
names, depending on pricing, undercutting her sworn statement that her choice of
printing vendor precluded that. [Exhibit 9]
l. A ballot printing vendor was not selected until March 16. [Exhibit 4]
m. Arapahoe County Clerks office used Ballot-On-Demand printers to print ballots in-
house for the Congressional District 6 Convention.
n. Two-sided (duplex) ballots with candidates names and pledge information were
used at the 2012 convention with over 800 candidates. [Exhibit 10]


2. The CRC could have selected a later convention date.

Respondents have claimed that printing ballots complying with the bylaws was
impossible and should be excused. The purported impossibility sprang from a short time
between county assembly/conventions and the April 9 convention. As demonstrated above,
compliant ballot printing turnaround time was adequate. But even if printing times were
actually a constraint, CRC cannot opt for a convention date that forces non-compliance with
bylaws and then claim impossibility of compliance.


a. The CRC selected the April 9 date, a full week earlier than required by statute.
[Exhibit 11]
b. Both the ballot-format bylaw requirement and the statutory date range of April 2-16
for the convention was known to the CRC on September 25, 2015 when the caucus
date was chosen. [Exhibit 11]

3. CRC had access to county delegate information by March 28 to determine ballot
content by March 29.

Respondents have dishonestly stated to this Committee that candidate information was
unavailable in time to print ballots with names as the bylaws require and to publish
complete lists of national delegate candidates. Respondents brief implies that generally
counties did not conduct their assemblies and transmit delegate information until March
2631. A review of the correspondence between EPCO and Banberger reveals that all
delegate information from county assemblies was available in sufficient time to both
print proper ballots with names and print accurate candidate lists. They merely chose
not to do either. Given the CRCs bias toward the official Cruz slate, the CRC had little
incentive to create fair and timely ballots and lists of other candidates.

a. Respondents misrepresent and understate the candidate information available to
them prior to March 31 for preparation of ballot content for printing. In fact, 61 of 64
counties had elected their state delegates by March 22. Intent to Run forms could be
verified against the 61 counties delegate list by Monday, March 28, after the March
27 deadline for filing Intent to Run forms.

b. The three remaining counties that held conventions on March 26 elected or ratified
159 delegates whose names could have been easily verified against the Intent to
Run form list with two or three hours of clerical time on March 28th or 29th, when all
county information would have been available. Only deletions from the candidate
Intent to Run lists were required upon verification, and no additional candidate

information was required to be added, contrary to Respondents claim. This should


have been a very manageable clerical task.
c. The CRC could have required county delegate submissions of no more than two
days after election, thereby obtaining the last 3 counties information for confirmation
by March 28, giving the CRC 12 days to finalize ballot content and printing.

4. Exclusions of candidates from ballot lists were not caused by county party changes to
delegate lists as Respondents and CRC claim.

Respondents and CRC made willful and egregiously untrue statements to the
Committee to attempt to deflect CRC errors onto the county parties in excluding certain
candidates from the published candidate listings.

a. Respondents allege that candidate names were excluded from the original
published ballot listings because county parties untimely amended their delegate
list. [Respondents SOP p.3; Banberger Aff. 11]
b. Research reveals that the exclusion of names of candidates from Adams,
Boulder, Douglas, and Pueblo Counties was not a result of county party error.
These county delegate reports were timely filed and not amended. The
exclusions of these candidates was a result of CRC error or mal-intent.
c. On March 31, prior to printing, CRC master candidate/delegate lists included all
known information from county uploads on state delegates included all
candidates ultimately assigned ballot numbers, although some were inexplicably
excluded from the published program booklet and only subsequently disclosed to
the convention delegates. The 38 candidates (including Contestant Alexander)
excluded from the website and from the originally published ballot listings were
not excluded because of late-arriving information from the counties, as
Respondents falsely claim.

5. CRC gave favored treatment to at least five Cruz slate Respondents, discriminating
against dozens of other candidates.

It was valuable to candidates to have their name published on the CRC website and the
original, official distributed list in the program booklet. It is a distinct disadvantage and
harm to a candidate to be excluded or to have an inaccurate or missing number. Special
favored treatment was given to Respondents Sharon Bjorkland (590), Kristi Burton-
Brown (591), Scott Anderson (592), Jon Hotaling (593), and Stephen Humphrey (594)
to include them and only two other candidates on a last-minute change to print their
names in the program booklet and website listing, whereas other similarly situated
candidates were excluded without explanation. Special last-minute luck of Cruz slate
candidates being added to the ballot list when dozens of other qualified candidates were
excluded is an unlikely explanation. A review of the email correspondence with the
vendors make it clear that these was special treatment.

a. Although CRC had access to all candidates names and credentials before April
1, at least 38 candidates were excluded from the program booklet printed on
April 2.
b. A last-minute change was made with the printer to add 7 favored candidates
including the five official Cruz slate candidates named above, although these
candidates were placed out of alphabetical order at the bottom of the list. [Exhibit
12]
c. CRC added Respondents Stephen Humphrey and Jon Hotaling to the ballot
listing although their names do not appear on the March 31 candidate list of
Intent to Run forms received, bringing their eligibility into question.
d. CRC added Respondent Kristi-Burton Brown to the original ballot listing although
her name did not appear on the March 31 or subsequent state delegate lists,
bringing her eligibility into question.
e. One of the other two favored candidates (not a Cruz slate delegate) was Ryan
Call, former Chairman of the CRC. Calls name did not appear on the March 31
or subsequent state delegate lists, yet he was added to the original ballot
publication listing, although other eligible candidates were excluded.

f. CRC published the candidate listing including these five Respondents on the
website on April 5, but excluded candidates with numbers from 606 to 636.
Candidates with numbers 606619 were not published until April 8. Candidates
with numbers 620636 were not published on the website at all.
g. Over 6% of the delegates who were assigned a number were subjected to some
type of debilitating error (wrong name, wrong numbers, misspellings, excluded
from list, duplicate numbers, etc.). No one on the official 16-member Cruz slate
was subjected to such errors.

6. Rules governing the meeting were unavailable, preventing the delegates ability to
determine the balloting process or to object.

Respondents falsely claimed that the proposed meeting rules were distributed via email
and on the website. Neither claim is true.

a. Contrary to Respondents claim [p.7] CRC members did not receive emails with a
copy of the meeting rules. [Affidavits at Exhibits 13-18]
b. Contrary to Respondents claim [p.7] the CRC did not post the rules on the website in
an accessible location, if at all.
c. CRC had email addresses for all 600+ candidates and did not send a copy of the rules
to candidates for national delegate.
d. CRC had email addresses for virtually all delegates and alternates, but did not send a
copy of the proposed rules to the delegates.
e. The 2012 proposed Meeting Rules were distributed as part of the 2012 written
program, but 2016 proposed rules were not included in the 2016 program.
f. Some delegates objected to the lack of disclosure of rules, but could not be
recognized by the Chair because of a lack of microphones, except on the stage, which
was inaccessible.
g. The Teller Committee did not operate under separate Teller Committee rules;
therefore, bylaws, meeting rules, and Roberts Rules of Order governed the balloting
process.

7. There were no provisions in Meeting Rules for election observers.

Given the complexity and controversy of the balloting process, Meeting Rules provisions
should have been made to permit advocate election observers on behalf of candidates
campaigns.

a. Election observers representing candidates are typically provided for in rules to
permit challenge of election irregularities.
b. No such oversight arrangements were provided in the 2016 rules, nor are they
provided in the bylaws.

8. Ballot tabulation accuracy is in question

a. Given the small margin of victory [Exhibit 28] several of the Respondent as
delegates or alternates, even tabulation errors of 2 or more votes can become
material and change the outcome of the election.
b. No adjustment of the vote totals was attempted for the candidates who were
assigned more than one ballot number , [Exhibit 19] making their vote totals
inaccurate on their face.
c. The unusual concentration of 63 votes for unassigned numbers 948 and 777
suggest a material problem in scanning or tabulation that could also infect
assigned ballot positions. No answers to inquiries have been forthcoming on the
anomalies, and Respondents and CRC refuse to provide Contestants with a
review of the ballots.
d. Contrary to Respondents claim, ballots must be identified under Rule 8.4 and
counted by county in order to provide additional election security and
transparency. Instead, the 3,897 ballots were commingled, making it more
difficult to investigate the anomalies. This requirement is practical and was
complied with in prior elections to assist in ballot security and accounting
measures.

e. Just prior to the delegate election, the balloting for statewide races, including
National Committeeman, was conducted by using the Dominion Voting system
as well as a compliant ballot. [Exhibit 20] Balloting errors discovered in this
contest should have informed and alerted CRC members and Tellers that
scanning and tabulating anomalies should be immediately and thoroughly
analyzed.
f. National Committeeman write-in candidate Edward Hairfield has stated and
documented that he garnered more votes in the election than reported
Initially the Tellers committee reported no votes for Hairfield, but 3 votes for Ed
Halvey [Exhibit 21] However, upon post-meeting protest, but after the adoption
of the Tellers Report, Hairfield was given credit for 3 votes, as the Teller
Committee chair improperly and unilaterally changed the Teller Report. [Exhibit
22]
g. Hairfield sought a review of the ballots and vote count though communications
with Chairman House, who promised a manual review of the ballots to answer
the question of the apparent inaccurate totals. The review has recently been
postponed as House states that all documents are locked down pending this
contest. Hairfield does not claim that he won the election, but instead is
concerned about the lack of accuracy in vote counting and reporting for the
convention at large.
h. Hairfields miscounted votes and the Tellers and Chairman Houses willingness
to personally and unilaterally change the official election totals [Exhibit 22]
demonstrate the lack of required election controls and oversight.

9. Ballot tabulation anomalies were concealed from candidates and delegates, preventing
their objections.

Without election observers ( 7. above), the anomalies were almost impossible for
candidates to detect, given the Chairmans failure to disclose key information when the
defective Tellers Report was presented.

a. The tabulation anomalies detailed at SOP [p. 7]in Statement of Position, including
the 2,132 ejected over-votes and the 136 anomalous votes for unassigned
numbers, are material factors in the vote tallies and were not reported to the
convention body in seeking their approval of the Teller Report.
b. Numerous subsequent requests to the party and their vendor EPCO, to inspect the
ballots and the anomalies have been denied, despite the fact that the EPCO records
are public records under the Colorado Open Records Act.
c. The convention body was not informed that some candidates had two different ballot
numbers [Exhibit 19] and their vote tallies had not been combined.
d. The convention was not informed that hundreds of flyers had been distributed with
inaccurate numbers through no fault of the candidates. The wrong ballot number
communication could have been caused by sabotage or unintentional error, made
possible because of the lack of names on the ballot.
e. Respondents and Banberger state that manual tabulations were made of over-voted
ballots, although the Tellers report shows no such tabulation or adjustment, and the
CRC has refused to provide any supporting documentation.

10. The Chairman failed to present a valid Teller report

The Teller report was non-compliant and failed to give the convention body fundamental
and accurate information on which to vote or object. The problem was exacerbated by
the lack of accessibility to the Rules making it impossible to object with confidence.

a. In the absence of specific Teller Committee Rules or Meeting Rules, CRC bylaws
require that Roberts Rules of Order Newly Revised (RONR) govern the meetings.
b. The Chairman did not report the quantitative results as required by the Rules and
RONR, but merely announced the delegates and alternates names. [Fore Affidavit
Exhibit 14]
c. The Chairman did not report the number of invalidated votes to the convention,
despite the requirement and the material number (2,132), which should have
generated concern.

d. The single-digit and fractional-percentage small margins between winning and


losing categories of candidates were not disclosed to the voting delegates or the
candidates themselves in time for objection to the Tellers report.
e. The Chairman did not report the unclear ballots that may have affected the close
margin results to present them to the convention as required by RORN for a
determination of how the votes should be recorded, although he and the Teller were
keenly aware of significant errors likely impacting the result. [See Alexander and
Sullivan affidavits in SOP.]
f. Chairman House did not disclose that he was aware of the potential that ineligible
electors (such as those who were not on the county-submitted delegates list. Exhibit
1) cast ballots that could have impacted the outcome and under RONR would have
required re-balloting.
g. Chairman House misled Contestant Alexander on the method of challenging the
Tellers report for inaccurate tabulations, telling her to send him a protest letter,
assuring her that he would make it right, effectively diverting her from a proper
challenge to the results at the convention rather than permitting an objection or
disclosing the error in the Tellers report. (See SOP Kelsey affidavit )

11. Respondents are not operating honestly and in good faith with this Committee.

Many of the Respondents key statements in the Statement on Position, on which
the Committee relied, are completely false and intended to misinform the Committee. A
schedule will be provided at the hearing of the false statements that document this fact,
although the underlying facts and law have been included in this and prior pleadings.

12. Respondents have changed their stories.

Although the Respondents claim to this Committee that there was only one
irregularity, several Respondents and Chairman House have previously made
statements that acknowledge the flawed process of the election at issue and undercut

the credibility of the Respondents Statement of Position. One such example is an email
to Contestant Porter from Respondent Dudley Brown. [Exhibit 23]

13. Material harm to voters and candidates occurred.

Despite Respondents absurd claim that the balloting error was harmless, the facts are
that numerous voters reported voter confusion, hesitation to mark ballot numbers
without names, and votes that they later realized were marked for incorrect numbers,
coupled with improperly credited votes and the inability to object to the irregularities all
caused material harm and made the will of the convention delegates indeterminable.
See affidavits at Exhibits 2, 13-18, and 25 for examples of harm to candidates and
delegates.

14. Edward Barlock is not defending his seat.

Respondent Edward Barlock, alternate delegate, chose not to respond to this Contest,
and the request to decertify his election as an alternate. [See Respondents SOP
footnote 1] Barlock told Marilyn Marks by telephone that he is choosing not to respond
to the contest because the state convention election was too messed up. Contestants
amend their request for relief accordingly at F below.


B. Additional Statements of Law and Rules Not Presented in Prior Pleadings

The following references of relevant governing authority are hereby added to the previous
references of governing laws and rules summarized at Exhibit 24.

1. Colorado Revised Statute (CRS) 1-13-301 provides for criminal punishment for
dishonesty or corruption in election activities occurring at an assembly or convention.
2. In the absence of specific bylaws, laws, or rules to the contrary, Roberts Rules of Order
Newly Revised (RONR) govern the meetings of the CRC. (CRC Bylaws Article XVIII)

3. RONR , 11th Ed., pagers 417-419 provide specific requirements for the content of a
Tellers report.
4. RONR, 11th Ed., page 419 provides for the manner in which questionable ballots should
be decided by the convention.
5. Meeting Rule 7.4 (d) provides that candidates names on the ballot appear in
alphabetical order, grouped by presidential preference.
6. Meeting Rule 7.4 (c) provides that each candidate for National Delegate will be given 10
seconds to address the convention.
7. Colorado Open Records Act CRS 42-72-202(6)(a)(I) defines public records to include
those made by a political subdivision of the state and includes the electronic scans of
the election ballots made by the El Paso County Clerks Office.
8. Ballot format requirements under Colorado election law (CRS 1-5-407) requires names
on ballots and limits the number of unassigned target areas. [This law is not controlling,
but provides basic ballot-format guidance.]

ARGUMENT

The entire narrative painted by the Respondents is false and fabricated to attempt to
excuse the biased, reckless, unfair, and improper conduct of the election. The degree to which
Respondents dishonest assertions and claims permeates their brief is shocking, particularly
given that documentary evidence is available to disprove the vast majority of Respondents
assertions and claims in the brief. The election irregularities were so pervasive and material in
nature that Respondents now appear to be willing to make any outrageous and provably false
claim to attempt to hopelessly confuse the contest facts. Sanctions and penalties against the
Respondents and counsel are appropriate for their disrespectful and dishonest conduct in
attempting to deceive the Committee.

A. The Will of the Convention Cannot be Reasonably Determined.

When an election is conducted in a manner that is materially out of compliance with
governing rules, the election results cannot be judged to be fair or reflect the will of the voters,

particularly when there is perceived bias, improperly tested technology, obstructed


transparency, negligence, unequal treatment, and widespread voter confusion. The election at
issue was such an election. While the Respondents argue that they were credited with the
most votes and nothing else matters, their large purported vote totals are to a great extent the
result of a combination of wrongful actions. The RNC must not permit such an election to
stand. To do so would send the message that none of the requirements submitted in the 16(f)
process need to be taken seriously. Permitting this election to stand without sanctions against
the Respondents would shock those who honor the system as having meaning and integrity.
The nation knows that the Colorado delegation in particular is split into factions on its
presidential preference. The thin margins of victory between categories of individual
Respondents must be recognized as subject to material error in the outcome because of even
minor mistakes or modest undue influence. It indeed makes a difference which individuals,
whether or not they were official Cruz slate delegates, are seated. In this case, the level of
irregularity and error is impossible to compute but quite material to the outcome.
If this election had been a public election, there is little doubt that such improper
conduct would have resulted in an invalid election, because the true will of the voters cannot
be determined. CRC does not have that luxury, and the considerable discretion available to
this Committee should be used to wisely balance the competing interests and avoid condoning
such irresponsible elections of national delegates.

B. The Excuse of the Tight Timeline Is Invalid.

As pointed out in A. 1. and A. 2., the narrative of a timeframe too tight to honor the
bylaws is fabricated by the Respondents and shamefully false. The evidence in the record at
every turn, whether in designing ballot format, uploading ballot content, printing or testing
ballots, or selecting the date of the convention was under CRC control with generous time
cushions built in. The CRC cannot circumvent bylaws by simply opting for meeting dates with
tight timelines and then declaring itself incapable of meeting the fundamental requirements of
the function. Selecting a vendor that cannot meet the fundamental requirements of ballot
layout and tabulation, then claiming impossibility of compliance, is disingenuous and should
not be tolerated by the Committee.

C. Respondents submitted a wholly false and intentionally misleading brief.

It indeed shocks conscience to read the Respondents brief and see the outright
falsehoods, gross misrepresentations, fabrications, half-truths, and deflections. Contestants
are at a loss as to how to adequately refute the scores of mistruths in the document in a
practical manner. Therefore Contestants have undertaken the unusual step of providing a
paragraph by paragraph rebuttal, not only to set straight the facts, but to enlighten the
Committee as to the level of unethical behavior the Respondents are engaged in. The Exhibit
containing the paragraph by paragraph rebuttal will be provided at the hearing, although the
underlying facts and law in dispute are covered in this and previous pleadings.

D. Respondents have improperly taken advantage of the favored treatment.

The Respondents may not now innocently throw up their hands claiming that they
merely campaigned more vigorously and were associated with the most popular presidential
slate. The truth is that they clearly had inside CRC influence and were given special privileges
of last-minute publication and being added to the candidate list without first passing the
eligibility test of being a verified and eligible state delegate, as other candidates were required
to do. None of the 16-member Cruz slate was subject to a misprint, a misspelling, a wrong
number, or a list exclusion.
It appears that Cruz-slate Respondents Humphrey, Hotaling, and Brown were not
required to meet the same delegate verification as other candidates.
Cruz-slate leaders were aware of Letter of Intent problems [Exhibit 23] and chose not to
use their influence to insist on a fair election, but to take advantage of the CRCs willingness to
conduct an irresponsible election.

E. CRC continues their favored treatment of Cruz slate and Respondents.

Respondents describe the role of the CRC as the neutral facilitator and arbiter of the
elections process. Indeed that is how it should be. But the CRC acted in any manner but

neutral. The favoritism continues now as the CRC is supplying legal counsel for this contest to
the Respondents at CRCs expense. CRC is defending the seats of the delegates gained in an
unfair and unverifiable manner.
The CRC refuses to provide even the most basic source documents such as
Credentials reports or Tellers reports to Respondent candidates after repeated requests
[Exhibit 26] Yet all relevant documents are available to the Respondents because of the
favored arrangement between the Respondents and the CRC.

F. Remedy Sought is Rational and Fair.

The Committee has misunderstood the relief sought in the Statement of Position, at IV
which explains that Contestants seek to have five delegate seats vacatedspecifically the 9th
through 13th delegate seats ranked by purported vote totals. Contestant delegates Porter,
Fore, Alexander, and Gamache should assume 4 of these seats with a 5th to be selected from
another slate by the Contestants.
Contestants wish to amend their proposed relief to address the failure of Respondent
Edward Barlock to respond or defend his seat. He has effectively defaulted on his ability to
claim rights to the seat. [See A 15 above] Barlock should be decertified as an Alternate
Delegate and replaced with a 6th eligible candidate to be selected from another slate by
Contestants.
The Respondents illogically argue that the vote totals are accurate, therefore the
Contestants do not have enough votes to exceed Respondents winning vote totals in order
to be seated. The fundamental nature of this contest is Contestants understanding that the
vote totals are materially inaccurate and unduly influenced by favoritism shown the official Cruz
slate. Problematic vote totals in question cannot be the baseline for determination of the
remedy to the very problem they represent.
The Committee has broad discretion in a case like this where the chaotic, non-compliant
convention election result is indeterminable. Quoting from the 2012 Maine contest case
decision by this Committee, the Committee has broad authority to fashion an equitable
remedy, especially in an instance like this where the non-compliance with the applicable
procedural rules was so widespread and fundamental in the election

Contestants respectfully repeat the remedy sought as described above and in SOP
[p.18] and further request that the Committee apply appropriate sanctions and penalties
against Ms. Banberger, the CRC, and the Respondents for their demonstrable attempts to
deceive this committee and to conduct and participate in these election irregularities and
unethical conduct. Additionally, the Contestants request an adverse inference with respect to
all assertions and negative implications that the denied documents could contain.

CONCLUSION
The Contestants respectfully request that the Committee grant the relief requested to
restore accountability and confidence in the process of the election and seating of RNC
delegates.

Hello Chuck,
I have copied Bill Murphy, our Director of Sales on this
email. Going forward, it will be his role to structure a
mutually acceptable relationship for Clear Ballot to run
the balloting on the upcoming Republican State
Assembly meeting on April 9th that you are hosting.
As promised, I'm attaching a sample 21" ballot PDF with
900 real names on it and their candidate affiliations.
We can tabulate this ballot at a sustained rate of 1
ballot / 2 seconds. That means that if all the ballots
were tabulated together it would take a little over an
hour on 2 scanners.
4,000 ballots x 2 seconds = 8,000 seconds / 3600 = 2.2 hrs on 1 scanner or 1.1 hrs on 2 scanners.

We can accommodate more names; each additional


inch of ballot length will allow 48 more names to fit.
Given that the ballots would be coming in over several
hours, I'd guess that the results would be available 1015 minutes after the last ballot was scanned.
Note at the top of the second side there are a couple
of very long names. Take a look and how they are

I just spoke with Marie. She said they have started printed the ballots for the assemblies and
they will continue to print through the evening and will have everything done in the morning.
Marie said she could probably bring by the ballots to you tonight. If so, can Chuck and a few of
our staff come up tomorrow morning around 9:00 a.m.?
We are conducting an election for Green Mountain Falls and they need to get back to the office
by earlier afternoon. It will work out best if the testing can be done in the morning.

The timeline for Colorado's caucus-assembly-convention process:


September 25, 2015

Colorado State Central Committee voted to approve March 1, 2016


caucus date (Colorado Revised Statute CRS 1-3-102[III]: In a year
in which a presidential election will be held, a political party may,
by decision of its state central committee, hold its precinct
caucuses on the first Tuesday in February. The committee shall
notify the secretary of state and the clerk and recorder of each
county in the state of the decision within five days after the
decision.) The timeline was known to CRC months in advance.

March 2-26

Range of dates for county assemblies/conventions to be conducted


(CRS 1-4-602: within 25 days of caucus).

April 2-16

Range of dates for state assembly/convention to be conducted


(CRS 1-4-601: no later than 73 days before primary election
primary election date June 28, 2016).
State convention could have been held April 16 to allow more
time between county and state assembly/conventions.

March 27

13 days prior to convention, National Delegate Notice of Intent


forms due (CRC Bylaws, Art. XIII, Section A[5][a]).

not receive a copy of the Standing Rules in my delegate materials. The Rules were not

printed in the official program. I did not receive the Standing Rules via email.

Two ballots, a ballot supplement booklet, and blue ballot supplement sheet were not collated.
It caused significant difficulty in distributing ballots to the delegates in my district and caused

voter confusion.

5.

I cast (or completely marked) my ballot before I realized there were more national delegates

candidates who were not included in the program and two ballot supplements, and had not
been announced yet.

6.

Two screens shots displaying additional national delegate names and numbers were briefly
shown and could not be seen clearlyfrom my assigned seating on the second levelof the arena.

There were no microphones, on either first or second level of the arena. Two microphones

were on the secured stage.

8. The outcome of the national delegate election was announced

by name only

no vote totals.

lnvalidated votes were not reported and there was no practical means of objecting or
amending the report.

9. There was no provision

for election observers on my behalf as a candidate in the teller

operations. I needed an observer to object to irregularities in the teller process, including


investigating over votes and marks to unassigned numbers.

Undoubtedly there were many things done wrong last weekend. The intent to run forms, and
numbering the ballots, were a wreck. I led to run from State, but was somehow added to run
from the 4th CD. A number of people (three on RMGOs state slate) had ballot numbers above
600 and werent even listed in the ocial program (though two of them sMll made delegate).
There were Trump supporters in the same boat (i.e. I can only aRribute this to incompetence).

And though my choice for U.S. Senate was surprisingly bumped by the fantasMc speech of one of
his opponents, I wouldnt claim foul play.

RMGOs slate was chosen very carefully, and we based much of that on known quanMMes. We
dont like taking chances on personal whims (i.e. do we like someone personally but have not
seen how they will handle pressure).

In my view, poliMcs is a team sport. So, my advice is to get to know those who work hard at
winning these slates, LONG before it happens (everyone is my friend when they want on our
slate).

If you wish to spend your Mme to get all GOP commiRees, assemblies, etc, to follow all the rules,
by the book, go ahead. Thats a complete and uRer waste of Mme, in my view, but its your Mme
to spend.

And I doubt it would have changed the outcome by even one delegate.

A heads up on what prompted me to contact you.... I am running for national
delegate. I'm a "rules" kind of person and have been witnessing what appears to
be a flagrant disregard of bylaws and overall poor organization of our
congressional and state assemblies and conventions.
For example, I am a member of the Colorado Republican Committee State
Central Committee. We have a meeting this Friday to cover credentials issues for
the state convention. No notice was ever sent. After I brought this up on
Facebook, we received an amended notice. However the amended notice is also

Chris,

In the interest of making the Objection brief and hearing presentation accurate and
factual and free of unnecessary controversy, I am requesting needed documents on
behalf of the Contestants. Please provide the following documents related to the State
Convention national delegate election by close of business Wednesday:

1. The official Tellers report with vote totals by candidate. The report should include
any manual adjustments made for corrections or manually reviewed ballots.
2. The credentials report for the meeting, including the names and counties of all
credentialed delegates.
3. Minutes of the Convention.
4. Appointment of the Teller Committee, including names of members.
5. Adopted or proposed rules for the Teller Committee.
6. The official list of ballot numbers assigned by candidate name.
7. Electronic copies of the ballot images (a feature of the Dominion system), or
alternatively permit Contestants to inspect the paper ballots, including the over-
voted ballots.
8. A copy of the video record of the convention proceedings broadcast over
YouTube.
9. The document which was read to the body announcing the results of the national
delegate election.
10. Copies of final delegate reports sent to the State Party from counties. The reports
should document the delegates and alternates elected from their respective
counties.
11. Copies of Intent to Run forms of all Respondents. Provide documentation of the
date the form was received in CRC office.
12. Provide vendor agreements between the state party and its balloting vendors
including the ballot printer, Dominion (voting system vendor), and the El Paso
County Clerks office. (You may redact dollar amounts from the agreements. Our
interest is scope of responsibilities, not the financial terms.)
13. Documentation of Respondents claim that potential ballot printers contacted
communicated printing deadlines of March 28 or prior.
14. The list of ineligible candidates removed from the candidate list after the official
reports were received from the counties.

As you know, these are basic records that are at the heart of the controversy. Records
such as the Credentials Report, and Teller Report should be readily available to any

delegate, although Chairman House has denied access to credentialed delegates. A fair
review of the facts requires a review of these documents. We can certainly make the
process more efficient and reduce unnecessary controversy by eliminating areas of
disagreement in advance of filing the Objection statement.

We have discussed this internally and we believe we can make this happen as we believe we can get
up to 870 candidates on to one 19 ballot and have it still legible. We can fit a lot more on to the
ballot itself, but we want to make sure that it is still legible for the voter. We have some more room
to play around with in the instruction header box at the top of the ballot, but we think overall that
we can get pretty close to 900. As we discussed, these would be paper ballots and we would run
them through our DS850 High Speed Central Count Scanner and read the results directly off of the
machine. For the next steps, Id like to have our team mock up a ballot with roughly 870 candidates
for you to look over, so that you can see the ballot for yourself. That will most likely be on Monday,
will that work for you?
Also, what is the # of vote fors for this contest? In other words, how many candidates can a voter
select for this race?
