1935.

Short title and


commencement.

1. These rules may be cited as the Registry Rules, 1936, and


shall come into operation on the third day of September, 1936.

"Kegistry".

2. The office of each of the following Courts, namely, the


Supreme Court, the Court of Criminal Assize, the Special Tribunal
established under Article 55 of the Palestine Order-in-Council,
1922, the District Courts, the Land Courts and the Magistrates'
Courts shall henceforth be referred to as "The Registry".

The officers in charge of the respective registries shall be :


(a) Tn the Supreme Court, the Court of Criminal Assize and
the Special Tribunal : the Chief Registrar;
(b) Tn the District Courts and Land Courts : the Registrar of
the District Court;
(c) Tn the Magistrates' Courts : the Chief Magistrate or
Senior Magistrate where there is more than one; and the
Magistrate where there is only one Magistrate.

4. The officers responsible for the proper maintenance of the


registers and records of the Courts.shall be the officers in charge
of the respective registries, or in the case of records of Chief
Magistrates' Courts, a Palestinian Magistrate to be nominated by
the Chief Magistrate.

There shall be kept in each Registry, for original civil and

Case Register" and "The Land Case Register" which shall contain in column form the following particulars :

k. Remarks : e.g. Date of appeal and where judgment is


varied on appeal, a precis of the Appeal Court judgment in red ink. Particulars of opposition and of
retrial (if any). Opposition including third party opposition should become part of the original file and be
assigned the same case number.
6. On the filing of a civil or land action, the filing clerk shall
forthwith mark on the top right hand side of the page or first
page of the statement of claim, petition or other document, and
thereafter on all documents filed in the Registry, the hour and the
date of filing and shall initial such endorsement.

The filing clerk, after satisfying himself that Court fees have
been paid, shall thereafter enter in the case register the details
necessary to complete columns (a), (b), (c), (d), (f) and (g), and
shall assign the case number to the statement of claim, petition or
other document so filed.

shall be similar!v treated.
7. A l l civil and land case files will commence by filing the
statement of claim, petition or other document instituting the action, at the back of the case file and subsequent documents will be
filed in proper chronological order of date of filing towards the front
of the file. Judges' and Registrars' notes and any notes of
evidence recorded by the record clerk together with notes of the
evidence shall be written on loose sheets and shall be filed from
the front of the case file towards the pleadings and other documents mentioned in the first paragraph of this section. Documents
on the file will be given serial numbers from the back and serial
letters from the front.

The columns of the criminal case register shall embody the following particulars :

b. Felony, misdemeanour or contravention (in separate columns) and whether summary case or not
c. Prosecutor (e.g. Attorney-General or private individual)
d. Name of accused
e. Date of issue of summons or warrant or date when information filed where case is committed from another Court
f. Section of law under which accused is charged
g. Particulars of offence charged
h. Date of hearing, or in a committed case, date of committal
for trial
i. Judgment and sentence or whether committed for trial, and
date thereof

The Probate

11. Tn all Courts having jurisdiction to issue grants of probate


letters of administration or to make declarations of succession
there shall be maintained a register to be known as "The Probate
Register" in which shall be entered in column form the following
particulars :
a. Serial number
b. Date of filing petition
c. Name of petitioner
d. Name of deceased
e. Whether petition is for probate, letters of administration
or declarations of succession
f. Order of Court and date thereof

12. There shall be maintained in each Registry registers of


judgments for civil and (in the District Courts) for civil and land

cases, and in the Registries of Courts having appellate jurisdiction,


registers of judgments in appeals, both civil and criminal.
Certified copies of all judgments will be written or typed and
engrossed in the registers.
13. There shall be no necessity to maintain separate registers
for applications for leave to appeal, whether in civil or criminal
matters, and such registers will be discontinued. The particulars
of such applications shall be inserted in the remarks columns of
the original case registers. Applications for leave to appeal will in
the Courts in which they are filed, (if other than the Court of trial)
be entered in the appeal registers and where leave to appeal is
granted the subsequent documents in the appeal will be filed in
the same file cover and will bear the same number as the application.

14. White, cream or buff coloured paper shall be used as far


as practicable both for file covers and formal documents in connection with civil cases.

Blue or azure blue paper shall be used as far as practicable both


for file covers and formal documents in connection with criminal
cases.
The civil and criminal case registers shall as far as practicable
be made up of white and blue or azure blue paper respectively.
The pages of the civil case registers and the criminal case registers should be numbered in numerical sequence, each double page
being considered as one page.
15. The Registries shall be open to the public at least six days
in every week (public holidays excepted) from 8.30 a.m. to 1 p.m.
The office hours of the staff shall be as prescribed from time to
time bv the Chief Justice.

16. All originals or copies of any judgments or orders or other


proceedings shall be marked by the clerk making the same with his
initials at the bottom left-hand corner of the page or last page
thereof. Where copies are typed, the initials of the clerk may also
be typed.

Rules, 1935.
19. Articles 5 to 1-1 inclusive, comprising Title I I of the Ottoman Code of Civil Procedure shall cease to have effect in Palestine in so far as concerns the Courts to which these rules apply.

The King's Most Excellent Majesty in Council.


W H E R E A S a Convention for the unification of certain rules relating to inter
national carriage by air was on the twelfth day of October, nineteen hundred and
twenty-nine, signed at Warsaw on behalf of His Majesty :

provision is made by the Carriage by Air Act, 1932, ( ) for giving


effect to the said Convention :

A N D WHEREAS

A N D WHEREAS by sub-section (2) of section one of the said Acts H i s Majesty may
by Order-inCouncil from time" to time certify who are the High Contracting Parties
to the said Convention, in respect of what territories they are respectively parties
and to what extent they have availed themselves of the provisions of the Additional
Protocol to the said Convention :
A N D WHEREAS since the date of the Carriage by Air (Parties to Convention)
(No. 2) Order, 1935,( ) the ratification of the said Convention by H i s Majesty in
respect of The Commonwealth of Australia (including Papua, Norfolk Island and the
mandated territories of New Guinea and Nauru) and H i s accession to the said Con
vention in respect of The Irish Free State have been deposited or notified and it
is therefore expedient that the said Order should be superseded by a more compre
hensive Order:

Council, to order, and it is hereby ordered, as follows :
1. It is hereby certified that the High Contracting Parties to the said Conven

Party who has availed himself of the provisions of the Additional Protocol to the

I N E X E R C I S E of the power vested in him by Article I V of the Palestine (Defence)


Order-in-Council, 1931, the High Commissioner has made the followingregulations :
Citation.

1. These regulations may be cited as the Emergency (Amendment) Regulations (No. 7), 1936.

Interpretation.

2. In these regulations the term "principal regulations" shall


mean the Emergency Regulations, 1936.

3. Regulation 15B of the principal regulations (as enacted in


regulation 4 of the Emergency (Amendment) Regulations (No. 3),
1936), shall be amended as follows :
(a) by the insertion between the words "place of his detention"
and the words "may be arrested" appearing in paragraph
(4) thereof, of the following words :
" , o r who fails to obey or comply with any orders or directions given by the Inspector-General of Police as to discipline or otherwise under paragraph (5) of this regulation, or with any order lawfully given under the authority
of anv such orders or directions,";
(b) by the substitution of the w ords "may give orders or directions" for the words "may give directions or prescribe regulations", appearing in paragraph (5) thereof.

SECTION

I N E X E R C I S E of the powers vested in him by section 16 of the


Dentists Ordinance, 1926, the High Commissioner has made the
following" rules :

1. These rules may be cited as the Dentists (Change of Name)


Rules, 1936.
2. Any person to whom a licence or permit has been granted
under section 4 or 7 of the Dentists Ordinance, 1926, who changes
his or her name, either on marriage or for any other reason, shall
notify such change to the Senior Medical Officer of the district in
which he or she resides, not later than sixty days from the date
on which such change takes place.
3. The notification referred to in the preceding rule shall be
made in the form set out in the schedule hereto and shall be accompanied by documentary evidence in support of such change of name.

4. The Director of Medical Services shall, if satisfied with the


evidence submitted, authorise the alteration of the name of such
person as aforesaid on the licence or permit, as the case may be,

pensation Ordinance, 1927, the High Commissioner-in-Council has made the follow
ing rales :

1. These rules may be cited as the Workmen's Compensation


Rules, 1936.

Citation.

2. In these rules the term "principal rules" shall mean the


rules made under the Workmen's Compensation Ordinance, 1927,
dated the 9th June, 1927, and published in the Gazette of the 16th
June, 1927.

Interpretation,

3. Rule 3 of the principal rules shall be amended by the addition of the following words at the end thereof :

Regulations of the Courts Office of the Clerk (2004)


Pursuant to my authority in the Courts Act (1984) Articles 82, 108, 109, and the Labor Courts Act
(1969), Article 43, and following consultation with the Minister of Industry, Commerce and Labor, in
reference to the Article cited above, I herein promulgate instant Regulations:
1. The office of each court, named below, shall be named Office of the Clerk, [Hereinafter the Office
of the Clerk]:
(1) The Supreme Court;
(2) District Court;
(3) Magistrate Court;
(4) National Labor Court;
(5) Regional Labor Court.
2. The Office of the Clerk shall maintain registration of the matters brought before the court, pertaining
to the following details:
(1) Court file number;
(2) Date the matter was brought to court;
(3) Name of the Judge, Magistrate, or members of the panel;
(4) Names and party designations in the process;
(5) Nature of the claim and its sum, and in criminal process the charges in the indictment;
(6) Fees paid;
(7) Dates of hearings.
3. (a) The court file shall be held in the Office of the Clerk and include all court records, including
records, exhibits, protocols, and decisions, but the court is permitted to order that an exhibit that
was filed in court be held by the party that filed it, under conditions set by the court; if the record
was in writing, it shall be scanned prior to its transfer to the party, and the scanned copy be held in
the computer of the court.
(b) All court records shall show the court file number.
(c) In instant Regulation, File - including one, which is electronically administered.
4. (a) Public hours of the Office of the Clerk shall be as follows:
(1)...

5. Any provision of instant Regulations shall be upheld in mechanized and electronic systems of the
courts, with the required changes, if so instructed by the Director of Administration of Courts.
6. Payment to the court shall be made in a manner that shall be published by the Director of
Administration of Courts in the Internet site of the court system.
6.a The Chief Clerks of the courts are authorized to certify that a copy of a court record is a true copy
of the record in the court file (amended in 2005).
7. The Regulations of the Courts Registration Office (1936) are voided.
8. Instant Regulations are effective 30 days from the date of their publication.
