Samala vs Valencia

Facts:
This is a case for disbarment filed by Samala against respondent Atty.
Valencia on the following grounds;
(a) Serving on two separate occasions as counsel for the contending parties.
(b) Knowingly misleading the court by submitting false documentary evidence
(c) Initiating numerous cases in exchange for non-payment of rental fees
(d) Having a reputation of being immoral by siring illegitimate children.
Commissioner found out that the respondent is guilty of violating Canons 15
and 21 of the CPR and recommended the penalty of suspension for 6 months.
IBP modified the recommendation by the Commissioner from 6months to one
year suspension.
Issue:
WON respondent should be suspended.
Ruling:
The grounds stated in the complaint against respondent is a clear violation of
the CPR.
The Court finds respondent Atty. Valencia guilty of misconduct and violation
of Canons 21, 10 and 1 of the CPR. He is suspended from the practice of law for
three years.
