After examining the briefs and appellate record, this panel has determined
unanimously that oral argument would not materially assist the determination
of this appeal. See Fed.R.App.P. 34(a); 10th Cir. R. 34.1.9. The case is
therefore ordered submitted without oral argument.

We review the district court's refusal to appoint counsel for appellant for an
abuse of discretion. Castner v. Colorado Springs Cablevision, 979 F.2d 1417,
1422-23 (10th Cir.1992). "A plaintiff asserting an employment discrimination
claim has no constitutional or statutory right to appointed counsel." Id. at 1420.
Title VII, however, gives the district court discretion to appoint counsel for
such a plaintiff. Id.; 42 U.S.C.2000e-5(f)(1). In determining whether to appoint
counsel, the district court should consider: "(1) plaintiff's ability to afford
counsel; (2) plaintiff's diligence in searching for counsel; and (3) the merits of
plaintiff's case." Castner, 979 F.2d at 1420. A fourth factor--plaintiff's ability to
present the case without counsel--comes into play in close cases. Id. at 1421.
We note that appellant was represented by counsel until a disagreement about
the handling of the case prompted appellant to discharge his attorney. In
addition, the EEOC determined that appellant's evidence did not support a
finding of discrimination. This fact is "highly probative." Id. at 1422. Under the
circumstances of this case and based upon our review of the record on appeal,
we conclude the district court did not abuse his discretion by not appointing
counsel for appellant.
Appellant's other arguments are likewise without merit and do not warrant
discussion.
