A regular session of Troy City Council was held Tuesday, July 5, 2016, at 7:00 p.m . in Council Chambers .
Members Present:

The meeting began with an invocation given by Mr. Phillips followed by the Pledge of

INTRODUCTIONS:

Recently appointed Firefighters David Schmolinsky and Andrew Bates were introduced .

PRESENTAT ION: Steven Justice of the Hope Over Heroin Coalition made a presentation. The Hope Over Heroin
(HOH) initiative is a collaborative effort by churches, organizations and social services to reach those suffering
from drug related issues. Local faith based organizers have scheduled a two night HOH event (July 8 and 9) at
the Miami County Fairgrounds to assist those who are willing to enter into treatment. The event will include a
memorial march. Several thousand persons are expected to attend the event over two days. Mr. Justice noted
that over 50 persons in Miami County are overdosing every month, with victims in all age and socio-economic
groups; 80-85% of the crimes in Miami County are related to heroin; 20-30 persons in the Miami County Jail at
this time are there to detox from heroin as the jail is the only place of detox in Troy; in Troy, Narcon is
administrated to those who overdose by firefighters; the HOH organization has prepared a brochure that
outlines where help can be obtained; in preparing the brochure it was found that there are gaps in the system of
care for addiction; earlier in the year, UVMC hosted the first clinical education for physicians in Ohio regarding
treatments for withdrawal; and it is believed it will take a community to address this situation.
As a part of this initiative Mr. Titterington explained that Troy would be the first community in Miami County to be
part of forming a Quick Response Team (QRT) to help those who have experienced a heroin overdose. The
City of Troy will participate in a pilot QRT for a period of up to 12 months. This will involve committing staff from
the Troy Police and Fire Departments to be part of four person team to include a support specialist of the faith
based community in Miami County, and a Miami County Recovery Council Addiction Treatment Specialist, to
intervene with Troy residents who have overdosed on opiates within 72 hours of the overdose event to assess
and determine whether the overdose victim is willing and ready to enter into treatment/counseling to recover
from the addiction . Mr. Titterington noted the program will have quarterly evaluations and a 12 month evaluation
to determine if it is seeing success and should be continued . He also noted that the City will be seeking State
grants/funding to offset any costs. It was noted that Colerain Twp., Ohio has implement a similar initiative and
has seen a substantial participation in treatment/counseling and reduction in crime.
Discussion.
-Mr. Phillips stated that as a 30-year law enforcement veteran, including five years in a narcotics division, he
understands that the City of Troy has been involved in addressing the addiction situation for adults and in the
schools, and while this may not receive a lot of publicity, the effort is being supported, and he applauds what
HOH is trying to accomplish .
-In response to Mrs. Baker, Mr. Titterington stated Council will be advised regarding the quarterly follow-up
evaluations of the program .
-Mr. Phillips suggested that the brochure developed by the HOH be available on the City website and provided
to businesses, organizations and churches.
-Council discussed amending the order of the Council agenda to consider the Resolution of Support for the
Quick Response Team at this time.

A motion was made by Mr. Kendall , seconded by Mr. Schweser, to amend the agenda to consider the
Resolution of Support at this time. Motion passed by unanimous roll call vote.
RESOLUTION OF SUPPORT QUICK RESPONSE TEAM . The Clerk read "A Resolution of Support, Quick
Response Team" (copy of which is attached to the original minutes).
A motion was made by Mr. Phillips,
seconded by Mr. Kendall, to approve the Resolution of Support Quick Response Team. Motion passed by

MINUTES: The Clerk gave a summary of the minutes of the June 20, 2016 meeting of Troy City Council.
There were no corrections or additions to these minutes. A motion was made by Mr. Phillips, seconded by Mr.
Twiss, to approve these minutes . Motion passed by unanimous roll call vote.

COMMITTEE REPORTS:
Personnel Committee: Mr. Terwilliger, Chairman, reported that Committee is supportive of establishing an
additional full time position of Firefighter/Paramedic Lieutenant, which would be an intermediate position
between that of Firefighter and Platoon Commander. This new position would perform a number of duties that
would serve, assist, and enhance the fire and EMS services of the Troy Fire Department. Committee noted that
as the position was not budgeted, a future reappropriation may be required. Legislative action to establish the
positon would not be presented to Council until after the City and IAFF bargaining unit representatives meet to
recommend a salary within the stipulations of the Collective Bargaining Agreement.
At that time, Council
would consider a Salary Ordinance amendment that would establish the position and the wage. As no
legislation is required at this time, Committee recommends that Council vote on accepting the Committee report.
A motion was made by Mr. Kendall, seconded by Mr. Twiss, that Council approves the Personnel
Committee report of June 30, 2016, recommending establishing an additional full time position of
Firefighter/Paramedic Lieutenant. Motion passed by unanimous roll call vote.
Oral Report: Mr. Terwilliger gave an oral report that Mayor Beamish has requested Council approve the
appointment of William Wolke to the Economic Development Revolving Loan Fund Loan Review Committee for
a term ending December 31, 2018. William Wolke would be completing the unexpired term of Russell Thayer,
who recently resigned.
A motion was made by Mr. Terwilliger, seconded by Mr. Phillips, to approve the appointment of William
Wolke to the Economic Development Revolving Loan Fund for a term ending December 31, 2018.
Motion passed by unanimous roll call vote .

COMMENTS OF THE MAYOR: Mayor Beamish commented:


-Encouraged Council to participate in the Hope Over Heroin Memory Walk, July 9, 5:00p .m ..
-Noted that there will be a downtown concert on July 8, a concert at Treasure Island Park on July 9, and a Troy
Civic Band Concert at Treasure Island Park on July 10.
-Presented the new logo/branding that will be used for wayfinding to and between Troy's historic downtown
district and newly renovated Treasure Island Park. He commented that over the next few months, corridor
banners, kiosks, bicycle racks, signage, and other furnishings will be re-branded with these new logos.
COMMENTS OF THE DIRECTOR OF PUBLIC SERVICE AND SAFETY: Mr. Titterington commented further on
the logo, noting that it has been used on the banners at Treasure Island Park. He noted this is part of improving
the wayfinding from the corporate boundary to the downtown to the river corridor. He further commented that
the new logo will also be able to incorporate the familiar Troy, Ohio USA design for the purpose of changing the
logo at the top of the community entrance signs, and the consistent brand and wayfinding should complement
the regional branding being undertaken by the MCD .
COUNCIL COMMENTS:
-Mr. Heath stated he thought the fireworks were well done.
-Mrs. Snee asked about a potential opening date for the marina building, with Mr. Titterington replying that late
summer is the goal of the restaurant operator.

This Committee met July 11 regarding bidding for the Sidewalk Improvement Program Phase 9. The project to be
bid includes the properties where the owners have not obtained a permit to have the work done. The estimated
cost of the work to be bid is approximately $300,000, which is the amount budgeted.
RECOMMENDATION: {To be read at Council meeting)
It is the recommendation of this Committee that legislation be prepared authorizing the Director of Public Service
& Safety to advertise for bids and enter into a contract for the Sidewalk Improvement Program Phase 9 at a cost
not to exceed $300,000.

DETAILED REPORT:
This Committee met on July 11, 2016, to consider authorizing bidding for the Sidewalk Improvement Program
Phase 9. The meeting was also attended by Mayor Beamish, Council President Baker, the Director of Public
Service and Safety, and members of the City staff.
The Sidewalk Improvement Program is to replace raised, cracked and otherwise dangerous sidewalks that have a
liability potential for the property owners and the City. Phase 9 has been identified as the areas along South
Plum, South Cherry, South Walnut and South Mulberry between Main and Franklin; South Market, South Walnut
and South Mulberry between East Franklin and East Canal; and the area encompassed by South Market, East
West, South Clay, Ross, and South Mulberry which include the following streets Young, Enyeart and Dakota.
Following Council's approval of the Resolution of Necessity regarding the repair/replacement for Phase 9 of this
program, property owners received notice. Of the approximately 121 parcels in Phase 9, the owners of about 92
did not request permits to perform the work. The City now bids for that work to be done for those properties
where permits were not requested. After the project is completed, property owners may pay the City for their
share of the project or have the cost assessed to the taxes as necessary to be paid over a five-year period. It is
estimated that the current work to be performed under the City's contract will not exceed $300,000, which is the
amount budgeted. The contract will not include replacing/establishing handicap ramps at intersections within the
area as that will be a part of a separate contract using Community Block Development Grant (CDBG) funding.
RECOMMENDATION:
It is the recommendation of this Committee that legislation be prepared authorizing the Director of Public Service
& Safety to advertise for bids and enter into a contract for Phase 9 of the Sidewalk Improvement Program at a
cost not to exceed $300,000.

Committee members Snee and Heath met on April 11 to consider the consent legislation provided by the Ohio
Department of Transportation (ODOT) regard ing ODOT's microsurfacing project to include the paving of SR
55 in State FY 2017. A small portion of the project is within Troy's city limits. The project is at no cost to the
City, but consent legislation is required.
RECOMMENDATION: (to be read at Council meeting)
We recommend that the consent legislation provided by ODOT be approved related to the paving of an area
of SR 55 within the City of Troy. Based on the ODOT format, we support the legislation being presented as
an emergency measure.

This Committee met on July 11, 2016 , to consider the consent legislation provided by the Ohio Department of

of SR 55 within the City of Troy. Based on the ODOT format, we support the legislation being presented as
an emergency measure.

sidewalk/curb/gutter, and utility work. The project area is from the alley west of Lake Street to the 1-75 overpass.
While this project has not yet been designed, it is currently estimated at $1,415,000. The OPWC grant would not
exceed $600,000. This project would be designed in 2017 and constructed in 2018.
RECOMMENDATION: (To be read at Council meeting)
It is the recommendation of this Committee that legislation be prepared authorizing the Director of Public Service

The City was notified by the Ohio Public Works Integrating Committee that the City's application for the McKaig
Road Improvement Phase IV has scored high enough to receive funding. The project area would be on McKaig
Road between the alley west of Lake Street and the 1-75 overpass. The project scope includes roadway
reconstruction/paving, sidewalk/curb/gutter, and utility work. While this project has not yet been designed, it is
currently estimated at $1,415,000. A more definitive estimate will be part of the design process; however, the
OPWC grant would not exceed $600,000. The City will be required to bid the project and seek reimbursement for the
State portion. The design of this project will be included in the 2017 budget. Construction would be in 2018.
RECOMMENDATION:

PREPARE AND SUBMIT AN APPLICATION TO PARTICIPATE IN
THE OHIO PUBLIC WORKS COMMISSION STATE CAPITAL
IMPROVEMENT
AND/OR
LOCAL
TRANSPORTATION
IMPROVEMENT PROGRAM!Sl AND TO EXECUTE CONTRACTS
AS REQUIRED AND DECLARING AN EMERGENCY

WHEREAS, the State Capital Improvement Program and the Local Transportation
Improvement Program both provide financial assistance to political subdivisions for capital
improvements to public infrastructure; and

WHEREAS, the City of Troy is planning to make capital improvements to McKaig Road
Phase IV; and

WHEREAS, the infrastructure improvement herein above described is considered to be a


priority need for the community and is a qualified project under the Ohio Public Works Commission
(OPWC) programs.

NOW THEREFORE, BE IT RESOLVED by the Council of the City of Troy, Ohio, as follows:
SECTION 1:

That the Director of Public Service and Safety of the City of Troy, Ohio is

hereby authorized to file all necessary applications and documents with the OPWC for funds as
described above for the McKaig Road Improvement Project Phase IV and to execute contracts with
OPWC as required .

SECTION II:

That the Director of Public Service and Safety of the City of Troy, Ohio is

authorized to enter into any agreements as may be necessary and appropriate for obtaining this
financial assistance.

SECTION Ill:

That this Resolution is declared to be an emergency measure necessary for

the immediate preservation of the public peace, health and safety of the City of Troy, Ohio, and for
the further reason that the application is required to be filed by July 25, 2016; NOW WHEREFORE,
this Resolution shall be effective immediately upon its adoption by this Council and approval by the
Mayor.

OHIO DEPARTMENT OF TRANSPORTATION FOR THE RESURFACING OF
STATE ROUTE 55 WITHN THE RIGHT-OF-WAY OF THE CITY OF TROY.
OHIO IN FY 2017 AND DECLARING AN EMERGENCY

The following Resolution is enacted by the City of Troy, Miami County, Ohio, hereinafter referred to as the CITY, in
the matter of the stated described project.
SECTION I - Project Description
WHEREAS, the STATE bas identified the need for the described project:
Microsurface various routes in Miami County to include State Route 55 Straight Line Mile 3.79 to 8.21 more or less, a
portion within the City of Troy, Miami County, Ohio. Said project is further identified as MIA MICRO FY2017 fA).
NOW THEREFORE, be it resolved by the City of Troy, Ohio.
SECTION II - Consent Statement
Being in the public interest, the CITY gives consent to the Director of Transportation to complete the above described
project.
SECTION Ill - Cooperation Statement
The CITY shall cooperate with the Director of Transportation in the above-described project as follows :
The CITY has no obligation for costs for the project as described in Section I. ODOT will provide all Federal-aid and
State funds as set aside by the Director of Transportation for the fmancing of this improvement from funds allocated
by the Federal Highway Administration, U.S. Department of Transportation.
In addition, the CITY also agrees to pay One-Hundred Percent (100%) of those features requested by the CITY which
are determined by the State and Federal Highway Administration to be unnecessary for the Project.
If curb ramps are constructed by ODOT in compliance with the Americans with Disabilities Act, future maintenance
of installed sidewalk curb ramps shall be the responsibility of the City. The City shall adjust any existing castings, as
required, with City forces.
SECTION IV - Utilities and Right-of-Way Statement
The CITY agrees that all right-of-way (if applicable) required for the described project will be acquired and/or made
available in accordance with current State and Federal regulations. The CITY also understands that right-of-way costs
include eligible utility costs. The CITY agrees to be responsible for all utility accommodation, relocation, and
reimbursement and will comply with the current provisions of23 CFR 645 and the ODOT Utilities Manual.
SECTION V- Maintenance
Upon completion of the Project, and unless otherwise agreed, the CITY shall: (I) provide adequate maintenance for
the Project in accordance with all applicable state and federal law, including, but not limited to, Title 23, U.S.C.
Section 116; (2) provide ample financial provisions, as necessary, for such maintenance of the Project; (3) maintain
the right-of-way, keeping it free of obstructions; and, (4) hold said right-of-way inviolate for public highway purposes.
SECTION VI - Authority to Sign
The Director of Public Service and Safety of said City of Troy is hereby empowered on behalf of the City of Troy to
(Contractual Agent-Title)
enter into contracts with the Director of Transportation necessary to complete the above described project.
SECTION VII - Rescind Resolution R-19-2016
That Resolution Number R-19-2016, related to the paving of a portion ofSR 718, is hereby rescinded as requested by
the Ohio Department of Transportation.
SECTION VIII - Emergency
That this Resolution is an emergency measure necessary for the immediate preservation of the public peace, health
and safety of the City of Troy, Ohio, and for the further reason to expedite the highway project and to promote
highway safety, NOW WHEREFORE this Resolution shall be effective immediately upon its adoption and approval
by the Mayor.

BE IT ORDAINED by the Council of the City of Troy, Ohio, at least two-thirds of the members
thereof concurring as follows :

WHEREAS, a request for zoning change was presented to the Planning


Commission of the City of Troy, Ohio, to rezone of part of Outlets 119 and 120 (Parcel#
D08-096930) in the City of Troy, and

WHEREAS, the Planning Commission of the City of Troy, Ohio, has reviewed
the plan and recommended approval, and

WHEREAS, at least thirty days notice of the public hearing of said change has
been provided in a newspaper of general circulation,

REPORT OF THE PLANNING COMMISSION ON THE REZONING OF PART OF OUTLOTS 119 & 120,
ABANDONED RAILROAD PROPERTY LOCATED SOUTH OF A PORTION OF E. RACE DRIVE, FROM
R-5, SINGLE FAMILY RESIDENTIAL DISTRICT, TO M-2, LIGHT INDUSTRIAL DISTRICT

On June 22, 2016, the Troy Planning Commission considered the rezoning of Part of Outlets 119 and 120 {Parcel#
D08-096930) from R-5, Single-Family Residential District, to the zoning of M-2, Light Industrial District. This is
2.6942 acres of abandoned railroad property, located south of E. Race Drive, abutting the lots with addresses of
910 E. Race Drive to 1112 E. Race Drive. The rezoning property owner/applicant is Habitat for Humanity.
In 2010, this property had split zoning of R-5, Single Family Residential, and M-3, General Industrial district.
Habitat for Humanity had a vision for the property which included an extension of Jeep Street to the west to
connect with S. Union Street for a project that would result in 14 new residential lots with the opportunity of a
large scale neighborhood to the south. The property was rezoned entirely to the R-5, Single Family Residential
District, to accommodate the then plan of Habitat for Humanity. However, due to the cost of the project and the
large parcel to the south (zoned M-3, General Industrial) not being suitable for residential development, Habitat
has opted to abandon the Jeep Street extension project and has requested the property be rezoned for industrial
use. If rezoned to M-2, Habitat for Humanity could then sell the land to the contiguous business, Spectracam, so
that Spectra cam can expend their facility.
The parcel proposed for rezoning touches Jeep Street, which provides frontage {although this portion of Jeep
Street is not yet paved). The property runs along the south property line of nine residential properties and to the
west of one residential property. The impact to the surrounding residential areas will be minimal due to the
unique topography and the natural buffer already in place, which consists of an earthen berm and heavy tree
density. A buffer between the residential zon ing district and the industrial district is required by the City of Troy
Zoning Code.
The Zoning Code describes the "M-2" Light Industrial District as designed to provide for industrial uses, which can
be operated in such a manner as to conform to the appl icable performance standards specified in the district.
Th ese performance standards regulate such uses in order to prohibit congestion and for the protection of
adjacent residential and business activities.
The Planning Commission determined not to hold a public hearing on this rezoning application.

By unanimous vote, the Troy Planning Commission recommends to Troy City Council that the rezoning be
approved for part of Outlots 119 and 120, consisting of 2.6942 acres of abandoned railroad property, located
south of E. Race Drive, abutting the lots with addresses of 910 E. Race Drive to 1112 E. Race Drive, from R-5,
Single-Family Residential District, to the zoning of M-2, Light Industrial District, as submitted, and based on the
findings of staff that:
o The area has the same zoning with two connecting parcels as the proposed zoning classification;
o The property already provides a required buffer between the residential properties and proposed
industrial property;
o The parcel meets the required bulk requirements for an M-2 zoned property and fits the proposed use
well;
o The proposed rezoning is consistent with the intent and purposes of the City of Troy Zoning Code;
o The rezoning would enable utilization of a currently unutilized property.

The proposed rezoning is consistent with the Zoning Code, specifically with sections 1131 .02(e}, and {r). These sections dictate the
intent and purpose of the Zoning Code. Theses sections are listed below:

1131.02(e) "To separate incompatible land uses and to cluster compatible and mutually supportive land uses".

1131.02{r) 'To direct particular land uses to the parcels of land best suited for them ... "

The rezoning is consistent with the above listed intentions of the Zoning Code. The industrial use of the property fits well with the
current uses that exist in the area .
(B) Whether the proposed amendment is made necessary because of changed or changing conditions in the area affected, and, if so,
the nature of such changed or changing conditions.
The application was not submitted based upon any changing conditions in the area .
(C) Whether the uses that would be permitted on the property if it were reclassified would be compatible with the uses permitted on
other property in the immediate vicinity.
The use would be permitted on the existing parcels of land currently zoned M-2 to the proposed rezoning parcel. In addition , the use
would also be allowed in the surrounding M-3 zoning district that exists to the south.
(D) Whether adequate utility, sewer, and water facilities, and all other needed public services exist or can be provided to serve the
uses that would be permitted on

a property if it were reclassified.

All utilities are provided or are available to this parcel.


(E) The amount of vacant land that currently has the same zoning classification as is proposed for the subject property, particularly in
the vicinity of the subject property, and any special circumstances, in any, that make a substantial part of such vacant land unavailable
for development.
There is no available land zoned M-2 Light Industrial in the area, however, a large parcel of land zoned M-3 General industrial exists to
the south of this parcel.
{F) Whether the proposed amendment would correct an error in the application of this Zoning Code as applied to the subject property.
Not applicable in this request.

Staff did not recommend a public hearing be held by the Commission and recommended approval of the
rezoning application based on:
o

The area has the same zoning with two (2) connecting parcels as the proposed zoning classification;

The property already provides a required buffer between the residential properties and proposed industrial

The parcel meets the required bulk requirements for an M-2 zoned property and fits the proposed use well;

The proposed rezoning is consistent with the intent and purposes of the City of Troy Zoning Code;

The Commission discussed that there does seem to be a good natural buffer. In response to Mr.

Titterington regarding extending the area to be rezoned to Williams Street, it was stated that the rezon ing follows
the current parceling of the land and Spectracam does not need the area to Williams Street.

Mayor Beamish

summarized that by Habitat selling this un-needed property will make it possible for Spectracam to expand their
business .

PUBLIC HEARING:

A motion was made by Mr. Titterington, seconded by Mr. McGarry, that the Planning

Commission not hold a public hearing on the rezoning of part of Outlots 119 and 120.

property is zoned R-5, Single Family Residential, and the applicant requests that the
zoning of the parcel be rezoned to M-2, Light Industrial District.
The property consists of 2.6942 acres located south of Race Dr. The surrounding zoning
districts predominately include R-5, Single-Family Residential to the north, east and west
and M-3 General Industrial District to the south. A map depicting the smrounding zoning
districts has been attached to this report

The Comprehensive Plan's Future Land Use (Figure 14-4) shows the surrounding area to

In reviewing a rezoning proposal, Section 1139.07 outlines the criteria on which to


base decisions:
(A) Whether the change in classification would be consistent with the intent and purpose
ofthis Zoning Code.

Due to the straight forward nature of the rezoning request and the fact that the topography

Council is required to hold a public hearing if the request proceeds on, staff does not feel
that a public hearing before the Planning Commission is warranted.
RECOMMENDATION:

Staff is advocating that the Planning Commission recommend approval of the rezoning
from R-5, Single Family Residential District to M-2, Light Industrial District, based on
the following:
o The area has the same zoning with two (2) connecting parcels as the proposed
zoning classification; and
o The prope1ty already provides a required buffer between the residential properties
and proposed industrial property; and
o The parcel meets the required bulk requirements for an M-2 zoned property and
fits the proposed use well; and
o The proposed rezoning is consistent with the intent and purposes of the City of

REASON FOR ZONING CHANGE

Applicant had previously received a zoning change for this real estate
from split zoning (R-5/M-3) to R-5 when it purchased the real estate. It
was purchased with the intention of extending Jeep St. and developing
the propetiy into lots for its programs. Applicant has determined that the
development will not take place since the extension of Jeep St. is not
financially feasible. So it would like to sell the real estate.
Applicant has entered into a sales agreement with the owner of
Spectracam for the Purchase of this real estate. This real estate is
contiguous to the cunent Spectracam real estate, which is zoned M-2.
Spectracam wishes to use this real estate as a parking lot and storage
area for its business. The sales agreement is conditioned upon the
rezoning of this real estate. Thus, Applicant requests that the real
estate's zoning be changed from R-5 to M-2.

Investment and Deposit Policy
Section 1

Policy

It is the policy of the City of Troy ("City") to invest public funds in a manner which will provide the
highest investment return with maximum security while meeting all liquidity and operating demands
of the City. i\11 investment activities must conform to all applicable federal, state and local statutes
governing the investment of public funds.
Section 2

Scope

This Investment and Deposit Policy ("Policy") applies to all financial assets of the City ofTroy. The
City funds subject to this Policy are hereinafter referred to as the "Active Portfolio."
The City may consolidate cash balances from all funds to maximize investment earnings. Investment
income will be allocated to various funds in accordance with generally accepted accounting
principles.
Section 3

Objectives

The primary objectives of investment activities, in order of priority, shall be safety, liquidity and
yield:

A. Safety ofPrincipal
Safety of principal is the foremost objective of the City. Investments shall be undertaken in a
manner that seeks to ensure the preservation of capital in the overall portfolio. This is
accomplished by:
I . Limiting investments to the securities authorized by this policy.
2. Pre-qualifying the financial institutions, broker/dealers, and advisors with which the City of
Troy will do business.
3. Diversifying the investment portfolio so that potential losses on individual securities will not
significantly affect the safety of the portfolio.
4. Structuring the investment portfolio so that securities mature to meet cash requirements for
ongoing operations, thereby avoiding the need to sell securities on the open market prior to
maturity.
B. Liquidity
The investment portfolio shall remain sufficiently liquid to meet all operating requirements that
may be reasonably anticipated. This is accomplished by:
!. Structuring the portfolio so that securities mature concurrent with cash needs to meet
anticipated demands.
2. The portfolio should consist largely of securities with active secondary or resale markets.
3. A portion of the portfolio may be placed in money market funds or local government pools
(Star Ohio) which offer same-day or weekly liquidity for short-term funds.

C. Return on Investments
The investment portfolio shall be designed with the objective of attaining a market rate of return
throughout budgetary and economic cycles, taking into account the investment risk constraints
and liquidity needs . Return on investment is of secondary importance compared to the safety
and liquidity objectives described above.
Section 4

Standards of Care

A. Delegation of Authority
Management responsibility for the investment program is hereby delegated to the City Auditor or
the Auditor's designee who shall act in accordance with established written procedures and
internal controls for the operation of the investment program, consistent with this investment
policy. The City Auditor or the Auditor's designee shall be responsible for all transactions
undertaken and shall establish a system of controls to regulate the activities of subordinate
officials. No person may engage in an investment transaction except as provided under the terms
of this policy and the procedures established by the City Auditor.
B. Prudence
The standard of prudence to be used by investment officials shall be the "prudent person" and/or
"prudent investor" standard and shall be applied in the context of managing an overall portfolio.
Investment officers acting in accordance with written procedures and this investment policy and
exercising due diligence shall be relieved of personal responsibility for an individual security's
credit risk or market price changes, provided deviations from expectations are reported in timely
fashion and the actions of the investment officer are in accordance with this policy.
C. Ethics and Conflicts ofInterest
Officers and employees involved in the investment process shall refrain from personal business
activity that could conflict with the proper execution and management of the investment
program, or that could impair their ability to make impartial investment decisions. Employees
and investment officials shall disclose to the City Manager any material financial interests that
could be related to the performance of the City's investments.
Section 5

Maturity

To the extent possible, the City will attempt to match the term to maturity of its investments with the
anticipated cash flow requirements. Unless matched to a specific cash flow requirement, the City
will not directly invest in securities maturing more than ftve years from the date of settlement.
Section 6

Diversification

The investment portfolio shall be diversified by:


a. Avoiding over-concentration in securities from a specific issuer or business sector
(excluding securities issued by the United States government or an agency or
instrumentality thereof); and
b. Investing in securities with varying maturities; and
c. Continuously investing a portion of the portfolio in readily available funds such as money
market funds, overnight repurchase agreements or local government investment pools to
ensure appropriate liquidity is maintained in order to meet ongoing obligations.

Section 7

Authorized Financial Institutions and Dealers

Any financial institution, as defined by O.R.C. 135.03, is eligible to serve as an approved depository
and/or investment provider. Eligible securities dealers and brokers must be members of the National
Association of Securities Dealers (NASD), meet a minimum capital requirement of $10,000,000, and
have been in operation for at least five years. These may include "primary" dealers or regional
dealers that qualify under the Securities and Exchange Commission (SEC) Rule ISC3-I (uniform net
capital rule). An investment advisor must be an eligible financial institution as defined by O.R.C.
135.03, or an advisor that is registered with the Securities and Exchange Commission.
The City Auditor or the Auditor's designee may conduct a review of the financial condition and
registration of qualified institutions at least once every five years or sooner if deemed appropriate.
The City Auditor's office will maintain information regarding the authorized institutions, and:
a. May make additions to the authorized list when investment policy requirements are met;
b. Shall make deletions from the list (i) to meet the following investment and deposit policy
requirements, (ii) upon failure of the financial institution to meet the requirement of this
policy, or (iii) upon request of the financial institution or dealer; and
c. May make deletions from the list based on the following:
I. Perceived fmancial difficulties of the financial institution or dealer;
2. Consistent lack of competitiveness by the financial institution or dealer;
3. Lack of experience or familiarity of the account representative in providing service to
large institutional accounts; or
4. When deemed in the best interest of the City.
Section 8

Authorized Investments

The City Auditor or the Auditor's Designee may invest on behalf of and in the name of the City in
the following instruments at a price not exceeding their fair market value:

D. Bankers Acceptances
Bankers acceptances which are eligible for purchase by the Federal Reserve System and which
are issued by institutions which are ranked nationally as being in the top one hundred in asset
and deposit size within their industry, or Ohio based banks with at least $2 billion in assets.

E. Repurchase Agreements
Repurchase agreements of a bank or savings and loan association organized under the laws of the
U.S. or State of Ohio for negotiable direct obligations of the United States or U.S. federal
agencies. If any repurchase agreement obligations do not have the backing of the full faith and
credit of the United States, any such investments shall be secured by collateral as provided in
Section 11 herein.

F. Money Market Funds


Money market funds whose portfolios consist of the foregoing (A-D).
G. State Treasury Asset Reserve of Ohio
The State Treasury Asset Reserve of Ohio ("STAR Ohio") is a statewide investment pool
managed by the Treasurer of the State of Ohio similar in concept to a money market fund. It is
available exclusively to political subdivisions of Ohio. This would include other investments
options from the Treasurer of the State of Ohio including STAR Plus.
H Other Ohio Investment Pools
Any other investment pool operating in Ohio and available exclusively to public fund agencies of
Ohio. The instruments of these pools must have the full faith and credit backing of the United
States or be fully collateralized or insured.

City ofTroy, Ohio Notes and Bonds


Any obligation of the City of Troy, Ohio without regard to term-to-maturity or interest rate, is an
authorized investment.

Section 9
A. Government Securities
U.S. government obligations, U.S. government agency obligations, and U.S. government
instrumentality obligations, which have a liquid market with a readily determinable market
value.
B. Non-Negotiable and Negotiable Interest Bearing Time Certificates of Deposit (CD)
Non-negotiable interest bearing CD's and negotiable interest bearing CO's in federally-insured
banks, organized under the laws of the United States, and chartered in and located within the
fifty (50) United States, provided that such deposits are insured by the Federal Deposit Insurance
Corporation (FDIC). Not more than the FDIC insured amount shall be invested in the bank
certificate of deposits of any single issuer.
C. Commercial Paper

Commercial paper which is rated at the time of purchase in the single highest classification by
Moody's or Standard & Poor's.

Derivatives

Investments in derivatives are strictly forbidden. A derivative is defined in Chapter 135 of the Ohio
Revised Code as a financial instrument, contract or obligation whose value is based upon or linked
to another asset or index or both, separate from the financial instrument, contract or obligation itself.
Section 10

Security for the Repayment of Public Deposits

All public depositories shall comply with the Ohio Revised Code, including sections 135.18 and
135.181, with respect to collateralized security for the deposits of the City. Failure of an institution
to abide by any of the provisions of this section is cause for immediate suspension of the institution
as a qualified depository for any City funds .
Section II

Active Management of Portfolio

The primary investment strategy for the City will be to purchase secuntles and hold them to
maturity. Active management includes a movement from one security to another and may be done

for a variety of reasons, such as to increase yield, lengthen or shorten maturities, to take a profit, or
to increase investment quality. Active management of the portfolio will only occur when no losses
to the portfolio will be realized and the benefits to active management outweigh the costs to pursue
such a strategy. Gains noted during these security trades must be recorded as a completed sale and
purchase.
Section 12

Safekeeping and Custody

All security transactions, including collateral pledges, except for "pooled collateral" arrangements,
shall be conducted on a delivery versus payment basis. Qualified financial institutions for the
purpose of investment transactions and or custody services are:
I) Financial institutions (federally insured banks and savings and loans associations) that have
been designated by the State of Ohio as a Qualified Public Depository.
2) Other financial institutions:
Are deemed credit worthy by the City Auditor
ln the opinion of the City Auditor, it would be in the best interest of the City to
approve and transact business with.

A. Any investment currently held that does not meet the guidelines of this policy shall be exempted
from the requirements of this policy. At maturity or liquidation, such monies shall be reinvested
only as provided by this policy.
B. The Investment Committee of City Council shall review this policy and the City's investment
practices.
C. The policies as stated herein may be changed only with the approval of City Council.

[nvestment Advisory Committee

The Investment Advisory Committee will be comprised of the City Auditor, the Mayor, and the
City's Law Director. As the Investment Advisory Committee deems necessary, other parties may be
invited to attend as well. The Administrator shall be responsible for maintaining records of all
investments and annually, the Committee will review the Investment policy and make
recommendations to City should the policy need to be modified.
Section 14

Reporting

The City Auditors' Office shall prepare an investment report at least quarterly, that provides an
overview of the current investment portfolio and the individual transactions executed over the last
quarter or year to date. The summary will be prepared in a manner that will allow the City to
ascertain whether investment activities during the reporting period have conformed to the investment
policy. The report should be provided to the Investment Advisory Committee. The report may
include an asset listing showing par value, cost, type of security, issuer and coupon rate and yield to
maturity and specifics such as call features, next call date and other pertinent information
Section 15

Internal Controls

The City Auditor's Office shall maintain a system of controls to regulate the activities of employees
involved with the cash management and investment activities of the City. Such internal controls and
compliance shall be subject to review during the annual audit conducted by or on behalf of the
Auditor of the State of Ohio. Such audit will include tests deemed appropriate by the auditors and
details will be included in the Comprehensive Annual Financial Statement (CAFR).

PERMIT ALLOWING RETAIL DISPENSARIES, CULTIVATORS, OR
PROCESSORS OF MEDICAL MARIJUANA WITHIN THE CITY OF
TROY, OHIO AND DECLARING AN EMERGENCY

WHEREAS, the City of Troy, Ohio desires to coordinate regulations regarding the

location and operation of businesses within the City, including Retail dispensaries, cultivators, or
processors of medical marijuana; and
WHEREAS, for the purposes of this Ordinance, a "retail dispensaries", "cultivators", and

"processors" are defined in newly enacted Chapter 3796 of the Ohio Revised Code; and
WHEREAS, the State of Ohio recently enacted laws concerning medical marijuana; and
WHEREAS, House Bill523 becomes effective on September 8, 2016; and
WHEREAS, Revised Code Section 3796.29 allows municipalities to prohibit and/or limit

the location of retail dispensaries, cultivators, and processors of medical marijuana within
corporate limits; and
WHEREAS , it is recommended that the City Administration review and make

recommendations on this issue to conform to the City's goals of providing adequate regulations;
and
WHEREAS, a moratorium on the granting of permits within the City of Troy will allow the

City time to accomplish these goals.


NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Troy, Ohio.
SECTION I. That the City Council seeks a moratorium on permits for the establishment

of retail dispensaries, cultivators, and processors of medical marijuana to preserve the public
peace, health, safety, and welfare of the citizens of the City of Troy, Ohio.
SECTION II.

That the City Council seeks to limit the duration of the moratorium and to

request the immediate investigation and review of proposed comprehensive regulations for the
establishment of retail dispensaries, cultivators, and processors of medical marijuana within the
one-hundred and eighty day period of the moratorium.
SECTION Ill.

That the City Council hereby imposes a moratorium on permits for the

establishment of retail dispensaries, cultivators, and processors of medical marijuana for a


period of one hundred and eighty 180 days from the effective date of this Ordinance.
SECTION IV. That the City Council further finds that a moratorium for one hundred and

eighty days is reasonable and will allow a study for comprehensive regulations.
SECTION V.

That this Ordinance is an emergency measure necessary for the

immediate preservation of the public peace, health, and safety of the City of Troy, Ohio, and for
the further reason that the moratorium needs to be instituted at the earliest possible date and
because Chapter 3796 of the Ohio Revised Code becomes effective on September 8, 2016,
NOW, WHEREFORE, this Ordinance shall be effective immediately upon its adoption and

approval by the Mayor.

ODOT began the North Market Street Redecking Project on June 6. North Market
Street will remain open. Water Street will be closed to traffic between N. Cherry St.
and N. Walnut St.

The Community Christmas Tree for the 2016 is being donated by Justin Beck.

Stranger performed at Treasure Island Park on July 9. The concert was well
received with at least 1800 attendees.

The Troy Civic Band gave their inaugural concert at Treasure Island Park on July
10. This concert was also well received with over 200 attendees.

Street/Solid Waste- Jerry Mullins, Foreman

Collected and transported 237 tons of residential trash since the last report of
242 tons.
Handled one recycling complaint and six trash complaints.
Cleaned and swept the square and downtown area.
Collected several compliant brush piles and T-bags.
Started our third round of sweeping. The sweeper will be out over the next few
months as weather permits. We usually can complete three to four rounds of
sweeping per year.
Completed three rounds of right-of-way and ditch mowing operations.
Used over 430 tons of asphalt on 182 repairs.
Provided barricades for the concert at Treasure Island Park.
Made improvements to the entry off of W. Main St. at Francis Furniture.
Cleared weeds and debris from the Adams Street Bridge.
Started our manhole reconstruction program and have noted 32 manholes in
need of repair. We have assessed our roads being paved and will make those

15 bulk water account holders withdrew a total of 799,904 gallons from


the WTP Bulk Water Station during the month of June; revenue total was
$6,819.39 .
A total of 7,743,068 gallons were pumped to the Extra High Service
pressure zone in northwest Troy by the EHS Booster Station for June1-30 ,
for an average daily consumption in that zone of 0.2581 MG.
Painters began touch-up work on the Train 1 clarifiers on July 5. Pressure
washing and repainting of the bridge structure will be included in this
project. Work will take about two weeks.
Water Distribution staff finished the fire hydrant installation at the south
end of the sludge lagoons.
The east transfer pump at the air stripper has been removed for cleaning.
City electricians and a vendor completed removal of the old Bulk Water
Station terminal and made modifications to the new control station
program.

Wastewater Treatment Plant - Mitch Beckner

July 15 will be Tim Snider's last day as Superintendent of the Troy


Wastewater Treatment Plant. The Plant's employees would like to thank
him for his 27 years of service with the City and we wish him the best in
his retirement.
On July 8 Public Notice was issued by the Ohio Environmental Protection
Agency regarding the Wastewater Plant's new National Pollutant Discharge
Elimination System Permit (NPDES). The posted draft permit will be
issued as a final action after 30 days unless written comments received
indicate that a public hearing is required. If approved, this new permit
will be valid for the next five years.
The Screw Pump Replacement Project is proceeding on schedule. The
latest update indicates that the first set of pumps will be delivered on
August 18. This should allow installation to take place during the
following months of relatively low flow due to seasonal weather.

has been reviewed and the design continues. Bidding and construction is anticipated for Fall of 2016 .

Council approved the ODOT LPA Agreement including accepting ODOT funding and finalizing bike path easements
according to federal regulations. Resurfacing is scheduled to occur SFY 2020 (calendar year July 2019). The

Invoices have been sent to the property owners involved in this program; the property owners had until April 15 to
pay the bills or they would be assessed to their property taxes for five years . Assessment cards are completed and
will be provided to Miami County Auditor's Office in August.
Sidewalk quantities are being obtained/measured for the 2016 sidewalk repair program . Staff is requesting Council
authorize the Resolution of Necessity for the 2016 sidewalk program which is located in the following location :
areas along S. Plum St., S. Cherry St. , S. Walnut St. and S. Mulberry St. between Main St. and Franklin St.; S.
Market St., S. Walnut St. and S. Mulberry St. between E. Franklin St. and E. Canal St.; and the area encompassed
by S. Market St., E. West St., S. Clay St., Ross St., and S. Mulberry St. which include the following streets Young,
Enyeart and Dakota. Packets explaining the City's sidewalk repair program were sent out with response from
property owners requested by May 13 as to how they would like to proceed with repair of their sidewalks. Council's
July 18 agenda will include the legislation authorizing bidding the sidewalk program to include those properties for
which permits were not issued.
Streets to be paved are being coordinated with Vectren Bare Steel/Cast Iron replacement program,
Water/Sewer/Storm necessary improvements, and the age of the existing street. Council authorized bidding this
project. The contract has been awarded to John R. Jurgensen Co. of Springfield. Work is anticipated to occur at the
beginning of August.
ODOT-Let and funded project. Construction began on June 6 with an anticipated completion date on August 20 .
The bridge will remain open but traffic will be modified with half of the bridge closed at a time. Resurfacing of N.
Market St. from Water St. to Staunton Rd. will be completed as part of the redecking project at an 80/20 cost split
(ODOT/City). Council authorized the 20% estimated funding for the project to proceed . Water St. has been closed
from Cherry St. to Walnut St. during construction.

Staff has been working with an outside contractor to make the Engineering electronic/hard copy files organized in
such a way that all staff can have access to most documents. This will improve efficiency with document filing and

personnel files clean-up, and project processes continue. P&Z files are also being organized. Records retention and

Section 3 construction has intermediate asphalt with final grading occurring for house pad elevations. Due to fill
issues, the escrow agreement continues to be evaluated with the developer. The homebuilder, Ryan Homes, has
contacted the City to remedy issues with the escrow agreement. Construction drive maintenance and stormwater
controls maintenance has been requested by the developer due to their current condition. Developer submitted
SM4 plans for review and approval.
Section 8 construction has intermediate course complete and housing development is ongoing. Section 9 is
approved and construction ongoing by C Miller Excavating . Utilities installed and proof rolling is occurring for the
street base.
Section 7 has obtained final course of asphalt, and escrow agreement will be held until final buildout of subdivision .
Section 8 was approved by Council. Construction plan comments have been returned to the developer's design
engineer, and staff is awaiting modifications.
Section 1 underground utilities installation and the initial course of asphalt have been installed. House construction
has begun. Staff has been asked to look into lighting options.
Section 2 awaiting final course of asphalt. The contractor began the punch list and final asphalt is anticipated to
begin in the next couple of months.
A developer has requested approval for a Planned Unit Development (PUD) for a plat of land along McKaig Road
east of Concord Elementa~ School. The Qroposal will be going to Planning Commission.

City of Troy Business Loan Programs are designed as "gap financing" and can help projects that are good,
but do not quite qualify for complete private sector bank financing. Usually, the City of Troy loan will
be subordinated to a primary bank loan. Loan terms can vary to suit a project's financial need. A typical
example is 10% owner equity, 60% bank loan, and a 30% City of Troy loan to fill the gap.
*CDBG loans require prior review/approval by Ohio Development Services Agency's Office of Community
Development. Federal requirements apply, including environmental review, payment of Davis-Bacon
Prevailing Wages for any construction work, and must benefit persons with Low-Moderate Income.
**SBD loans require City of Troy review, only. The program uses no state or federal funds.

NOTES:
1) The Community Development Block Grant Revolving Loan Fund (CDBG) is the oldest business loan program.
The first project in 1990 was the CJ Highmarks Restaurant. The loan must not exceed 50% of the project cost.
State approval is needed before City Council can give final approval. Projects must create at least one new
job per $25,000 loaned and over half of new hires must be from households with Low-Moderate Income. A
Waiver of the job-creation requirement can be sought from the State in some limited circumstances, such as
repair of a deteriorated Downtown Troy building. Federal and State of Ohio CDBG regulations must be
followed, including public notifications, hearings, environmental review, historic review, civil rights, fair
housing, prevailing construction wages, other labor standards, the Uniform Relocation Act, procurement
standards, and other CDBG contract management requirements.
2) The Small Business Development Revolving Loan Fund (SBD) is Troy's newest program. It does not have the
federal and State restrictions that limit the CDBG loan program. It was established in 2007, in response to the
catastrophic collapse of the roof of a building housing small businesses. An SBD loan can be made much faster
than a CDBG loan. The first loans were small and had relatively short terms. The program has since grown
and now can do larger loans (up to the amount of the available balance in the fund) for longer terms.
3) A $250,000 SBD loan to Clopay Building Products has been approved, but is not yet closed.
4) An $850,000 DBR loan to Troy Community Works was approved, with $208,806.90 disbursed. A separate
grant of $30,000 has been obtained from the Ohio Finance Fund for planning and design work. An architect
and an historic tax credit consultant are nearing completion of a renovation plan. Contractors have provided
estimates for roofing and exterior repairs, which alone are expected to cost over $600,000. Application is
being made to the Ohio Finance Fund for additional funding for the project. Construction is expected to begin
after a decision is made by the State Historic Preservation Office regarding possible historic tax credits.
5) A 152,300 SBD loan to Smith's Boathouse Restaurant has been closed, but not yet disbursed.
6) A $26,000 SBD loan to Adventures on the Great Miami has been approved, but is not yet closed.
7) Inquiries also have been made for prospective purchses of some Downtown Troy buildings that have
outstanding City of Troy loans. Although the loans were not written to be assumable, this could be a good
opportunity to influence the future of those buildiongs.

Planning Division Update

I have attached two reports which summarize concerns that are being
addressed by the Planning Division from June 29, 2016 to July 12, 2016.
The first report shows all permits that were issued by the Planning Division.
The report contains the address and type of permit and separates the
information by each ward. There were 41 permits issued during this time
period.
The second report contains the address, type of concern, and a summary of
the current status of on-going issues. Both open and closed concerns are
listed and are separated by each ward.
As in the past, all costs associated with the removal of trash and elimination
of noxious weeds will be invoiced to the property owner. If the property
owner does not pay the invoice, the cost will be assessed to the property
taxes.

photos a woman came out and spoke with me. We discussed the ordinance regarding this and she said that 3 of the dogs were
hers and she did not live there . I explained that no more that 3 could be there at any given time. The owner of the home,
her boyfriend then came out and we all 3 discussed the issue. He said she was there temporarily and would be moving and the
dogs would go with her. I explained that since we spoke in person I would not send a letter but would log this and follow up
in 30 days . He agreed and I will follow up 8-8 - 16.
