Who is Al Imam AI-Shirazi?

-His Honour is Ayatollah AI- Uzma AI-Imam Sayyid Muhammad AI-

Husayni AI-Shirazi.

-His Honor was born in the Holy Najaf of Iraq in 1347 H.

From noble conservative knowledgeable religious family.

-The most memorable persons of his family are Ayatollah AI- Sayyid
AI-Mirza Muhammad Hasan AI-Mujaded AI-Sherazi the leader of (
the tobacco revolution) in Iran.

And Ayatollah AI-Uzma Shikh Muhammad Taqi AI-Sherazi the leader

of (the 1920 revolution) in Iraq from the mother's side.

-His Honour's ancestry is connected to Imam ( Zain AIAbedeen ) Ali

bin AI-Hussein bin Ali bin Abi Taleb ( peace be upon Them).

-His Honour had written about 850 Books in religion, Social, political,
cultural educational and various other subjects of which is the Islamic
laws of Worship and Contracts Encyclopedia which compiles into 130
volumes.

-His honour delegated his life to hunderds of social, religion, cultural ,

educational and humanitarian projects also his honour exerts every

 effort to struggle against the injustice in the world by using anti -
violence and lawful ideology.
-His honour's aim is to lead the Muslims to their honourable dignity ,
by putting the most important question in life (Why did they progress
and why did we retreat)?

In the name of ALLAH, The compassionate, the merciful praise be to

ALLAH, lord of the universe, peace and prayers be upon the final
prophet and messenger Muhammad and his household the immaculate.

No Doubt that ALLAH has put some rules and regulations to be

followed by his creatures to complete the birth cycle.

The process of birth cycle starts with the need for having intercourse
and reaching climax. It is the moment where the strongest sperm wins
the female egg to fertilize.

The pregnancy period starts with the sweet and sorrow time spent
between the child and the mother who will end to a severe struggle
needing to be separated this is what we call labor and child delivery.

This struggle could be a reason for birth control. However soon after
the hugging and Brest milking the announcement of peace process
between child and mother is declared away from the husband's
interference.

This is the Natural chain of birth cycle.

Nowadays man discovered methods to give birth to those who have

difficulties in following the whole chain process, either by grafting or
by cloning.

Being a short cut or by pass to the natural chain, these methods will
certainly face difficulty and shall not achieve perfection otherwise
ALLAH would have selected these mothers for his creatures to follow
for pro-creation.

 On the 15 April 1997 I was honored to visit his eminence Ayatollah
Al-uzma Sayyid Muhammad Al Husayni AL Sherazi at Qum-Iran
where I forwarded to his honor some questions related to cloning of
human being, via the follow ins .pages shall compile and reflect the
views and fatwa's of Ayatollah Al-uzma Sayyid Muhammad Al
Husayni Al Sherazi, may ALLAH bless him.

Clone: A group of organisms or cells of the same genetic constitution

that are descended from a common ancestor by asexual reproduction,
as by cuttings, grafting.

Q1. Is cloning process permitted?

A.I. "cloning process is permitted unless it is unlawful (1) or illegal

like uncontrolled system. (2)
(1) Unlawful to break the legitimate rules which ALLAH put for the
society.

(2) Uncontrolled system: Disturbance of the social position and the

natural system ALLAH had formulated and accepted for the society.

Q2. Whose is the born child?

A.2. "The child will be for both parents if they are alive married
couple, otherwise the child will be doubtful (uncertain).

Note: The doubtful child (uncertain child) inherits from both doubtful
parents, but the illegitimate child does not inherits from both his
adulterous parents.

Both doubtful parents, but the illegitimate child does not inherit from
both his adulterous parents.

Q3. Is it permitted to use a woman's egg and her cell for cloning?

A.3. "As mentioned in A.I."

 Q4. Is cloning process allowed between husband and wife?

A.4. "No harm"

Q5. Is it permitted to graft a woman's cell into another woman's

egg for cloning purpose?

A.5. "Primarily permitted unless unlawful."

Q6 - Is it permitted to graft a strange man's cell into a strange

woman's egg (womb) for cloning purpose?

A.6. "Not permitted ".

Q7. If we took a cell of an illegitimate daughter and we clone it, is

the born girl an illegitimate as well?

A.7. "The child is legitimate (lawful) if born of a marred couple, I.E

illegitimate daughter is married to a man or an legitimate son is
married to a woman, their children are le2itimate ( lawful ) . Also
please see A. 13

Q8. Is the cloned child pure (immaculate)

A.8. "Pure (immaculate)"

Q9. If the father is Sayyid will the cloned son be Sayyid as well?

A.9. "If the father is Sayyid the cloned son will be Sayyid as will"

Q10. If we used the eldest son's cell with his mother's egg their
child will be a transcript of the eldest son. Will the cloned child be:

a- The eldest son's twin?

A. a." As if the son fornicated by mistake with his mother."

The cloned child is her child and the brother of his father _ who is the
eldest son.

 b- Will the child be the eldest son?

A. b· "No."

c- What will be the law of inheritance among the cloned person

and his relatives?

A. c- "Will be as a doubtful child in inheritance. I.E. he will not be an

illegitimate son who does not inherit."

-The illegitimate child does not inherit but his children and the spouse
inherit from him.

- The doubtful child (uncertain child) inherits from both sides of

parents as a lawful child.

Q11. If a man's cell is grafted in his daughter's egg, and the born
child is clone of the man will the cloned child be?

a- The same man?

A11.a_ "No".

b- The man's brother?

A11.b_ "No".

c- The man's grand son?

A11.c_ "It is as if the father fornicates with his daughter by mistake

(without knowing).
_The child will be her son and his grandfather's son.

"As mentioned in Q 10".

Q12. If a man's cell is grafted in his wife's egg will the cloned child
be:

b_ The husband's brother?

A12.b_"No"

c_ The husband's son?

A12.c_ He is the husband's son".

Ql3. If a woman's cell is grafted in her egg, will the cloned child be:

a_ The same woman?

A 13.a_ "No"

b- The woman's sister?

A 13.b_ "No"

c_ The woman' s daughter?

A13.c_ "The child is the woman's daughter."

d_ What is the relationship between the cloned child and the

woman's husband?

A13.d_ "She is his wife's daughter".

Q14. If your honor allow cloning process .is it a must to carry a

marriage contract between a man and a woman?

A14. "Yes, it is a must so the child will be legitimate (lawful) and not
doubtful child (uncertain) "

Q15. If your honor allows cloning process between two women,

would a marriage contract be made between the two women?

 A.15. "No marriage contract possible between two women, also no
marriage contract between two men".

Q16. If the cloning child in your honor's opinion is illegitimate

child, based on which evidence did your honor make that
judgment bearing in mind that the used cells are not sperms nor
from testicles?

A16. "As we said the child is not illegitimate child, we said doubtful
child (uncertain)

Q17. Is it allowed to clone an animal?

Al7." Yes".

Q18. Is it allowed to eat the meat of cloned lawful animal?

Al8. "Yes".

Q19. The evidence of some Muslims to prohibit cloning is surah al

nisa text 119 from the holy Quran where the Satan says ((I will
mislead them and I will create in them false desires:

I will order them to slit the ears of cattle and to deface the (fair)
nature created by Allah. ". Whoever forsaking .Allah takes Satan
for a friend hath of surety suffered a loss hath is manifest.

Al9. "They are some Muslims, not all of them in some explanations it
is interpreted to some acts before Islam".

Q20. If the man's sperm was frozen, is it allowed to be injected into

his wife's womb after his death?

a_ Before the elapsing of the husbands death waiting period for his
wife and what about the heritage?

A20.a_ "Perhaps it is permitted; it appears that the child will inherit if

the heritage was not distributed".

 b- After the elapsing of the husband's death waiting period fot his
wife?

A20.b_ "Not permitted."

"No inheritance".

Q21. If we took a woman's egg and fertilized it with her husband's

sperm then put the fertilized egg into another woman's womb.

a_ is this allowed and lawful?

A21.a_ "Yes, we mentioned it in the rental of womb".

b_ What is the relationship between the pregnant woman and the

child?

A 21.b_" No relationship what so ever"

c- Does the labor of the container (pregnant) woman have any

rights?

A21.c_ " A similar case happened in Ali's (peace be upon him) time"

*A wife had lesbian sex with a virgin who became pregnant.

_The wife was stoned.

_The virgin was whipped.

_The wife was liable for the virgin's dowry.

_The child was related to the owner of the sperm ( the husband) as
well as to the virgin.

Q22. The new science developed a new method called D.N.A. finger
printing tests by which it can relate the person to his tenth ancestor
by examining their. Cells. Is this method permitted to give solid
evidence to prove the doubtful child?

 A.22 "If proved certain then it is permitted as the science is evidence."

Q23. Is it allowed to kill a person who has brain damage (dead

brain) and there is no hope for him to recover?

A.23. "If the person is considered alive then not permitted."

Q24. Is it allowed to use a person who has brain damage (dead

brain) as human spare parts?

A.24. "If not called alive then it is allowed, Also this case can be
considered as a case of importance and a more important case for
example to use some ones kidney for another who need's it."

Q25. Is it permitted for a person who has two different sexual

organs to put his male organ into his female organ?

A.25. "If as intercourse not permitted other wise considered as playing

with himself"

Q26. If that person with the two different organs had intercourse
with himself and became pregnant what will the child be?

A.26. "H suppose the child came from one person then this person is
considered the child's parents".

I.E father and mother.
