SALE, EXCHANGE OR LEASE OF PROPERTY

A. Generally

The sale, exchange or lease of school property must be for the


benefit of the school division and must be consistent with sound
business principles. The School Board does not have the power to
make a gift of school property, except as noted below.

B. Personal (Movable) Property

1. Generally

The school division has the authority to exchange personal


property or lease personal property (as lessor or lessee), or sell
personal property.

The school division shall apply trade-in allowances on equipment


to be replaced against the purchase cost of the new equipment
whenever possible.

The school division may dispose of equipment having no trade-in


value by informal bid, auction or pre-priced sale and consigned for
sale to an auction house or dealer as appropriate to the public. If
items are valued in excess of five hundred dollars ($500), formal
authorization for negotiated sale or for putting the items to bid
shall be obtained from the School Board.

Sales of school division property are governed by the Virginia


Conflict of Interest Act, the Ethics in Public Contracting Act, and
Policy 4.2.

If reasonable attempts through the bidding or direct sales process


to dispose of the items are unsuccessful, then the Superintendent
is authorized to arrange for their disposal.

2. Vehicles

Surplus Vehicles are to be sold by public bidding.

3. Technology Equipment

The school division may donate obsolete educational technology


hardware and software which is being replaced pursuant to the
Virginia technology replacement program. Any such donations
shall be offered to other school divisions, to students as provided
in Board of Education guidelines, and to preschool programs in
the Commonwealth. Any donations of software must be
consistent with the licensing agreements for such software.

Obsolete technology not being replaced in accordance with the


Virginia technology replacement program, may be disposed of
under the general rules of this policy.

C. Real (Immovable) Property

The sale or exchange or lease of property shall be in accordance


with state law. The School Board may convey title to real
property to the Falls Church City Council.

If the School Board determines that it has no use for some of its
real property, it may sell such surplus property after a public
hearing has been held, and may retain all or a portion of the
proceeds upon the approval of the local governing body. In the
event of a sale, a capital improvement fund shall be established
and the proceeds shall accrue to such fund.

As lessee of real property, the School Board may expend funds for
capital repairs and improvements on leased real property, if the
lease is for a term equal to or longer than the useful life of such

repairs or improvements.
