SWORN STATEMENT
Q1. Kindly state your name, address and other personal circumstances.
A1. I am PO3 MAR UMI, a member of Daraga Municipal Police Station with Office address at
Daraga, Albay.
Q2. What is your purpose in executing this Sworn Statement?
A2. I want to testify on matters I personally witnessed during the buy-bust operation that
transpired on January 16, 2015 at about 12:00 AM against the suspect ALDUB YU at
BRTTH Compound, Daraga, Albay.
Q3. Do you know that the person taking your statement is PO3 DOREMI LAYAS of Daraga
Municipal Police Station?
A3. Yes sir.
Q4. Do you swear to tell the truth and nothing but the truth in this statement?
A4. Yes sir.
Q5. Do you understand the consequences of giving this sworn statement and that if later
on it can be proven that you made false statement in your narration, you could be
imprisoned?
A5. Yes sir.
Q6. A while ago, you mentioned that you are a member of Daraga Municipal Police Station,
kindly tell us what is your present position at said Police Station?
A6. I am an Intelligence Operative of Daraga Municipal Police Station sir.
Q7. Since when have you occupied such position?
A7. Since 2011 sir.
Q8. Do you remember having reported to work on October 16, 2015?
A8. Yes sir.
Q9. When you reported to work on said date, do you remember any incident that happened
in relation to this case?
A9. Yes sir.
Q10. What was that incident all about?
A10. There was a buy-bust operation that transpired on said date at around 12:00 AM
against the suspect ALDUB YU at BRTTH Compound, Daraga, Albay.
Q11. How did you know that there was a buy-bust operation that transpired on the said
time, date and place?
A11. Because I personally witnessed it and was part of the team that conducted the buybust operation.
Q12. When and how did you learn that there will be a buy-bust operation?
A12. When i reported to work on January 16, 2015 I was informed by our team leader Police
Superintendent ABNER MAL that there will be a briefing with the Confidential Informant
at our office at 10:00 in the morning and it was there that I learned that there will be a
buy-bust operation and that I will be a part of the team.
Q13. What happened during the briefing?
A13. Police Superintendent ABNER MAL designated me as the arresting officer and PO3
DUTER TY was designated as the poseur Buyer and I was instructed to stay close to PO3
DUTER TY and observed everything that takes place. PO2 KOLAI POLES was also
designated as photographer, while the rest of the team members as back-up and
perimeter security. Likewise, several pieces of paper cut boodle money in bundle
together with a genuine five hundred peso bill (Php500.00) buy-bust money with Serial
No. 14344 placed inside a white long mail envelope was handed to PO3 DUTER TY by

Police Superintendent ABNER MAL and had it photocopied the genuine peso bill and
entered the Serial No. of the bill in Pre-Operational Report.
Q14. What happened next if any?
A14. We were informed that the subject of the operation was a certain ALDUB YU a resident
of Bagtang, Daraga, Albay. Accordingly, the CI who was also a resident of Bagtang,
Daraga, Albay has already arranged a drug transaction for us wherein the subject
person will deliver a shabu worth Php22,000 to us at the BRTTH Compound, Daraga,
Albay at about 12:00 AM of October 16, 2015.
Q15. After that what happened next, if any?
Q15. It was agreed that a pre-arranged signal is that PO3 DUTER TY will give or hand the
white long mail envelope containing the buy-bust money and the paper cut money size
boodle money to the subject to confirm that the sale is consummated.
Q16. What happened then after that?
A16. A Pre-Operational Report and Authority to Operate signed by Police Superintendent
ABNER MAL was accomplished and coordinated to the Operations Division, PDEA ROV.
Q17. What happened after the briefing?
A17. At around 12:00 AM of the said date, we proceeded at the said agreed meeting place
for the transaction and discreetly prepositioned ourselves. While thereat, Police
Superintendent ABNER MAL went to Daraga Municipal Police Station to coordinate with
the Chief of Police of Daraga regarding our operation in the area.
Q18. After that what happened?
A18. I together with the CI and PO3 DUTER TY parked our motorcycles at the BRTTH
Compound, Daraga, Albay at around 11:30 AM and waited for the subject to arrive.
Q19. What happened next if any?
A19. While we were there at the BRTTH Compound, Daraga, Albay, a man in motorcycle
(who was later identified by our CI as ALDUB YU) approached us and told us that Padi,
dara ko na ang item. Magayun ini. Hain na ang kwarta?
Q20. What happened after that?
A20. I saw PO3 DUTER TY showed to him the white long mail envelope containing the buybust money.
Q21. What happened next?
A21. After showing to us the two (2) heat-sealed transparent plastic sachets containing
white crystalline substance and gave the same to me, ALDUB YU asked for the
payment. And after briefly examining the same items (shabu), PO3 DUTER TY gave the
white long mail envelope containing the buy-bust money and the paper cut money size
boddle money to ALDUB YU which the latter count the money.
Q22. What happened after?
A22. Immediately after ALDUB YU about to count the buy-bust money and the paper cut
money size boddle money, PO3 DUTER TY immediatelty uttered Pulis kami! Arestado
ka! (We are Police! You are under arrest!) and instantaneously restrained ALDUB YU
who is then resisting arrest.
Q23. What happened after that?
A23. At the place of incident and in the presence of the suspect himself, PO3 DUTER TY
personally marked the two (2) large heat-sealed transparent plastic sachets containing
white crystalline substance that he bought from ALDUB YU with YBS-1 1/16/15 and YBS2 1/16/15. With this, I apprised the suspect of his constitutional rights in a manner and
language known to him and informed him of the reason of his arrest (Violation of Sec. 5,
Art. II, RA9165 [selling of illegal drugs]). Afterwhich, I conducted search incidental to a
lawful arrest on the suspect. All of which were photographed and properly documented
at the scene by PO2 KOLAI POLES
Q24. What happened after?
A24. We left the scene and conducted inventory and documentation of the items recovered
at the Daraga Municipal Police Station in the presence of the witnesses, two (2) Brgy.
Officials, DOJ-NPS representative and Media Representative and the suspect.

Q25. Who took custody and control of the recovered drug evidence during the buy-bust?
A25. PO3 DUTER TY took custody and control of the two (2) heat-sealed transparent plastic
sachet containing white crystalline substance that I recovered during the buy-bust and
he immediately submitted it to the PNP Crime Laboratory Office for Laboratory
Examination which later on yielded positive result for the presence of
Methamphetamine Hydrochloride otherwise known as shabu.
Q26. Who took custody and control of the confiscated non-drug evidence?
A26. I took custody and control of the white long mail envelope containing the buy-bust
money and the paper cut money size boodle money which was recovered on the scene.
Please include also the non-drug items recovered from the suspects.
Q27. Is there anything else you wish to tell in this statement?
A27. For the mean time there is none.
