o f the W ork; (2) the means, methods, techniques, sequences, and procedures of
construction to be em ployed by Bidder; and (3) Bidder's safety precautions and programs.

Bidder agrees, based on the inform ation and observations referred to in th e preceding
paragraph, th a t no fu rth e r examinations, investigations, explorations, tests, studies, or data
are necessary fo r the determ ination o f this Bid fo r perform ance of the W ork at th e price bid
and w ith in the tim es required, and in accordance w ith th e o ther term s and conditions of
the Bidding Documents.

Bidder is aware o f the general nature o f w ork to be perform ed by Owner and others at the
Site th a t relates to th e W ork as indicated in the Bidding Documents.

The submission o f this Bid constitutes an incontrovertible representation by Bidder th a t


Bidder has com plied w ith every requirem ent of this Article, and th a t w ith o u t exception the
Bid and all prices in th e Bid are premised upon perform ing and furnishing the W ork
required by the Bidding Documents.

ARTICLE 4 - BIDDER'S CERTIFICATION

4.01

Bidder certifies tha t:


A.

This Bid is genuine and not made in the interest o f or on behalf o f any undisclosed
individual or e n tity and is not subm itted in conform ity w ith any collusive agreem ent or
rules o f any group, association, organization, or corporation;

B.

Bidder has not directly or indirectly induced or solicited any other Bidder to subm it a false
or sham Bid;

C.

Bidder has not solicited or induced any individual or e n tity to refrain from bidding; and

D.

Bidder has not engaged in corrupt, fraudulent, collusive, or coercive practices in competing
fo r the Contract. For the purposes o f this Paragraph 4.01.D:
1.

"co rru p t practice" means the offering, giving, receiving, or soliciting of any thing of
value likely to influence the action o f a public official in the bidding process;

2.

"frau d ule nt practice" means an intentional m isrepresentation of facts made (a) to


influence the bidding process to the d e trim ent o f Owner, (b) to establish bid prices at
artificial non-com petitive levels, or (c) to deprive Owner o f th e benefits o f free and
open com petition;

3.

"collusive practice" means a scheme or arrangem ent between tw o or m ore Bidders,


w ith or w ith o u t the knowledge o f Owner, a purpose o f which is to establish bid prices
at artificial, non-com petitive levels; and

4.

"coercive practice" means harming or threatening to harm, directly or indirectly,


persons or th e ir property to influence th e ir participation in th e bidding process or
affect the execution o f th e Contract.

ARTICLE 6 - TIME OF COMPLETION


6.01

Bidder agrees th a t the W ork w ill be substantially com plete w ith in 1,020 consecutive calendar
days after th e date when the Contract Times commence to run as provided in Paragraph 2.03 of
the General Conditions, and w ill be com pleted and ready fo r final paym ent in accordance w ith
Paragraph 14.07 o f the General Conditions w ith in 1,095 consecutive calendar days a fte r the
date when th e Contract Times commence to run.

6.02

Bidder accepts the provisions o f th e Agreem ent as to liquidated damages.

The fo llow in g M ajor Equipment & Supplier Table designates items which shall be identified by the
Bidder upon subm ittal o f Bid.
1.

The Bidder m ust circle one (1) named supplier fo r each item listed in the table. The named
supplier circled fo r each equipm ent item w ill identify whose equipm ent is included in the
Bidder's Lump Sum Bid Price and whose equipm ent w ill be supplied by th e Bidder during
construction. If no supplier is circled fo r any equipm ent item , th e Owner w ill choose the named
m anufacturer whose equipm ent w ill be supplied by the Bidder at no adjustm ent o f the Bidder's
Lump Sum Bid Price.

2.

O wner acceptance o f equipm ent supplied by a named m anufacturer or supplier does not
constitute a w aiver o f the Specifications.

3.

Equipment by a m anufacturer or supplier not named in the referenced equipm ent specification
w ill be considered fo r equivalence to the Acceptable M anufacturer(s) listed in the referenced
equipm ent specification during the bid period only in accordance w ith Article 11 o f the
Instructions to Bidders. A non-named m anufacturer shall dem onstrate fu ll compliance w ith the
specifications in all aspects including form , features, construction materials, O&M cost,
mechanical and control functionality, perform ance reliability, quality, and general configuration.

Failure to include all listed inform ation w ith the subm ittal shall result in a determ ination th a t the
non-named equipm ent m anufacturer is not considered "o r equal" and, therefore, not
acceptable.

5.

The Engineer and O wner w ill determ ine if the non-named m anufacturer's equipm ent w ill be
added as a named m anufacturer ("or equal") in the referenced equipm ent specification. Final
determ ination is at the sole discretion o f the Engineer and Owner, and w ill occur prior to the Bid
opening. There w ill be no process to appeal this determ ination.

If th e Engineer and Owner determ ine th a t any non-named m anufacturer is considered


equivalent ("or-equal") to the named manufacturer(s), the referenced equipm ent specification
w ill be revised by Addendum to include additional named manufacturers. However, addition of
a m anufacturer by addendum shall not relieve the Bidder of full responsibility fo r any facility
redesign or other costs required to install the equipm ent. The m anufacture r/ supplier and
Bidder shall com ply w ith the fo llo w ing during construction:

M anufacturer/S upplier shall include in his quote to potential Bidders all additional
construction costs (mechanical, architectural, structural, electrical, and engineering
redesign costs) associated w ith the proposed equipm ent. The Bid shall also include all
paid licenses necessary fo r the use o f th e proposed equipm ent, if required by the
m anufacturer.

b.

Any redesign associated w ith th e proposed equipm ent shall be prepared by the
Engineer. Reimbursement fo r engineering redesign shall be based on the Engineer's raw
salary costs tim es a m u ltip lie r o f 3.15 plus any direct, non-labor expenses such as travel,
per diem, or reproduction services. The Owner w ill bill th e C ontractor m onthly based on
the Engineer's invoice to the Owner. The Contractor shall reimburse the Owner, who
w ill in tu rn reim burse the Engineer, w ith in 30 days of receipt of the Owner's billing.
N on-paym ent w ith in 30 days shall constitute grounds fo r the Owner to w ithhold partial
paym ent to Contractor.

c.

Bidder agrees th a t delays caused by redesign necessary fo r the proposed equipm ent
shall not constitute grounds fo r a contract m odification, change order, claim, or contract
tim e extension.

The M ajor Equipment Table is provided w ith blank spaces fo r an "o r equal" equipm ent item
approved by the Engineer and named via addendum during the Bid period, in accordance w ith
Article 11 o f th e Instructions to Bidders.

A.

The above is a suggested form for the Financial Statement, and the Bidder is not
required to follow the form explicitly. The Financial Statement submitted must clearly
show to the satisfaction of the Owner the Bidders current financial condition. The Owner
reserves the privilege of requiring additional information as to financial responsibility of
the Bidder prior to awarding Contract.
