RESOLUTION NO.

R97-07-39
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HOMESTEAD, DADE COUNTY, FLORIDA, AMENDING THE
PERSONNEL RULES OF THE CITY OF HOMESTEAD BY
ADOPTING A POLICY CONCERNING NEPOTISM.
WHEREAS, as authorized by Ordinance 97-07-20 of the City of Homestead; and
WHEREAS, Ordinance 97-07-20 authorizes the adoption of policies to amend the
personnel rules by Resolution; and
WHEREAS, the City Council of the City of Homestead wishes to adopt a policy
on Job Announcements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF HOMESTEAD, FLORIDA:
SECTION 1. That the following policy on Nepotism which is attached hereto and
made a part hereof and marked Exhibit A is hereby adopted as a policy of the City of Homestead
concerning the personnel rules of the City of Homestead.
SECTION 2. That all policies presently in effect in the City of Homestead
inconsistent or in conflict with the policy being adopted pursuant to this Resolution be, and the
same are hereby, repealed and rescinded.

Policy Statement #

NEPOTISM
In accordance with Florida Statutes Section 112.3135, a public official may not appoint, employ,
promote, or advance, or advocate for appointment, employment, promotion, or advancement of a
relative in or to a position in the City in which he or she is sending or over which he or she exercises
jurisdiction or control any individual who is a relative of the public official. Nor may an individual be
appointed, employed, promoted, or advanced in or to a position in the City if it has has been
advocated by a public official serving in or exercising jurisdiction or control over the City, who is a
relative of the individual or if such appointment, employment, promotion, or advancement is made by
a collegial body, of which a relative of the individual is a member.
In addition, to prevent the possibility or appearance of alleged or actual favoritism by one family
member toward another member of that same family, the City prohibits relatives from working in the
same department. Relatives are defined as a father, mother, son, daughter, brother, sister, uncle, aunt,
first cousin, nephew, niece, husband, wife, father-in-law, mother-in-law, son-in-law, daughter-in-law,
brother-in-law, sister-in-law, stepfather, stepmother, stepson, stepdaughter, stepbrother, stepsister,
half brother, or half sister.
