FACTS OF THE CASE;


Investigation conducted showed that on or about 08:00 am of June
11,2015 ,along no.23 apartment, Matamis St. Brgy. Payapa, San Juan City. The Land
Lady identified as Mrs. Vina Morales nee Magdayao, 40 yrs. Old, married, Native of
Leyte, Land lady of the apartment, presently residing at the said address, Reported
certain activities of the suspect where the room rented, curtains and windows are
always closed. The suspect also carry large boxes every time he went out of his room
and large boxes were carried into a vehicle. On her observation she noticed that the
room rented was made up to became a clandestine laboratory and the suspect was
delivering a drug paraphernalia. Upon knowing this, she immediately reported to this
station Filed and Complaint.

AFFIDAVIT OF INVESTIGATOR
I, SPO2 DAVIE F. MAZO, legal age, member of the Philippine National Police
and presently assigned at Station Anti-Illegal Drugs Special Operation Unit, San Juan
Police Station, San Juan City. After having been duty sworn to in accordance with the
law to hereby depose and states to following to it.
THAT, I am bonafide member of the Station of Anti-Illegal Drugs Special
Operation Unit, San Juan Police Station, San Juan presently assigned as investigator of
the Station Investigation and Detective Management Branch with the four of duty
commencing from (7:00am to 7:00pm) daily.
THAT, On or about 9:00am of June 17, 2015 SPO1 Sam Milby and SPO1 Piolo
Pascual both member of Station Anti-Illegal Drugs Special Operation Unit, San Juan
Police Station, San Juan City, this station referred to me the living of one Mr. Ronald
Cruz y Corpuz 42years old, married, jobless, native of Bicol and presently residing at
No.12 Matamis St. Brgy Papaya apartment, San Juan City, together with the
confiscated pieces of evidence such as,
Three (3) pcs of Fomenters Marked RCC/JBB dated 06-17-15 mark as A-1
thru, A-3 Two (2) pcs of Separator Funnel Marked RCC/JBB dated 06-17-15 mark as
A-4 to A5 One (1) pc Flask Marked RCC/JBB dated 06-17-15 mark as A-6, One (1)
pc of Heating Mantel Marked RCC/JBB dated 06-17-15 mark as A-7 One (1) pc of
Gas Generator Marked RCC/JBB dated 06-17-15 mark as A-8, One Toyota Fortuner

THAT, above named arrested suspect was apprehended by the herein officer for
violation of Article II, Sec 10 of Republic Act 9165 known as (Comprehensive
Dangerous Drugs Act of 2002) identified as one Ronald Cruz y Corpuz 42years old,
married, jobless, native of Bicol and presently residing at No.12 Matamis St. Brgy.
Papaya Apartment, San Juan City.
THAT, Afore cited laboratory equipment used to deliver for manufacturing,
production, processed, preparation of dangerous drugs were all brought to the PNP
Crime Laboratory Office for technical examination and yielded a Positive Result for
the presence of Methamphetamine Hydrochloride,
Together with the urine sample taken from the arrested suspect was submitted to
the same office for Screening examination. And yielded Positive Result to the
presence of methamphetamine hydrochloride.
Which were confiscated during the raid operation and appraised his constitutional
rights in front of Brgy. Chairman Angel Locsin who witness the raid operation,
THAT , based on the aforesaid result the name arrested suspect were charged
for the violation of Sec.10 (Manufacture or Delivery of Drug Paraphernalia) and
Sec.15 (Used of Illegal Dugs) Article II of R.A.9165 otherwise known as
( Comprehensive Dangerous Drugs Act of 2002), before the office of prosecutor;

2.In connection with the above cited reference, please be informed that on or
about June 17,2015, This office conducted an Anti- dangerous drug operation (Raid with
Search warrant no.008 issued by Judge Lea Salonga of RTC branch 156 City of San
Juan ) At No.12 apartment Matamis St.BRGY.Payapa , San Juan City owned by Mrs.
Vina Morales nee Magdayao, 40 yrs.old married, landlady of the apartment, native of
Leyte, The Warrant has been served and warrable to seized the following such as;
1. Three(3) pcs. Of fomenters marked RCC/JBB dated 06-17-15 mark as A-1
thru A-3.
2.Two(2) pcs. Of separator funnel marked RCC/JBB dated 06-17-15 marked
asA-4,to A-5
3. One (1) pc of flask marked RCC//BB Dated 06-17-15 mark as A6
4. One (1) pc of Heating Mantel marked RCC/BB Dated 06-17-15 mark as A7

3. Initial investigation conducted showed that on or about 8:00 am of June 11
2015 a concerned citizen identified as Vina Morales nee Magdayao 40 years old,
married, land lady of an apartment and presently residing at No. 12 Matamis St. Brgy
Payapa apartment San Juan City. Reported her new boarder identified as Ronald Cruz
y Corpuz 42 years old, married, jobless, Native of Bicol and presently residing at No. 13
Matamis St. Brgy Payapa apartment San Juan City.
Reported certain activities of the suspect where the room rented, curtains and
windows are always closed. The suspect also carry large boxes every time he went
out of his room and large boxes were carried into a vehicle. On her observation she
noticed that the room rented was made up to became a clandestine laboratory and the
suspect was delivering a drug paraphernalia. Upon knowing this, she immediately
reported to this station Filed and Complaint regarding this serious matters.
Operatives of San Juan Police Station conducted a surveillance lead by SPO11 DAVIE
MAZO and yielded a positive results. PCI Mike Tan instructed SPO2 Davie Mazo to

make application for search warrant No. 008 against Ronald Cruz y Corpuz for
Violation of Sec.10 of R.A. No. 9165. Before implementation of search warrant ,this
station coordinated with the (PDEA) and barangay officials concerned which resulted to
the seized of the following equipment's forwarded to PNP Crime Laboratory Office for
Examination.

2. In connection with the above cited subject and reference, please be informed that on
or about 8:00am of June 11 2015, this office conducted an anti dangerous drugs
operation (Raid with Search Warrant no. 008 issued by judge Lea Salonga of RTC
branch 156). At No 23 Matamis St. Brgy Payapa Apartment, San Juan City, Owned by
Vina Morales nee Magdayao. 40 years old, land Lady of an apartment, native of Leyte
and presently residing at No.12 Matamis St. Brngy Payapa Apaertment San juan City.
The warrant has been served and was able to seized the ff.
Fomenters, Separatory Funnel, Flask Heating Mantel and Gas Generator and
Vehicle. There was subsequently forwarded to Crime Laboratory Office for technical
examination.
3. . In initial investigation conducted showed that on or about 8:30 am of June 11
2015 a concerned citizen identified as Vina Morales nee Magdayao 40 years old,
married, land lady of an apartment and presently residing at No. 12 Matamis St. Brgy
Payapa apartment San Juan City. Reported her new boarder identified as Ronald Cruz
y Corpuz 42 years old, married, jobless, Native of Bicol and presently residing at No. 13

4. That based on the aforesaid result, Violation of No. 9165 (Comprehensive


Dangerous Drug Act of 2002) Sec 10 (Manufacture or Delivery of Paraphernalia) and
Sec.15 (Used of Illegal Drugs) were charge against Ronald Cruz y Corpuz, 42 years
old, married, jobless, native of Bicol and presently residing at No.23 Matamis St. Brgy
Payapa Apartment, San Juan City, thus the suspects are now detained at the City Jail of
San Juan.
