Chancellor and SBHE MembersAfter further study over the past two days, I've learned much more about this matter. My initial understanding of the
situation, as it was described to me, was not accurate.
Although I grasp the direction and ultimate goals of our Athletic Department regarding this matter, their process was
flawed to a level that requires an immediate revocation of the media policy pending further study. If and when a new
plan is created, it will be fully vetted with the University community including myself (none of which had taken place in
advance of announcing the media policy). The Athletic Director is in full agreement with the above path forward. NDSU
is in the process of issuing the attached press release.

North Dakota State University President Dean L. Bresciani today directed the athletics department to
rescind media guidelines issued last Friday.
President Bresciani was not informed in advance of the release of the guidelines. "I was profoundly
disappointed when I learned the facts about this issue. This is not the way NDSU treats local
journalists and our many loyal fans who value the breadth of news coverage NDSU enjoys. As the
state's land grant university, our commitment is to access and inclusion in all endeavors."
Athletic Director Matt Larsen has apologized for the impact on the institution. "I erred in not bringing
these ideas forward for the president's review, and I regret the damage this has caused to the
administration, institution and university community," Larsen said.
Larsen will be contacting media outlets to ensure working journalists are welcome and appreciated at
athletic events and on the NDSU campus.

Clarification of Expectations

MattAlthough we've discussed the current concern to exhaustion, and in particular the principles on which my concerns are
based, I thought it best to formally confirm the expectations we discussed so as to avoid something like the current
situation being repeated in the future.
1)
As Athletic Department policies with any public and/or reputational implications for the Athletic Department,
NDSU or related agencies or affiliates are developed and readied for announcement and implementation, they
will be vetted with relevant campus/campus community constituencies, and in particular the Office of the
President.
2)
You and I will continue to meet in person, on a regular and frequent basis, so that I remain up to speed on
Athletic Department activities, plans, and initiatives planned or underway.
3)
We will continue to evaluate and always assure that you and I remain in agreement regarding the role, impact,
and integration of the Athletic Department's activities and programs are a complimentary part of the vibrant
campus and external campus community we enjoy.
Thank you for your welcome and openness to the above. Your expressed good intentions toward the best interests of
NDSU has been greatly appreciated and is a compliment to your professionalism.

Please indicate what the impact will be of the cut. In student affairs case, e.g. processing of student
requests will be slowed, less students will be able to use the service, etc. For athletics, deferred
maintenance will accumulate, equipment normally replaced on a standard timeline will be used past
its intended lifespan, ticket processing will be slowed, etc.

As I mentioned, Ill need an itemized list of what you would propose your cuts are leading to a 15%
savings of appropriated dollars at the levels we discussed. The list needs to be down to the level of
position category but not someones title or name. For the times falling in the 10-15% range please
put them in your priority order so that if we dont have to do a full 15% (or have any discretion on
where to draw the line), we can do so in an informed manner.
NDSU needs to assemble all these (for all divisions of the campus) in mid-June, so the need to
hammer it out is pretty immediate. If you can get it done in a week Ill buy you a beer but at most it
must be done in two weeks; sorry for the short timeline.

Kachine Alexander's departure from the women's basketball staff. This is magnified by the current search
we have in process to replace Patrick Harrison. Given the critical recruiting period the next month

mature and bright young man. I always remembered as a young administrator people that
would go out of their way to spend time, talk about the profession, etc. hopefully I was able to
pay it forward.

I took Logan and a friend to bfast his last day and he made it clear that USC would have
never exposed him to what he experienced here. He thought it would be given some
work and tasksand told me he almost ended up feeling guilty about not DOING
anythingbut rather LEARNING abouteverything. He was blown away by what he
was exposed to and had access to. And then theres the car loan thing. Im betting

Dean,
I hope all is well and that you are having a great summer! Are you doing anything
fun over the summer? I know that NDSU keeps you pretty busy.
I have been well as I graduated from NDSU this past May with honors. It was
great to see a familiar face as I walked across the stage. That is a great milestone
that I will always cherish. Thank you for helping me get in touch with some
people at Texas A&M. Even though they did not have any openings I cannot
express how much I appreciated it. Although, I am proud to announce that I am
currently getting ready to moving to Wyoming as I have accepted a football
operations position at UW under Coach Bohl. I am also engaged so have been
busy wedding planning. We are getting married next May so we are right under a
year out. I also have been accepted into Liberty Universities online MBA program
so I'm excited about that. I'm also looking for ways to improve and better myself.
Thank you for everything that you did for me while I was at NDSU, I really
appreciated it. I hope to have the opportunity to work with you again someday
and I look forward to hear back from you.

No real issues from my end. My only question is it mentions periodic reviews. Would they be internal or external?? My
guess is the institution would review their policies periodically, etc to make sure hiring and recruitment practices are in

NCAA Presidential Pledge
On January 19, 2016, the Board of Governors of the National Collegiate Athletic Association approved a
resolution reaffirming the Association's commitment to establish and maintain an inclusive culture that fosters
equitable participation for student-athletes and career opportunities for coaches and administrators. The Board of
Governors recognized a growing concern with the low representation of racially and ethnically diverse individuals
and women in coaching and athletics administration at all levels.
To address the objectives as set forth in the resolution, the Board of Governors acknowledged the importance of
presidential leadership and appointed an ad hoc committee comprised mostly of presidents and chancellors to
identify strategies and initiatives whereby the Association is encouraged to create more diverse and inclusive
cultures. To that end, the NCAA Board of Governors Ad Hoc Committee to Promote Cultural Diversity and Equity
has recommended the adoption of a presidential pledge of commitment whereby presidents and chancellors will
demonstrate their support for increasing diversity through improved pipeline development and targeted hiring
practices on their respective campuses. Please see this draft copy of the presidential pledge.
We plan to request the adoption of this pledge at the Board of Governors meeting in August. Therefore, please
provide any feedback you might have to Bernard Franklin, executive vice president of education and community
engagement/chief inclusion officer, by Friday, June 24. You can send your feedback to bfranklin@ncaa.org.
We should note that the draft presidential pledge has been presented to the NCAA Division I Board of Directors
and NCAA Divisions II and III Presidents Councils during their April 2016 governance meetings, and there was
widespread support for moving the pledge toward ratification.

associations to provide to the Settlement Administrator (Gilardi) the names and last-known contact information of potential
Settlement Class Members. If a school or alumni association does not voluntarily provide this information, Class
Counsel may need to pursue other means, including issuing a subpoena, to get the required information. Once we
obtain this information, the Settlement Administrator will mail the Settlement Notice to potential Settlement Class Members.
For purposes of the notice process, there is a website for you to provide the required information. Additional technical details
on the process are at the end of this memorandum and in the separate attached instructions document. The instructions can

While Excel is a common format for most institutions, and the default Census form is in Excel format,
you may already have this data in another tabular format, like Microsoft Access or a tab delimited text
file, and you may submit your data in this tabular format, being sure to adhere to the below Data
Submission Guidelines.
Excel
The file should contain one sheet per dataset. If the number of records exceeds the capacity of the
Excel sheet (too many records) such that the records would need to be split among two or more sheets,
another file format, such as an Access table, should be considered. The file should not include any
unnecessary data or objects, such as images, VBA code, forms, etc. The data should not contain
control characters such as carriage return, line feed, tab, etc.
Numeric values should be actual values and not formula or calculation results. Date values should be
formatted as MM/DD/YYYY.
Delimited Text
The file should be a tab or pipe-delimited format with double-quote text identifiers. Comma separated
files can only be accepted with double-quote text identifiers. Date values should be formatted as
MM/DD/YYYY.

REQUEST FOR ASSISTANCE
Essentially, the member schools (and if necessary their alumni associations) will upload the names and last-known contact
information of Settlement Class Members, who are current and former student-athletes, onto a confidential website created by
the Court-appointed Settlement Administrator, Gilardi & Co. Gilardi will work with the schools and alumni associations to
make the process as efficient and flexible as possible, taking into account the varying data capabilities and protocols of the
schools and alumni associations. The process for getting the names of potential class members and for providing the lastknown contact information is described in the instructions at the end of this memorandum.
The Proposed Settlement
The Settlement Class is defined in the Settlement Agreement as follows: All Persons who played an NCAA-sanctioned sport
at an NCAA member institution on or prior to the Preliminary Approval Date. The "Preliminary Approval Date" means the
date the Preliminary Approval Order was entered by the Court, namely July 15, 2016.

Colleagues,
I have a few items about state budget issues to share with you:
As I have reported to you over the past months, our solutions to a one-time budget cut required by
the state (commonly referred to as the allotment) are in place. Because of the past six years of
careful financial management, we are managing this one-time adjustment without undue duress.
Please know that the possibility exists for another state-mandated one-time cut later this year. If
that occurs, we will keep you apprised of how it will be handled.
In preparing for the next biennium, the governor directed us to plan for a 10 percent decrease in
state funding. Because we anticipated this possibility, I asked Provost Ingram earlier this year to lead
a budget study group that submitted its final report last week. Simply put, the work of the group is
outstanding. I dont believe such a thoughtful, dispassionate, intelligent and strategic product could
have been produced in any other institution where Ive worked. Our early anticipation of a potential
budgetary challenge for the state, the framework provided by the Strategic Plan, and the work of the
study group over the past few months, provided for an inclusive and thorough outcome. The group
recommended that smaller work groups be organized to further develop various items, and I have
agreed.
More immediately, I directed non-academic units to prepare 10 and 15 percent reductions to their
budgets. We are also announcing a Voluntary Separation Incentive Program. Details will be
distributed via a subsequent message later this week from Provost Ingram and Vice President
Bollinger.
Thank you to all who have so generously collaborated to address these issues. Together, we will
ensure that NDSU continues to serve our states needs, and will be even stronger in the future for
having planned and executed with discipline and foresight.

Although weve discussed the current concern to exhaustion, and in particular the principles on
which my concerns are based, I thought it best to formally confirm the expectations we discussed so
as to avoid something like the current situation being repeated in the future.
1) As Athletic Department policies with any public and/or reputational implications for the
Athletic Department, NDSU or related agencies or affiliates are developed and readied for
announcement and implementation, they will be vetted with relevant campus/campus
community constituencies, and in particular the Office of the President.
2) You and I will continue to meet in person, on a regular and frequent basis, so that I remain
up to speed on Athletic Department activities, plans, and initiatives planned or underway.
3) We will continue to evaluate and always assure that you and I remain in agreement
regarding the role, impact, and integration of the Athletic Departments activities and
programs are a complimentary part of the vibrant campus and external campus community
we enjoy.

Chair Neset and Chancellor HagerottI would like to invite the SBHE to hold their Oct. 27 meeting in Fargo. On that day we will be
holding the Grand Opening dedication event for NDSU's Sanford Health Athletic Complex.
As you may know, when completed, the Complex will represent the largest collection of
proximal athletic facilities not only in the state but region. The economic implications for
North Dakota are significant.
Given the statewide asset which the Complex represents, I anticipate attendees will include a
large number of state business leaders, federal and state legislators, and an otherwise notable
list of attendees. Having the SBHE members there would be an honor for us, and I believe it
would also offer the SBHE some very positive public visibility.
We've taken the liberty to confirm that meeting space is available, and we would of course
also look forward to hosting a Board reception the evening before.

I took Logan and a friend to bfast his last day and he made it clear that USC would have never
exposed him to what he experienced here. He thought it would be given some work and tasks

NCAA Presidential Pledge
On January 19, 2016, the Board of Governors of the National Collegiate Athletic Association approved a
resolution reaffirming the Association's commitment to establish and maintain an inclusive culture that fosters
equitable participation for student-athletes and career opportunities for coaches and administrators. The Board of
Governors recognized a growing concern with the low representation of racially and ethnically diverse individuals
and women in coaching and athletics administration at all levels.
To address the objectives as set forth in the resolution, the Board of Governors acknowledged the importance of
presidential leadership and appointed an ad hoc committee comprised mostly of presidents and chancellors to
identify strategies and initiatives whereby the Association is encouraged to create more diverse and inclusive
cultures. To that end, the NCAA Board of Governors Ad Hoc Committee to Promote Cultural Diversity and Equity
has recommended the adoption of a presidential pledge of commitment whereby presidents and chancellors will
demonstrate their support for increasing diversity through improved pipeline development and targeted hiring
practices on their respective campuses. Please see this draft copy of the presidential pledge.
We plan to request the adoption of this pledge at the Board of Governors meeting in August. Therefore, please
provide any feedback you might have to Bernard Franklin, executive vice president of education and community
engagement/chief inclusion officer, by Friday, June 24. You can send your feedback to bfranklin@ncaa.org.
We should note that the draft presidential pledge has been presented to the NCAA Division I Board of Directors
and NCAA Divisions II and III Presidents Councils during their April 2016 governance meetings, and there was
widespread support for moving the pledge toward ratification.

I thought it respectful to let you know that my son was a former employee of your university and has
not received all of his wages according to the agreed upon contract from your athletics department.
Derek St. John entered into an employment agreement as an assistant wrestling coach in the
summer of 2014. He negotiated this contract with Coach Kish and Athletic Director, Matt Larson.
Once Derek did not resign his contract for the 2015_2016 wrestling season he did not receive the
remainder of payments due to him. This work included his work in helping your university facilitate
the National Greco and Freestyle Tournament. Derek has sought help of a lawyer to request
payment from Matt Larsen and the athletic department with no response. The amount due to him is
$9000.00.
I am writing to let you know we are prepared to pursue a Congressional complaint and/or go to the
local media in pursuit of payment for the remainder of the wages due to him. Please let me know if
you would like an opportunity to review the documents and resolve this complaint prior to waging a
formal complaint.

As noted, adequate notice to the Settlement Class is essential to securing the benefits and protections of the proposed
settlement for the NCAA and your schools and conferences.
Under the Court's July 15, 2016 Order, the NCAA is required to ask its member institutions and their affiliated alumni
associations to provide to the Settlement Administrator (Gilardi) the names and last-known contact information of potential
Settlement Class Members. If a school or alumni association does not voluntarily provide this information, Class
Counsel may need to pursue other means, including issuing a subpoena, to get the required information. Once we
obtain this information, the Settlement Administrator will mail the Settlement Notice to potential Settlement Class Members.
For purposes of the notice process, there is a website for you to provide the required information. Additional technical details
on the process are at the end of this memorandum and in the separate attached instructions document. The instructions can
also be found on Gilardi's webpage here:

NDSU Director of Athletics. For even me to dip down to this level of discourse would in my
experience be ill-advised. You will open a door of unimaginable proportions if individuals like this
receive a response.

I have been well as I graduated from NDSU this past May with honors. It was great to see a

SUBJECT:
NCAA Presidential Pledge
On January 19, 2016, the Board of Governors of the National Collegiate Athletic Association approved a
resolution reaffirming the Association's commitment to establish and maintain an inclusive culture that fosters
equitable participation for student-athletes and career opportunities for coaches and administrators. The Board of
Governors recognized a growing concern with the low representation of racially and ethnically diverse individuals
and women in coaching and athletics administration at all levels.
To address the objectives as set forth in the resolution, the Board of Governors acknowledged the importance of
presidential leadership and appointed an ad hoc committee comprised mostly of presidents and chancellors to
identify strategies and initiatives whereby the Association is encouraged to create more diverse and inclusive
cultures. To that end, the NCAA Board of Governors Ad Hoc Committee to Promote Cultural Diversity and Equity
has recommended the adoption of a presidential pledge of commitment whereby presidents and chancellors will
demonstrate their support for increasing diversity through improved pipeline development and targeted hiring
practices on their respective campuses. Please see this draft copy of the presidential pledge.
We plan to request the adoption of this pledge at the Board of Governors meeting in August. Therefore, please
provide any feedback you might have to Bernard Franklin, executive vice president of education and community
engagement/chief inclusion officer, by Friday, June 24. You can send your feedback to bfranklin@ncaa.org.
We should note that the draft presidential pledge has been presented to the NCAA Division I Board of Directors
and NCAA Divisions II and III Presidents Councils during their April 2016 governance meetings, and there was
widespread support for moving the pledge toward ratification.

(5) state, (6) zip code, (7) e-mail address(es), and (8) telephone number(s). If you do not have information for a particular
field, you may leave it blank, but we ask that you provide as much information as possible.
We ask that you provide the required information as soon as possible, but in any event,no later than September 15,

With the recent hiring of Jamie Trachsel at Iowa State and her subsequent hiring of current NDSU pitching
coach, Brynne Dordel, I am requesting a hiring exemption from the normal HR procedures in posting these
two coaching vacancies. July is a critical recruiting period for the softball program and to be down two
coaches during this time is not ideal. Our goal is to get the staff filled by early July to allow the full staff to
