DEFINITIONS FOR THE PURPOSE OF THE SLS, PUNE INTERNAL ELIMINATIONS:

The following terms have the corresponding meanings:

1.1 "ADMINISTRATORS" means the Moot Court Association (herein after referred to as
MCA) of Symbiosis Law School, Pune (herein referred to as SLS, Pune) and/or
any other person(s) appointed to administer the SLS, Pune Internal Elimination
(hereinafter referred to as Internal Elimination).
1.2

COURT MASTER means the student appointed by the Moot Court Association for
conducting the affairs of the court room.

1.3 DISQUALIFICATION means that the Participant will not be allowed to participate in
the Internal Elimination, and could be banned to participate in any future Mooting
Activities organised by Moot Court Association of Symbiosis Law School, Pune.
1.4 JUDGE means any person appointed to evaluate a participants Memorial or Oral
Pleadings or Researchers Test as the context maybe.
1.5 "MEMORIAL" means the written submission of arguments and ancillary pages by each
participant, submitted in pursuant to the Rules.
1.6 "MOOT PROPOSITION" means the official problem of the Internal Elimination
supplemented by any Problem clarifications or corrections as published by the
Administrators.
1.7 "PENALTIES" means Raw Points deducted for any Rule violation pursuant to Rule 12.
1.8 "PROBLEM CLARIFICATIONS" means the official clarifications of the Moot
Proposition, as published by the Administrators.
1.9 "PARTICIPANTS" means an eligible student recognized by the Moot Court Association
who participates in the Internal Elimination, pursuant to Rule 2.

1.10 "RULES" means the Official Rules of the Internal Elimination and any applicable
Supplementary Rules notified pursuant to Moot Court Association Policy 2016-17.
1.11 SUPPLEMENTARY RULES means additional rules or clarifications applicable to the
Participants subsequently notified by the Moot Court Association.

1. ORGANISATION OF THE INTERNAL ELIMINATION


1.1. ADMINISTRATION
This Internal Elimination is conducted by the MCA of SLS, Pune to select the participants
that represent the college in various national and international moot competitions. All
materials developed by SLS, Pune for the Internal Elimination, including, without limitation,
the Official Rules, the Internal Elimination Problem, and the Problem Clarifications, are the
sole property of SLS, Pune and must not be reproduced for any purpose other than
participation in or administration of the Internal Elimination without the express and prior
written consent of the MCA. In addition, all Memorials become the sole property of SLS,
Pune and the MCA reserves to right to hand it over to any student representing the College in
any Moot Court Competition. The copyright for the same will subsist with SLS, Pune.

1.2. INTERPRETATION OF RULES


The Moot Court Faculty in-charge shall serve as the final arbiter of the implementation and
interpretation of these Rules and of any Supplementary Rules. MCA reserves the right to
amend or supplement any rule.

2.1. Participant Eligibility

LL.B. of SLS, Pune are eligible to participate in the Internal Elimination, 2016 upon
formal acceptance of application as per the subsequent Notice issued by the MCA
pursuant to the Internal Elimination.
b) Participants who have outstanding debts towards College during previous Moot Court
Competitions or who have not returned the Library Books borrowed under the
Mooters Card during previous Moot Court Competitions and any other obligations
can be disqualified at any stage in the following year's Internal Elimination until such
fees have been paid or obligations have been met.

2.2. Anonymity of Participant


Participants must not reveal their Names, Roll Numbers, PRN Numbers, or any other
identification detail to Judges at any point of time during the Internal Elimination. The
Administrators shall have a right to disqualify or impose a penalty against any Participant
who intentionally or inadvertently discloses his/her Name, Roll Number, PRN Number or any
other identification detail to a Judge, whether or not such disclosure occurs during an Oral
Round, Memorials or through any other mode of communication.

THE INTERNAL ELIMINATION SHALL BE IN ENGLISH LANGUAGE.

PARTICIPANT REGISTRATION

All the eligible participants, as per Rule 2.1(a) need to complete the registration formalities
with the MCA by filling the Online Form as prescribed in the notice.

5.

CONDUCTION OF INTERNAL ELIMINATION

5.1. Dates of the Elimination: The Internal Elimination shall take place on the dates as
notified by the MCA.
5.2. Internal Elimination shall consist of three stages: Memorials Submission (from
Both Sides), Oral Pleadings (from Both Sides) and Researchers Test.
5.3. Memorial Submission The participants are required to submit memorials from both
sides in accordance to the guidelines as mentioned in Rule 7.
5.4. Researchers Test: The participants will have to appear in a researchers test which
shall be conducted by the MCA.
5.5. Allotment of Sides: The participants shall be allotted both the sides of oral pleadings
along with the dates of designated sides in advance (as per draw of lots). Since the
participants are required to plead from both sides, hence, if a participant is allotted
petitioner on the first day of pleading, on the subsequent pleading date he/she shall be
allotted respondent or vice-versa.
5.6. Oral Pleadings: The participants are required to plead from both the sides i.e.
Petitioner / Appellant and Respondent / Defendant in accordance with the following
provisions:
5.6.1. Each participant shall face a different opponent in the subsequent pleading.
For ex: If there are 4 participants, A, B,C and D where A & C are allotted petitioner on first
day of pleading and they face B & D respectively who are allotted respondents on that same

day, then on the subsequent day of pleading A & C will be respondents and theyll go
against D & B respectively who will be petitioners for that day.

5.6.2. No participant shall face the same judge in both the pleadings.
5.6.3. Both the pleadings shall be conducted in the same court room.
For ex: If in a Court Room on days of Oral Pleading there are 10 participants then their sides
and opponents for the pleadings would be in the following format:

5.7. Results: The results shall be declared after completion of all the three stages in form
of Speaker Rank and Researcher Rank along with Individual Scores for Memorials
(both sides), Oral Pleadings (both sides) and Researchers Test in the ratio as shall
be declared by the MCA. For detailed explanation refer to Rule 11.

6.

TIE BREAKER METHOD


6.1. Speaker Tie- Breaker:
a) Tier - I Tie- Break: The aggregate memorial marks for the Eliminations shall be
considered. The speaker with highest memorial marks will win the tie and will
be allotted the speaker position in the team.
b) Tier - II Tie- Break: In case a tie continues, researchers test marks will be
considered to break the tie.
c) Tier - III Tie- Break: In case a tie continues even after the tier II tie-break, then
the speaker to be allotted the position will be chosen by a random draw of lots.
6.2. Researcher Tie - Breaker:
a) Tier - I Tie- Break: The memorial marks for the Eliminations shall be
considered. The Researcher with highest memorial marks will win the tie and
will be allotted the researchers position in the team.
b) Tier - II Tie- Break: In case a tie continues, Researchers Test marks will be
considered to break the tie.
c) Tier - III Tie- Break: In case a tie continues even after the tier II tie-break, then
the researcher will be chosen by a random draw of lots.

7.

MEMORIAL

7.1. Each participant must prepare memorials from both the parties to the dispute. The
hard copies must be exact print outs of the soft copies. Non - compliance with this
rule would entail disqualification under Rule 12.

7.2. Time in the SLS, Pune office clock will be the official time for all the purposes of this
Internal Elimination. Details regarding the time limit will be made available to all
Participants on the Notice Board of the MCA. Any Memorial submitted later than the
aforementioned time in notice would be penalised. Equipment failure or other
technical problems or any other excuse will not be considered for improper formatting
or for late submission of Memorials. Memorials once submitted to the MCA cannot
be altered.
7.3. All participants must submit a hard copy of their memorials from both the sides on or
before the date and time specified in the Official Schedule. A soft copy of the
memorial in *.doc / *.docx format should be mailed on the same date to
moot.correspondence@symlaw.ac.in. The body of the mail should contain:

7.4. The soft copy of the memorial for each side shall be a single file and in *.doc / *.docx
and *.pdf format. It shall correspond with the hard copy of the memorial. The mail
should contain only two word documents (All parts of each memorial must be in a
single document), one for Petitioner / Appellant and the other for the Respondent /
Defendant. (Separate Ancillary Pages and Arguments Advanced are not allowed
& will attract penalty).
7.5. Participants must submit 3 Hard Copies of each side of the memorials [Total 06
copies] on the Date stipulated by the Notice.
7.6. The penalties for delay in submission of hard copy and soft copy of the memorials
shall be notified subsequently by the MCA.
7.7. Each Memorial should not exceed more than 30 A4 pages (14+16). The "Arguments
Advanced" and the "Prayer" should not exceed more than 16 A4 pages(15+1).

7.8. The memorials should not contain the name of the participant in any part thereof.
Also, no logo or any mark of identification should be made in the memorials. Noncompliance with this rule will lead to immediate disqualification.
7.9. The Cover Page of the Memorial must have the following color scheme:
Blue: Petitioner / Appellant Cover Page Red: Respondent / Defendant Cover Page
7.10. The Cover Page of each Written Submission must contain the following information:
a)

The Name & Year of the Internal Elimination

b) Name of the forum resolving the dispute.


c)

Jurisdiction

d) Subject matter of the dispute


e)

Title of the suit

f)

The party for which the Written Submission has been prepared.

7.11. The memorials must contain the following:

7.12. Legal Arguments Limited to Arguments Advanced Section


Substantive, affirmative legal arguments or legal interpretation of the facts of the Internal
Elimination Problem must only be presented in the Arguments Advanced of the Memorial,
including the Conclusion and/or Prayer for Relief (except insofar as such arguments may be
summarized in the "Summary of Arguments" or anticipated in the "Issues Presented").
7.13. Index of Authorities
Each Memorial must include an "Index of Authorities." The Index must contain a list of all
legal authorities cited in any section of the Memorial (Cases, Books, Treaties, Conventions,
Legislations, and Articles etc.). The Index must include a description of each authority
adequate to allow a reasonable reader to identify and locate the authority in a publication of
general circulation. Include the page number(s) of the Memorial on which each authority is
cited.
7.14. Statement of the Facts
Statement of the Facts should be limited and concise to the stipulated facts in the problem.
Facts should be relevant and material facts. The Statement of the Facts should not include
unsupported facts, distortions of stated facts, argumentative statements, or legal conclusions.
7.15. Summary of Arguments
Summary of Arguments should consist of a substantive summary of the Arguments
Advanced section of the Memorial in brief and concise manner, persuasively stating the key
arguments with factual support. Do not include case laws or other legal authorities. The
Summary of Pleadings should contain a summary of the substance of the arguments, and
should not be a mere reproduction of the various headings and sub-headings of arguments.
7.16. The Memorial shall be formatted according to the following specifications:

Typed on standard A4 size page.

2.

Font type: Times New Roman.

3.

Font size for body text: 12; the text of the written submission must have 2.0
(2.0 lines) spacing. Font size for the cover page may be 14 or 12.

Font size for footnotes: 10; text of footnotes should be single-spaced (1.0).

5.

Margin: 1 inch margin on each side of the A4 size page.

6.

Quotations of sources of 50 words or more in any part of the memorial should


be block quoted, indented and must be in italics.

7.

The participating teams should include Header and Footer in their memorials
to the effect that the Header should mention the full Name of the Internal
Elimination and the Footer should mention the side on whose behalf memorial
is submitted along with Page Number at Bottom Left Corner of the Page.

7.17. The footnotes must follow the 19th Bluebook format of citation.
7.18. Limitations on the use of Footnotes
Only footnotes can be used in the memorial. Practice of Endnotes is not followed in this
Internal Elimination. However, footnotes are to be used only to identify the source of a
statement made in the body of the Memorial and to provide the reader with a citation to a
generally-available reference for that source. Footnotes must neither include substantive
pleadings, examples, nor any text other than the actual cite.

Illustrative example of a footnote in violation of the Official Rules: Minerva Mills v.
Union of India AIR 1980 SC 1789 (In the Minerva Mills case, the Supreme Court
provided key clarifications on the interpretation of the basic structure doctrine. The
court unanimously ruled that the power of the Parliament of India to amend the
constitution is limited by the constitution)
7.19. The Memorial must not contain any Annexure / Photographs / Sketches / Exhibits /
Affidavits etc.
7.20. The memorial will carry a maximum of 100 marks.
7.21. Parameters for Judging the memorials are:

8. Proper use of citations and citation form,
9. Effective use of authority to support arguments,
10. Ability to distinguish adverse cases &
11. Neatness, legibility and formatting.

8.

METHOD OF CITATION OF AUTHORITIES

Participants should cite their legal authorities which they seek to place reference to in the
following manner. Citations may also conform to the current edition of The Bluebook: A
Uniform System of Citation (Harvard University, U.S.A.)

9.

ORAL PLEADINGS
9.1. Time Limit

The speaker will be allotted 10+2 minutes. (This is inclusive of time for Rebuttal and SurRebuttal). Participants will not be allowed to make any further oral argument after the
stipulated time.
9.1.1. Extension of Time at Judges' Discretion
Judges may, at their discretion, extend Participant oral argument time beyond the stipulated
Participant oral argument time.

9.2.

Scope of Pleadings

A Participant's oral pleadings are limited to the scope of the Participant's Memorial submitted
to the MCA on the day of submission. No amendments to the said memorial will be
entertained. Non-Compliance may lead to DISQUALIFICATION.
9.3.

Rules for Oral Pleadings

a) There will be two Elimination Rounds i.e. Round - I and Round - II, which will take
place in a period of two days respectively. Participants will have an opportunity to
argue from both the sides. In each of the Elimination Rounds the respective
participants will be assigned either side i.e. Petitioner / Appellant or Respondent /
Defendant subject to the draw of lots and would be pleading from the other side on
the subsequent day.
b) Each participant will face Different Opponents as well as Different Judges in both the
rounds and shall necessarily plead from both the sides.
c) The list for each courtroom (in which the Petitioner / Appellant and Respondent /
Defendant would alternate) will be prepared on the basis of a draw of lots.
d) The Petitioner / Appellant would speak first followed by the Respondent / Defendant.
Thereafter, there would be a Rebuttal by the Petitioner / Appellant only on the points
argued by the Respondents / Defendant. This will be followed by a Sur-Rebuttal by
the Respondent / Defendant only on the points argued in rebuttal. No further oral
submissions would be admitted. Non-Compliance may lead to Disqualification or
deduction of marks.
e) However, in case of speakers not showing up or there being a mismatch between the
number of appellants and respondents, suitable arrangements would be made by the
MCA which would have to be complied with by the participants.
9.4.

Internal Elimination Communications

Only oral communications with the Judge are permitted. No written communication or
exhibits or case-books must be delivered by any Participant to any Judge. However, if the

Judge permits, then the same can be complied by forwarding the required material through
the court master only.
9.5.

Spectators

All Rounds are open to the public. Administrators may however limit the number of
spectators in a room during the Rounds. Presence of coaches, advisors, or other spectators
affiliated with the Participant is permitted in the courtroom during an Oral Round involving
the Participant. No participant is allowed to witness any other Proceeding.
9.6.

Computers and Laptops in Courtrooms

During an Oral Round, participants must not operate laptop, handheld or any other computing
devices for any purpose.
9.7. Parameters for Judging the Speaker are:
1. Knowledge of the facts,
2. Proper and articulate analysis of the issues arising out of the facts,
3. Understanding of the international / national / common law principles directly
applicable to the issues,
4. Ability to explain clearly international / national / common law principles in
general adherence to the time allotted,

10. SCOUTING
Participants or persons directly affiliated with any Participant must only attend Rounds in
which the Participant is pleading. Upon the commencement of the Internal Eliminations Oral
pleading rounds, participants are not allowed to interact with the public before they enter
their Court Room and should be seated in a separate room assigned to them by the
Administrators.

11. INTERNAL ELIMINATION SCORING


11.1. Scoring of the Internal Elimination shall consist of three parts: the scoring of the
written Memorials (Individual Scoring of Both Sides), Researchers Test and the
scoring of the Oral Pleadings (Individual Scoring of Both Sides).
11.2. The ratio for Speaker Rank and Researcher Rank will be notified by the MCA
through a subsequent notice before the declaration of Results.
11.3. Aggregate Memorial Marks is half of the summation of Memorial Marks of both
Sides of a Memorial awarded to a Participant.
11.4. Aggregate Speaker Marks is half of the summation of Speaker Marks of both Sides
of the Oral Pleadings awarded to a Participant.
11.5. Access to Score sheets: All participants of Internal Moot Eliminations can see their
score sheets on a date and time which will be notified after the declaration of
results.
11.6. Speaker Rank.
The Speaker Rank of a Participant would be sum of his aggregate Speaker Score, aggregate
Memorial Score and Researchers Test. All the Scores would be calculated according to the
Ratio as notified through a subsequent Notice by the Moot Court Association and the Final

Total obtained after summation of the marks would determine the Speaker Rank of the
Participants. For instance:

11.7. Researcher Rank
The Researcher Rank of a Participant would be sum of his aggregate Speaker Score,
aggregate Memorial Score and Researchers Test. All the Scores would be calculated

and the Final Total obtained after summation of the marks would determine the Researcher
Rank of the Participants. For instance:

12. PENALTIES & DISQUALIFICATION


12.1. Penalties
12.1.1. Memorials Penalties
Penalties on Memorials may be imposed by the Administrators and shall be deducted from
each of the individual Judges' scores on a Participant's Memorial. Heads of penalty are as
follows:

2. Improper Formatting
3. Exceeding the specified page limit
4. Violation of Rule of anonymity
5. Substantial copying of Ancillary pages and/or Issues.
6. Difference between Hard Copy and Soft Copy submission.
12.1.2. Oral Round Penalties
The Administrators/ Judges may impose penalties during the Oral Round, if necessary after
consultation with the Court Master. The heads of penalty will be as follows:
1. Improper courtroom communications
2. Scouting
3. Violation of Rule o\f anonymity in courtroom
4. Pleading outside the memorial (at the discretion of the judge)
5. Exceeding the allotted time limit for pleading
12.2. Disqualification
The participant will be disqualified from the Internal Elimination on the following grounds:
1. Skipping or Missing any Oral Pleading and/or Researchers Test.
2. Delay / No submission of Memorial.
3. Scouting.
4. Misplacing and Hoarding of Library Books and Resources.
5. Reveal of Identity (Non-Compliance with Rule of Anonymity)
6. Delay in arrival on the day of Oral Pleadings.

13. ALLOTMENT OF MOOT


13.1. Allocation of all the State / National / International Level Moot Court Competitions
and other related legal activities would be done by the MCA from the Internal
Elimination Pool, except the Moots specified under the Challengers.
13.2. The MCA will intimate all the Internal Elimination Participants through Notice
and/or, through email about the Moots that will be allotted to the Participants under
the Internal Elimination Pool, as soon as the MCA receives invitation of any
competition, along with date, time and venue of the Allotment session.
13.3. Cut Off Rank: A Cut Off Rank may be notified along with the Notice for the
Moot that is allotted or at the time of the declaration of ranks. Only those
Participants of Internal Elimination who have secured the notified rank or less
would be eligible for bidding in the Allotment Session.
13.4. The Participant will be allowed to Participate in only TWO MOOTING ACTIVITY
from the given Symbiosis Law School, Pune - Internal Elimination Pool for the
academic year 2016 2017.

14. HOARDING AND MISPLACING OF LIBRARY BOOKS & RESOURCES


All the participants of the Internal Elimination are hereby informed that they should keep the
books taken by them in the same cupboard when they leave the library or when the use is
over. Participants should not be in possession of more than two books at a time. Anyone
found in breach of the above said will be DISQUALIFIED from the Internal Elimination and
punished according to the Guidelines of Symbiosis International University.

15. COPYRIGHT
15.1. SLS, Pune, shall have the right to assert copyright over the memorials of the
Participants and reserve the right to publish any memorial.
15.2. The copyright over the memorials submitted for participation in the elimination is
assigned by participants and shall also vest completely and fully in SLS,Pune
15.3. Further use and exhibition of these materials, electronically or otherwise, shall be
the exclusive right of SLS, Pune and they shall not be responsible for any liability
to any person for any loss caused by errors or omissions in this collection of
information, or for the accuracy, completeness, or adequacy of the information
contained in these materials.

16.DE MINIMIS RULE


1. Administrators may in consultation with and upon approval of the Faculty-in-charge;
MCA may promulgate such other measures for the orderly conduct of the Internal
Elimination or to correct deficiencies in the Internal Elimination.
2. The MCA holds the right to Amend or Change or Incorporate new Rules or
Guidelines in Internal Elimination with prior notice.
