Subject: FIR against the custodians of cows left unattended along with the tainted officials
of the Municipal Corporations / Councils and Committees, who failed to perform their
official cum constitutional duties, breach of trust as well.
Greetings,
It is humbly submitted that:
1. OIPA, International Organization for Animal Protection: www.oipa.org is an
International Confederation of Associations for the animal protection and for the
defense of animal rights all over the world. OIPA is NGO affiliated with the UN
Department of Public Information and the UN Economic and Social Council. The
Organizations purpose consists in the defense of animal rights and in the defense of
the animals from every kind of mistreatment. It also follows the purpose of
improving the public health through the abolishment of any kind of animal
experiment throughout the world, whereas Naresh Kadyan, Master Trainer, Animal
Welfare Board of India, Chairman, PFA Haryana, representing OIPA in India.
Animals have five liberties, which were upheld by the Supreme Court of India read
with the section 3 of the Prevention of Cruelty to Animals Act, 1960; i) Freedom
from hunger, thirst and malnutrition; ii) Freedom from fear and distress; iii)
Freedom from physical and thermal discomfort; iv) Freedom from pain, injury and
disease.v) Freedom to express normal patterns of behaviour.
2. As per section 3 and 11 of the Prevention of Cruelty to Animals Act, 1960, the
custodians of cows are failed to perform and their cow progeny are left unattended
on street to eat garbage and to spoil neat and clean environment.
3. As per article 51 A (g) of Indian Constitution, we all are duty bound to protect all
living creatures from unnecessary pain and sufferings.
4. The cow is a symbol of the Earth, the Nourisher, the evergiving, undemanding
provider. The cow represents life and the subtenance of the life, just as a liberated

soul gives freely of his spiritual knowledge, so too does this gentle and generous
animal who takes nothing more than water, grass and grass, and gives unstintingly
all through her life. The cow is vital to life and substenance. She is symbol of grace
and abundance, and emvodies the virtues of gentle selflessness. These cows are
being left unattended by their custodians to eat garbage, which hurt the religious
feelings and believes of Hindu community, violation of 295-A of IPC.
5. All these abandoned cows became public nuisance, responsible for road blockage
and accidents, which violate the IPC 268 and 289, criminal conspiracy as well,
besides it animal lives also in danger, violation of 428-429 IPC.
6. The Municipal Corporation Act read with the state cow protection legislations are
also violated because these abandoned cows are easy target for butchers and these
kinds of violations, spoiled our social fabric, peace and harmony.
Hence FIR against all the custodians of abandoned cows along with the tainted officials of
the Urban and Local bodies may kindly be lodged and abused cow progeny may kindly be
rescued for further rehabilitation within time frame policy.
Stray cattles: 237963 in Rural and 54499 in Urban areas, total 292462.
Stray dogs: 650915 in Rural and 195178 in Urban areas, total 846093.

Description

Complaint No: AMC-0816988279 on dated 18-Aug-2016, bearing token


CNCD-0816105412, to Capture the Animals like Cows, dogs and put them
in the Pound all around in the jurisdiction of Municipal Corporation areas
of Ahmadabad. The United Nation affiliated "International Organization
for Animal Protection" OIPA - Indian People for Animals demands: 1.
Immediate FIR against all custodians of these Cows, roaming around in
the Municipal Corporation areas of Ahmadabad because, these cow legal
rights are being upheld by the Supreme Court of India i) Freedom from
hunger, thirst and malnutrition; ii) Freedom from fear and distress; iii)
Freedom from physical and thermal discomfort; iv) Freedom from pain,
injury and disease.v) Freedom to express normal patterns of behaviour. 2.
As per section 3 of the Prevention of Cruelty to Animals Act, 1960,
custodians of these cows failed to perform their responsibilities and duties
: towards their pet animals. 3. As per article 51 A (g) of Indian
Constitution, we all are duty bound to protect animals from unnecessary
pain and sufferings, including Governor, Chief Minister, Chief Justice,
Speaker, MP's, MLA's, Mayer and Commissioner with District
Magistrate and Commissioner of Police etc, common public as well. 4. IPC
268 and 289 read with 120-B violated. 5. Municipal Corporation Act needs
immediate attention. 6. Infirmaries be functional, as required under
section 35 of the Prevention of Cruelty to Animals Act, 1960. 7. The
Society for Prevention of Cruelty to Animals: SPCA be functional, as
required under section 38 of the PCA Act, 1960. 8. Community pets, stray
dogs be vaccinated against Rabies and operated to control their
population under scheme of animal birth control. Animal Welfare
Division and AWBI may look in to for further immediate coordination
with the Municipal Corporation of Ahmadabad in Gujarat.
