Letter From The Editor

Recently, the DEA issued a statement reinforcing their position that cannabis has no medical benefit
whatsoever, consequently recommending that it remain a Schedule 1 drug. In response to their blatant lies
and attempt to save jobs and DEA funding, this issue we bring you the story of the Federal Marijuana patients.
We traveled to Oregon, one of our favorite legal cannabis states, where we were met with warmth, kindness
and open arms by our fellow colleagues in this industry. We had such an amazing time, it was almost
unnoticeable that we were on a mission to uncover the truth about the governments lies.
How is it that the Federal government says there is no medical benefit to marijuana, yet there are two
patients currently receiving medical Federal cannabis issued by the government? How are
their medical rights any different than anyone elses?
We learned that the Federal weed they are sending out is 8 years old, grown in 2009, testing
at less than 5% THC. While these patients had to sue the government in order to obtain safe
access to Federal medical cannabis, why is it that George W. Bush decided to shut down
the Compassionate Innovative New Drug Program so that no one else could ever legally
obtain Federal pot?
Additionally, we would like to point out how unethical it is for Federally employed doctors
and scientists to be sending out medical cannabis from nearly a decade ago. In case you
didnt know, cannabis loses 20% THC potency each year its stored, and thereby increases
in CBN levels. Its no wonder the cannabis tests at such low THC potencies. The quality of
the cannabis supplied from the Feds is extremely questionable.
Higher quality cannabis is available that is easier to obtain than from the Feds. As we
already know, marijuana has become legally and medically available in several states,
which makes the government weed almost a monthly souvenir to remind the two surviving
patients of the program of their legacies.

Nevertheless, the truth exists in the mainstream today. Share the knowledge and spread
the word. Anytime anyone ever says, Yeah, but its still a Schedule I Drug, now you can
educate them about the hypocrisy and let everyone you know understand that we are still uncovering so
many amazing facts and stories while continuing to make history together as an industry.

waiter or family members. Every conversation is an opportunity to educate. Until cannabis is DESCHEDULED and off the Controlled Drug Substance List, we still have work to do.

Welcome to the Policy Update Column! This


is where you can now find a recap on the
current state of cannabis related legislation
and policy, on the federal, state, and local
level.
Starting with the good news: Five states - Arizona,
California, Maine, Massachusetts and Nevada - are
going to have recreational cannabis on the November
ballot!
Recent polls show favorable numbers for California,
Maine and Nevada, while Massachusetts and
especially Arizona face a tougher battle.
Prop 64, the California initiative (also known as
AUMA or the Sean Parker initiative) enjoys the most
favorable poll results, with 60% support among likely
voters. Unlike previous attempts for legalization in
California, the current initiative has a united coalition
behind it with organizations such as the Drug
Policy Alliance and Marijuana Policy Project, and
the initiative goes into more regulatory details and
creates the infrastructure that was missing in prior
legalization attempts.
Having raised nearly $8.5 million to support the
legalization efforts, with the opposition raising less
than $200k, and despite concerns from the cannabis
industry claiming it will have a negative effect on
medical cannabis and pave the way for a Big Tobacco
style takeover, signs point to a successful passage of
the initiative.

On a less positive note, the DEA has decided to keep


cannabis as a Schedule 1 drug, citing the need to prove
medicinal properties. The irony and hypocrisy has not
been lost on the cannabis community, with a new viral
campaign designed to draw attention to #6,630,507,
a patent titled "Cannabinoids as antioxidants and
neuroprotectants", which was issued to the US
Department of Health back in 2003, and describes
benefits for the treatment of stroke and trauma,
Alzheimer's, Parkinson's disease, and HIV dementia.

Hollyweed Is Coming To Town

The flowering of new TV and film productions is having a
budding flare as the top producers are lighting up the small
and big screen with cannabis programming. Since the
groundbreaking television series Weeds originally had
its debut on the Showtime network eleven years ago, the
canna-business has been consistently growing, changing,
and evolving at an exponential rate. It seems that more and
more each day, the mainstreaming of cannabis is becoming
a reality. As we experience a matter of fact presentation
of life in home entertainment that just happens to involve
a bit of infusion, well be further paving the path toward
acceptance and legalization.

One breakthrough show in production is coming from


Sony TV for streaming content, and is inspired by the
book, Humboldt: Life on Americas Marijuana Frontier,
written by Emily Brady. This story, Humboldt, will
highlight the Northern California community, which for
nearly 40 years has existed primarily on the cultivation
and sale of marijuana. After a year of residing within
the secretive society of cannabis cultivators, Brady
was able to smoke out the everyday life and personal
aspects as California transcends into legalization.

John Malkovich, the two time Academy nominated


actor, will star as the dynamic patriarch of an influential
family whose lives are gritty and sticky with resin.
Malkovich rarely is featured on the small screen and his
most recent TV foray was on NBC's short-lived pirate
drama Crossbones. This is coming from Sony TV and
Anonymous Content (True Detective, Mr. Robot), and

Bates as Netflix has given a series order to Disjointed,
a comedy from successful show producer Chuck Lorre.
Bates stars as a lifelong marijuana-legalization advocate
who realizes her dream of running a pot dispensary in
Los Angeles. Working alongside Bates's character is
her son, three budtenders, and a security guard. The
comedy will share the High profile of what its like
working in a dispensary setting.

HBO has picked up six episodes of High Maintenance,


created by husband and wife team, Katja Blichfeld & Ben
Sinclair back in 2012. Starting as a web series, it gained
popularity and is now receiving attention as we move
further towards legalization. Ben Sinclair stars as a nameless
marijuana deliveryman called The Guy as he delivers his
product to clients in New York City. Each episode focuses
on a new set of characters as they all procure their cannabis
from Sinclair's character.
Also in development from Adam and Naomi Scott of Get
Rad Productions, have created Buds and sold it to NBC
with writer/comic Joe Mande (Parks & Recreation). The
comedy revolves around the day-to-day operations

Comedian Margaret Cho has been harvested to star in


an Amazon marijuana-themed family dramedy, titled
Highland. This project follows Chos character, who
after court-ordered rehab gets a chance to start over,
but has to move in with her dysfunctional family now
running a dispensary. Co-produced by Tomorrow
Studios and Amazon Studios, Highland hails from
writer Liz Sarnoff (Deadwood, Lost, Alcatraz).
Cho is attached besides starring to executive produce
the show. Cho starred in her own sitcom on ABC, AllAmerican Girl, from 1994-1995, and she recently guest
starred on ABCs Ken Jeong comedy Dr. Ken. She had

Lorre and David Javerbaum serve as writers and


executive producers on the series, which received
a 20-episode season-one order, from Chuck Lorre
Productions and Warner Bros. Television. Disjointed
is Lorres first non-CBS television show since ABCs
Dharma & Greg. He currently has The Big Bang
Theory and Mom at the broadcast network. Bates
most recent television work came in the last three
seasons of Ryan Murphys FX anthology American
Horror Story. She won an Emmy in 2015 for American
Horror Story: Coven. She also won a guest-actress
Emmy in 2012 for her work on Lorres Two and a Half
Men. Her Academy Award came from her starring
role in the film Misery, which had critical acclaim.
Nice to see that the quality of programing is growing
green with talented writers and directors.

Hollyweed, a project financed by
Fremantle Media and five films with
ties to the rapidly growing cannabis
industry.

United Talent Agency (UTA) has signed
the publication High Times to its roster
as it becomes the first official cannabis
client for a major Hollywood agency.
High Times, has been the go to print
publication for over 40 years, dedicated
to the culture, lifestyle, cultivation, and
activism of cannabis. Back in 1974 is
when the ground breaking magazine
took a risk with what was at that time,
a very provocative subject. UTA will
represent High Times across film,
television, digital, consumer products,
licensing, games and premium brand
sponsorships. This is the first cannabis
based business to be regarded enough
of a name talent to find a top agent to
represent them.
As cannabis themed TV and film are
budding in demand the green grass
is growing with awareness. Medicinal
and recreational access to cannabis is
now available in 23 states and with the
impending November election possibly
set to raise that to a higher statistic.
This makes the acceptance even more
of a high time for main stream media.
As most know, the entertainment
industry has a large contingent of 420
friendly creative staff, who is now
feeling comfortable about coming out
in the workplace. In the last year alone,
a great many more pitches had a green
theme to story lines than ever before.
As this country become legitimized,
the reflection in programing cannabis
centric stories will only continue to
grow, and yield even more successful
harvests for the networks behind

Something very exciting happened on July 26th of this


year. The Food and Drug Administration (FDA) finally
decided it was time to update the nutritional label format
that we see on all food packages. For years we have been
looking at labels that were created back in 1990 and as the
times have changed, so have our dietary concerns.

Elvy Receives Federal Government Prescription Cannabis Since 1988


Elvy Musikka!? Who she is, and why you should know who she is if you consume medical
cannabis!
Elvy Musikka resides in Eugene, Oregon, where she is close to her son and his family in a quaint
downtown apartment. She lives near an abundance of stores and restaurants in a place with
small town energy that makes you feel right at home. Here we are, in a recreational state about
to unveil to many in the community and industry of cannabis, a clandestine aspect of our United
States Federal Government. A subject of which information has been squelched, scenarios altered
for secrecy, and an appearance of cover ups galore as... Elvy has been receiving free medical
cannabis for 28 years, from (shhhhhhh) Uncle Sam!

How did this secret program get initiated into our Federal Government? The Compassionate Care
Investigational New Drug Study program began after Robert C. Randall filed a lawsuit against
the Food and Drug Administration, The National Institute on Drug Abuse, the Department of
Justice, and the Department of Health, Education & Welfare. Robert was afflicted with glaucoma,
a degenerative eye disease and had made a wise calculative move to make reference to the
Common Law doctrine of necessity to argue against charges of cannabis cultivation because
it was deemed a medical necessity. This is the case of United States verses Robert Randall in
1976. After the trial and presentation of evidence on November 24th, 1976, Federal Judge James
Washington ruled in Randalls favor in a major landmark case. The first medical cannabis
prescription in the United States since the 1930s was written, and Robert headed over to the
local pharmacy to fill his prescription.
The second person to be admitted to the IND Program was Irvin Rosenfeld back in 1982. Irvin has
a rare degenerative bone disease from a very young age and was in his freshman year at college
when he tried cannabis. He discovered by smoking cannabis he was able to sit for more than 30
minutes, which was virtually an impossible feat with his disease. With an analytical mind and

Elvy, along with Irvin Rosenfeld are part of the Compassionate Care Investigational New Drug
Program, also known in short as: Compassionate IND. First started in 1976, it is a United States
Federal Government-run program that allowed a limited number of patients to use medical
cannabis grown at the University of Mississippi. The program is not available to any new patients,
as it was dissolved in 1992 under the jurisdiction of President George W. Bush. During its time,
they had about 30 participants at its peak, and upon closure they had 13 active participants.

IND program and won, so on November 17th, 1988,
Elvy went to her local pharmacy to fill her prescription
for 320 marijuana cigarettes every month.

She speaks each year at HempFest, the festival held in


Seattle, Washington now running twenty years. With
attendance at over 120,000 hemp/cannabis friendly
supporters, it is one of the largest gatherings in the U.S.
celebration of the culture and lifestyle of cannabis. Of
course to those in attendance, Elvy is a treasured icon
and heralded by all once she graces the stage. She is
known to break out in song, as she does consider
herself a musician. She autographed her album for
us when we were spending time in her apartment
in Eugene, Oregon. Elvy is also part of Patients Out
Of Time, a non-profit organization that focuses on
education about the medical attributes of cannabis with
continuing education accredited classes. She speaks at
least once a year to appreciative nurses, doctors and

power to change the laws, as for the past 28 years she
has lived as an open cannabis consumer. But on the
other hand, she has had her phone tapped and her life
scrutinized for her actions. Is she breaking the law?

arrested and threatened. At this time in her life, Elvy
would like acceptance and true freedom from this
scrutiny. Musikka says her glaucoma is under control
and reaffirms that her consumption of cannabis is proof

or aspirin are available in her home as medical cannabis

activist. She is passionate that prohibition should not be

of Uruguay, where there are no rules or restriction on

Advocates for legalizing cannabis either for medical
or recreational purposes say the program is a glaring
contradiction in the nation's 40-year war on drugs

people. While we have 200,000 people in Federal U.S.
Prisons for simple possession of cannabis, yet the
same Federal Government has been supplying it to
needy medical patients for the past 40 years, starting
with Robert Randall who passed away in 2001. He
was an amazing visionary who we need to honor and

The First Ever Cannabis Exhibit in an American State Fair


Cannabis finally got live exposure to the general public as nine fresh potted plants were
on display at the Oregon State Fair. This exhibit, organized and hosted by the Oregon
Cannabis Business Council, will the very first of its kind in an American state fair.

The nine specimens that will be on display were hand picked by judges in a competition
at the Oregon Cannabis Growers Fair which was held on August 13th. Three of each
plant were winners in the sativa, indica and hybrid categories. Due to state regulations,
these plants will be unbudded, yet the industry hopes that such laws will change by next
years. The exhibit itself will be housed in a tent will guards and admittance will only be
allowed to guests who are 21 and over.
The Oregon State Fair will be held from August 26th to September 5th in Salem, Oregon.

agencies requested an out-of-court settlement. The
resulting settlement provided Randall with prescriptive
access to marijuana through a federal pharmacy located
near his home.
The settlement in Randall v. U.S. became the legal basis
for FDA's Compassionate IND program. Initially, this
program was limited to patients afflicted by marijuanaresponsive disorders and some orphan drugs. In the
mid-1980's however, the Compassionate IND concept
was expanded to include HIV-positive people seeking
legal access to drugs which had not yet received final
FDA marketing approval.

In the Matter of Craig Reichart

In response to pleas from the parents of a young


man afflicted with terminal cancer, Imperial County
Superior Court Judge Don Work issued three orders to
facilitate the legal availability of marijuana to treat the
symptoms of nausea, vomiting and weight loss. Judge
Work ordered the sheriff of Imperial Court to provide
the young man's physician with contraband supplies
of marijuana; immunized the physician from criminal
liability for possessing the marijuana and for dispensing
it to the patient; immunized the patient from criminal
liability for possessing the marijuana provided to him
by his treating physician.

Diana argued his use of marijuana


was a "medical necessity". The court
refused to hear medical evidence and
convicted Diana. The Washington
Court of Appeals overturned the
verdict and returned the case to the
lower court for retrial. The Appeals
Court ruled that "medical necessity"
was a valid defense and instructed the
lower court to consider evidence of
Diana's medical need.67
On retrial Diana presented testimony
from numerous medical experts, his
treating physicians, his family and
other multiple sclerosis patients who
endorsed marijuana's medical value
in relieving severe muscle spasms. The
Court concluded that Diana was "not
guilty by reason of medical necessity."

State of Florida v. Musikka

A middle-aged woman afflicted


with glaucoma was arrested for
growing six marijuana plants. At
trial, Musikka, who had already lost
sight in one eye as a result of failed
surgical interventions, argued her use
of marijuana was a "medical necessity."
Musikka's treating physician, a noted
ophthalmic researcher at Miami's
famous Bascom-Palmer Eye Institute
testified that "if marijuana were legal
I would have prescribed it for Elvy
Musikka's medical use in the treatment
of glaucoma." He further testified that,
without marijuana, Musikka would go
blind.
The Court, after hearing from other
medical experts, concluded Musikka's
use of marijuana was protected by the
Common Law defense of "medical
necessity" and found Ms. Musikka not
guilty. In reaching this verdict, Judge
Mark E. Pollin wrote:

water while juicing in a masticating juicer will assist in the
processing. The potency can depend on how much water
you add as well, so add the water sparingly as you dont
want your juice to get diluted.

One tried and true juicer of the mastication extraction is the


Champion Juicer or a wheatgrass Juicer. I still have a hand
crank wheatgrass juicer and back in the days of studying
at Twin Lake Holistic College I grew my own wheatgrass
and would grind out my own juice. Oh those were the
days when I had the time and a simple life of a student.
Nowadays, when I have a bunch of fresh clean cannabis
leaves I use a Champion Juicer. If you have the luxury of
juicing from fresh buds, an everyday blender is a prefer
method as it is quick and easy and you are able to utilize
most of the plant products in the process.

Once you juice your leaves and if you have more than you want to drink
in a day you may freeze the juice. It may not the same potency, but it
will still have the some of the beneficial qualities. A great suggestion
with the extra juice is use an ice cube tray, fill the tray and store it in
a freezer zip lock bag while in the freezer. Then you may pop out a
cannabis ice cube anytime, or you may want to store the juice in the
refrigerator and drink throughout the day. With the pulp you may use
that to chew, make sauces, blended in a smoothie as there are still some
properties of nutrition to be ingested.
What happens once you drink the raw cannabis juice is different for each
individual. As we know each persons physiological make up varies.
Some feel immediate effects, of course being with no psychoactive results.
I personally have felt an energized sensation when drinking the juice. It
is as if I had a charge of natural energy and a continued zing in my step
for about an hour. It truly makes a great difference in your health if you
are able to ingest the raw cannabis juice on a continuous daily basis you
should feel the amazing benefits.
Raw cannabis does not provide acute symptom relief, but some have had
digestive issues bring immediate relief by dissipation of severe nausea
as well as subsiding issues from chronic ulcerative colitis and crohn's
disease. Others have has physical balance seemly restored and most have
dramatic results by drinking the juice over a four to six week plan. It takes

FREAKY FISH TACOS WITH LIME-CHIPOTLE CANNA-AIOLI
Fish tacos are a perfect dinner party meal. Not only are these really tasty (and authentic), but they
have the potential to knock your socks off if you eat more than two. There is also something really
rewarding about making your own salsa, so I included my cucumber-avocado salsa in this recipe for
you. Its the perfect complement to this dish.
1. Put the onion, cucumber, avocado, tomato, garlic,
cilantro, and jalapeo in a small bowl. Pour in just
enough red wine vinegar to cover well. Add a pinch of
salt, the lime juice, and the cannaolive oil mixture. Set
aside for at least 30 minutes.
2. In a large bowl, combine the flour, 1 teaspoon salt,
garlic powder, chili powder, and cumin. Sift together
well with a fork.
3. Season the fish with salt and pepper, then coat the
fish with the flour mixture.
4. Preheat oven to 340F.
5. At the same time, heat a large skillet over mediumhigh heat. Add 1 inch of olive oil. Gently fry the fish
for 3 to 4 minutes, then turn over and cook for another
2 minutes. Remove the fish with a slotted spoon and
drain on a plate lined with paper towels. Set aside.
6. Stack the tortillas, separating each with a slightly
dampened sheet of paper towel. Wrap in foil. Heat in
the oven for 5 minutes.
7. Top each tortilla with a pinch of shredded cabbage
and some of the cooked fish, then, using a slotted
spoon, top each one with the cucumber-avocado salsa.
Garnish with Lime-Chipotle Canna-Aioli (page 54), a
lime wedge, and cilantro. Dig in!

FAKIN BAKIN VEGGIE CHEESEBURGER


No vegetarian section would be complete without a cheeseburger, and I love the flavor of the
chipotle combined with the tarragon in this version. Top things off with some Candied Eggplant
Bacon (page 159) and Lime-Chipotle Canna-Aioli (page 54), and youve got a rockin veggie burger
on your hands.

Steps

1. In a medium pan, saut onion with light olive oil and a


sprinkling of salt and pepper until caramelized.
2. In a large bowl, mix together the caramelized onion
with the remainder of the burger ingredients. Using your
hands, mash and knead until everything is thoroughly
combined. Divide burger meat into 4 equal portions.
3. Oil your hands with a little olive oil and make patties
that are about 1 inch thick. Place them on a plate lined
with paper towel and cover them with plastic wrap.
Refrigerate for 30 minutes.
4. Cover the bottom of a skillet with olive oil. Cook the
patties 2 to 3 minutes per side until lightly browned.
5. Serve on whole-wheat buns topped with cheese,
Candied Eggplant Bacon , lettuce, tomato, and LimeChipotle Canna-Aioli for a complete experience.

One of my all-time favorite dishes! I make 6 minis to snack on during the week. You
can also make one large souffl by placing all the blintzes on top of the melted butter
in a large baking dish. Then just pour the souffl mixture over the crepes and bake
for 1 hour.

For the crepes:


1 cup milk
cup cold water

2 teaspoons pineapple juice
2 teaspoons vanilla

Steps

1. Blend together the crepe ingredients: milk,


cold water, flour, sugar, eggs, and canna-butter.
2. Heat a small nonstick pan on medium. Rub
the stick of grass-fed butter around bottom
and sides of the pan.
3. Pour enough batter into the pan to coat the
bottom. Cook for 30 to 40 seconds until the
batter sets. Shake gently to loosen. Flip, using
a small silicone spatula, and cook another 30 to
40 seconds. Transfer to a plate and repeat until
all the batter is used.
4. In a medium mixing bowl, combine cheesefilling ingredients: ricotta cheese, mascarpone
cheese, confectioners sugar, crushed
pineapple, and egg. Mix well.
5. Place 1 tablespoon of the cheese filling in
each crepe and fold the bottom of the crepe
over the filling. Fold in both sides and then roll
up over folded edges to create a closed little
blintz. Set aside and repeat.
6. Preheat oven to 340F.
7. Pour 1 to 2 tablespoons of melted butter
to cover the bottom of each of six 8-ounce
ramekins. Place 1 crepe in each ramekin.
8. Blend the remaining souffl ingredients:
sugar, eggs, sour cream, pineapple juice,
vanilla, cinnamon, crushed pineapple, and salt.
Pour the mixture over the crepes, filling each
ramekin three-quarters full. Bake for 1 hour
until golden brown and then serve.

KALE SALAD WITH PUMPKIN SEEDS & COTIJA CHEESE


Kale is one of the only leafy greens that can actually benefit from sitting in the fridge with the
dressing on. Other salad greens will wilt almost immediately, but kale can actually marinate and
soften. This means it can also be dressed in advance and left to sit before being served, if you so
choose. This salad is paired with other vegetables that will hold up well to marinating.

Ingredients

1. Heat 1 tablespoon of cooking oil in small saut pan and


add shallot. Saut over medium heat until golden brown,
remove from heat, and set aside.
2. Wash kale and cut out the tougher end of the stems.
With your hands, tear the kale into medium-large bitesize pieces. Place at bottom of large salad bowl.

Juice of 4 limes
1 tablespoon white wine vinegar
teaspoon pepper

2 carrots, peeled and grated medium
1 red beet, peeled and grated medium
pint cherry tomatoes, each cut in half
1 cup toasted pumpkin seeds
1 cup crumbled Cotija cheese (or
crumbled sheeps-milk feta if you cannot
find Cotija)

3. Place garlic clove and salt in a mortar and pestle,


and grind until they form a paste. Put the paste in a
Mason jar and add the shallot, honey, lime juice, vinegar,
pepper, and cannaolive oil mixture. Vigorously shake to
emulsify the ingredients.
4. Add all the remaining vegetables and pumpkin seeds
to the salad and toss well with the dressing. Adjust salt
and pepper to taste. Top with crumbled cheese, and serve.
*Approximate dose per serving is based on infusing 5 grams of
cured/dried/decarbed cannabis into 5 ounces of oil.

U.S. v. Burton

Mr. Burton, a glaucoma patient, argued his use of


marijuana was a "medical necessity." Testimony
was received from Burton's personal physician, an
ophthalmic physician who had researched marijuana's
use in glaucoma therapy, from his uncle who was
blinded by glaucoma, and from relatives and others who
testified to Burton's good character and work habits.
The jury refused to convict Burton on the felony charge
of marijuana cultivation with intent to distribute, but
found him guilty of simple, misdemeanor possession.
A Reagan-appointed federal judge, however, sentenced
Burton, a Vietnam veteran with no prior criminal
record, to serve one year in federal prison. Federal drug
agencies seized Burton's home, truck and farmland.
After serving his criminal sentence, Burton and his wife
fled the United States. The couple now live in Holland,
where Burton can legally obtain the marijuana he
medically requires.

State of Minnesota v. Gordon Hanson

A man suffering from epilepsy was arrested for growing marijuana.


At trial he argued his use of marijuana was "medically necessary" to
control debilitating seizures. Research neurologists from New York and
Washington, D.C. testified that Hanson's use of marijuana was medically
appropriate. The local court dismissed this medical testimony and found
Hanson guilty. On appeal, the Minnesota Supreme Court ruled that
"medical necessity" could not be used as a defense against criminalization
for marijuana cultivation. The ruling drew sharp editorial criticism from
many local newspapers. Hanson served nearly one year in prison. During
that time he had numerous gran mal and petite mal seizures.

State of Florida v. Kenneth & Barbara Jenks

Kenny Jenks, a hemophilic, and his wife, Barbara, were arrested in March,
1990 for growing two marijuana plants. They were charged with three
felony counts. At trial, however, the young couple revealed they both were
infected by the deadly AIDS virus, and argued that their use of marijuana
was "medically necessary" to control the nausea, vomiting and rapid weight
loss caused by advanced HIV-infection. The local court refused to heed
medical testimony from their treating physician and other experts and they
were convicted on all three felony charges.

In April, 1991, the Florida Court of Appeals reversed the lower court,
overturned the young couple's criminal conviction and ruled their use of
marijuana was a "medical necessity" in the treatment of AIDS. In October,
1991 the Florida Supreme Court upheld the Appeals Court's verdict and
ordered the prosecutor to file no further appeals in the landmark case.
State of Idaho v. Hastings
A woman afflicted by crippling arthritis was arrested for growing a few
marijuana plants. At trial she argued her use of marijuana was "medically
necessary" to control the debilitating pain caused by her arthritis. Her
treating physician, other patients afflicted by chronic pain and muscle
spasm, testified in her defense. The local court refused to consider the
medical evidence, but withheld judgement. On appeal the Idaho Supreme
Court ruled the defendant did have the right to "introduce evidence
relating to the common law defense of necessity". The Court ordered the
lower court to consider all evidence of Ms. Hasting's medical needs. At this
juncture the prosecutor dropped all criminal charges against Ms. Hastings.

The end of August will mark the one month milestone for six cannabis businesses
in Tallahassee, Florida, that had received their distribution licenses. Trulieve,
the first cannabis dispensary to open in Florida, has reported prosperity since
opening its doors back in July 26. Kim Rivers, the CEO of Trulieve, shares that
their clinic had received at least 500 calls on the first day from doctors who
want to prescribe cannabis and patients who want to take it.

The interest level is very high, and were in education mode right now,
Rivers explained. In Florida, there are a lot of specific criteria that patients
and doctors have to meet to use and prescribe medical marijuana. To register,
physicians have to take an eight-hour course on the use of medical marijuana,
and patients have to have a 90-day established relationship with a registered
physician before they can get a prescription.
So far, only three types of patients are allowed to use cannabis: Cancer patients,
patients who suffer from seizures and muscle spasms, and the terminally ill
who qualify under the Right to Try Act. In spite of these limitations, Trulieve
and other dispensaries are confident and hopeful that the upcoming November
elections will result in allowing more patients gain access to cannabis.
Were hoping to see the conditions continue to be expanded and for us to have
the ability to service even more patients, says Trulieve CEO, Rivers. There are
a number of patients and conditions that are not served by current legislation.
Though it has been a great first step, we hope to see more growth soon.
Someday soon, it will no longer be news that a dispensary opened up in a nonmarijuana friendly state.

in Oak Park, Illinois

On the west side of Chicago, the village of Oak Park welcomed its very
first cannabis dispensary, Seven Point, with the cut of a ribbon on the
morning of August 19th. Seven Points founder and CEO, Brad Zerman,
worked for two years by investing about $1 million in the dispensarys
construction as well as its legal fees, start up costs and licensing. Zerman
has expressed pride for his efforts and is excited to serve the community
as he has received much support for his endeavor.
"We have so many seniors that come by, whether they qualify or not, who
want to help their relatives," Zerman said. "We have chamber representatives
here and even representatives from Berwyn. I think the community
is a liberal one, and they've all been welcoming us with open arms."

On August 26, Seven Points will officially welcome visitors who carry
an official medical marijuana registry card. The dispensary is expected
to carry over 50 strains of cannabis in the forms of pills, oils, waxes,
concentrates, edibles and tinctures.

Commerce explains that Mr. Zerman and the staff of Seven Point have
been strong supporters of Oak Parks health initiatives and is thrilled that
