This petition is for the issuance of a new owners
duplicate copy of Transfer Certificate of Title (TCT) No.
T-45557.

It is the torrens title of a parcel of land with improvements,
located at No. 3 Panay St. Golden Meadows Village, Las
Pias City, Metro Manila.

Mr. Witness, why are you asking the court for the
issuance of a new owners duplicate copy of TCT No. T45557?
Because our owners duplicate copy of the title was lost.
Can you explain how the owners duplicate copy of TCT
No. T-45557 was lost?
My wife and I have kept the owners duplicate copy of the
title, along with other important documents, with the bank
for safekeeping. A few years ago, we retrieved the
owners duplicate copy of the title from the bank in
preparation for a potential transaction involving the
property, which, however, did not push through.
Somehow, however, we lost track of the duplicate copy of
the title after that failed transaction and could no longer
figure out its whereabouts.
What did you do, if any, after you discovered that the
owners duplicate copy of the title was lost?
We diligently searched and looked for it in our house and
in other places where we could have placed them, but our
efforts proved futile. To date, it remains missing, and we
have reasonable grounds to believe that it was lost
beyond recovery.

We decided to execute an Affidavit of Loss of the title.

These are my name and my signature.

These are the name and the signature of my wife,
petitioner Mary Doe.

Why do you know that this is the signature of your wife?


Because I saw her sign the Affidavit of Loss, and I am
very familiar with her signature having seen her sign
documents in numerous occasions.
