WHAT IS IDAHO COALITION FOR MOTORCYCLE SAFETY?
Idaho Coalition For Motorcycle Safety (ICMS) is a state motorcycle rights organization (SMRO). Whether you
ride American or foreign, big bike or small, even if you don’t ride at all, ICMS works to protect and promote your
right to free choice and to ride free. From fighting discriminatory laws and practices to creating and promoting
educational programs, ICMS and its members stand for the preservation and advancement of the motorcyclists’
lifestyle.

ICMS closely monitors legislative action, traces legal trends and maintains a strong link with other motorcycle
rights organizations to insure its members are as fully informed and current on developments as is possible.
The members of ICMS are actively involved in their communities by raising funds for various charitable
organization and food drives. Members also take an active part in the political process, from passing petitions
to contacting legislators. Although it is not required for membership, ICMS would like to encourage a high level
of involvement.
ICMS works closely with governmental and private organizations to promote rider education programs, greater
motorcycle awareness, and is a leading proponent for the fair and unbiased treatment of motorcyclists in the legal
arena.
Additionally, membership in ICMS is an opportunity to meet, socialize and ride with a diverse group of people
joined together for the common good. ICMS members know how to have fun as well as get the job done. Join

WHAT HAS I.C.M.S. DONE?
Idaho Coalition for Motorcycle Safety (ICMS) was incorporated as a non-profit educational corporation in
September 1985 with the intent of introducing a rider education program to Idaho and to campaign for public
awareness for motorcycles.
ICMS was instrumental in organizing the Steering Committee in February 1991. ICMS was successful in
defeating HB301 which would have required all riders to wear motorcycle helmets. The Steering Committee
continued to work on motorcycle legislation in 1991 and 1992.
In April 1991 ICMS was successful in having the Idaho Transportation Department form a Motorcycle Safety
Task Force which prepared legislation known as the Motorcycle Safety Program for Idaho.
In January 1993 ICMS became qualified as a political action committee.
In March 1994 ICMS successfully lobbied the passage of the Motorcycle Safety Program which provides for
motorcycle rider education and licensing for Idaho.
Since January 1993 ICMS has been the full time legislative watchdog in Idaho. In Washington, DC ICMS was
successful in having 100% of our delegation vote in favor of motorcyclist’s rights and the federal blackmail of the
states without mandatory helmet laws was defeated.
In March 1995 ICMS was successful in lobbying to change the law to make a more equitable means of funding
Rider Education for motorcycle riders statewide.
ICMS is a sustaining member of Motorcycle Riders Foundation and actively works with and supports the work
of MRF in Washington, D. C. and in April 1995 brought the Best of the West Seminar to Boise. ICMS also
hosted the Best of the West Seminar in Boise in June, 2005.
2002 ICMS lobbied and it was passed that insurance companies cannot discriminate against motorcycle riders
on health care.
ICMS publishes the Two Wheel Advocate, a newsletter to keep its members currently informed of all legislation
that may affect motorcyclists.ICMS continues to work to protect motorcyclists’ rights, in Idaho and nationally.

At a time when our democratic process stands ready to strip us as motorcyclists and citizens of our rights to ride
free and unencumbered, ICMS offers all motorcyclists the opportunity to join together and fight back. Whether
the issue is mandatory helmet use or discrimination against “lifestyle” choice, the ICMS organization is prepared
to mobilize its strengths in the direction of best defense... and one of the ICMS’s greatest strengths is in its
membership. ICMS believes the direction of best defense is through education; from educating its membership
on the latest legislative battle to educating the legislators themselves on “the other half of the story;” to training
riders to ride safe.
Joining the ICMS is making a commitment to defend your freedom with active involvement. As an ICMS
member, you have the opportunity to attend monthly Board Meetings, runs, rallies, and a host of other events
throughout the state. Active members are involved by joining committees, holding office, manning telephones,
writing articles for the newsletter or doing any one of the million-and-one things that have to be done. ICMS
members tend not to be passive.

23rd ANNUAL ICMS AWARENESS RALLY HUGE SUCCESS!
For the 23rd year in row, the Idaho Coalition for Motorcycle Safety (ICMS) hosted its annual Awareness Rally.
According to Chuc Coulter, the purpose of this rally is to raise the awareness of motorists that motorcyclists are out
there and to reinforce the need to share the road. While ICMS serves many functions to the motorcycle community,
this particular event is strictly to raise the awareness of and remind motorists to watch for motorcyclists.

While individual motorcycles were not counted, a total of 865 waivers were signed with an additional 22 waivers for
minors submitted. There was great representation and support from various clubs, groups, and individuals. A wide
variety of motorcycles were present; from imports to choppers, Harleys and trikes, along with 6 scooters. This variety
of support reinforced the solidarity and unity of the event and reiterates ICMS’s goal to educate, promote awareness,
and to protect the rights and freedoms of all who ride.

Eastern Idaho Awareness Rally


The Eastern Idaho Awareness Rally boasted 726 motorcycles in attendance. JaRene Stewart, Coordinator of
the 2008 rally, described the ceremony as follows:
The POW/MIA members opened the ceremony by posting the colors. Then Frank Smith, of the American
Legion, led all in The Pledge of Allegiance. JaRene had copied and distributed the lyrics to The Star Spangle
Banner and all bikers and guests sang. JaRene said, “We are still getting the shivers!” After, the Mountain River
Ranch Pipes and Drums played America the Beautiful and Battle Hymn of the Republic. This was followed by
Dave Kahn, Dirt biker Dave, reading the State of Idaho Proclamation. STAR Instructor, Tom Hammond spoke
on behalf of the STAR program. JaRene recited a poem she had penned. The ceremony was brought to a close
with a prayer by Harry Lord, of the Christian Motorcycle Association (CMA). A moment of silence followed.
The group then rode to Freeman Park for a pig roast served and furnished by Dolly’s Club in Rigby, ID. A
terrific raffle was also held during the dinner and no-one was disappointed. In closing, JaRene said, “I want
to thank you all for attending and supporting the 2008 Rally. See you all next year, same place, same time, I
will be there.”

SPRING FUN RUN
ICMS’s 18th Annual Spring Fun Run was a wonderful opener to
a new riding season. Justin “The Kid” Crawford reports, “With 93
sign-ins, we had a greater turnout this year than in previous years.”
The Winner of high hand was Jeff Hannes, low hand Anne Larsen.
The Kid also said,” I want to thank all of the Clubs and everyone
who attended. ICMS appreciates everyone’s support and we look
forward to seeing you next year.”

NEW STAR COORDINATOR


Stacey Axmaker (Ax) came to Idaho from Oregon to become the STAR
training manager in 2006. Ax has been appointed by the Superintendent of
Department of Education to be the State Coordinator.

With Ron Shepard’s untimely death, this is a difficult transition. Everyone


is asked to support Ax in this new position for him. Ax is well qualified hav-
ing come from the Oregon rider education program and working with Ron
in the Idaho program. When you see Ax welcome him.

TRAINED RIDER EXPERIENCE


Utah: Rider Education and Fatalities. There are 143,000 motorcycle
endorsed riders in Utah. Of those some 25,000 have taken a rider
education/safety course. In the past 10 years Utah has experienced
342 bike fatalities. Only three of those had taken the rider education
course.

STATISTICS
Did you know that some of the statistics being used to promote mandatory
helmet laws ignore statistics collected by the same people. Those ignored
statistics tell a different story and that different story is that helmets are not
the answer. For example:
New Hampshire and Iowa have no helmet laws and the reported statistics
of fatality rates are 3.0 and 3.5 deaths per 10,000 motorcycles in 2006. And
the rates in Mississippi and Maryland, which have mandatory helmet laws,
show 20 and 12 respectively, per 10,000 motorcycles. Even the Insurance
Institute recognizes this.

ABATE OF CALIFORNIA ASKING FOR HELP
Many of you have been aware that over the last few years there has been a lot of litigation going on in California
over their mandatory helmet law. These various pieces of litigation in California are now narrowing down to one
important case and though in the past it has been just a few carrying the battle, now ABATE of California has
stepped into the fight. Now it’s getting very expensive.
Most have not understood that organizations like the State ABATE organizations (and like ICMS in Idaho) are
formed under strict legal restrictions that control what these organizations can do with their money if they want
to enjoy the exemptions from taxation, etc. The treasury of these organizations that are enjoying the exemption
cannot use their funds for the benefit of any individual. Helping someone out with their litigation, like fighting a
helmet ticket, is not the proper function for an exempt organization. As a consequence when asked for donations
and they don’t respond with a donation there can be hard feelings.
So the answer is that individual bikers can donate to support such an effort as this, but not the exempt
organization.
And, yes there have been occasions when these organizations have gone outside the limits. The “downed rider
fund” that many have is an example. But if they are using the exempt treasury, it is risky.
The California case is entitled Quigley v. California Highway Patrol, et al. The case has challenged the Highway
Patrol’s conduct in writing helmet tickets in the face of a court order not to enforce the California law. The
defect is that the law requires a rider to wear a helmet that is compliant with the federal FMVSS218 standard
for helmets. It is argued that neither the rider nor the officer can read that law and know how to comply with it.
The law can only be applied arbitrarily. The standard states nothing about a helmet’s fabrication nor what it is
supposed to look like. The law merely describes laboratory procedures that only appropriately trained engineers
would know how to follow. And if you follow the procedures you would destroy the helmet.
If you can’t understand it and you can’t follow it, the law is “vague”.
There is no list of “approved” helmets and a DOT sticker is not an approval because the Department of
Transportation does not “approve” helmets. In fact there is no entity that “approves” helmets. Depending on the
result of this lawsuit, many other states may benefit.
The whole analysis is an interesting exercise.
The bottom line for California is that they plan to win, but to do so is costing a lot of money and they’d appreciate
some help. Maybe do a fund raiser and send them the proceeds. If you do, contact ICMS and ICMS will make
sure the contribution gets to them.

BOISE IS NUMBER FOUR


A new study from The Media Audit ranks the Boise
area as number four in total motorcycles per capita out
of 88 cities surveyed. 14.8% of the residents in the area
own a motorcycle. Other northwest cities ranking high
were Spokane at #1 with 18.5%, Reno at 15.2%, and
Salt Lake with 14%. The Motorcycle Industry Council
attributes the recent growth to the rise in popularity of
motor scooters and female riders. Maybe it’s just all of
the great riding Idaho has to offer.

of motorcycle owners are married (59.2%) with an
average age of 41 years. Adults who own a motorcycle
earn $77,714 in annual household income, a figure that
is $12,424 higher than the household income for the
average U.S. adult. So much for the theory that we are
