COMPLAINT FOR PATENT INFRINGEMENT

This is an action for direct patent infringement of United States Letters Patent No.

D704,752 brought against defendant, who is an Ontario, Canadian corporation.

THE PARTIES

Plaintiff is S.A.S. of Luxemburg, a corporation duly organized and existing under

the laws of the State of Wisconsin. Plaintiff is the exclusive owner of U.S. Patent No. D704,752,
which is issued to Paul D. Secker on May 13, 2014.

Defendant is Bateman Manufacturing. On information and belief, Bateman

Manufacturing is a corporation duly organized and existing under the laws of Ontario, Canada.

JURISDICTION AND VENUE

This action arises under an Act of Congress, the patent laws as codified in Title 35

United States Code, and under Section 281 and other applicable sections thereof. Subject matter
jurisdiction is based on 28 U.S.C. Sections 1331 and 1338.

Plaintiff is a corporation organized in the State of Wisconsin. The defendant is on

information and belief actively doing business in the State of Wisconsin. This court has jurisdiction
under 28 U.S.C. Section 1332. Venue is proper in this judicial district under 28 U.S.C. Section
1391(c) and 1400(b).

CLAIM FOR RELIEF

On May 13, 2014, United States Letters Patent No. D704,752 was issued to Paul D.

Secker for an invention entitled, Extractor Tongs; plaintiff is presently the assignee of said Letters
Patent. A copy of Patent No. D704,752 is attached and identified as Exhibit A.

Defendants are presently directly infringing said Letters Patents by making, using,

selling and offering for sale an extractor tongs, offered under the product name of Autogator
embodying the patented invention, and are infringing said Letters Patents under Title 28 U.S.C.
Section 271. Defendant will continue their acts of direct patent infringement unless enjoined by this
Court.

The defendant is offering to sell its Autogator product through the Recycling Product

News magazine. The April 2016 issue of Recycling Product News on page 20 includes an
advertisement of the Bateman Autogator. The Autogator product may be purchased through its
website of www.batemanmanufacturing.com. A front page of the Recycling Product News
magazine, page 20 of the same and an enlarged view of the Bateman advertisement and identified as

Exhibit B. The Bateman Autogator product was offered for sale in Wisconsin, because a copy of
the April 2016 Recyling News was mailed to Paul Secker of SAS Forks at an address of 2425
Ironwood Drive, Green Bay, WI 54304. Therefore, Bateman Manufacturing offers its products for
sale in the state of Wisconsin.

The Autogator product directly infringes the Claim of US Patent No. D704,752 by

being confusingly similar to the ornamental design for extraction tongs, as shown and described.

Plaintiff is entitled to damages from the date of issuance of said patent, under 35

U.S.C. 287. Defendant does not have a license from Plaintiff to utilize US Patent No. D704,752.

WHEREFORE, Plaintiff S.A.S. of Luxemburg, Ltd. respectfully prays this Court for an
Order:

1.

Granting judgment in favor of plaintiff and against the defendant herein, said order

holding that defendants have infringed United States Letters Patent No. D704,752.

2.

Awarding to plaintiff its compensatory and consequential damages incurred by

plaintiff, because of such infringement, and further that such damages assessed be trebled in
accordance with 28 U.S.C. Section 284;

3.

Enjoining defendant by preliminary and permanent injunction from continuing their

acts of infringement of said patent, said injunctions to be binding on defendant, its officers, agents,
servants, employees, and attorneys, as well as any juridical persons owned or controlled by them,

and upon those persons in active concert or participation with them who receive actual notice of the
order by personal service or otherwise;

Awarding to plaintiff prejudgment and post judgment interest on the award of

damages, as well as its Court costs;

5.

Awarding to plaintiff its reasonable attorney fees incurred in prosecuting this action

under 28 U.S.C. Section 285, and holding that, because of the willful and deliberate nature of
defendants acts of infringement, the present action is an exceptional case;
6.

That the defendant be ordered to collect and tender for destruction all infringing

product under its control.

7.

For such other and further relief as to this Court shall appear just and equitable.

Authority For Civil Cover Sheet
The JS 44 civil cover sheet and the information contained herein neither replaces nor supplements the filings and service of pleading or other papers as required
by law, except as provided by local rules of court. This form, approved by the Judicial Conference of the United States in September 1974, is required for the use
of the Clerk of Court for the purpose of initiating the civil docket sheet. Consequently, a civil cover sheet is submitted to the Clerk of Court for each civil complaint
filed. The attorney filing a case should complete the form as follows:
I.
(a) Plaintiffs-Defendants. Enter names (last, first, middle initial) of plaintiff and defendant. If the plaintiff or defendant is a government agency, use only
the full name or standard abbreviations. If the plaintiff or defendant is an official within a government agency, identify first the agency and then the official, giving
both name and title.
(b) County of Residence. For each civil case filed, except U.S. plaintiff cases, enter the name of the county where the first listed plaintiff resides at the

Jurisdiction. The basis of jurisdiction is set forth under Rule 8(a), F.R.C.P., which requires that jurisdictions be shown in pleadings. Place an X in one
of the boxes. If there is more than one basis of jurisdiction, precedence is given in the order shown below.
United States plaintiff. (1) Jurisdiction based on 28 U.S.C. 1345 and 1348. Suits by agencies and officers of the United States are included here.
United States defendant. (2) When the plaintiff is suing the United States, its officers or agencies, place an X in this box.
Federal question. (3) This refers to suits under 28 U.S.C. 1331, where jurisdiction arises under the Constitution of the United States, an amendment to the

Residence (citizenship) of Principal Parties. This section of the JS 44 is to be completed if diversity of citizenship was indicated above. Mark this section
for each principal party.

Nature of Suit. Place an X in the appropriate box. If the nature of suit cannot be determined, be sure the cause of action, in Section VI below, is
sufficient to enable the deputy clerk or the statistical clerks in the Administrative Office to determine the nature of suit. If the cause fits more than one nature of
suit, select the most definitive.

Origin. Place an X in one of the seven boxes.

Original Proceedings. (1) Cases which originate in the United States district courts.
Removed from State Court. (2) Proceedings initiated in state courts may be removed to the district courts under Title 28 U.S.C., Section 1441. When the petition
for removal is granted, check this box.
Remanded from Appellate Court. (3) Check this box for cases remanded to the district court for further action. Use the date of remand as the filing date.
Reinstated or Reopened. (4) Check this box for cases reinstated or reopened in the district court. Use the reopening date as the filing date.
