AFFIDAVIT OF WITNESS

I, MAINE M. RICHARDS, of legal age, Filipino, single and a

resident of #145 Italy Drive, Bagong Buhay Subdivision,
Brgy. Miranda, Pontevedra, Negros Oriental, after having
been duly sworn to in accordance with law, depose and state
that:

1. I am an owner of a mini-grocer located at Bagong

Buhay Subdivision, Brgy. Miranda, Pontevedra, Negros
Occidental;
2. I personally know of the deceased, Andrew Tuvilla and
his spouse, Mary Joanne Tuvilla as they are both my
neighbors and are patrons of my store;
3. I also personally know Ramon Lanzar Jr., Monterio
Jiloma, Leo Ubera as they are likewise patrons of my
store;
4. My store opens at around 6:00 in the morning until
12:00 midnight;
5. Last July 26, 2016, the group of Ramon Lanzar Jr.,
Monterio Jiloma, Leo Ubera came to the store at around
9:00 in the evening to have their drinking session;
6. Together with them is a guy named Jojo, who was
introduced to me by Leo Ubera;

7. Around 11:10 in the evening, the spouses Andrew and

Mary Joanne Tuvilla passed by our store where they
met their friends Ramon, Monterio and Leo;
8. The group of Ramon then invited the spouses to join
them which the latter obliged;
9. I executed this affidavit to attest the truthfulness of the
foregoing facts.

AFFIDAVIT OF WITNESS

I, SEAN MALIK, of legal age, Filipino, married to Gigi Malik,

and a resident of #124 Italy Drive, Bagong Buhay
Subdivision, Brgy. Miranda, Pontevedra, Negros Oriental,
after having been duly sworn to in accordance with law,
depose and state that:

1. I am a resident of Bagong Buhay Subdivision, Brgy.

Miranda, Pontevedra, Negros Occidental for sixteen
(16) years, from 2000 until present;
2. I personally know the spouses as they are my next
door neighbours;
3. Last July 26, 2016, at around 11:45 in the evening, I
heard the spouses went home with a group of friends. I
peeked into the window to see what was happening
outside as our dogs were barking very loudly;
4. I saw Andrew Tuvilla and Mary Joanne Tuvilla opening
their gate with four (4) other men with them;
5. At around 12:30 in the morning, I again heard our
dogs barking very loudly. As I peeked through the
window, I saw a man, who was one of the friends who

came home with the spouses, outside. He seemed to be

waiting for someone under our gates light post;
6. Just a few minutes after, I saw a group of policemen,
approximately around ten (10) armed men in police
uniform approached the one who was waiting under the
light post;
7. One of the men talked to the person waiting under the
light post and gave an envelope and bottles of liquors;
8. After a quick conversation, the man waiting under the
light post went back inside the spouses house while
the group of ten (10) armed men in police uniform
waited just outside the [spouses] gate;
10.
I executed this affidavit to attest the truthfulness
of the foregoing facts.

AFFIDAVIT OF WITNESS

I, CHRISTINA CHISMOSO, of legal age, Filipino, married

to Kael Chismoso, and a resident of #125 Italy Drive,
Bagong Buhay Subdivision, Brgy. Miranda, Pontevedra,
Negros Oriental, after having been duly sworn to in
accordance with law, depose and state that:

1. I am a resident of Bagong Buhay Subdivision, Brgy.

Miranda, Pontevedra, Negros Occidental for ten (10)
years, from 2006 until present;
2. I personally know the spouses as they are my next
door neighbours and our fellow officers in Bagong
Buhay Home Owners Association;
3. On the early morning of July 27, 2016, I was awakened
by gun shots fired. I woke my husband, Kael Chismoso
to accompany me in checking what was happening;
4. I then saw a group of armed men, approximately
around seven (7) of them, in police uniform standing
just under the lighted post outside the Tuvillas
resident;

5. Just after a few seconds, I heard Mary Joanne cry for

help which prompted me to go outside our house to
check what was happening;
6. My husband initially stopped me from going out as
there might be unforeseen danger, but eventually
allowed me to do so;
7. I then rushed into the house of the spouses through a
back gate connecting their house to ours and the
Maliks;
8. Through their kitchen screen door, I immediately saw a
body lying on the floor with Mary Joanne carrying the
upper portion of it;
9. I immediately rushed towards Mary Joanne and saw the
body of Andrew Tuvilla, lifeless and full of blood;
10.
I then asked Mary Joanne what happened, but she
was not answering and was only crying aloud;
11.
One of the armed men within the living room, in
police uniform then answered me sarcastically, t kay
indi gid b mag untat pang deal, to which I answered
with a confused look;
12.
As a trained paramedic, I tried reviving Andrew to
no avail, as there was a lot of blood gushing out of his
wounds, one near the chest area and one on the thigh;

I executed this affidavit to attest the truthfulness
of the foregoing facts.
