CRIMINAL COMPLAINT AFFIDAVIT
I, Mary Joanne Tuvilla, the undersigned, of legal age, and
a resident of #123 Italy Drive, Bagong Buhay Subdivision,
Brgy. Miranda, Pontevedra, Negros Oriental accuses Chief
Inspector Andrew Cruz, SPO3 Ian Go, SPO2 Alexander
Pos, and SPO2 Gerrold Trespa of the crime of Murder,
committed as follows:

1. At around 11:00 PM last July 26, 2016, the now

deceased, Andrew Tuvilla, was driving his motorbike,
along the streets of Corner Canada Drive and China
Drive when he met his wife, the undersigned, Mary
Joanne Tuvilla;
2. As they were driving, they met their friends Ramon
Lanzar Jr., Monterio Jiloma, Leo Ubera and one Jojo.
They invited the couple to join them as they were
having their drinking session;
An affidavit of the witness is attached herewith
as Annex A.
3. Andrew Tuvilla and Mary Joanne Tuvilla initially refused
but when they were asked again, Andrew consented
and the couple stayed for approximately 15 minutes;
4. Jojo was introduced to Andrew and Mary Joanne as
the batch mate of Leo Ubera who eventually met with
the latter as they were having their batch reunion last
June 2016;
5. When the store where the friends drank closed, all of
them decided to continue their merry-making in
Andrew and Mary Joannes house;

6. When they got into the house of the couple, they then
contributed 100 pesos each to buy new drinks. Jojo,
however, told them that he has to go outside to call
someone;
7. When the group finally came up with the complete
collection for their drinks, Ramon, Monterio and Leo
went out to buy the drinks leaving Andrew and Mary
Joanne in their abode;
8. Just a few minutes after the group went out, Jojo
came back surprisingly with a stash of money. He
claimed that a friend who owed him money met him
outside and paid him. He likewise introduced several
imported liquor claimed to be very potent;

9. While waiting for Ramon, Monterio and Leo to come
back, Jojo asked Andrew to taste Absinthe as this was
the most potent of all the drinks he brought;

Andrew obliged. As he was on his 3 rd glass, he felt
a little dizzy yet Jojo made him drink a little more as
they are still waiting for their friends to come back.
During this time, I was still in the kitchen preparing for
their pulutan, but can also vividly hear the
conversation in the dining area;

effects is herewith attached as Annex B.

When I checked, Andrew fell asleep on the dining
table after his 5th glass of Absinthe;
12.
To my shock, two (2) armed men thereafter
entered their house and announced that Andrew is
arrested pursuant to their buy bust operation;

When Andrew awakened, his initial instinct was to
protect me. He then grabbed a kitchen knife and
proceeded to confront the two (2) armed men in the
living room. He, however, instructed me to remain
inside the kitchen so that I will not be caught in the
middle of the altercation;
14.
As Andrew went into the living room, two (2)
gunshots were fired. To my horror, I went out to see
Andrew already lying on the floor, in his own pool of
blood;
15.
Standing and carrying firearms were two (2) men
in PNP uniform and Jojo;
16.
It took about fifteen (15) minutes before the
entire team of Pontevedra Police enter our house and
took some items inside allegedly as evidence against
Andrew;
17.
One of our neighbours, however, rushed towards
our house just a few minutes after he heard the
gunshots. He then saw Andrew on the floor with no life.
He walked towards us asking, ano natabo, Jo?;
18.
One of the men inside the house then answered
him, t kay indi gid b mag untat pang deal, apparently
answering my neighbours question;

19.
From my view, I can clearly see the police officers
take what apparently was a firearm from Andrews
body, when I can remember that he only took a kitchen
knife with him to confront the armed men in our living
room;
20.
I later on, I identified the armed men to be SPO3
Ian Go and SPO2 Alexander Pos. Jojo was later on
identified as SPO2 Gerrold Trespa, who intentionally
befriended Leo Ubera to serve as the infiltrator;

21.
That all these stated herein are true and were
stated freely without any force or intimidation done
against me;
22.

the subject of the

operation at Barangay Miranda.

Police said that during the operation, they heard shots being
fired by the suspects prompting them to shoot back.
Barangay Chairman Eddie Garcia earlier said he brought Tuvilla to the
Pontevedra Police last week to surrender after the suspect promised to
stop his illegal operations.
However, Garcia said he recently found out that the illegal drug
operation in Tuvilla's house continued.
Recovered from the crime scene were the .45 caliber pistol used by
Tuvilla and a .38 caliber pistol used by one of his companions.
