FranciscoHerrerasapplicationforaWritofMandatetocompeltheSanFranciscoDept.ofElectionstoprinthis
Chinesenameontheballot.JudgeKahnagreedtohearthecaseasitwasinthepublicinterestafterMr.Herrera
successfullychallengedapreliminaryrulingagainsthim.
Herrerasubmittedhisthree character ChinesenametoElectionswithhisnominationpapersforD11Supervisor
inmidJune.ThenamewasgiventohimduringhiscampaignforMayorbyasupporterwhohasdonetranslation
workforSFUSD.Herrerastranslator, who was supportive of his Mayoral bid,pointedouttohimthatElections
eight character phonetictranslationamountedtogibberishinChinese.He thencreatedathreecharacter
transliterationfor Herrera basedonthefirstsyllableofhisfamilynameandtwosyllablesofhisgivenname.The
ChinesecharacterschosenarealsoarerepresentativeofMr.Herrerascharacter,familyhistory,andaffinitiesas
heisknownasastandupguywhocomesfromamusicalfamily.
For the D11 Supervisorial race, Elections rejected Herrara's given name on the grounds that it sounded like "Van
Gogh" and issued their final decision that the eight character "gibberish" would be used instead. The court action
followed.
Herrerachosetorepresenthimselfincourt.Ofcourse,Imdisappointedintheruling,Herrerasaid.Ifollowed
thelaw.Electionsignoredtheirowncalendarandrefusedtohearmycomplaint.Othercandidatesmoreinline
withthepoliticalmachineareallowedtousewhatevernamestheyfeelmightgivethemanadvantageatthepolls.
MynamewasgiventomebyamemberoftheChinesecommunity.Itwillnotbeontheballot.ThetreatmentI
receivedwasdiscriminatory.
Herreravowstokeepfighting.Even though it won't be on the ballot, IllcontinuetousetheChinesenameIam
nowknownbyintheDistrictthatIllbeproudtorepresent.Illcontinuetofightforsocialjusticeandequal
opportunityandtostrengthenthefabricofourcommunitybaseduponrespectfordiversity.
