    FOR IMMEDIATE RELEASE  September 14, 2016  CONTACT:  Francisco Herrera  (415) 812­-9362       Email:  franciscoherrera001@gmail.com ELECTIONS STRIKES D11 CANDIDATE’S CHINESE NAME AND REPLACES IT WITH  “GIBBERISH”  On Wednesday, September 14, Superior Court Judge Harold Kahn denied District 11 Supervisorial Candidate  Francisco Herrera’s application for a Writ of Mandate to compel the San Francisco Department of Elections to print his Chinese name on the ballot. Judge Kahn agreed to hear the case as it was “in the public interest” after Mr. Herrera  successfully challenged a preliminary ruling against him.  Herrera submitted his three character Chinese name to Elections with his nomination papers for D11 Supervisor  in mid­June. The name was given to him during his campaign for Mayor by a supporter who has done translation  work for SFUSD. Herrera’s translator, who was supportive of his Mayoral bid, pointed out to him that Elections’  eight character phonetic translation  amounted to “gibberish” in Chinese. He then created a three character  transliteration for Herrera based on the first syllable of his family name and two syllables of his given name. The  Chinese characters chosen are also are representative of Mr. Herrera’s character, family history, and affinities as  he is known as a “stand­up” guy who comes from a musical family. For the D11 Supervisorial race, Elections rejected Herrera's given name on the grounds that it sounded like "Van Gogh" and issued their final decision that the eight character "gibberish" would be used instead. The court action followed. Herrera chose to represent himself in court. “Of course, I’m disappointed in the ruling,” Herrera said. “I followed  the law. Elections ignored their own calendar and refused to hear my complaint. Other candidates more in line  with the political machine are allowed to use whatever names they feel might give them an advantage at the polls.  My name was given to me by a member of the Chinese community. It will not be on the ballot. The treatment I  received was discriminatory.”   Herrera vows to keep fighting. “Even though it won't be on the ballot, I’ll continue to use the Chinese name I am  now known by in the District that I’ll be proud to represent. I’ll continue to fight for social justice and equal  opportunity and to strengthen the fabric of our community based upon respect for diversity.”   Case details and rulings are available on the SF Superior Court Website.  http://www.sfsuperiorcourt.org/online­services  by Petitioner’s name: Francisco Herrera, Case Name: Francisco Herrera v. John Arntz, and Case Number CPF­16­515244.
