OFFICER/CREW AGREEMENT

This Agreement is made on 20/12 of year 2016 between

Messrs KATA MARINE SDN BHD (hereafter calledthe company)owner/agent of
Motor Vessel/Tanker
MT RAWU III Flag : MALAYSIA GRT: 729 and KOSTANTINUS MAIGODA (hereafter
calledthe Officer).

This Agreement is concluded pursuant to the ters and condition as follows :

1. The company will employ the Officer/Crew and Officer/Crew to serve the
vessel owned/managed and or operated by the company with working hours
at discretion of Owner/Master/Chief Engineer of vessel.
Employee understands that the wage indicated in Clause(3a) is all inclusive
of any overtime that he many be required to perform under the contract.
2. The period of service hereunder shall be 12 (Twelve) months.
Duration will commence from the date of engagement,subject to a
probationary period of 3 (three) months.During the probationary period,the
company reserves the right to terminate misconduct of the Officer/Crew
concerned.In such case the Officer/Crew will be responsible for his
repatriation.The termination of the service during period may be effected at
the port engagement.
3. (a)The Company shall pay the Officer/Crew for his service the aforesaid sum
of RM 4.200/z (Malaysia) per month payable on the calendar month during
the period of the contract of agreement.
(b) Increment on his salary shall be based on merit only.
4. Provision of food for the Officer/Crew will be supplied to the vessel by the
Company.
5. The Company shall be at liberty to terminate this Agreement by giving the
Officer /Crew a
1(One) month salary in lien of notice.
The Company reserves the right to terminate his service immediately and
without further notice if the Officer/Crew has been found guilty of negligence
and or misconduct in which case the Company shall,in the case,be the sole
judge of the matter.It is also agreed that the Officer/Crew can terminate this
Agreement by giving the Company a 1(One) month notice or a refund of
1(One) month salary.
6. Should the Officer/Crew breach the contract,all expenses incurred during the
course of employing him shall be at his own account,including but not limited
to,cost of security bond and medical examination required for the processing
of the work permit as well as the work permit.

In the event the Officer/Crew breaks the law or commits an act that causes the
security bond to become payable ,the Officer/Crew hereby agree to indemnify
the company agains any losses incurred by the company asa result of his
action.
7. In the even the Officer/Crew should request termination before expiry of
this contract,his transport and subsistence during repatriation to his home
town shall be at his own account.The Officer/Crew shall also repay,on a prorated basis,of all the costs incureed to process his work permit,including but
not limited to,the cost of the security bond,medical examination(s) and work
permit.
8. The company will be responsible for the repatriation of the Officer/Crew to
his country of origin upon completion of this Agreement.
9. The Officer/Crew agreesto be transferred to any other vessel controlled by
the Company and or their associated Company provided always that the
rating and the rate of wages be the same as herein specified and the total
service does not exceed 24 (Twenty-Four) months.
They also agree to be accommodated ashore during transfer when
necessary.
10. Officer/Crew shall be entitled to regular hospitalization and medical
treatment fees of their expenses under the established Internasional Maritime
Practice.
11. Compensation for death or injury resulting whilst in performance of duty and
compensation of damage/loss to personal effects cause by loss of vessel or
any ship accident shall be handled according to the terms and condition of P &
I insurance and according to the laws of the Nationality of the vessel.
12. Officer /Crew is required to observe all Safetyand Environmental Protection
Regulation and to adhere to the Company,s Safety Management Manual.
13.

The Law for the time being in force in Malaysia shall apply to this Agreement
and the same shall be interpreted and applied in accordance with such Laws
and parties here to submit to the jurisdiction of the court of the Malaysia.
IN WITNESS WHEREOF the Company and the Officer/Crew have executed
this Agreement on the date appearing at the head here of.
