A commentary on Practice of Law 694 SCRA 795

Technology has highly evolved over time. It is not surprising how every
minute of what we do involves the use of technology, from the simple
how tos to seeking advices off the internet about important and
crucial circumstances we encounter. But what is interesting is the use
of these tools as a bridge of the citizens to the legal practitioners if it
comes to legal advices. Best example is the great deal of websites in
which you could ask real lawyers free of charge. Not only it succors
people who cant meet the expense of lawyers fees, but also, it is
perhaps the most within easy reach of everyone. Nonetheless,
technology has also caused the unauthorized to give out legal
advices to people, which can be deceptive and equivocal. Like what the
author said in the article, individuals who, having studied the basic
and rudimentary application of the law and with familiarized
themselves with the procedure related to the enforcement of such law,
have presented themselves to the public as providers of legal relief.
More often than not, individuals, as soon as they knew somebody
studying in the field of law will assume proficiency to the latter then
seek advice and feels satisfaction with the counsel given. I think that
in the practice of laws, as the definition given by the Supreme Court,
or at least how I understand it, it may be restricted to certain persons,
particularly those who are members of the Bar, or to those who are not
members, but are trained and experienced individuals.
I personally believe that, practice of laws is so intricate that not
everyone are entitled to exercise unless given the authority, and that
practice of laws are given to those who are privileged and are worthy
of it.
We cannot stop innovation. Not only material things are innovating or
evolving, but also the way of living, aspects of making a living, and
also the way a person think is also changing. People nowadays are
being practical. They want things to become easier and more

accessible, because who would say that people doesn't want an easy
life. Let's admit it. We all want that. But not all things should be made
easy, it should take time, dedication and diligence and one of that is
Legal Profession. One of the most noble and valuable profession.
Legal profession is not a joke, it is a very serious profession so that's
why not all people even though having the access of free information
in the internet about legal matters could apply the practice of law.
That's why there are law school to mold law students to become a
skilled lawyers and could properly and effectively grasp the practice of
law.
The so called practice of law now a days is becoming very rampant
brought by the increasing innovations on our technology. The
consequence in the society is that we are too much relying ourselves
sometimes on the resources that are provided online. This should not
be the norms that the world of legal profession should be. Even if that
sources of legal knowledge is becoming easier to access by the those
professional who are not certified to be in a practice of law, for me this
should not be how a practice of laws should be. For me there should
be a law that would prohibit this act. The reason is that we might not
know and for those people who badly needs an assistance of a legal
expert the reliability of the legal information that are provided.
It is rather favorable that who took and pass the bar exam are the
only ones who will be recognize to engage in the practice of law. Once
they get they passed the bar, we can now consider them as certified
one who is authorized for legal profession.
There is also no issue when a practice of law is exercised by a bar
passer who did not go into the litigation profession. A manager can still
exercise his knowledge as a lawyer if he Is really indeed certified by
the supreme court.
In trying to find the meaning of Practice of Law on the internet, it is,
in its most general sense, the practice of law involves giving legal
advice to clients, drafting legal documents for clients, and representing
clients in legal negotiations and court proceedings such as lawsuits,
and is applied to the professional services of a lawyer or attorney at
law, barrister, solicitor, or civil.
It is very clear that only those who
passed the bar are given the right to full practice of law.
But, according to a website, as a general matter, only a lawyer may
give actual legal advice, whereas any non-lawyer may recite legal
information. Furthermore, it is generally illegal for a non-lawyer or

unlicensed attorney to offer legal advice or otherwise represent


someone other than himself or herself in a court of law.
In conclusion, the three of us have the same perception on the
practice of law.
