KARLO ANGELO DABALOS, boyfriend of complainant, was charged with violation of RA 9262, for the
alleged use of personal violence on the said complainant [name not revealed pursuant to VAWC], by
pulling her hair, punching complainants back, shoulder and left eye, thereby demeaning and degrading
the complainants intrinsic worth and dignity as a human being, in violation of Section 5(a) of the Republic
Act 9262.
In his motion, DABALOS alleged that at the time of the said incident, they were not in a dating
relationship anymore. Hence, RA 9262 does not apply.
Complainant admitted that her relationship with petitioner had ended prior to the subject incident.
RTC: denied Dabalos motion, ratiocinating that since the parties had admitted a prior dating relationship,
the infliction of slight physical injuries constituted an act of violence against women and their children as
defined in Sec. 3(a) of RA 9262
