REGULATION ORDINANCE NO. 2013-328


AN ORDINANCE REQUIRING ALL CONTRACTORS AND OWNERS
OF CONSTRUCTION SITES TO CLEAN UP THEIR CONSTRUCTION,
RENOVATION AND DEMOLITION DEBRIS AND PROVIDING
PENAL TIES FOR VIOLATIONS THEREOF

WHEREAS, construction, renovation and demolition projects in the City, both public and
private, are sometimes left with debris, like earth mounds, sand/gravel stockpile, open excavation
and other construction materials along public roads and highways or public lands;

WHEREAS, construction, renovation and demolition debris pose a danger to motorists


and coftfmuters alike, and contribute to clogging of waterways during a heavy downpour;

WHEREAS, it is the policy of the City Government oflloilo to be firmly committed to


the implementation of the State principles, policies and the provisions of the Local Government
Code of 1991 and the National Building Code of the Philippines as well as to promote and
protect our people's and the environment's welfare by requiring all contractors to clean up the
location of their finished projects.
WHEREAS, SECTION 1.01.07 (a) of the National Building Code of the Philippines
states that:

"The land <>r site upon which will be constructed any building <Jr
stn1cture, or any ancillary or auxiliary facility thereto, shall be sanitary, hygienic
<>r sqfe. Where the /a11d or site is polluted, insanitary, unh}gienic, unsqfe, or
hazardous, conditions contributing to or causing its bei11g polluted, insanitary,
unhygienic, unsafe, or hazardous shall he reasonably improved or corrected, or
proper remedial measures shall be prescribed or incorporated i11 the design or
constn1ction <if the building or struct11re. "
NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City of
lloilo, that
SECTION 1. TITLE. ~This Ordinance shall be known as "An Ordinance requiring
all contractors and owners of construction sites to clean up their construction, reno1,ation and
demolition debri.~ along public roads and/or lands and providing penalties for violaJions
there<Jf'.
SECTION 2. APPLICABILITY. - The Ordinance shall be applicable within the entire
territory and jurisdiction of the City of Jloilo and shall be implemented by the City Engineers
Office which shall be tasked to monitor and inspect all finished public and private construction,
renovation and demolition projects.

SECTION 3. DEFINffiON OF TERMS.

BUII~DING

- refers to any man made structure built from the ground constructed for a
purpose as per standard plans and specifications, or as defined in the National Building
Code
Any structure built for the support, shelter, or enclosure of persons,
animals, chattels, or property of any kind. (National Building Code of the
Philippines)

2. CITY BUILDING OFFICIAL - is a technical person duly designated by the Secretary of


DPWH as Building Official in a city whose main function is to implement properly PD
1096, otherwise known as the National Building Code of the Philippines;
3. CONTRACTOR - is a person, firm or corporation who perfonns any construction,
demolition, remodeling, or landscaping service relating to buildings or accessory
structures.

4. CONSTRUCTION, RENOVATION AND DEMOLITION DEBRIS - are building


materials and solid waste generated from construction and demolition activities,

including, but not limited to, sand/gravel stockpile, fully cured asphalt, concrete, brick,
rock, soil, lumber, gypsum wallboard, cardboard and other associated packaging, roofing
material, ceramic tile, carpeting, fixtures, plastic pipe, metals, tree stumps, and other
vegetative matter resulting from land clearing and landscaping for construction,
deconstruction, demolition or land developments.
5. UTILITIES or UTILITY COMPANY - are service companies such as electric, water,
telephone, telecommunications providers, and the like.

SECTION 4, PROHIBITIONS. I. It shall be unlawful for any contractor, building owner, utility company, or government
agency to leave any debris along all public roads or on public lands, upon completion of
its construction, renovation and demolition projects.
2. Contractors, building owners, utility companies, or government agencies are required to
install and provide appropriate and sufficient reflectorized warning signs before and after
their construction sites. Furthermore, provision of steel metal plating for excavation sites
shall be undertaken by the contractors_
3. It shall be unlawful for any contractor, building owner, utility company to stockpile
construction materials along public roads in the course of any construction, renovation, or
demolition activity.
4. The City Engineer and/or Building Official shall not approve the Occupancy Permit and
Certificate of Completion of a structure unless all public roads and/or lands affected by
any construction, renovation and demolition activity shall be cleared of debris produced
by the same activities.

SECTION 5. NOTIFICATION OF VIOLATION. Whenever it is determined that construction debris exists along public roads/lands, the
City Engineer's Office shall notify and instruct in writing the contractor or building
owner to remove the debris within three (3) working days of receiving the notice.
2. Tn the case of non-compliance by, or the absence of a response from, the contractor or
building owner after the notice has been received and the three day period has elapsed,
the City Engineers Office will undertake a clean-up operation of the debris and stockpiled
materials left on the road in the concerned site.
In such case that the City Engineer's Office will undertake the clean-up operation, a bill
to be prepared by the said office for the total cost of the clean-up shall be charged to the
contractor or building owner.

SECTION 6. PENALTIES AND SANCTIONS. 1. For non-compliance or violation of Section 4_ l, 4.2 and 4.3 of this Ordinance, the City
Government, may undertake the clean-up of the area at the expense of the contractor or
building owner. The following shall likewise be imposed on the erring contractors:

A fine of 5,000.00 and the clean-up cost of P 10,000.00.

2. In case the contractor or building owner fails to pay the fine of P 5,000.00 and clean up
cost of P 10,000.00 within three (3) days from receipt of the bill, the penalty of

suspension of business permit and possible blacklisting of the contractor in all biddings in
the city government of lloilo shall be imposed.
3. Payments of fine shall be made directly to the Office of the City Treasurer.
SECTION 7. SEPARABILITY CLAUSE. - If for any reason, any provision of this
Ordinance shall be declared unconstitutional or not valid by any court for competent jurisdiction
such judgment shaJI not affect or impair the other provisions or parts thereof which shall
continue to be in force and in effect
SECTION 8, REPEALING CLAUSE. - All Ordinances, rules and regulations or any
part thereof which are in conflict with or inconsistent to the provisions of this Ordinance are
hereby repealed, superseded and/or modified accordingly.
SECTION 9. EFFECTIVITY CLAUSE. - This ordinance shall take effect 30 days after
its publication in a local newspaper of general circulation.
Let copies of this ordinance be furnished the Office of the City Mayor and the Bids and
Awards Committee (BAC), for information and guidance.
