REGULATION ORDINANCE NO. 2014-140

AN ORDINANCE EXTENDING THE FRANCHISE OF DON BENITO Q. ACAP,
SR. PERIMETER B<)UNDARY TERMINAL TO OPERATE AND MAINTAIN A
PUBLIC UTILITY T~RMINAL AT BARANGAY MOHON, AREVALO, ILOILO
CITY, FOR A PERIOD OF TWENTY (20) YEARS
Sponsored by Councilor Plaridel C. Nava II, duly seconded by Councilors
Rodel F. Agado, Jason R. Gonzales and Carlos P. Guarin

WHEREAS, pursuant ~ Regulation Ordinance No. 2005-214, the city government of Iloilo
City, through the Sangguniang':Panlungsod has granted Don Benito Q. Acap, Sr. Perimeter Boundary
Terminal to operate and main.ain a public utility boundary terminal in Barangay Mohon, Arevalo,
Iloilo City, for a period often (IO) yedars;
WHEREAS, the owner and management of the said boundary terminal has applied for an
extension of its fracnhise granted by the city government which is about to expire;
WHEREAS, the Committee on Transportation has favorably recommended for the approval of
the ordinance extending the applicant's franchise after finding that it has all the qualifications and
none of the disqualification.

NOW, THEREFOREJ! be it ordained by the Sangguniang Panlungsod of the City oflloilo, that:
Section 1. -The franc~ise granted to Don Benito Q. Acap, Sr. Perimeter Boundary Terminal to
operate and maintain a public utility boundary terminal in Barangay Mohon, Arevalo, Iloilo City, shall
be extended for a period of twenty (20) years.

Section 2. - The term$ and conditions set forth in Regulation Ordinance No. 2005-2134 shall
remain effective, applicable Jd reiterated.
Section. . 3. - The proyision of the comprehensive perimeter boundary ordinance against transloading shall be strictly and f8fthfully enforced by the terminal.
Section 4. - If any wovision of this Ordinance is held invalid by a competent court, the
remained provision shall not hie affected thereby.
Section 5. - The grant~e of this franchise shall cause this ordinance to be published once in a
newspaper of general circulation in the City of Iloilo and this ordinance shall take effect after ten (10)
days from publication date.
