REGULATION ORDINANCE NO. 2014-086


AN ORDINANCE CREATING THE ILOILO CITY LIQUOR
LICENSING AND REGULATORY COUNCIL (ICLLRC), AND
OTHER RELATED PROVISIONS

Joshua C. Alim, duly seconded by Councilors Lyndon V. Acap and
Plaridel C. Nava II
WHEREAS, Book Ill, Article 3 Section 458 (4) {v) of the Local Government Co of the
Philippines allows the Sangguniang Panlungsod to regulate the sale, giving
ay or
dispensing of any intoxicating malt, vino, mixed or fermented liquors at any retail outle ;
WHEREAS, there is a need to create an office for licensing and regulation of Ii uor or
other alcoholic beverages within the vicinity of lloilo City and to help in the implementa ion of
the provisions and ordinances related hereof;
NOW, THEREFORE, be it ordained, as it is hereby ordained by the City C uncil of
lloilo, THAT:
SECTION 1. Declaration of Policy. It is hereby declared that it is the policy of the
City of lloilo:

1. To regulate the selling, serving and dispensing of liquor and/or alcoholic beverages;
2. To regulate the est$blishment and operation of the liquor and/or alcoholic beverages
business in the City;
3. To provide for the C<1>11ection of fees and charges constituting lawful source of revenues
or income; and
4. To compel business establishments who sell, serve or dispense of liquor or alcoholic
beverages to comply with the requirements of law, ordinances and directive regulating
business operations,
SECTION 2. Definition of Terms - :
a. lloilo City Liqa.>r Licensing and Regulatory Council (ICLLRC) - an office
created to overs~e. facilitate and regulate the sale and serving/dispensing of liquor
or alcoholic bev~rages within lloilo City;
b. Liquor or alcotjolic beverages - shall include any alcoholic drink containing a
specific percent~ge of alcohol by volume or weight which may be in the form of
whisky, brandy, i gin, rum, cordial, liquor, cocktail, wine, champagne, vermouth,
basi, tuba, saki, beer, ale, stout and others;
c. Licensee - any entity, whether a person, partnership, firm or corporation, allowed
by law to engage in the business of selling, or serving/dispensing liquor or alcoholic
beverages;
d. Selling - to provide, supply or extend to person/s the liquor or alcoholic beverages
for personal consumption outside the establishment of the Licensee;
e. Serving/Dispensing - to provide, supply, or extend to person/s liquor or alcoholic
beverages for personal consumption of in the premises of the Licensee;
f. Academic SchI - includes those offering elementary, high school and college
courses classified as academic by the Secretary of the Department of Education,
including schools offering vocational courses;
g. Public Place - refers to any place, building or structure of any kind designated as
such by the City Government including public streets, sidewalks, plazas, parks,
theatres and the like.
h. Vehicle - a mode of transportation used privatey, or servicing the general
population such as. Ut not limited to airplanes, ships, boats, buses, taxi cabs,
public utility jeepneys, tricycles, trisikads, and other similar vehicles.
i. Event License to Sell and Serve/Dispense - license issued to a retailer during
events duly organize by the City of lloilo or on special occasions
j. Establishment - whether a retail or wholesaler selling only liquor or alcoholic
beverages. This shall include sari- sari stores or convenient stores. Night clubs,
bars/ Cocktails/ Lounges, Beer Houses, Hotels and Restaurants are also
considered establishments selling and serving/ dispensing liquor or alcoholic
beverages.
k. License to Sell - a license issued by the ICLLRC for Retailers/ Wholesalers
allowed only to sell liquors or alcoholic beverages
I. License to Sell and Serve/Dispense - a license issued by the ICLLRC for
establishments selling and serving/dispensing of liquor or alcoholic beverages to its
costumers
m. Nightclubs - an establishment for evening entertainment, generally open until the
early morning, t~at serves liquor and usually food and offers costumers music,
comedy acts, a floor show, or dancing;
n. Bars/ Cocktails/Lounges - a counter or room or establishment where generally
all goods or food are sold and served including alcoholic beverages
o. Beer Houses - entertainment establishments serving liquor or alcoholic beverages
p. Hotels - a com~rcial establishment offering lodging to travellers and sometimes
permanent residency to some, and often having restaurants, meeting rooms,
stores, etc that are available to the public.

q. Restaurants - commercial establishments where meals are served to the public for
a certain fee

r. Special Events. - events such as Kasadyahan, Dinagyang, Chinese New Year,


Paraw Regatta, (and the likes, duly organized by the City of lloilo for the boost of
tourism in lloilo ~md for celebration of special occasions such as but not limited to
town fiestas, celtebrated local holidays, etc. This shall also include big events
celebrated in llpilo City such as concerts, anniversaries, and other special
occasions by an: individual, group, firm or corporation, provided with the approval
by the City Government.
s. Licensing Offic~r/s - the officer/s of the day duly assigned by ICLLRC to accept
application form~ for licenses and issue licenses to those who have complied with
the requirements
SECTION 3. Creatipn of the lloilo City Liquor Licensing and Regulatory CouncilPursuant to the ena~tment and approval of this Ordinance, an office shall be created
under the City Mayor's .Office which shall be known as the ILOILO CITY LIQUOR
LICENSING AND REGUlj.ATORY COUNCIL (ICLLRC), which shall be composed of a
Chairman, which is the City Mayor or his/her designated Representative, and the following
offices:

One ( 1) Representative from the City Treasurer's Office
Chairman of the Committee on Moral Recovery
One ( 1) Representative from the City Legal Office
One ( 1) Representative from the City Health Office
One (1) Representative from the City Social Welfare and Development; and
One (1) Representative from the lloilo City Police Office

The Chairman and the members shall be detailed from among the existing employees
of lloilo City Government.
The lloilo City Liquor Licensing and Regulatory Council shall be assigned an office
duly designated by the City Mayor.
SECTION 4:.
Regulatory Council.

Powers and Functions of lloilo City Liquor Licensing and

The lloilo City Liquor Licensing and Regulatory Council shall have the following
powers and functions, to wit:
a. To coordinate with the speedy implementation of the government policies and
programs on liquor selling and/ or dispensing;
b. To oversee, facilitate and regulate the sale and serving/ dispensing of liquor or
alcoholic beverages within lloilo city;
c. To formulate and adopt policies to ensure the effective implementation of the
programs on liquor selling and/ or dispensing;
d. To evaluate and monitor the selling and/ or dispensing of liquor or alcoholic
beverages;
e. To issue licenses to the respective Licensee upon approval of its application
and presentation of receipts from the City Treasurer's Office;
f. To monitor retailers, wholesalers and other establishments such as but not
limited to Restaurants, Hotels, Bars/ Cocktails/ Lounges and Nightclubs;

g. To monitor Rjetailers, Wholesalers and other establishments or any person the


strict implementation of lloilo City Ordinances on selling liquors to minors and
non-drinking in public places and the likes;
h. To evaluate ~nd monitor the rise of alcoholism in lloilo City and create programs
helping cons~mers who suffers from alcoholism;
i. To request ~ssistance from any department, bureau, office or agency in the
performance ~nd functions of ICLLRC;
j. To study and1recommend to the city a program in helping residents of lloilo City
in abating crifhes related to liquor intoxication;
k. Prepare and! submit a quarterly performance report to the Sangguniang
Panlungsod;
I. To submit ~ quarterly report to the City Mayor, Permits and Licensing
Department, and City Treasurer;
m. To keep all i the records of the Office relative to its operation, names of
establishment, data gathered from different agencies of the Government; and
n. To perform other functions whenever it deems necessary.

Section 5. Vacancy in Office The City Mayor shall immediately appoint the successor/s in the vacant position who
shall likewise serve at the pleasure of the appointing authority.
Section 6. Monthly Meeting and Special Meetings The monthly meeting shall be every first (1st) Tuesday of the month.
Special meetings shall be set by the Chairman with a three (3) day notice to all the
Council members.
Section 7. Quorum The presence of the four (4) members including the Chairman shall constitute a
uorum in order to transact business.
Section 8. Separability Clause If any provision of this Ordinance is held invalid, the other provisions not affected
thereby shall continue in operation.
Section 9. Repeali'1J Clause All local laws, rules and regulations which are inconsistent with the ordinance are
hereby repealed or modified accordingly.
Section 10. Effectivity Clause This Ordinance shall take effect after fifteen (15) days from publication in a newspaper
of local circulation in lloilo City.
