AN ORDINANCE CREATING A TRUST 'UND FOR ALL PHILHEALTH
PACKAGES TO BE PROVIDED BY THE PHILIPPL'IE HEALTH
INSURANCE
CORPORATION
(PHILHEALTH)
FOR
QUALIFIED
BENEFICIARIES OF THE CITY OF ILOILO OF THE NATIONAL HEALTH
INSURANCE PROGRAM (NHIP)
Sponsored by Councilor Lyndon V. Acap, duly seconded by Councilors
Jason R. Gonzales, Lady Julie Grace L. Baronda and Rodel F. Agado
WHEREAS, the Philippine Constitution declares as a State policy to provide its territorial and
political subdivision genuine and meaningful local autonomy to enable them to attain their fullest
development as self-reliant communities and as effective partners in the attainment of national goals;

WHEREAS, the State likewise declares that the besting of duty, responsibility and
accountability in local government units (LGlJs) shall be accompanied with provision for reasonably
adequate resources to effectively carry out their functions;
WHEREAS, in support of the Aquino Health Agenda to provide Universal Health Care for all
Filipinos or Kalusugang Pangkalahatan (KP) and consistent with its execution plan, through the
Primary Care Benefit Program, Philhealth aims to ensure that all Filipinos have access to quality

health services that are efficiently distributed, fairly financed and appropriately utilized by an infonned
and empowered public;
WHEREAS, this priority program is aimed at "setting into motion a meaningful health care
financing and delivery mechanism anchored on local government";
WHEREAS, the body, considering the beneficent features of RA 10606 as it will vastly
improve the over-all health status of the JX>pulation and ultimately their general quality of life and
rationalize the City Government's expenditures for health, collectively agreed to adopt the National
Health Insurance Program (NHIP) of the National Government.
WHEREAS, the creation of Trust Fund for all Philhealth Packages is necessary to attain its
purpose and objectives.
NOW, THEREFORE, be it ordained by the Sangguniagn Panlungsod of the City of Jloilo, that:
Section I. TITLE. - This Ordinance shall be known as "AN ORDINANCE CREATING A
TRUST FUND FOR ALL PHILHEALTH PACKAGES TO BE PROVIDED BY THE PHILIPPINE
HEALTH INSURANCE CORPORATION (PHILHEALTH) FOR QUALIFIED BENEFICIARIES
OF THE CITY OF JLOJLO OF THE NATIONAL HEALTH INSURANCE PROGRAM (NHIP)".
Section 2. - The Philhealth Fund shall be released on a quarterly basis by the Corporation
under the following conditions:
2.1 Accreditation of the District Health Units as service providers with Philhealth.

2.2 Provision of services as stated and mandated in Philhealth Circulars/Manual of


Procedures/Memorandu1n/Office Orders/Issuances.
2.3 Timely submission of required reports.
2.4 Compliance \vith other require1nents set by' the corporation.
Section 3. - The disposition of the Philhealth Fund shall be governed by the following rules:

3.1 As stated and mandated in Philhealth Circulars/Manual of Procedures/Memorandum/Office

3.2 The disbursement and liquidation of the fund shall be in accordance with pertinent
gov-ernment accounting and auditing rules and regulations.
3.3 A separate book ofaccoWlts shall be maintained by the local government unit.
3.4 Only drugs listed in the Philippine National Drug Formulary (PNDF), medical supplies and
equipment necessary to carry out the delivery of the required services 1nay be charged to the Philhealth
Fund.
Section 4. - The Corporation may withhold the release of fund in case of violation in the
perfonnance commitment as agreed by Philhealth and the C-ity Government of lloilo.

Section 5. - Separability Clause. - If any provisions of this ordinance is held unconstitutional


or invalid other provisions hereof which are not affected shall remain in full force and effect.

Section 6. - Repealing Clause. - All other provisions of existing ordinances, resolutions and
executive issuances inconsistent with this ordinance are hereby repealed, amended or modified
accordingly.
Section 7 ..- Effectivity. This is ordinances shall take effect upon approval.
