REGULATION ORDINANCE NO. 2015-195

AN ORDINANCE ESTABLISHING THE ROUTE OF TRISIKADS OF JEREOS
DIKE TRISIKAD OWNERS AND DRIVERS ASSOCIATION (JDTODA) FROM
JEREOS DIKE BRGY, JEREOS, LA PAZ PASSING GUSTILO STREET,
MAGDAW STREET, ARROYO STREET, LA PAZ, ILOILO CITY AND VICE
VERSA EXCEPT IN ROADS CLASSIFIED AS NATIONAL IDGHWAYS

WHEREAS, Ordinance No. 200 in relation to Ordinance No. 131 of the City of lloilo,
"l:risikad" operation is permitted along Barangay Jereos in the District of La Paz;
WHEREAS, Section 458 (a) paragraph 3 (vi) of Republic Act 7160 provides that the
Sangguniang Panlungsod shall:

"(3) ~")ubject to tl1e provisions of Book II of this Code, enact ordinances granting
franchises and authorizing tlie issuance of permits or licenses, upon such purposes
intended to promote the general welfare of the inhabitants of the city and pursuant to
this legislative authority ... "

WHEREAS, the Sangguniang Barangay of Barangay Jereos, La Paz, approved Resolution No.
2014-16, Series of2014, thereby recommending the approval of a regulation ordinance for the trisikad
operation within the territorial jurisdiction of the said barangay;
WHEREAS, there is a need to regulate the operation of the public utility trisikads in order to
pro1note and uphold public convenience, public order and safety .
NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City oflloilo, that:
Section l. - Any person who is interested and desiring to operate and maintain a public utility
trisikad or to be a driver thereof shall, as a condition precedent, comply with the following
requirements:
a) Secure a Barangay Clearance from the Punong Barangay of Barangay Ingore, La Paz, Iloilo
City
b) Register with the Iloilo Licensing Office after payment of the required fees.
Section 2. - A driver or operator is hereby encourage to register with the duly accredited
association in order to avail of the benefits of the designated parking/]oading and unloading areas
identified by Sangguniang Baranay ofBarangay Jereos, La Paz, Iloilo City;
Section 3. - Trisikads operating in Barangay Jereos, La Paz, shall follow the designated route
provided in City Ordinance No. 131 and shall not ply any national road or highways;
Section 4. - The Sangguniang Barangay of Barangay Jereos, La Paz, Tloilo City is hereby
authorized to desib'llate the parking/loading and unloading area of the trisikads operating within its
territorial jurisdiction;
Section 5. - Any violation of the provision of this ordinance shall cause the confiscation of the
trisikad unit which shall be returned to the registered owner upon payment of the fine of Two Hundred
(Php 200.00) Pesos;

Section 6. - Designating the Route of Operation of trisikad with in Barangay Jereos, La Paz,
/ ./more particularly defined as follows, to wit:

"FROM JEREOS DIKE BRGY. JEREOS, LA PAZ PASSING GUSTILO

STREET, MAGDALO STREET, ARROYO STREET, LA PAZ, ILOILO CITY
AND VICE VERSA EXCEPT IN ROADS CLASSIFIED AS NATIOAL
HIGHWAYS"
Section 7. -This ordinance shall take effect after fifteen (15) days from approval hereof.
