AN ORDINANCE STRICTLY PROHIBITING MINORS TO OPERATE ANY KIND OF VEHICLE
INCLUDING BUT NOT LIMITED TO MOTORIZED BOAT, MOTORCYCLE, TWO-WHEELED OR
THREE-WHEELED VEHICLE AND ABOVE AND PROVIDING PENALTIES FOR VIOLATION THEREOF.

SECTION 1. It is strictly prohibited for minors to operate any vehicle including but not limited to
motorized boat, motorcycle, two-wheeled or three-wheeled vehicle and above, within the
territorial jurisdiction of the Municipality of Santa, Ilocos Sur. However, a minor student-driver
with the corresponding valid LTO Student License Permit shall be allowed to operate a motorized
vehicle when accompanied by an adult with a valid LTO Drivers license.

Furthermore, for the purposes of this Ordinance, a motorized vehicle shall include all kinds of
conveyances, which include but not limited to gas-engine vehicles, electric vehicles, and other
kinds of vehicles capable of transporting individuals along the national highway.

SECTION 2. The Santa-PNP or any duly deputized agent by the LGU-Santa is hereby authorized to
seize and capture any violators of this Ordinance and temporarily impound the vehicles at a safe
place.

SECTION 3. The parents and guardians of the minors caught violating this Ordinance shall be
penalized as follows:

An administrative fine of Five Hundred Pesos (PhP500.00)


or Two (2) days community service
An administrative fine of One Thousand Pesos
(PhP1,000.00) or Four (4) days community service
An administrative fine of One Thousand Five Hundred Pesos
(PhP1,500.00) or imprisonment of not exceeding One (1)
week or both fine and imprisonment at the discretion of the
court.

SECTION 4. Subject to the provisions of Republic Act 10630 or An Act Strengthening the Juvenile
Justice System in the Philippines, Amending for the Purpose Republic Act No. 9344, Otherwise
Known as the Juvenile Justice And Welfare Act Of 2006 and Appropriating Funds Therefor, in
addition to the penalties to be paid for by the parents or guardians of the apprehended minors,
all minors who shall be caught violating this Ordinance shall be penalized as follows:

Reprimand and shall undergo Traffic Safety Lecture by the

One (1) day Traffic Safety Lecture by the Santa Philippine

National Police and a Certificate of Misdemeanor to be


submitted by the Municipal Social Welfare & Development
Office to the Guidance Counselor of the minors school. In
case the minor is not enrolled, the Certificate of
Misdemeanor shall appear in the Police Clearance to be
issued by the Santa PNP;

A minor who shall be found to be a repeat offender shall be considered to have acted with
discernment and shall be considered as an adult. In such cases, in lieu of the parent or guardian
to be penalized, the minor shall be made to suffer the penalty of the third or succeeding offenses,
as provided for in the preceding section. Furthermore, a Certificate of Grave Misdemeanor shall
be issued to the Guidance Counselor of the minors school. In case the minor is not enrolled, the
Certificate of Grave Misdemeanor shall appear in the Police Clearance to be issued by the Santa
PNP.

SECTION 5. SEPARABILITY CLAUSE: If for any reason, any provision, section or part of this
ordinance is declared not valid by a court of competent jurisdiction or suspended or revised by
the Sangguniang Panlalawigan, such judgement shall not affect or impair the remaining
provisions, section or parts thereof and shall remain or continue to be in full force and effect.

SECTION 6. REPEALING CLAUSE: All ordinances, executive orders, implementing rules and
regulations, or parts thereof, in conflict with, or inconsistent with any provisions of this code are
hereby repealed, amended or modified accordingly.

SECTION 7. EFFECTIVITY: This Ordinance shall take effect upon its approval and completion of
its posting requirements for at least three (3) consecutive weeks.
