REGULATION ORDINANCE NO. 2015-358


AN ORDINANCE REGULATING THE SEATING CAPACITY OF MOVIE
HOUSES IN THE CITY OF ILOILO AND PROVIDING PENALTIES FOR
VIOLATION THEREOF
Sponsored by Councilor Joshua C. Alim, duly seconded by Councilors Rode! F.
Agado, Lyndon V Acap, Plaridel C. Nava II and Jason R Gonzales

WHEREAS, the Local Government Code of 1991 (Republic Act No. 7160) accords every

local government unit power and authority to promote the general welfare within its territorial
jurisdiction, including the promotion of health and safety of its constituents;
WHEREAS, the local government has the authority to protect its inhabitants in accordance
to the powers vested into it by the Constitution and the Local Government Code of 1991;
WHEREAS, the Iloilo City recognizes that it must act with necessity to regulate the seating
capacity of movie house within its territorial jurisdiction to secure the safety of all their
constituents;
Be it ordained, therefore, by the Iloilo City Council tbat:
Section 1. Title- This ordinance shall be known as "AN ORDINANCE REGULA TING
THE SEATING CAPACITY OF MOVIE HOUSES IN THE CITY OF ILOILO AND
PROVIDING PENALTIES FOR VIOLATION THEREOF"

Section 2. Purpose. - It is the purpose of this Ordinance to safeguard public safety and
ensure the well being of all its constituents by protecting them from the possibility of stampedes
and other accidents.
Section 3. Coverage. - This Ordinance shall apply to all persons, whether natural or
juridical, whether resident or not, and in all places, found within the territorial jurisdiction of Iloilo
City.

Section 4. Definition of Terms. ~As used in this Ordinance, the terms below shall have the
meanings ascribed to them in this section. Any words or tenns not defined shall be given their

plain and customary meanings, unless the context requires otherwise, and shall be interpreted in a
manner consistent with the purpose and spirit of this Ordinance.
a) Movie Houses - a venue that contains an auditorium for viewing movies

(films) for entertainment, catering to the general public, who attend by


purchasing a ticket.
b) Seating capacity - as used in this ordinance means the maximum number of
persons that can occupy the fixed seats inside the movie houses,
c) Fixed seats - as used in this ordinance means, those seats are securely
fastened to the floor.
Section 5. Responsibility of Owners -Owners of movie houses are required to post their
maximum seating capacity signages (stating therein the ordinance number and the imposable
penalty) on their ticket counter(s) where the movie goers can easily see it. They should also make
sure that their employees assigned at the ticket counter and inside their movie houses should
monitor the number of vacant seats available. If the seating capacity of the movie house is
exhausted, no movie goer(s) should be allowed to enter.
Section 6. Responsibility of Customers or Clients - Movie goers should abide with the
maximum seating capacity of the movie houses. If the seating capacity is exhausted, they should
be given priority on the next screening schedule of the day.
Section 7. Prohibited Acts - The following acts are declared unlawful and are prohibited
by this Ordinance:
a. Failure of the establishment owner(s) to post the signage(s) required under
this Ordinance.
b. There should be no 'standing room only' for movie goer(s).
c. The seating capacity having been exhausted, the employees assigned at the
said movie house continue to let movie goers in.
Section 8. Agencies. The Iloilo City Engineers Office shall, in the discharge oftheir official
functions, serve as the lead agency in the implementation of this Ordinance, including the filling
of the case in proper court in coordination with the Iloilo City Legal Office. The Bureau of Fire
Protection is requested to give their full support, assistance and cooperation in implementing this
ordinance.
A composite team composed of City Engineer, City Lega~ and the Chairman of the
Conunittee on Police Matter and Public Safety of the Iloilo City Council shall be created through
an Executive Order by the City Mayor, purposely to monitor compliance of this ordinance and can
conduct inspection anytime. The manager/owner shall allow such inspection of the team or any
member thereof. However, the team or any member thereof shall not be exempted from payment
of ticket fees.

Section 9. Penalties:
First Offense: fine ofPhpl,500.00
Second Offense: Php 3,000.00
Third Offense:
a. On the third offense, the violator shall suffer the penalty of six (6) months

and one (1) day minimum to one ( 1) year imprisonment as its maximum and
/or a fine of Five Thousand Pesos (Php5,000.00) at the discretion of the

court.
b. In the case of a corporation or partnership, the manager shall suffer the
penalty and imprisonment above-mentioned (Sec. 9 par. a) and revocation

of business permit; employees on duty who failed to comply with the


ordinance shall suffer the penalty of three (3) months and one (1) day as
minimum to six (6) months imprisonment as its maximum and/or a fine of
One Thousand Five Hundred Pesos (Phpi,500.00) at the discretion of the
court
Section 10. Separability Clause. If for any reason, any provision, section or part of this
ordinance is declared unconstitutional or not valid by a court of competent jurisdiction. or
suspended by competent authority, such judgment shall not affect or impair the remaining
provisions, sections or parts which shall continue to be in full force and effect.
Section 11. Repealing Clause. All other Ordinances inconsistent with the provisions of this
Ordinance are hereby repealed or modified accordingly.
Section 12. Etfectivity. This Ordinance shall take effect after its publication in a
newspaper of general circulation in lloilo City.
