WHEREAS, Section 16 of Republic Act 7160 or the Local Government Code of 1991 states: "Every
local government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as
well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which
are essential to the promotion of the general welfare. Within its respective territorial jurisdictions, local
government units shall ensure and support among other things, the preservation and enrichment of culture,
promote health and safety, enhance the right of the people to ecology, encourage and support the
development of appropriate and self-reliant scientific and technological capabilities, Improve public morals,
enhance economic prosperity and social justice, promote full employment among their residents, maintain
peace and order, and preserve the comfort and convenience of their inhabitants.
WHEREAS, there were several incidents where taxi drivers have been victims of serious crimes
wherein the culprits have hired the taxi within lloilo City with destinations, and beguiled the taxi to other
municipalities only to be robbed and even killed by their passengers;
WHEREAS, the culprits of these crimes are emboldened to commit the same because as passengers
their identity is unknown and their faces could even be hardly noticed by the driver;

WHEREAS, presen!y, police stations have been designated as log-innog-out centers but because
lloilo City has many entry/exit points, there is a need to establish additional log-in/log-out booths in convenient
and strategic places where the taxi drivers can report pertinent infoITTlations about their passenger/s;
WHEREAS, due to lack of manpower on the part of the PNP-ICPO; the additional log in/log out booths
stated in this Ordinance will be manned by CVO's/Brgy. Tanods and or lloilo City Government personnel of the
place where tt is located to act as force multipliers to the PNP personnel/s assigned thereat;
NOW THERFORE, be it ordained by the Sangguniang Panlungsod, in session assembled that,
Section 1. The following are the location of the identified log in/log out centers:

Section II. The following are the rules to be followed in the log innog out system:
a. All taxi drivers picking up passengerls within the City of lloilo between 9:00 o'clock in the evening
to 4:00 o'clock A.M. and are travelling outside lloilo City with their passengerls are required to log
innog out at the nearest PNP station designated log in/log out booths;
b. The following infoITTlation must be recorded in the log book at the PNP Station or tog in/log out
booth:
bt. Name of the taxi driver evidenced by presentation of his valid Driver's Ucense, provided that if
the driver's license of the driver concerned is confiscated for traffic violation; the citation ticket
must be presented together win any other identification cardls with his piclure
b2. Name of the taxi company and the taxi unit's body number
b3. The specific point of origin and destination of the passenger/s
b4. The time of exit of the taxi
b5. The name of the passengerls

c. The log book from the designated additional tog in/log out booths manned by Brgy. Tanodsl
CVO's or City Government personnel must be presented to the police authorities every month
together with machine copies of the entries for the said month for authentication and proper
recording.
d. CCTV camera/s must be provided to additional log in/log out booths and must be maintained
by the Barangay where the log in/log out booth is located.
e. Only authorized personnel from taxi companies and the proper authorities can request for a copy
of the entries in the log book frm the designated log in/log out booths.
f.

The Association of Taxi Operators in Panay (ATOP) shall be responsible for the maintenance
costs of the additional log in/log out booths;

Section Ill. That itshall be mandatory to all taxi companies to install in all their taxi units "emergency
blinker or SOS system" which is highly visible to the public and not noticeable to their passenger/s;
Section IV. That is shall be mandatory to the taxi driver to log in, in his place of entry in the City of
lloilo and to have his name and taxi company and unit body number recorded in the log book with his time of
entry.
Section V. Penal Provision
1. Any taxi driver who fails to log out while enroute outside the City of lloilo or log in on the nearest
log innog out booth upon approval of this ordinance shall pay the fine of two hundred pesos (Php
200.00) for the first offense; five hundred pesos (P 500.00) for the second offense and five
thousand pesos (P5,000.00), for the third offense
2. Any taxi company or operator found to have violated the provision provided for under Section IV of
the Ordinance shall be fined and shall likewise pay the fine of Five Thousand Pesos
(Php5,000.00)
3. The maximum penalty of five thousand pesos (P 5,000.00) as provided for under the Local
Government Code of 1991 shall be imposed upon any driver who willfully disregard the log inftog
out booths after a proper case is filed in court;
4. Fines collected in connection with this Ordinance shall be set aside by the City Treasurer and
deposited in a Trust Fund that will be used for the sole purpose of maintaining the log-in/log-out
booths established for its purpose.
Section VI. That this ordinance shall take effect upon approval.
